REQUEST FOR PROPOSALS FOR INMATE MEDICAL SERVICES
PROPOSALS DUE BY
3:00 PM, December 18, 2020 The County of Kennebec seeks written proposals to provide a comprehensive response for the product/services presented below. This Request for Proposal (RFP) states the overall scope of products and services desired, specific functionality, as well as desired vendor qualifications. Included in this request are:

VENDOR INSTRUCTIONS
1. RESPONSE INSTRUCTIONS
The submitted proposal must follow the rules and format established within this RFP. Adherence to these rules will ensure a fair and objective analysis of all proposals. Failure to complete any portion of this request may result in rejection of a proposal.
2. CONTACT WITH COUNTY EMPLOYEES
To ensure fair and objective evaluation of all proposals, vendors are required to submit all inquiries to the project contact noted on the cover of this RFP.
3. ASSESS RFP DOCUMENTS
Before submitting a proposal, vendors shall examine the specifications in order to understand all existing conditions and limitations. The vendor shall indicate in the proposal the total sum to cover the cost of all items included in the RFP.
4. COSTS OF RFP PREPARATION AND SUBMISSION
Each vendor shall be responsible for all costs incurred in order to prepare and submit their response to this RFP.
5. PROPOSAL REVIEW
All documents submitted as part of the vendor’s proposal will be deemed available to all parties subsequent to the bid opening date and time designated on the front cover of the RFP. All applicable information will be subject to public disclosure in accordance with the Freedom of Information Act.
6. PROPOSAL SUBMISSION
All bid proposals must be in a sealed envelope marked “INMATE MEDICAL SERVICES PROPOSAL FOR KENNEBEC COUNTY JAIL”. THREE (3) COPIES OF THE BID PROPOSAL ARE REQUIRED. Bids will be awarded at the next regularly scheduled Commissioner’s meeting after evaluation has been completed.
Delivery of Proposals: RFPs must be delivered by the date/time specified and to the address indicated on the title page of this RFP. It is the sole responsibility of the vendor to see that their RFP is received in the proper time. Any proposal received after the proposal opening date and time shall be eliminated from consideration and returned to the vendor unopened.
7. RIGHT OF REFUSAL
The County reserves the right to reject all RFPs in their entirety or to select certain applications from the RFPs
8. EVALUATIONS
Evaluation of the proposals is expected to be completed within 30 days after receipt. An evaluation team will evaluate proposals on a variety of quantitative and qualitative

criteria. Any award made as a result of this bid will be determined through best value analysis.
The proposal selected shall provide the most cost-effective approach that meets the stated requirements. The lowest price proposal will not necessarily be selected.
The County reserves the right to:
a) reject any or all proposals, or to make no award b) require modifications to initial proposals c) make partial or multiple awards
The County further reserves the right to excuse technical defects in a proposal when, in its sole discretion, such excuse is beneficial to the County.
The County may award based on initial proposals received, without discussion of such proposals. Selected vendors may be invited to make oral presentations to the evaluation team.
VENDOR BACKGROUND AND QUALIFICATIONS
In addition to detailed response requested below, provide narrative responses to the following questions and provide the necessary documentation for each item listed below.
1. Specify the number of years the vendor has been in business.
2. Provide a chronology of the company’s growth, heritage, staff size and ownership structure.
3. Indicate whether the business is a parent or subsidiary in a group of companies.
4. Provide a brief statement of the company’s background demonstrating longevity and financial stability.

