REGULAR CITY COUNCIL MEETING MINUTES

MONDAY, MARCH 15, 2021

CALL MEETING TO ORDER: The Regular Meeting of the Bowie City Council was held on Monday, March 15, 2021, virtually. Mayor Adams called the meeting to order at 8:30 p.m. due to technical difficulties. PLEDGE OF ALLEGIANCE TO THE FLAG: Mayor Adams led the Pledge of Allegiance to the Flag. QUORUM: In attendance were Mayor Adams, Councilmembers Boafo, Esteve, Harrison, Ndebumadu, and Woolfley, City Manager Lott, Assistant City Manager Mears, City Attorney Levan, City Clerk Hernandez, and Staff. CITIZEN PARTICIPATION:

1. Dorothy Van Doren, Victoria Heights Dr – Comment attached. CITY BOARDS AND COMMITTEES:

Councilmember Harrison motioned to appoint Ms. Bisola Owolabi to the Education Committee for a two-year term. Mayor Pro Tem Boafo seconded the motion. Motion passed 6-0. Mayor Adams swore-in Ms. Owolabi. CITY MANAGERS REPORT: City Manager Lott reported that staff is in the final preparation stages of the FY 2022 budget and making sure that all City employees get vaccinated. CONSENT AGENDA: Councilmember Woolfley made a motion to approve items A) Approval of March 1 Regular Meeting Minutes; B) Approval of Proclamation P-4-21 Recognizing the 64th Anniversary of Ghana’s Independence; C) Adoption of Resolution R-13-21 Accepting Bid for the Construction of the Northview Drive Mid-Block Crossing; D) Adoption of Resolution R-14-21Waiving the Competitive Bidding Requirements of Section 61 “Purchasing and Contracting” of the Charter of the City of Bowie to Allow the City Manager to Enter Into an Annual Support Agreement with ConvergeOne to Provide Managed Services on the Telephone System; E) Adoption of Resolution R-15-21 Authorizing the Waiving of Biding Requirements to Allow for the Purchase of a Street Sweeper by Piggybacking a General Services Administration Bid; F) Adoption of Resolution R-16-21 Accepting a Bid Proposal for Jericho Park Trail. Mayor Pro Tem Boafo seconded the motion. Motion passed 6-0.

NEW BUSINESS:

A. Adoption of Resolution R-6-21 Adopting the Housing and Community Development CARES Act Amendment: Substantial Amendment to the FY2019-2023 (HUD FY2018-2022) Consolidated Plan, FY2021 (HUD FY2020) Amended Annual Action Plan, and the Amended Citizen Participation Plan – Grants Manager George Jones, summarized the staff report. As an entitlement community, the City of Bowie (“City”) received $209,962 in Community Development Block Grant-Coronavirus (CDBG CV-3) funds from the Department of Housing and Urban Development (HUD). Public Hearing: Since there were no comments received, Mayor Adams declared the Public Hearing to have been held. Councilmember Harrison motioned to adopt Resolution R-6-21 and send the plan to HUD. Mayor Pro Tem Boafo seconded the motion. Motion passed 6-0.

B. Discussion on City of Greenbelt request for cost-sharing of expenses related to SCMaglev DEIS Review – City Manager Lott reported to Council that the City was told by the Governor’s Office that SCMAglev will not be going near or through the incorporated City of Bowie. He also stated that he has not had a conversation about this request with any staff members of the City of Greenbelt, he received this letter via email and was asked to pass it to Council.

Council asked City Manager Lott to reach out to the City of Greenbelt to get more information

about the request. ADJOURNMENT: Mayor Pro Tem Boafo motioned to adjourn the Regular City Council meeting. Councilmember Harrison seconded the motion. Motion passed 6-0. The meeting adjourned at 8:56 p.m.

