ABSL Actions focused on anti-crisis shieldWe are collecting on the on-going basis member companies' recommendations for regulatory anti-crisis support ,
economy “ defrosting” plan for ABSL positions
▪ Anti-Crisis shield - ABSL position papers and comments send to the government & City Mayors – 15.03, 23.03, 3.04
Mains demands from our sector:
− Postponement of deadlines for filing tax returns and declarations at least until July 1, 2020
− Liquidity support by releasing cash accumulated on VAT accounts and accelerating VAT returns
− Postponement of the entry into force of the new VAT rate matrix and the introduction of JPK_V7M and JPK_V7K
until the end of 2020
− Government support through co-financing of employees' remuneration,
− Extending the validity of employees’ medical certificates and withdrawing from initial occupational medicine
examinations.
− Enabling employee temperature checks before entering office . Ability to send employees on vacations and flexible
use of Social Fund.
− Extending by law the validity of documents legalizing the work of foreigners on the territory of the Republic of
Poland.
▪ Anti-Crisis shield - a joint appeal of business organizations from Lesser Poland – 23/03
▪ Reactivation of the Enterprise Council together with other leading employers’ organizations - 24/03 and joined appeal 3.04,
work on Anti-crisis shield 2.0.

Short term consequences for the office market:
Uncertainty over timely delivery of investments(buildings, space arranged for tenants)
Increase of fit-out costs(higher costs of office projects overall)
Little can be done to ease that challange(value engineering)

Office activities not prohibited... but actual use of premises is reduced
Overall slown down of business and temporary liquidity hardships
Deteriorating PLN – EUR exchange rate
Landlord challanges:
Irrespective of the situation, need to pay back its bank loans
Obligation to upkeep of the premises

Commercial negotiations in COVID-19 reality (1)
No statutory automatic mechanism allowing for unilateral
suspension of rental payments or its reduction
Civil code („Kodeks cywilny”) provisions enable to bring the
case up to the court but... mind the uncertainty of the court’s
verdict and certainty of legal fees
Each case is individual and should be analysed separately –limited chance for any ‚collective action’

Review your lease and its legal provisions(eg. force majeure provisions, early termination clauses)
Consider an arrangement with landlord aimed at:
Lease restructuring (temporary rental exemptions being paid back later
on; service charges adjustment)
Lease renegotiations (rental exemptions in return for extending the lease,
waiving the break option/ contraction option)
In reality, amicable solution (win-win) is a must

So what can office tenants do?
Negotiations outcome depends on factors related to the landlord specifics and the attractiveness of the ‚bargain’
Acquisition financing and ownership structure
Existing insurance policy of landlord (loss of rent)
Structure of landlord’s portfolio (e.g. office vs. retail component)
Tenant’s barganing chip (e.g. willingness to extend the lease)
Rent free inducement or/ and temporary postponement of rental
obligations; perhaps review of service charges fees

• Operations: Overall, most centers are up and running• Disruptions (home office, technology)
• Productivity
• Transitions (back, into)
• Shifts within (SC/PTP-OTC)
• BCP works for most
• HR & Talent: most centers and GBS organizations continue as usual• Hiring, onboarding continues (few hiring freezes)
• HR support activity increase
• Work tracking, management issues
• Technology: higher maturity and agility now pay off• Automated centers move with ease (no paper invoices…)
• Tech investments into communication tools (Teams, Slack…): delay of other projects ?
• SDM: too early to tell how changes in GBS will look like, different views on everything• More automation