SECTION1-INSTRUCTIONSANDGENERALCONDITIONS
Purpose1.1.1 TheCountyofKennebecisrequestingproposalsfromorganizationsthatarequalified
toprovideinmatehealthcareandtooperateandmanagetheinmatehealthcareprogramattheKennebecCountyJail.ThisRequestforProposals(RFP)containsthekeyquestionsandinformationrequirementsforrespondentstoaddress.Submissionsmustfullyaddressallitems.ItistheintentoftheRFPprocesstoreceiveproposalspreparedinaccordancewiththisRFPandconsistentwiththescopeofservicesrequired.
1.1.2 InnovativeideasformanagementofKennebecCountyinmatehealthcareserviceswill
bewelcomed.KCCFanticipatesreceivingallproposalsandthennegotiatingamanagementagreementwithoneBidder.ProposalswillbeevaluatedbasedonthecriteriaestablishedwithintheRFP.KCCFreservestherighttonegotiateanyandallfeesandcontractualtermsuponselectionofthepreferredContractor.Itisanticipatedthatthecontracttermwillbeforaperiodoftwo(2)years,withapossibleoptiontorenewthecontractforuptotwoadditionaltwo-yearterms.
1.1.3 TheCountyofKennebecreservestherighttorejectanyorallproposals.
Definitions:InthisRFP,thefollowingtermswillhavethemeaningssetforthbelow:
1.2.1 “ACA”meansAmericanCorrectionalAssociation.
1.2.2 “Bidder”/“Contractor”meanstheperson,firm,corporation,orotherentityrespondingtothisRFPandsubmittingaproposal.Theterms“Bidder”and“Contractor”maybeusedinterchangeablyinthisRFP.
1.2.3 “ClosingTime”meanstheclosingdate,time,andplaceassetoutonthetitlepageof
thisRFP.
1.2.4 “Contract”meanstheexecutedagreementbetweentheKennebecCountyJailandtheContractoronthetermsandconditionssetoutintheContractDocuments

1.2.8 “Facility’sDesignatedRepresentative”meansemployeesorrepresentativeswhoare
authorized inwriting todealwith theContractoronbehalf of KCCF in connectionwiththegoodsandservicesortomakedecisionsinconnectionwiththeContract.
1.2.9 “HealthCareDeliverySystem”meansmedical,mentalhealth,substanceabuse,and
dentalservices.
1.2.10 “KCCF”meansKennebecCountyCorrectionalFacility.
1.2.11 “KCCFAuthorizedRepresentative”meansemployeesorrepresentativeswhoareauthorizedtodealwiththebidder/contractoronbehalfofKCCFinconnectionwiththegoodsandservicescontemplatedbythisRFPandanyresultingcontract,ortomakedecisionsinconnectionwiththecontract.
1.2.12 “NCCHC”meansNationalCommissiononCorrectionalHealthCare.
1.2.13 “Proposal”meanstheproposalwithallaccompanyingschedules,appendicesor
addendasubmittedbytheBidderinresponsetotheRFP.
1.2.14 “ProposalSubmissionForms”meanstheProposalsummaryandrequiredinformation,completedinaccordancewithSection3-ProposalSubmissionInstructions,Format,andForms.
1.2.15 “RFP”meansthisRequestforProposalconsistingofallpapersboundwithorattached
tothisdocument.Thesemayincludebutnotbelimitedto:Addenda(orAddendumifsingular)issuedduringRFPprocess;Section1-InstructionsandGeneralConditions;Section2-StatementofRequirementsandSpecialConditions;Section3-SubmissionInstructions,Format,andForms.
1.2.16 “Requirements”or“Services”meansallspecificationsandrequirementssetoutinany

1.2.19 “ContractMonitor”meansKCCFmaydesignateaCorrectionalHealthCareMonitor
whowillbeitsrepresentativeandwhoshallrequiretheContractortomeetallcontractrequirements;monitorContractorscomplianceandanycorrectiveactiontoresolveareasofnon-complianceordeficiencies;recommendanyactionsKCCFshouldtakebasedonnon-complianceandtofacilitatedisputeresolution.