PROCLAMATIONOF THE COUNCIL OF THE CITY OF BOWIE, MARYLAND

PROCLAIMING APRIL 2021 AS AUTISM AWARENESS MONTHIN THE CITY OF BOWIE

WHEREAS, Autism Spectrum Disorder, the fastest growing developmental disability in theUnited States, affecting 1-in-54 children, is an urgent public health crisis that demands a nationalresponse; and

WHEREAS, in recognition of the growing needs of the worldwide autistic community and to raise awareness about Autism Spectrum Disorder and the need to provide services to individuals and families who are affected, the United Nations has sanctioned April 2nd as World Autism Awareness

Day; and

WHEREAS, Autism FYI Organization, an organization dedicated to promoting a safeenvironment, employment opportunities, and independence of those on the Autism Spectrum providesa safety program offering easily identifiable products for quick identification by emergency personnel,a hotline for accessing emergency contacts and medical information, and training. Training offered forfirst responders, childcare providers, transportation models, hair salons, restaurant staff, schoolresource officers, correctional officers, and medical staff is available in-person and online through itsAutism online course marketplace. Autism FYI will have an annual camp for children and youngadults with Autism that will help teach them life skills. Autism FYI provides a national membershipprogram along with the IRIS (Immediate Recognition Increases Safety) Program that works on thepremise that immediate recognition of one’s disability and need for special considerations helps firstresponders act appropriately more quickly while providing a source specifically designed to holdmedical, demographic and behavioral information necessary in an emergency. Autism FYI advocatesfor individuals with Autism and their families, promotes the awareness of Autism worldwide; and

WHEREAS, in light of the growing impact of Autism Spectrum Disorder and the need forgreater awareness, Autism FYI holds their “Light It Up Blue!” campaign on World Autism AwarenessDay, designed to increase awareness about Autism by asking participating organizations to turn theirlights blue; and

WHEREAS, the City of Bowie, Maryland is honored to take part in the annual observance ofAutism Awareness Month and World Autism Awareness Day in the hope that it will lead to betterunderstanding of the disorder.

NOW, THEREFORE, BE IT PROCLAIMED that the Council of the City of Bowie,Maryland hereby recognized April 2, 2021 as World Autism Day and recognizes April 2021 as AutismAwareness Month in Bowie, Maryland to raise public awareness of Autism Spectrum Disorder and themyriad of issues surrounding autism, as well as to increase knowledge of the programs that have beenand are being developed to support autistic individuals and their families.

M E M O R A N D U M TO: City Council FROM: Alfred D. Lott, City Manager SUBJECT: Contract Award for Bowie City Hall Masonry Repairs Project

R-17-21 DATE: March 25, 2021 On February 25, 2021, the Department of Community Services issued a Request for Proposals for masonry repairs needed on the exterior walls of City Hall. On March 18, 2021 seven (7) bids were received and opened. The results were as follows:

Firm Total Tecta America East, Jessup, MD $19,800 Eastern Waterproofing & Restoration of Virginia, Toano, VA $29,963 Contracting Specialists, College Park, MD $37,220 Atlantida Builders, Inc., Gaithersburg, MD $40,634 Colossal Contractors, Burtonsville, MD $43,000 DC Mason Builders, Inc., Beltsville, MD $49,000 Jones Masonry Restoration, Harrisburg, PA $50,000

Adequate funds are available in Repair & Maintenance – Buildings (01180-51235) to complete this project. When evaluating the proposals received, staff considered the expertise and experience of each firm, successful completion of similar commercial masonry repair projects, as well as experience with the City of Bowie or other municipal agencies. The low bid submitted by Tecta America East did not meet the minimum experience qualifications as outlined in the RFP. Upon confirming the understanding of the scope of work, completion timeline, and verifying references for Eastern Waterproofing & Restoration of Virginia, the Department of Community Services recommends a contract be awarded to Eastern Waterproofing & Restoration of Virginia located in Toano, Virginia in the amount of $29,963 for the work specified in the Request for Proposals.

WHEREAS, the City of Bowie owns and operates Bowie City Hall; and WHEREAS, the City intends to make repairs to certain masonry and replace damaged

The upgrade was completed in March 2016. Part of the proposal from ConvergeOne includes the annual maintenance for the phone system. Avaya is the sole provider for 24x7 Onsite Hardware Support, Support Advantage Software Support and Upgrade Advantage for the phone system. The annual cost for the maintenance is $55,441.80. The funds for the maintenance are allocated in the FY21 budget. In accordance with City Charter Section 61, we are requesting that Council waive bidding requirements and allow for the issuance of a Purchase Order to Avaya in the amount of $55,441.80. When evaluating the proposals, staff considered the expertise and experience of each

bidder. The lowest bid, submitted by Sandy Audio Visual, LLC, is not significantly lower than the bid submitted by Applied Video Technology, Inc.

