Power, LLC (Applicant) liled'a Motion toAmend a Certificate of Site and FaciTity

(Motion) with the New Hampshire SiteEvaluation Committee (Committee]. TheMotion requests that the Committee

amend certain conditions contained in theCerlificate of SiLe and Facility issued inNHSEC Docket No. 2008-04, Application

of Granite Reliable Power, LLC, on July 15,2009 (Cert(Geste).

On July 15. 2009. the Committee'ranted a CertIBcate to 'the Applicant for

tile siting, construction and operation of a99 MW wind powered electric generation

facility consisting of 33 wind turbines anprivate lands located in Dixvige, Erving's

Location, Migsfield, Odeg and the Town ofDummer in Coos County (Facgity.) The

Facility is fully construci.ed and commer-

ciaBy operating. The Certificate imposed

tion Mitigation Settlement Agreement. In-

cluded within the High Elevation Mitiga-

tion Settlement Agreement, Section A,

Paragraph 5, and incorporated in the Cer-

plicant asserts that that the maintenancerequirements of the Facility necessitatethe repeated and periodic disturbance ofthe revegetated areas along ihe roadbed ioaccommodate heavy constructionequipmenL The Applicanl. seeks to amendthe Certdicate to replace the road vodth

condiiion with a Revised High ElevationRestoration'Plan that will require that roadwidths he reduced generally to 16 feet. Inaddition lhe Revised High Elevation Res-toration Plan includes additionalreqiurements perlaining to: I) mudmiza-

tion of temporary and permanent distur-, bances; 2) restricted access; 3) slabiliza-

tion and revegetation (includingrequirements pertaining to grading, sailpreparabon, tree seedlings, and mulch formoisture retention and soB stabilization):4) monitonng. and; 5) maintenance.

The Applicant asserts that expedited re-lief is necessary in order to undertake therequirements of the Revised 16gh Eleva-
