Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education

(NCTE) was convened on 17th

– 18th

February, 2017 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar,

Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of

the 233rd

ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about

the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the

permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee

for its due consideration and appropriate decision.

ATTENTION!

1. The committee unanimously decided that the institution may reply in

response to the decision of the committee uploaded on the ERC website

without waiting formal letters from the office of ERC. The replies so

received will also be considered by the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per

programme. (See ERC website: www.ercncte.org for detail).

3. The institution need to submit list of 10 schools for internship and school based

activities duly approved by District Education Officer.

4. Institutions must give the affidavit for consent / willingness for number of units

either one or two if it was not submitted earlier.

5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any

course or training in Teacher Education without obtaining recognition or

permission under this Act, the qualification in teacher education obtained

pursuant to such course or training or after undertaking a course or training in

such institution, shall not be treated as a valid qualification for purposes of

employment under the Central Government, any State Government or

University, or in any school, college or other educational body aided by the

Central Government or any State Government.

6. The Committee suggested to prepare Data Bank for the teachers.

7. The institution needs to install Fire Safety equipment and submit

the Fire Safety Certificate if not submitted earlier.

8. The cut of date for granting/refusal of recognition for the session 2017-18 is

3rd

March, 2017, hence, the institution may submit the compliance on the

basis of proceedings uploaded in the ERC NCTE website.

ER-233.12 [Miscellaneous Case- Authentication of NOCs issued to TTIs]

1. 233.12.1

Verification of NOCs issued by Bihar School Examination Board, Patna, Bihar in

respect of starting D.El.Ed. programme and affiliating bodies (Universities/Boards

etc. of each State) for the session 2017-2018. (File No. 3-4/ NCTE/ERC/2016)

A letter was issued to Bihar School Examination Board, Patna, Bihar on 24.01.2017 and subsequently on

02.02.2017 wherein requested to verify NOCs issued to the various aspirants intended to start D.El.Ed. course in

their teacher training institutions. ERC has given deadline on 06.02.2017 to B.S.E.B., Patna to submit

verification/authentication report and in case of non-receipt of the reply in time, all such NOCs issued by them

will be processed as per provision of NCTE Act, Rules and Regulations, 2014. The reply is awaited from

B.S.E.B., Patna till date.

In view of the above, the Committee decided as under:

(i) All NOCs issued by Bihar School Examination Board, Patna and other affiliating bodies during 2016 are

accepted for further processing of the applications.

(ii) If, there is any gap in terms of years between academic session and date of issue of NOC from affiliating

bodies, the institutions are required to submit either fresh NOC or countersign to the previous NOC by

the affiliating body for the session applied for.

ER-233.6 [Reply to LOI/SCN after LOI]

2. 233.6.1

the matter in detail and decided as under:

(i) As the show cause notice has been decided to D.El.Ed. programme (ERCAPP4097), hence the B.Ed.

application be kept in abeyance.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and reserve

fund in the joint name of RD, ERC, NCTE and institution with the reply of letter of intent.

from the NCTE Hqrs. from time to time and reply in response to SCN before VT, the Committee discussed the

matter in detail and observed as under:

(a) Show Cause Notice was issued on 30.09.2016 on the following grounds:

(i) Inspection letter was issued on 06.02.2016.

(ii) Dr. R.K. Mohanty, VT member informed through letter dated 19.04.2016 that he had

telephonically called and one member of the managing committee told that the institution is not

ready to conduct the inspection.

(iii) The institution vide letter dated 12.05.2016 informed that the building is under construction and

will be completed upto November 2016. The institution requested to accept the application for the

session 2017-18.

(iv) The committee has not accepted the request of the institution.

(v) As the second file of B.Ed programme (ERCAPP3345) has already been refused, hence D.El.Ed

application (ERCAPP3266) comes under the category of standalone institution.