Applied Video Technology, Inc. was the only responding company the equipment

manufacturer, Newtek, has designated as a Platinum Partner and Authorized Support Provider. This provides for manufacturer-authorized post sales support and we feel this to be the most advantageous choice.

The Communications Division recommends that the bid proposal from Applied Video

Technology, Inc. in the amount of $63,000 be accepted.

Lott, ICMA-CM, CPM City Manager SUBJECT: CB-21-2021 Food/Beverage Stores and Gas Stations in the R-A Zone DATE: March 31, 2021 County Council Member Todd Turner has presented CB-21-2021, a legislative bill that seeks to permit a food and beverage store and gas station in the R-A (Residential Agriculture) Zone, under certain circumstances (copy attached). The legislation was requested by the owner of a vacant, three-acre property located in the median of Maryland Route 3, south of Maryland Route 450, across from Beall Funeral Home (see map below).

2 Memo to City Council re: CB-21-2021

CB-21-2021 will revise the Permitted Uses in the R-A (Residential Agriculture) Zone to allow a food and beverage store with a gas station, which would be regulated as if the property were zoned C-M (Commercial Miscellaneous), subject to approval of a Detailed Site Plan. This legislation, which has already been presented at a County Council meeting, is awaiting review by the Council’s Committee of the Whole at an upcoming meeting. The property intended to benefit from this zoning text amendment is not within the City limits, which are close by at Whitemarsh Park, about 900 feet to the south. As stated by the proponent’s attorney, there is currently strong interest in this property from commercial developers. Analysis There are reasons for the City to be concerned about CB-21-2021. In this instance, the zoning text amendment process is clearly an end run around any other process that might rezone the property, such as a piecemeal rezoning, a rezoning through the Countywide Map Amendment (CMA) or a Sectional Map Amendment following approval of the Bowie-Mitchellville and Vicinity Area Master Plan. For decades, the City has opposed development, especially traffic generating development, in the US 301/MD 3 median. The proponent’s attorney points out that the legislation is needed now, because the future of CMA approval is uncertain, and they believe that there will not be a Sectional Map Amendment (SMA) following approval of the Bowie Master Plan. The proponent’s attorney explained that they tried to limit the bill from applying to all median properties in the R-A zone by excluding property that is not within 2,500 feet of an existing major intersection or planned interchange. Staff believes this legislation is unnecessary and very untimely, especially given the timelines for CMA completion and approval of a new Master Plan for Bowie-Mitchellville and Vicinity. We understand that the Maryland General Assembly is likely to approve legislation this session that will allow the CMA to move toward final approval. Additionally, M-NCPPC staff advised us this week that, although the Bowie-Mitchellville and Vicinity Master Plan does not have a concurrent SMA, the intent to follow the Master Plan approval with a new SMA has always been their intent. The Preliminary Area Master Plan is due to be published this summer. There are multiple City development policies contained in the Development Review Guidelines and Policies document recently approved by City Council on March 1st that apply directly to this effort to amend the County Zoning Ordinance. Land Use US 301/MD 3 Median

• Existing properties in the MD 3/US 301 median shall be retained in the R-R zone. Expansion of existing commercial uses shall be discouraged, as they will further contribute to an already over-burdened transportation system and create the potential for increased vehicular conflicts. Any future commercial rezoning of residential properties to commercial zones is discouraged.

• The consolidation of existing commercial properties in the MD 3/US 301 median shall be encouraged to

provide more coordinated and attractive development.

• Any improvement to median properties shall include adequate turning lanes and acceleration/deceleration lanes.

Rural and Agricultural Areas Development of properties in the Rural and Agricultural Areas shall address the following:

• protection of agricultural uses; • minimization of lot coverage and building bulk to avoid overly imposing new structures;

• the use of conservation and wildlife habitat landscaping and avoidance of non-native plants; • preservation or creation of meadows and woodlands; • restrictions in sizes of lawns around all structures; and • use of aesthetically pleasing vinyl and aluminum siding.