ReceiptofProposal1.4.1 ProposalswillbereceiveduptotheClosingTime.TheProposalandrequirednumber
ofcopies(inaccordancewithSection3)shallbesubmittedinasealedenvelopeorpackage,markedwiththeBidder’snameandtheRFPtitleandnumber,bythedateandtimeshownonthetitlepageofthisRFP.AnyproposalsreceivedafterthescheduledclosingtimeforthereceiptofproposalswillnotbeconsideredandwillbereturnedtotheBidder,unopened.
1.4.2 Biddersmaywithdrawand/orresubmittheirproposalatanytimepriortotheclosing
timeforreceiptofproposals.Proposalsmaybewithdrawnafterthescheduledclosingtimeforreceiptofproposal,butneworamendedproposalsmaynotbesubmittedaftertheclosingtime.
1.4.3 IfalternativeProposalsareoffered,theProposalsshallbesubmittedseparatelyinthe
sameformatastheinitialProposal.
1.4.4 AnydeviationsfromtherequirementsortheconditionsspecifiedinthisRFPmustbeclearlystatedandjustifiedwithathoroughexplanationintheBidder’sProposal.Countywillbethesolejudgeastowhatconstitutesanacceptabledeviation.IfnodeviationsareindicatedintheProposal,CountyexpectstheBiddertobeinfullcomplianceoftherequirementsandconditionsasstatedherein.
1.4.5 AProposalwhich:

OtherwisefailstoconformtothisRFP;mayberejectedinwholeorinpart.Countymaywaiveanynon-compliancewiththeRFP,specifications,oranyconditionsincludingthetimingofdeliveryofanythingrequiredbytheRFP.CountymayatitssolediscretionelecttoretainforconsiderationProposalswhicharenon-conforming,whichdonotcontainthecontentorformrequiredbytheRFPorbecausetheyhavenotcompliedwiththeprocessforsubmissionsetoutherein.
1.4.6 AllcostsforthepreparationofProposalswillbebornesolelybytheBidders.
UnacceptableProposals1.5.1 ProposalsreceivedaftertheClosingTimeorinlocationsotherthantheaddress
indicated,willnotbeacceptedandwillbereturnedunopened.Unacceptableproposalswhichareopenedinerrorwillnotbeconsidered.
1.5.2 Biddersarecautionedtocarefullyreadandfollowtheinstructionsstatedhereinas
CountyreservestherighttodisqualifyanyProposalthatfailstomeetanyoftheRequirementsofthisRFP.
1.5.3 CountyreservestherighttorejectanyorallProposalsatanytimewithoutfurther
explanationortoacceptanyproposalconsideredadvantageoustoCounty/KCCF.
Pre-QualificationCriteria1.6.1 BidderMinimumRequirements.ThissectionhighlightstheBidder’scriticalminimum
requirementstobidonthisRFP.TheCountymay,initssolediscretion,waiveoneormoreoftheserequirementsuponreceiptofawrittenstatementfrombidder,receivedwiththebid,explainingitsinabilitytomeetsuchrequirements.
TheBiddermustsubmitawrittencertificationstatementthatitisfinanciallystable.ThiscertificationmustincludeacopyoftheBidder’smostrecentannualreportwithafinancialstatement.
TheBidder’schieffinancialofficer,accountingfirm,orauditormustalsoattesttothefactsinthecertificationstatementontheappropriateletterhead.TheBiddermustprovideidenticalinformationforallproposedsubcontractorsitintendstoincludeinthisRFP.
TheBiddermust,ataminimum,havefiveyears’experienceprovidingtheservicesdetailedinthespecificationstoaninmatepatientpopulationinacorrectionalsetting.

