I have reviewed your response to the Performance Review Report resulting from my desk review on June 3, 2020 and find your corrective actions satisfactory. We are pleased to inform you that your agency may continue to participate in the HUD Housing Counseling Program. This is effective immediately and covers a 3-year period.
Enclosed is your Certificate of Approval. The name and address of your agency will continue to appear on the list of agencies that participate in Housing Counseling Program posted on HUD's website and will continue to be included in the toll-free 800 number referral service provided by HUD. Please be certain to advise this office promptly of any change in your counseling work plan, staff, address or telephone number.
It is your agency's responsibility to check the Housing Counseling System (HCS) to ensure that your agency's information is current and accurate. This data must be verified at least once every ninety days. If no change is required, simply mark the "Validate" box at the top right of your agency profile page to indicate you have verified the information, and then click the "OK" button at the bottom of the page. Agency data from HCS is used to produce the state-by-state lists of agencies that participate in the Housing Counseling Program posted on HUD's website and provided on the telephone interactive referral system. Refer to HCS’s webpage at HCS.

Box 3126 Winter Haven, FL 33885 Dear Ms. Dobison: Thank you and your staff for the courtesy and cooperation given to the Office of Housing Counseling during the on-site review on June 3, 2020. The review was conducted to ensure that your agency continues to comply with all HUD Housing Counseling Program requirements including 24 CFR, Part 214; HUD Housing Counseling Handbook 7610.1, relevant mortgagee letters; and grant agreement, if applicable.
During the review I found deficiencies that existed in your agency’s performance. You are required to correct these deficiencies within 90 days in order to continue participating in HUD’s Housing Counseling Program. Failure to adequately address these issues in a timely manner may result in your removal from the Housing Counseling Program. As of the date of this letter, HUD hereby grants your agency a conditional re-approval for 90 days or until all the noted findings have been corrected, whichever is earlier. An unconditional approval certificate will be issued at such time as HUD has determined that all findings have been satisfactorily corrected. During the 90-day period of conditional participation, the name and address of your agency will continue to appear on the list of agencies participating in HUD’s Housing Counseling Program that is available on HUD’s website. Please submit, within 30 days of the date of this letter, a written response to the findings outlined in the performance report, including a timeline and description of proposed or undertaken corrective actions to me at the email below. I. PURPOSE:
The purpose of this review is to evaluate the housing counseling agency’s ability to ensure compliance with HUD Housing Counseling Program requirements, including 24 CFR, Part 214, HUD Housing Counseling Handbook 7610.1, applicable mortgagee letters, other guidance and grant agreements, if applicable. Additionally, this review is conducted to ensure that the housing counseling agency is implementing its programs and services in accordance with the counseling work plan submitted to HUD.
II. METHOD AND SCOPE OF REVIEW:
This review entailed Judy Ayers Britton, Management Analyst, meeting and interviewing Al Miller, Deputy Director of Community Services and Economic Development Division and Pa Houa Lee-Yang, Director of CSBG/Economic Development Department. The five (5) files shown below were reviewed for compliance with the Notice of Funding Availability (NOFA) Applications, Grant Agreement, Federal Register and OMB requirements and Handbook and Regulation requirements. The file types reviewed included: 3 Mortgage Default and 2 Rental files.
The following files were reviewed: 4441531 4287669 2821735 4381282 4210765
The items reviewed included the following: Audited financial report dated November 26, 2019, agency housing counseling Work Plan, housing counseling grant quarterly reports, HUD 9902s - Housing Counseling Activity Reports, staff resumes and training received, agency disclosure form, verification of non-profit status, community resources information, and individual client files for the following regulation compliance: action plans, budget, financial analysis, counselors procedures, log of activities, file documentation, demographics, disclosures, follow-up activities, termination of files, intake forms, notes, funding sources and general management of client files.
Grant Periods – October 1, 2017 to March 31, 2020
The Agriculture and Labor Program, Inc. (ALPI) received two HUD Comprehensive Housing Counseling Grants in the amount of $17,908 under Fiscal Year 2018 NOFA and $12,427.00 under Fiscal Year 2019 NOFA.

The purpose of the grants were to provide rental and mortgage default one-on-one counseling. The agency utilized the funding to support their activities in these service areas as well as training their counselors for HUD Housing Counselor Certification.
III. GENERAL COMMENTS:
ALPI provides financial management/budget counseling, mortgage delinquency and default resolution counseling, and rental counseling. ALPI also assists clients with rental and utility payments and provides exceptional services to their community. The files reviewed were maintained in accordance with 24 CFR Part 214, HUD Handbook 7610.1, and applicable housing counseling grant agreement except for the findings below.
IV. OBSERVATIONS: Observation No. 1: Supervisory Monitoring Supervisory Monitoring is completed but not formally documented. Agency has created a
document to support activity and will submit when responding to the findings. Observation No. 2: Quarterly Reporting Quarterly grant reports need to be submitted on time. If nothing to report, agency will submit an email that there is nothing to report for that quarter. Agency has been transferred to different POC's over the past few years and has not had clear guidance in this area. Observation No. 3: Client Management System (CMS) Training ALPI should obtain more training on their CMS on submitting 9902's and entering client data. Reviewer discussed the importance of proper reporting and explained Section 10 reporting. Agency agreed to obtain training and enter data properly so 9902’s capture client data properly.
V. FINDINGS:
Finding No. 1: Failure to Document Results of Counseling and Termination The Reviewer was unable to determine reason for termination on most files reviewed. Counselor doesn't specifically state reason for termination and whether goals were met.
RECOMMENDATION AND ACTIONS REQUIRED: Effective immediately, all client counseling files shall contain the reason for termination and the outcome of counseling. If the client’s goals were not met, an explanation documenting the reason shall be included in the client file notes. For guidance, refer to references listed below.

Provide a certification to HUD signed by the C.E.O. that all counseling staff have read and will comply with HUD Regulation 24 CFR Part 214.315 (h) and HUD Housing Counseling Handbook 7610.1, Chapter 3, paragraph 3-5 (H), and Chapter 5, paragraph 5-7 (I).
Finding No. 2: Disclosure Statement
The agency failed to provide an approved disclosure statement to three of the five clients reviewed. ALPI states they use a specific disclosure for rental clients. However, an acceptable disclosure was not provided. The same approved disclosure should be provided to all clients and documented in the client file.
RECOMMENDATION AND ACTIONS REQUIRED: Effective immediately, all open and future client counseling files must contain a disclosure statement that contains all applicable requirements. A written disclosure must be provided to each counseling program client. For guidance, refer to references listed below. Provide a certification to HUD signed by the C.E.O. that all counseling staff have read and will comply with HUD Regulation 24 CFR 214.303 (g) and HUD Housing Counseling Handbook 7610.1, Chapter 5, 5-7 (H) and 5-8 (H), and Chapter 6, paragraph 6-1 (H).
VI. CONCLUSION: The reviewer recommends a 90-day conditional re-approval until all findings have been
corrected. A follow-up visit within 90 days may be conducted depending on agency’s response and implementation of the above recommendations.