Economic Prosperity Strip commercial development, particularly single-use or pad site configuration, shall be discouraged. Commercial development shall be located in planned or designated centers rather than on isolated, scattered sites. Transportation and Mobility MD 3 Policy The City supports a completely grade separated interchange (Option A) at the intersection of MD Route

450 and MD Route 3 to encourage drivers destined for points west of Bowie to use US Route 50 as opposed to MD Route 450. Regarding the upgrading of MD Route 3, the City supports the Boulevard Concept (Alternate #3) with the following modifications:

points. • Connect Columbian Way to Forest Drive using bridge over MD 3. • Construct half diamond for access to MD Route 3 on the south side of Columbian Way/Forest

Drive bridge. • Install 2-way stop on service road at Forest Drive and install stop signs at Sylvan Drive and

Whitemarsh Park. • The grade-separated interchange shall also accommodate east/west and north/south bicycle

traffic through the interchange. Natural Environment The Patuxent River is recognized as being a valuable environmental resource within close proximity to the City of Bowie. This resource has a rich heritage dating back to pre-historic and Colonial times and is worthy of protection efforts from local government, residents and the business community. The network of environmental assets related to the Patuxent ecosystem includes “Sensitive Areas”, such as 100-year floodplain, wetlands, steep slopes, and other natural characteristics. In addition, the Countywide Growth Management Policy in Plan Prince George’s 2035 identifies the benefitting property as lying within the Rural and Agricultural Area, where new development is discouraged. The General Plan, on page 106, defines Rural and Agricultural Areas as “areas with significant natural and agricultural resources that are best suited for low-density residential development on well and septic, agricultural activity, and forest preservation.” Staff believes that development of the above-mentioned property with commercial uses, at this time, would not be consistent with the current City and County development policies set forth above. An approved concept plan exists for the grade separation of MD 450/MD 3 intersection and construction of an interchange and service road system at that location. However, there is no funding for design or construction of this improvement in the current Maryland Department of Transportation’s Consolidated Transportation Program. The conceptual design for the interchange is depicted below. The construction of the interchange will occur just north of the referenced three-acre property and, upon its completion, the current southbound lanes of MD 3 will become a two-way service road. The parcel is likely to be impacted by SHA right-of-way acquisition for lane widening on the northbound lanes of MD 3 and construction of the service road along the current southbound lanes. Given the uncertainty of State funding for the interchange and its construction timetable, staff believes it would be premature to convert

this parcel to commercial use. Staff recommends retaining it in rural and agricultural uses as allowed under the current R-A zoning.

Recommendation Staff recommends Council OPPOSE CB-21-2021 because the proposed legislation, with respect to the three-acre parcel in the median of MD 3, south of MD 450:

• is not consistent with current City and County land use policies; • interferes with the process now underway to update the Bowie-

Mitchellville and Vicinity Area Master Plan and the planning area’s zoning pattern; and,

• is premature in relation to plans for construction of a new interchange at MD 450/MD 3 and its related service road system.

Hawkins, II, Chair Committee of the Whole Prince George’s County Council County Administration Building 14741 Governor Oden Bowie Drive Upper Marlboro, Maryland 20772 RE: CB-21-2021 (R-A Zone) Dear Chair Hawkins: On April 5, 2021 the Bowie City Council reviewed CB-21-2021, which will permit food and beverage stores and gas stations in the R-A (Residential Agriculture) Zone, under certain circumstances. The legislation was requested by the owner of a vacant, three-acre property located in the median of Maryland Route 3, south of Maryland Route 450, across from Beall Funeral Home. The property intended to benefit from this zoning text amendment is not within the City limits, which are close by at Whitemarsh Park, about 900 feet to the south. As the City understands it, there is currently strong interest in this property from commercial developers. The City Council believes this legislation is unnecessary and very untimely, especially given the timelines for CMA completion and approval of a new Master Plan for Bowie-Mitchellville and Vicinity. We understand that the Maryland General Assembly is likely to approve legislation this session that will allow the CMA to move toward final approval. Additionally, M-NCPPC staff advised the City that, although the Bowie-Mitchellville and Vicinity Master Plan does not have a concurrent SMA, the intent to follow the Master Plan approval with a new SMA has always been their intent. As you are aware, the Preliminary Area Master Plan is due to be published this summer. In addition, the Countywide Growth Management Policy in Plan Prince George’s 2035 identifies the benefitting property as lying within the Rural and Agricultural Area, where new development is discouraged. RESOLUTION OF THE COUNCIL OF THE CITY OF BOWIE, MARYLAND

ADOPTING PILOT COMMUNITY WORKFORCE AGREEMENTS FOR FY22-27 STREET RESURFACING AND WATER DISTRIBUTION SYSTEM

RECAPITALIZATION PROJECTS

WHEREAS, the City of Bowie (“the City”) manages and oversees a significant capital construction budget, and is committed to ensuring that its capital construction funding creates high quality careers in construction for City residents, including recent Bowie High School graduates, women, all ethnics groups within its population, veterans, returning citizens, and residents with social and economic disadvantages; and