1.6.2 MinimumEvaluationCriteria.Biddersareherebynotifiedthattheminimumevaluationcriteriaoutlinedbelowshallbeusedtodeterminetheminimumstandards

ofacceptabilityofeachproposalsubmitted.A“no”responsetoanyofthequestionsbelowmay,inCounty’ssolediscretion,automaticallydisqualifyaproposalfromfurtherconsideration.
Doesthebidderhaveaminimumfiveyears’experiencedeliveringtheservicesdetailedinthespecificationstoaninmatepatientpopulationinacorrectionalsetting?
DoestheBidderhaveexperienceprovidingmedicalservicestofemaleinmatesorpatients?HastheBidderprovidedthesemedicalservicesforacombinedinmateorpatientpopulationofatleastonehundredandsixty-sixinmatesorpatientswithinasinglefacility?
d.IstheBidderqualifiedtodiagnoseandassesspatientsforopioidusedisorderandisBidderqualifiedtodevelop,administer,andotherwiseparticipateinMedicationAssistedTreatmentprogramsforinmatesdiagnosedwithopioidusedisorder?WillallcontractorpersonnelandsubcontractorpersonnelbetrainedandincompliancewiththePrisonRapeEliminationAct(PREA)standardsandguidelines?

1.6.3 References.Biddershallsubmitalistofnofewerthanthreebusinessreferences,atleasttwoofwhicharejailsordetentionfacilitieswithaveragedailyinmatepopulationsofnofewerthanonehundredandfifty.Eachreferencemustinclude:referencename,title,companyname,address,andtelephonenumber,andadescriptionoftheinstitutionincludingtherelativesize.
Countyintendstocallaminimumofthreereferences.Thiswillincludeabasictelephoneinterview.AdditionalquestionswillbeaskedofthereferencebasedontheBidder’sRFPresponseandtheanswersofferedbythereference.ItistheBidder’sresponsibilitytoensurethatanyreferenceprovidedinitsresponsebeawarethattheymaybecontactedbyCountyregardingtheservicesprovidedbytheBidder.AllreferencereviewsaredoneinaprofessionalandtimelymannertominimizethedemandsontheBidderreferencecontacts.However,referencecontactswhichrefusetodiscusstheBidder,ortheRFPprovidedbytheBidder,willresultinanegativeratingfortheBidderforthatreference.CountyisnotresponsiblefornegotiatingaresponsefromareferenceprovidedbyaBidderandwillnotacceptsuchreferenceresponsesas“Wearenotallowedtodiscussthat,”“Wedonothavetimetodiscussthis,”etc.TheBiddermustprovideanauthorizedprimaryandsecondarycontactnameforeachreferencesubmitted.ThiswillallowCountytocompleteanyreviewsinatimelymanner.
1.6.4 Biddershallalsosubmitacurrentlyvalued,three(3)yearslossrunrelativetothe
MedicalProfessionalLiabilityClaimsfortheBidder.

1.7.2ItistheresponsibilityoftheBiddertothoroughlyexaminethesedocumentsandsatisfyitselfastothefullrequirementsofthisRFP.Inquiriesorquestionsaretobeinwrittenformonlyande-mailedtothecontactpersonsshownbelowin1.7.5.Inquiriesmaybemadeupto3:00p.m.E.T.,December2,2020.Ifrequired,anaddendumwillbeissuedtoallBidders.
1.7.3CountymayissueawrittenaddendumuptofiveworkingdayspriortotheClosing
TimeandwillmakeeveryefforttoensurethatallBiddersreceivealladdenda.However,itistheresponsibilityoftheBiddertoensureitreceivesalladdendabeforetheClosingTime.
1.7.4Countyshallnotbeboundbyoralorotherinformation,explanations,or
clarificationsnotconfirmedbywrittenaddendum.
1.7.5AllquestionsmustbesubmittedtotheattentionofLt.BryanSlaneysentviae-mailto:[email protected].
1.8ContractRequirements1.8.1 ThesuccessfulBidderwillberequiredtoenterintoacontractnolaterthanthirty(30)
workingdaysafterdeliveryoftheContracttothesuccessfulBidderbyCounty/KCCF,unlessanextensionismutuallyagreedupon.ThecontractmaycontaintermsandconditionsnotincludedinthisRFP.Bidder/Contractorisexpectedtocomplywithsuchadditionaltermsandconditionsasmaybeincludedinthecontract.
1.8.2 Thecontractperiodshallbefortwo(2)yearsfromMarch1,2021.The
officialstartdateshallbedocumentedbyaletterofagreementbetweenCounty/KCCFandtheContractorbutisanticipatedtobeMarch1,2021.AttheoptionofCounty,thecontractmayberenewedfortwoadditionaltwo(2)yearperiods.
1.8.3IfanyofthetermssetouthereinareunacceptabletotheBidder,theBiddermustidentifysuchtermsandprovidesuggestedalternativesinitsProposal.Countyisnotobligatedtoacceptorconsideranyalternatives.CountywillnotbeobligatedinanymannertoanyBidderwhatsoeveruntiltheContractisfullyexecuted.
1.8.4IfthesuccessfulBidderfailstoexecuteandreturntheContracttoCountywithinthirty

