A. Project Description

1. PCL has been engaged by BC Hydro to provide construction delivery services for BC Hydro

offices and other facilities in more than 100 communities throughout BC. These facilities

consist of offices, yards, workshops, warehouses, truck bays and other buildings.

2. Project types generally include:

• Interior space renovations which may include;

o Drywall

o Paint

o Flooring

o Mechanical/Electrical

o Finishes and Specialties

• Supply and/or replacement of building systems and end of life components such as:

o HVAC,

o Plumbing,

o Fire and life safety;

• Supply of new, replacement or major repairs to:

o Roofs

o Security gates and/or fencing

o Building envelopes,

o Yards;

• Supply and installation of new storage buildings/vehicle bays;

• hazardous material abatement

• other assets replacement projects, small repairs and other minor work on as needed

basis.

3. The average age of many of the facilities is between 25 to 30 years old and all potentially need

ongoing improvement, repairs and maintenance over time. Facilities range in size from about

3000‐4000 square feet to up to 80,000 square feet, and include two large multi‐story office

towers in Vancouver and Burnaby.

4. PCL anticipates that projects will be distributed roughly as follows: 70% in the Lower Mainland,

25% in the Northern and Southern Interior and 5% on Vancouver Island.

5. This Program Pre‐Qualification covers contractor services from September 15, 2015 through

March 31, 2019.

B. General Information

1. PCL Constructors Westcoast Inc. (hereinafter referred to as “PCL”) invites you to participate in a

Trade Contractor prequalification process for the BC Hydro Facilities Improvement Projects.

Please see the map in section J of this Program Pre‐Qualification for Clarification of Regions.

2. All enquiries related to this Program Pre‐Qualifications are to be directed, in writing, to the

3. Information obtained from any other source is not official and should not be relied upon.

Enquiries and responses will be recorded and may be distributed to all Trade Contractors at

PCL’s option.

4. On an annual basis, if requested, approved contractors may be requested to submit updated

financial information.

C. Submission Instructions

1. Trade Contractors should submit their information as requested on the attached letter

regarding P: CL's Subcontractor Default Insurance program.

a. Appendix A – PCL Subcontractor Default Insurance Letter

2. Trade Contractors to submit one of the following:

a. one complete set paper copy,

b. one electronic (CD or flash drive) copy or;

c. via email to the contact listed on the previous page.

3. Submissions and their envelopes should be clearly marked with the name and address of

the Trade Contractor and the Project Title shown below. If submitting by email, send to the

contact shown under section B.2 above. If submitting by hand, please submit in a sealed

envelope addressed as follows:

5. All responses to this Program Pre‐Qualification will be subject to the Freedom of

Information and Protection of Privacy Legislation.

D. Submission Forms

1. Submit using the forms provided. Submissions using forms other than those provided may

be rejected.

2. Submissions not completed as instructed may be rejected.

E. Opening of Submissions

1. Submissions received will be privately opened.

2. No immediate information or formal decision will be issued with respect to the

submissions until all submissions have been reviewed in detail.

F. Acceptance and Pre‐Qualification Process

1. The Trade Contractor, in submitting a response to this Program Pre‐Qualification,

acknowledges and agrees that neither PCL or BC Hydro will be responsible for any costs,

expenses, losses, damage, or liability incurred by the Trade Contractor as a result or, arising

out of, or connected with their submission, or due to the acceptance or non‐acceptance of

the Trade Contractor’s submission.

2. Neither BC Hydro or PCL have any legal or other duty or obligation to a Respondent or a

Pre‐ Qualified Trade Contractor to:

a. invite any one or more Pre‐Qualified Trade Contractor to participate in a

competitive process relating to the procurement of a construction services

contract; or

b. award, or enter into, a contract or agreement, with any one or more of the

Pre‐ Qualified Trade Contractors.

3. This Program Pre‐Qualification is not an agreement or an offer to enter into a contract or to

purchase any goods or construction services, and does not commit PCL or BC Hydro in any

way to pre‐qualify a Trade Contractor or subsequently award a contract to a Respondent,

and PCL specifically reserves the right at any time, whether before or after the Program

Pre‐ Qualification Closing, to modify or terminate the Program Pre‐Qualification.