(b) As the another B.Ed. file (Code No. ERCAPP3345) has already been refused on the same grounds in

222nd

ERC Meeting. Therefore, the application of D.El.Ed. is under standalone category which is not

accepted as per NCTE Regulations, 2014.

In view the above, the committee decided as under: The committee is of the opinion that application bearing Code No.ERCAPP3266 of the institution regarding

recognition of D.El.Ed. Programme is refused under section 14(3)(b) of NCTE Act 1993.

ER-233.7 [Reply to SCN after VT]

7. 233.7.1

from the NCTE Hqrs. from time to time and reply in response to SCN after VT, the Committee discussed the


(a) Show Cause Notice was issued on 01.03.2016 on the following grounds:

(i) As per VT Report, built up area is only 2150 Sq. Mts. which is less than requirement for B.P.Ed.

+ D.P.Ed. as per NCTE Regulations.

(b) In reply to SCN, the institution submitted its reply vide letter dated 02.12.2016 received in ERC NCTE

on 09.12.2016. The ERC considered the reply of the institution and observed that the institution is still

deficient on the following grounds:-

(i) As per VT Report, the total built up area was only 2150 Sq. Mts.

(ii) Now, the institution submitted photocopy of building plan of existing hostel building (Block-C)

mentioning total built up area 1368.26 Sq. Mts. out of which Ground floor having 684.13 Sq. Mts.

built up area which was constructed after the inspection and the same is not accepted by the

committee.

(iii) As per NCTE Regulation 2014, there is no provision for re-inspection of the institution.

In view the above, the committee decided as under:

The committee is of the opinion that application bearing Code No.ERCAPP2362 of the institution regarding

permission of D.P.Ed. Programme is refused under section 15(3)(b) of NCTE Act 1993.

ER-233.4 [Appeal Case]

8. 233.4.1

Dr. B R Ambedkar College of Education, Plot No.- 1924, Vill. -Matiyani, Po. -

Sahadev Khap, Tehsil/Taluka - Gaya, Town/City - Gaya, Dist - Gaya, Bihar -

824234 (B.Ed.-Addl. Intake) (Private) (Magadh University) (ERCAPP3092)

The ERC vide its order No. ER-213.6(i).65/ERCAPP3092/B.Ed.-Addl. Intake/2016/46316 dated 02.05.2016

granted permission for existing B.Ed. course with an additional intake 50 (one basic unit) from the academic

session 2016-2017, against an application for two units.

The appellate authority vide Order No. 89-310/2016-Appeal/10th Meeting – 2016/36648 dated 08.08.2016

remanded back the case to ERC, Bhubaneswar for granting two units of B.Ed. (Additional).

The ERC re-viewed the matter in accordance with the appeal order and decided as under:-

Formal permission order under clause 7(16) of the NCTE Regulation 2014 for applied B.Ed. programme with

an additional intake 50 i.e. another one basic unit from the academic session 2017-18 be issued to the

institution.

ER-233.12 [Misc. Case – Complaint / RTI cases & others]

9. 233.12.2

Matter of relaxation for appointment of Professors and Associate Professors for

appointment in institutions offering M.Ed. course and practices followed by ERC,

NCTE while taking decisions. [File No. 9-1/NCTE/ERC/RTI/2016(Vol-III)]

The RTI application dated 23.12.2016 was received from Dr. Achyutananda Nayak, Bhadrak, Odisha seeking

information under RTI Act 2005, alleging against the decision taken by ERC in its 217th

meeting in the matter of

Deshapran College of Teacher Education, Midnapore, West Bengal (ERCAPP2297) regarding his appointment

as Professor for M.Ed. course in the said institution and not considered as qualified by ERC.

The committee considered the representation of the applicant and observed as under:-

As per Norms and Standards for M.Ed. course contained in Appendix-5, Clause 6(2)(B) under Regulation 2014,

the qualification for the post of Professor & Associate Professor is as under:

(i) Postgraduate degree with minimum 55% marks in the discipline relevant to the area of specialisation.

