LIMITED WARRANTY & LIMITATION OF LIABILITY DallasPolewarrantsitspolestobefreefromdefectsinmaterialsandworkmanshipforthewarrantyperiodfromthedateofdelivery.DallasPoleretainstherighttoeitherrepairorreplaceanypartoftheequipmentdeliveredhereunderwhichundernormalandproperuseprovestobedefectiveinworkmanshipormaterialwithinthewarrantyperiod.ThecorrectionofsuchdefectsbyrepairorreplacementshallconstitutefulfillmentofallDallasPoleobligationswithrespecttotheequipmentsoldhereunder.

Thewarrantyexcludesdefectsresultingfromimproperhandling,storage,installation,actsofGod,fire,vandalismorcivildisturbances.Furthermorethewarrantyspecificallyexcludesfatiguefailureorsimilarphenomenaresultingfrominducedvibration,harmonicoscillationorresonanceassociatedwiththemovementofaircurrentaroundtheproduct.

Thefollowingconditionwillvoidtheproductandfinishwarranty:

1.Groutedpolebaseswithoutweepholes.

2.Baseplatesittingdirectlyonconcreteorothercorrosivesurfaces.

3.Missingpolecapand/orhandholecoverswherethepoleisallowedtofillwithdebris.

ItisexpresslystatedthatDallasPoleassumesnoliabilityforindirect,incidental,consequentialdamagesofanykindorliquidateddamagesarisingoutofabreachofthesale,includinganywarrantiesarisingtherefrom,andbuyer’sremedyshallbelimitedtorepairorreplacementofdefectivepartsasdescribedabove.TheliabilityofDallasPoleunderthiswarrantyforanylossordamagetotheequipmentortothepersonsorpropertyallegedlycausedbytheequipment,whetherbasedoncontract,stricttortliability,negligenceorwarrantyshallnotinanycaseexceedcostofcorrectingdefectsintheequipmentashereinprovidedandupontheexpirationofthewarrantyperiodallsuchliabilityshallterminate.

AnyassistanceDallasPoleprovidestheoriginalpurchaseroutsideofthetermsandexclusionsofthesewarrantieswillnotconstituteawaiverofthewarrantytermsandexclusions,norwillsuchassistancereviveorextendthewarranty.Thesewarrantiesaregiveninlieuofallotherwarrantiesexpressedorimplied,includingandwithoutlimitation,thewarrantyofmerchantabilityandthewarrantyofsuitabilityforaparticularpurpose.

PurchasermustnotifyDallasPoleinwriting,orcalltheDallasPolecustomerservice,within30daysofnoticingthedefect.DallasPolereservestherighttochangethewarrantyperiodwithoutpriornoticeandwithoutincurringobligationandexpresslydisclaimsall

warrantiesnotstatedinthislimitedwarranty.

DALLAS POLE WILL NOT ALLOW CHARGES FOR LABOR, TRAVEL, LIVING EXPENSES, INSPECTIONS, MATERIALS, ETC. THAT DOES NOT HAVE PRIOR WRITTEN APPROVAL BEFORE SUCH WORK IS IMPLEMENTED.