G. Rejection of Submission

1. PCL may, in its sole discretion, reject or retain for consideration submissions which

fail to conform to the requirements of this Program Pre‐Qualification in form or

content.

2. Notwithstanding any other terms herein, or any industry practice or custom, PCL may, in

its sole and absolute discretion do any of the following:

a. pre‐qualify any Respondent; or

b. not pre‐qualify any Respondents.

H. Evaluation

1. Submissions will not be evaluated if the Trade Contractor’s current or past corporate or

other interests may, in the opinion of PCL, give rise to a conflict of interest in connection

with this program.

2. Evaluation of submissions will be by a committee that may consist of various members of

PCL (Purchasing, Facilities, and Projects) and professional consultants.

3. Evaluations will be completed as submissions are received.

4. PCL reserves the right to add additional trade contractors to the approved list at any

point beyond the closing of this tender.

5. The criteria to be considered in evaluation of submissions may include, but not be limited

to, the following:

a. Man Power availability

b. Occupational health and safety compliance (management of worksite safety plan)

and past record

c. Environmental Record

d. Previous project performance and quality of work and services, substantiated by

recent and relevant client references:

i. Quality of construction services/work

ii. Quality of Project Management/Contract Administration

iii. Adherence to Project Schedule and Project Safety Requirements

iv. Change management

v. Quality of project documentation (budgeting, invoicing, O&M Manuals)

vi. Experience and capabilities of tradespeople

vii. Owner satisfaction

e. Aboriginal Inclusion

f. Financial Stability

g. Overall experience in projects over $100,000.

h. Overall experience in projects/construction within occupied areas

i. History of disputes/litigation on projects

6. Qualified shortlisted Trade Contractors may be invited to bid on subsequent

tenders/requests for proposals for individual BC Hydro projects.

I. Dispute Resolution

1. If any dispute between PCL and a trade Contractor arises out of or relating to this

process at any time before or after this process terminates, the parties will

attempt to resolve the dispute amicably through confidential good‐faith

discussions.

2. If the parties cannot resolve the dispute within ten (10) Business Days, or such longer

period as the parties may agree in writing, then the parties will submit the dispute to

be settled confidentially by a single neutral arbitrator under the Commercial

Arbitration Act (British Columbia) and the rules of the British Columbia International

Commercial Arbitration Centre. If the parties cannot agree on an arbitrator within

ten (10) Business Days after the dispute is referred to arbitration then the British

Columbia International Commercial Arbitration Centre will appoint the single

arbitrator. The arbitrator will apply the federal laws of Canada and the provincial

laws of British Columbia. The arbitrator’s decision will be binding upon the parties,

and judgment on the decision may be entered in any court of competent jurisdiction.

The arbitration hearing will be held in Burnaby, British Columbia and will be

conducted in English. The parties will share

equally in the arbitrator’s fees and expenses and the cost of the facilities used for the

arbitration hearing, but will otherwise each bear their respective costs in connection

with the arbitration

6. Aboriginal Inclusion

BC Hydro recognizes that some work on this Project will occur within the traditional territory of

through themselves or their subcontractors, as part of the submission.

B. Costs for these Security Checks are the responsibility of the Subcontractors.

8. Disclosure of Interest

A. In accordance with the approved policy of PCL, all Trade Contractors may be required, as part of this Request for Pre‐Qualification make full disclosure of any business relationships within the last five (5) years including any donations/gifts in excess of one hundred dollars ($100.00), with any BC Hydro staff, or immediate relatives of any BC Hydro staff.

B. If the Trade Contractor fails to disclose an interest and/or the interest is falsely or

insufficiently reported, PCL reserves the right to terminate or cancel prequalification of the Trade Contractor for this project.

Part of the prequalification phase is having your company pre-approved for Subcontractor Default Insurance (SDI), PCL’s in-house risk insurance program. This program provides 100% coverage over performance, labour, and materials.

PCL as a company has implemented a secure, online system to process SDI applications. Please email a PQM Textura/Oracle invitation request to Jill Quick at [email protected]. Include the contact name, phone number and email address of the person who will be responsible for uploading SDI information (i.e. manager, accountant, administrator, etc.) This person will receive an email invitation from Textura PQM/Oracle with directions on how to complete the SDI application process.