1.8.5AwardofthecontractconfersnolegalorotherrightsonBidder/ContractoruntilsuchtimeasawrittencontractissignedbyallpartiesandKennebecCountyJail.
Evaluation
1.9.1 EvaluationCriteria:CountywillevaluatetheproposalsreceivedonthebasisoftheoverallbestvaluetoCountyandanycriteriasetouthereinbasedsolelyonKCCF’sassessmentoftheProposalincludingbutnotlimitedto:
Thoroughnessandcompletenessofproposal;responsivenesstoRFPrequirements.
Demonstratedunderstandingoftheproblemsandneedspresentedbytheproject.SoundnessofBidder’sapproachtotheproblemsandneedspresentedbytheprojectincludingBidder’smethodologyforachievingspecifictasksandobjectives.References(see§1.6.3,above).

sameevaluationprocess,ataminimum.ItistheresponsibilityoftheBiddertoguaranteethatallsubcontractorswillcomplywithalltherequirements,termsandconditionssetoutintheRFPdocument.
1.9.3 Presentationand/orAdditionalInformation:Aftertheproposalopening,BiddersmayberequiredtoprovideadditionalinformationasdeemednecessarybyCounty/KCCF.Anycostsincurredinprovidingpresentationorotherinformationistheresponsibility

1.9.4 Negotiations1.9.4.1 Countyreservestheright,atitssolediscretion,toenterintonegotiationswiththe
BidderorwithanyotherBiddersconcurrently.InnoeventwillCountyberequiredtoofferanymodifiedtermstoanyBidderpriortoenteringintoaContract,andCountywillnotbeliabletoanyBidderasaresultofsuchnegotiations.
1.9.4.2 Countymay,priortoandafterContractaward,negotiatechangestothe
requirements,services,specificationsoranyconditionswithanyoneormoreoftheBidders.CountymaydosowithouthavinganydutyorobligationtoadviseanyotherBidderortoallowthemtovarytheirProposalasaresultofchangestothescopeoftherequirements,services,specificationsoranyconditions.CountyshallhavenoliabilitytoanyotherBidderasaresultofsuchnegotiationsormodifications.
Award1.10.1 AcontractresultingfromthisRFPshallbeawardedtotheresponsiveandresponsible
BidderwhoseproposalisdeterminedtobemostadvantageoustoCountytakingintoconsiderationpriceandtheevaluationfactorssetforthherein.Therightisreservedtorejectanyandallproposalsreceived.CountywillbethesolejudgeastowhetheraBidder’sproposalhasorhasnotsatisfactorilymettherequirementsofthisRFP.
1.10.2 CountyisnotunderanyobligationtoawardaContractforthisRFPandreservesthe
rightatitssolediscretiontoterminateoramendthisRFPatanytime.See§1.21,below.
TheBidderacknowledgesandagreesthatCountywillnotberesponsibleforanycosts,expenses,losses,damages(includingdamagesforlossofanticipatedprofit)orliabilitiesincurredbytheBidderasaresultoforarisingoutofsubmittingaProposalfortheproposedContract,orduetoCounty’sacceptanceornon-acceptanceoftheirProposaloranycontractawardnotmadeinaccordancewiththeexpressorimpliedtermsoftheRFP.1.11AdvertisingTheawardofaContractdoesnotpermitaBiddertoadvertiseitsrelationshipwithCounty,withoutCounty’spriorwrittenauthorization.
1.12TradeSecretConfidentialityandMaineFreedomofAccessAct
Allproposalsreceivedandrecordedatthebidopeningareconsideredpublicrecordand