(ii) Postgraduate degree in Education (M.Ed./M.A. Education) with minimum 55% marks.

(iii) Ph.D. degree in Education or in the discipline relevant to the area of specialization.

(iv) Any other qualifications prescribed by UGC like NET qualification or length of professional teaching

experience as per UGC or State Government norms for the positions of Professor and Associate Professor.


The committee is the opinion that prescribed qualification for M.Ed. course as per NCTE Norms & Regulations,

2014 was followed for the requirement of Professor. The applicant be informed accordingly.

10. 233.12.3

Dr. B.R. Ambedkar College, Vill/PO.-Mallighati, PS-Debra, Dist.- Paschim

Medinipur, West Bengal -721211 (B.Ed.) (Private) (Vidyasagar University)

(APE00317)

The institution was granted recognition vide Order No. ERC/7-70.6.2/2006/3835 dt. 31.10.2006 for conducting

B.Ed. course with an intake of 100 from the academic session 2006-2007, followed by revised order issued vide

No. 31927 dated 23.05.2015 as per NCTE Regulation, 2014.

Sh. Sachindra Nath Mishra, Secretary of the Malighati Dr. B.R. Ambedkar Society for Advancement of

Learning and Health, Paschim Medinipur, West Bengal has submitted a representation dated 03.01.2017 along

with letter dated 02.01.2017 requesting to withdraw the B.Ed. course from the academic session 2017-2018 as

the institution is unable to comply the Norms & Standards of NCTE relating to land and building, qualified

Principal & lecturers, Endowment & Reserve fund, Audited Accounts, Infrastructure & Website etc.


The committee accepted the request of the institution and decided that the recognition of the institution for B.Ed.

course be withdrawn from the academic session 2017-2018 and copy of the withdrawal order be endorsed to the

concerned State Government as well as affiliating body.

11. 233.12.4

Jamini Kant B.Ed. College, Vill-Salbani-Lapadabar, PO-Bara-Khurshi, Via-

Mahulia, Tehsil/Taluka-Ghatsila, East Singhbhum, Jharkhand - 832304 (Private)

(Ranchi University) (APE00971)

The institution was granted recognition vide Order No. ERC/7-150.6.23/NCTE/B.Ed./2013/16581 dated

02.03.2013 for conducting B.Ed. course with an intake of 100 from the academic session 2013-2014, followed

by revised order issued vide No. 32505 dated 30.05.2015 as per NCTE Regulation, 2014.

A complaint vide letter No. 2230/Conf. dated 13.12.2016, received against the institution, from office of the

District Magistrate and Commissioner, East Singhbhum, Jamshedpur, Jharkhand along with a copy of letter No.

2014 dated 10.12.2016 and enquiry report from District Education Officer, East Singhbhum, Jamshedpur,

Jharkhand in the matter of committing suicide by a student namely Late Bindu Singh due to harassment by the

management relating to admission fees paid by her through cheque or internet banking which was not accepted

by the management of the institution, for taking necessary action.


Inspection u/s 13 of NCTE Act, 1993 may be conducted and the matter be referred to the NCTE Hqrs., New

Delhi.

12. 233.12.5

Fundamental Institute of Teachers Training, Plot No.- 129, 136, 138/703,

Vill- Bataskuri, PO.- Banshihari, Tehsil/Taluka- Bhaktipur, Town/City-

North Bengal College of Education, Plot No.-1574, 1575, 1575/2811, Street No.-

NH-31, Vill/Po-Ghokshadanga, Town/City-Ghokshadanga, Tehsil/Taluka-Choto

Shimulgachi, Dist.-Cooch Behar, West Bengal-736171 (B.Ed.) (Private) (University

of North Bengal) (ERCAPP1782)



from the NCTE Hqrs. from time to time, VTR and representation received from institution, the Committee

discussed the matter in detail and observed as under:

(1) Refusal order was decided in 226

th ERC Meeting held on 29

th -30

th November, 2016 on the following

grounds:-

a. SCN was issued on 30.09.2016 on the following grounds:

(i) Percentage of marks is not reflected in the M.Ed mark sheet of Aashish Ghosh.