WHEREAS, although Bowie is one of the county’s most affluent localities with a majority African American population, some segments of its population face economic, educational, and career development obstacles; and

WHEREAS, the City recognizes that Community Workforce Agreements (CWAs) and MBE/WMBE certifications are strategic vehicles for addressing the legitimate needs and interests of underserved populations that historically have been excluded from the benefits of economic and career path development; and

WHEREAS, the City recognizes that CWAs promote a well-trained workforce that earns family-supporting wages with employer-sponsored health and retirement benefits, which contributes to the economic prosperity of the city and surrounding county, and reduces the need for government-sponsored safety net services; and

WHEREAS, a pilot CWA undertaken by Prince George’s County Public Schools demonstrated that minority contractors and construction trades unions can work together successfully to deliver projects on time and on budget, and create workforce opportunities for residents; and

WHEREAS, the COVID-19 pandemic highlights the critical need for jobs that provide workers with affordable, employer-sponsored health insurance coverage and the tragic impact of the failure to adequately insure persons of color; and

WHEREAS, local governments across the country have successfully leveraged tax dollars to uplift residents in their respective districts and the City desires to contribute to this effort in Maryland.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bowie, Maryland, that a pilot Community Workforce Agreement shall be incorporated into the FY22-27 procurement of street resurfacing and water distribution system recapitalization projects that meets local and minority business requirements, Maryland/county prevailing wage

requirements, and diverse workforce stipulations, and strives to provide opportunities for minority, women, disabled and disadvantaged business owners, and certified MBEs to participate as contractors or suppliers; and

BE IT FURTHER RESOLVED that upon successful completion of the pilot, the City shall consider continuation of the Community Workforce Agreement and expansion to other scopes of work, where appropriate. MEMORANDUM

TO: City Council FROM: Daniel J Mears Assistant City Manager SUBJECT: Federal Earmark Lobbying Proposal DATE: April 1, 2021 When federal legislators recently decided to bring back the earmarking process for federal funding of local projects, staff had discussion with the City’s lobbyist, Venable, regarding the potential for the City of Bowie to receive an earmark. With variable and looming deadlines for submitting earmark requests, I authorized Venable to work on an hourly basis to submit the earmark requests on behalf of the City for tuberculated water main infrastructure funding. That work was completed with submissions to our Congressional and Senatorial representatives. I asked Venable to provide the City with a proposal for what a lobbying effort would entail and the cost for the earmark, since that is outside the scope of the existing lobbying services. The lobbyists propose a fee of $4,000 per month between now and the end of the year with a review in three months to review hours spent on this matter and whether the retainer should be lowered or increased based on time spent working on this matter. An item under New Business for Monday’s agenda has been added for the City Council to discuss whether it would like to engage Venable for the federal earmark lobbying services. A motion to direct staff to engage the lobbyists would be appropriate. We will ask representatives from Venable to be available for questions regarding their proposal for Monday night. Some detail of the earmark request is below. FY22 Requested Funding - $2,000,000 Description of Request – The City of Bowie is seeking funding to replace one mile of tuberculated cast iron water main. As part of 90 mile water main system that is majorly impacted by tuberculation. The City is currently constructing the first 2.5 mile portion of a 7 mile phase. The City’s water distribution piping, constructed in the 1960s, suffers from severe tuberculation. Tuberculation is a development of small mounds of corrosion products on the inside of iron pipes, which reduce the interior pipe diameter and trap iron particles. The tuberculation causes flow restrictions and frequent incidents of discolored (brown or yellow) water. In some cases, flow restrictions threaten fire safety since hydrants cannot flow an adequate quantity of water. The funds would support design, construction, replacement meters, and related costs for a portion of the approximate 72 miles of impacted pipes the City of Bowie needs to replace.

Description of Maryland Impact – The City of Bowie is a predominately residential community whose residents work in critical industries and government in the Baltimore/Washington region. Reliable and high quality water is critical to daily life, and is necessary for these residents to meet their responsibilities to the workforce and region. Demonstration of Community Support – To support the recapitalization program the City adopted a special charge of $22.75/quarter per customer beginning in FY 2018.