availableforpublicinspection.TradesecretscontainedinaproposalmaybekeptconfidentialiftheBidder,atthetimetheproposalissubmitted,designatesthesecretandrequeststhatitbekeptconfidential.ThisrightofprivacywillbeconstruedasnarrowlyaspossibletoprotecttheinterestsoftheBidderwhileattemptingtomaximizetheavailabilityofinformationtothepublic.AllproposalsandinformationsubmittedinresponsetothisRFParesubjecttotheMaineFreedomofAccessActregardingpublicaccesstorecords.AnystatementsreservingorattemptingtoreserveanyconfidentialityorprivacyrightsinsubmittedproposalsorotherwiseinconsistentwiththeMaineFreedomofAccessActwillbevoidanddisregarded.
1.13FederalTaxes
KennebecCountyisexemptfromandwillnotpayFederalExciseTaxesorTransportationTaxes. 1.14StatesSalesTax
IfBidderisrequiredtochargestatesalestaxonBidder'ssales,Biddershallnotincludeitaspartoftheproposalprice.KCCFwillpaystatesalestaxoverandaboveproposalpriceswheninvoiced,ifsorequired.Biddersshouldindicateintheirproposalwhichcostitemsareormaybesubjecttostatesalestax.
1.15.ResponsibilityofCompliancewithLegalRequirementsTheBiddershallbeinfullcompliancewithanyandallapplicablefederal,state,local,environmentalandsafetylaws,regulations,ordinancesandstandards,theMaineDepartmentofCorrectionsStandards,allapplicablestateCodes,andACAand/orNCCHCstandards.
1.16Defense,Indemnification,andAgreementtoHoldHarmless
TheContractbetweenCountyandthesuccessfulBiddershallincludethefollowingorequivalentlanguage:

ForpurposesoftheindemnificationprovisionsofthisAgreement,thefollowingdefinitionsapply:

1.17IndemnityandWaiverContractorwaivesastoIndemnifiedPersons,andshallIndemnifyandDefendIndemnifiedPersonsfromandagainst,anyandallClaimsArising,orallegedtoArisefromInjuryconnectedwithContractor’sperformanceofitsobligationsinthisAgreement.ContractorshallpromptlynotifyKennebecCountyoftheassertion,filing,orserviceofanyclaimsagainstIndemnifiedPersons.IfKennebecCountyreceivesnoticeofclaims,KennebecCountywillprovidenoticeoftheClaimstoContractor.Uponreceiptofnotice,fromwhateversource,ofClaimsagainstIndemnifiedPersons,ContractorimmediatelyshalltakenecessaryandappropriateactiontoprotecttheIndemnifiedPersons’interestwithregardtotheClaims.Nofurthernotice,demandortendershallberequired