(ii) Amardip Ray, faculty of Geography is not eligible as he does not possess required 55%

marks in M.A. (Geography).

(iii) Ambika Roy is not eligible as she does not possess required 55% marks in M.P.Ed.

b. The institution has not submitted the compliance of SCN issued on 30.09.2016 and time limit is

over.

(2) The institution submitted a representation vide Ref. No. NBCE/10/16 dated 08.12.2016 stating that due

to wrong name & address of the institution, they could not get letter issued by ERC NCTE, also

requested to revoke the refusal order and permit two months time to complete the process.

(3) As per record available and latest letter head submitted by the institution, it reflects the same address of

the institution where correspondence was made.

(4) The committee has not accepted the request of the institution.


The decision of refusal order stands unaltered and the order of refusal be issued to the institution accordingly.

14. 233.12.7

Mahatma Gandhi Academic Institute, Plot No.-1181, Street/No.-Mirjapur,

Vill.- Sadikpur, P.O.-Gankar, Tehsil/Taluka-Raghunathganj, Town/City-Jangipur,

Dist.- Murshidabad, West Bengal-742227 (D.El.Ed.) (Private) (West Bengal Board

of Primary Education) (ERCAPP1387)

The institution was granted recognition vide Order No. ERC/7-160.6.25/NCTE/D.El.Ed./2013/20586 dated

31.08.2013 for conducting D.El.Ed. course with an intake of 50 from the academic session 2014-2015 on the

above mentioned address.

The Secretary of the institution vide representation dated 25.10.2016 informed regarding change of postal

address of the institution due to jurisdiction of postal service for which no letter is being delivered at their place.

The committee considered the representation of the institution and observed that the new postal address is

different from the old postal address.


The institution is directed to submit the documentary proof of change of address of post office on the following

from Post Master General, Govt. of West Bengal:

Address: “Vill.- Sadikpur, P.O.-Gankar, West Bengal-742227” changed to “Vill- Kulori (Near MDI), P.O.-

Uttar Ramana B/O, West Bengal-742235”.

15. 233.12.8

Ratulia Secondary Teachers Training Institute, Panskura Vidyasagar Social Welfare

Society Building, Vill-Kanakpur, PO-Naranda, Dist-Purba Medinipur, West Bengal

– 721139 (B.Ed.) (Private) (Vidya Sagar University) (APE00573)

The institution has submitted representation vide Ref. No. 05/RSTTI/2016 dt. 19.10.2016 regarding constitution

of new managing committee along with copy of extract of Resolution dated 01.07.2016.


The committee noted the information regarding change of Managing Committee as intimated by the institution.

16. 233.12.9

Shailabala Womens College, Plot no.-45-52, Street no.-Mission Rd, Po-Buxi Bazar,

Tehsil/Taluka-Cuttack Sadar, Town/City-Cuttack, Dist-Cuttack, Odisha-753001

(B.Ed.) (Government) (Utkal University) (ERCAPP3073)

(Change of affiliating body-Existing TEI)

The institution was granted recognition vide Order No. ERC/7-213.6(i).160/ERCAPP3073/B.Ed./2016/45923

dated 02.05.2016 for conducting B.Ed. course with an intake 50 (One basic unit) from the academic session

2016-2017 and the affiliating body was Utkal University, Bhubaneswar.

An e-mail dated 22.09.2016 received from the institution along with a letter vide No. 2494 dated 22.09.2016

requesting to change the affiliating body from Utkal University, Bhubaneswar to Rama Devi Women‟s

University, Bhubaneswar. The ERC in its 224th

meeting held on 24th October, 2016 considered the matter and

accordingly, a letter vide No. 49925 dated 07.11.2016 was issued to the institution with direction to get the NOC

from the proposed as well as existing affiliating body and submit the same to ERC NCTE.