byCountytotriggerContractor’sobligationstodefend,indemnify,andholdharmless.Anyandallcounsel,whomContractorprovidestoDefendIndemnifiedPersonsshallaccept,andacknowledgereceiptofKennebecCounty’sguidelinesandrequirements,andthoseoftheMaineCountyCommissionersAssociationSelf-FundedRiskManagementPool,andshallconducttheDefenseofIndemnifiedPersonsstrictlyinaccordancewithsaidguidelinesandrequirements.IfKennebecCounty,initssolediscretion,determinesthatthecounselisunacceptable,KennebecCountymayreplacethecounsel.Contractor,aspartofitsIndemnityobligationunderthisAgreement,shallpaytothenewcounsel,orreimbursetoKennebecCounty,anyandallfeesandexpensesastothenewcounsel,includinganyandallexpensesorcoststochangecounsel.KennebecCountyshall,atalltimes,havetherighttodirectthedefenseof,andtoacceptorrejectanyoffertosettleanyClaimsagainstIndemnifiedPersons.EachPartytothisAgreementisliableonlyforthoseactsoromissionsofitsemployees,agents,ordelegates.NofurtherreliefshallbesoughtfromonePartytotheotherforactsoromissionsofothersnotactuallyrelatedtosuchPartiesobligationsunderthisAgreement.1.17.1 ScopeofIndemnity,ObligationtoDefend,andWaiversAllIndemnities,WaiversandobligationstoDefendinthisAgreementareandshallbe(i)independentof,andwillnotbelimitedby,eachotheroranyinsuranceobligationsinthisAgreement(whetherornotcompliedwith)ordamagesorbenefitspayableunderworkers’compensationorotherstatutes,and(ii)willsurvivetheterminationofthisAgreementuntilallclaimsagainstIndemnifiedPersonsarefullyandfinallybarredbyapplicablelaw.TheIndemnityWaiver,andobligationtodefendprovisionsinthisAgreementshallincludeallapplicablelawaffectingthevalidityandenforceabilityofthoseprovisions,andtheapplicablelawwilloperatetoamendthoseprovisionstotheminimumextentnecessarytobringtheprovisionsintoconformitywiththeapplicablelaw.Theprovisions,asmodified,shallcontinueinfullforceandeffect.ALLINDEMNITIES,WAIVERS,ANDOBLIGATIONSTODEFENDINSECTION___OFTHISAGREEMENTSHALLBEENFORCEDTOTHEINDEMNIFIEDPERSONS’BENEFIT,REGARDLESSOFTHECAUSE(S)ORALLEGEDCAUSE(S)OFTHECLAIMS,REGARDLESSOFWHETHERTHECLAIMSAREGROUNDLESS,FRAUDULENT,ORFALSE,ANDREGARDLESSOFWHETHERTHECLAIMSARECAUSEDORALLEGEDTOBECAUSEDBYANYOFTHEINDEMNIFIEDPERSONS’ACTAREOFAPASSIVENEGLIGENCE,BYTHESOLE,JOINT,CONCURRENT,ORCOMPARATIVENEGLIGENTORFAULTOFANYINDEMNIFIEDPERSONANDCONTRACTORORANYOTHERPERSON,BYANYINDEMNIFIEDPERSON’SSTRICTLIABILITY,BYANYINDEMNIFIEDPERSONS’INTENTIONALACT,ORBYANYINDEMNIFIEDPERSON’SWILLFULNESSCONDUCTORGROSSNEGLIGENCE.”Bidder/Contractor’sobligationtodefend,indemnifyandholdharmlessmaybedescribedingreaterdetailinthecontractbetweenCountyandBidder/Contractor.
1.18 Insurance