In response, an e-mail dated 15.11.2016 received from the institution along with copy of Notification dated

30.05.2015 of Higher Education Department published in the Odisha Gazette vide No. 888 dated 4th June, 2015

wherein stated that the State Government do hereby alter the territorial Jurisdiction of the Utkal Unviersity by

exclusion of all Women‟s Colleges admitted to its privileges and established a new University as the „Rama

Devi Women‟s University‟ with effect from 30th

May, 2015 having Jurisdiction over all Women‟s Colleges

admitted to the privileges of the Utkal Unviersity before such establishment.


The committee noted the change of affiliating body from „Utkal University, Bhubaneswar‟ to „Rama Devi

Women‟s University, Bhubaneswar‟ as per decision taken by the State Government of Odisha.

17. 233.12.10

Dr. B.R. Ambedkar Institute of Education, Plot No.18, Street No.-18, Vill-

Balarampur, Tehsil/Taluka-Barelia, Town/City-Baruiour, P.O.-Madarat, Dist-South

24 Parganas, West Bengal-743610 (B.Ed.) (Private Aided) (ERCAPP863)

The above mentioned institution was granted recognition vide Order No. ERC/7-160.1.1/2013/20967 dated

23.09.2013 for conducting B.Ed. course with an intake of 100 from the academic session 2013-2014 followed by

revised Order vide No. 32280 dated 27.05.2015 as per NCTE Regulation 2014.

The institution vide representation dated 25.09.2016 submitted a proposal for changing of the name of the

institution from „Dr. B.R. Ambedkar Institute of Education‟ to „Dr. B.R. Ambedkar Institute of Education, B.Ed.

College‟ along with copy of Resolution dated 20.02.2016 of the management and a copy of gift deed in this

regard.

The ERC considered the matter and observed as under:

(i) The institution submitted an unregistered gift deed relating to change of name of the institution, which is

not accepted.

(ii) For change of name, the institution is required to submit registered gift deed in the name of proposed

institution.


A letter be issued to the institution to submit the reply within 21 days to ERC NCTE.

18. 233.6.2

Rajiv Gandhi University, Plot No- Rono Hills, Vill- Rono Hills, PO- Doimukh,

Tehsil/Taluka- Doimukh, Town/City- Doimukh, Dist- Papum Pare, Arunachal

from the NCTE Hqrs. from time to time, VTR and reply in response to LOI, the Committee discussed the matter

in detail and observed as under:

(i) As per submitted staff list, the institution appointed five Assistant Professors out of which one is

Principal/HOD.

(ii) As per NCTE Regulations, 2014 to conduct one unit (100) of B.P.Ed. requires one Principal, two

Associate Professors and six Assistants as full time basis.

In view the above, the committee decided as under: The institution be directed to submit the compliance on or before 28

th February, 2017 as the cut of date for

granting/refusal of recognition for the session 2017-2018 is 3rd

March 2017.

Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused

on the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act

1993 to the institution to submit its reply within the stipulated time as mentioned above before the Committee

takes final decision.


19. 233.4.2

Nand Kunwar Hari Roy College of Education, Plot No. 2507, Street/Road- 10, Vill-

Digha Ghat, Po-Digha, Tehsil/Taluka- Digha, Town/City- Patna, Dist.- Patna, Bihar-

800011 (D.El.Ed.-New proposal) (Private) (Bihar School Examination Board)

(ERCAPP3351)

The Appellate Authority vides Order No. 89-509/2016-Appeal/15th Meeting – 2016 dated 03.01.2017 remanded

to ERC with a direction to consider all the relevant documents and take further action as per the NCTE

Regulations. The appellant is directed to submit again a complete set of all the requisite documents including the

deed correction to the ERC within 15 days of receipt of the orders on appeal.





20. 233.4.3