1.18.1 InsuranceRequirements
ContractorandallitssubcontractorsshallmaintaininsurancefromcompanieslicensedtowritebusinessinMaine,withanA.M.Bestratingof“A”orhigher,andacceptabletoKennebecCounty,ofthekindsandminimumamountsspecifiedbelow.TheinsurancerequirementswillbesetforthingreaterdetailintheContractbetweenCountyandthesuccessfulbidder.CountyshallbelistedasanadditionalnamedinsuredoneachoftheinsurancepoliciesprocuredbytheContractorasrequiredherein.
1.18.2 CertificatesandNoticeofCancellation
Beforecommencingworkunderthisagreement,ContractorandallitssubcontractorsshallfurnishCountywithcertificatesofallinsurancerequiredbelow.Certificatesshallindicatethetype;amount,classofoperationscovered,effectivedateandexpirationdateofallpolicies,andshallcontainthefollowingstatement:“Theinsurancecoveredbythiscertificatewillnotbecanceledormateriallyaltered,exceptafter(30)day’swrittennoticehasbeenreceivedbyKennebecCounty."CertificatesofInsuranceshallfurthershowtheCounty’sstatusasanadditionalinsured.Contractorshallauthorizeitsinsuranceagent,brokerand/orcarriersinwriting,tofurnishCountywithcompleteinformationregardingthecoveragesrequiredherein,includingpremiumsorassessmentscharged,copiesofcoverageforms,declarationspages,andanycorrespondenceorcommunicationsbetweenContractoranditsagents,brokers,and/orcarriersrelatingtosaidinsurance.ContractorshallprovidetheCertificatesofInsuranceandwrittenauthorizationstoCounty.
1.18.3 Workers’CompensationandEmployers’LiabilityInsurance
CoveringalltheContractor'sanditssubcontractors’employeesengagedintheworkunderthiscontract,providingtherequiredstatutorybenefitsunderMainestateworkers’compensationlaw,andemployers’liabilityinsuranceprovidinglimitsatleastintheamountof$100,000.00and$500,000.00applicabletoclaimsduetobodilyinjurybyaccidentordisease.
1.18.4 CommercialGeneralLiabilityIncludingcoverageforindependentcontractoroperations,contractualliabilityassumedundertheprovisionsofthiscontract,products/completedoperationsliabilityandbroadformpropertydamageliabilityinsurancecoverage.Thepolicyshallprovide

liabilitylimitsatleastintheamountof$1,000,000.00peroccurrence,and5,000,000.00aggregate,applicabletoclaimsduetobodilyinjuryand/orpropertydamage.Countyshallbenamedasadditionalinsuredunderthispolicy.
1.18.5 AutomobileLiabilityInsurance
Coveringallowned,non-ownedandhiredvehicles,providingliabilitylimitsatleastintheamountof$1,000,000peroccurrencecombinedsinglelimitsapplicabletoclaimsduetobodilyinjuryand/orpropertydamage.
1.18.6 ProfessionalLiabilityInsuranceTheContractorandallitssubcontractorswillberequiredtoprocureandmaintainProfessionalLiabilityInsuranceprovidingliabilityinsurancelimitsat$2,000,000.00peroccurrenceandatotalpolicynolessthanintheamountof$3,000,000.00TheContractorwillberequiredtomaintainthiscoverageforaperiodofatleastsix(6)yearsbeyondsubstantialcompletionofthecontract.ThiscoveragemustextendtoallofContractors’andsubcontractors’employees.
1.18.7 UmbrellaLiabilityInsurance
ProvidingcoverageasexcessabovetheunderlyingCommercialGeneralLiabilityInsurance,AutomobileLiabilityInsurance,andEmployersLiabilityInsurancepoliciesrequiredbythisContract.Thiscoverageshallprovideexcessliabilitylimitsatleastintheamountof$2,000,000peroccurrence,combinedsinglelimits,applicabletoclaimsarisingfrombodilyinjury,personalinjuryand/orpropertydamage.ThepartiesnamedasadditionalinsuredsundertheprimaryunderlyingpoliciesaretobeincludedasadditionalinsuredsundertheUmbrellaLiabilityInsurancecoverage.
Addendum
TheRFPpackageconstitutestheentiresetofRFPinstructionstotheBidder.Countyshallnotberesponsibleforanyotherinstructions,verbalorwritten,madebyanyone.AnychangestothespecificationswillbeintheformofAddendumprovidedtoallBidderswhoarelistedashavingattendedanypre-bidconference.
CompliancewithRFPRequirementsFailuretocomplywiththeseprovisionsmayresultinrejectionofproposal,inthesolediscretionoftheCounty.
1.21RighttoRejectProposalsCountyreservestherighttorejectanyorallproposalsinpartorinwhole.
1.22.1CountymayrequireContractortofurnishaperformancebondintheamountof$150,000.00

conditioneduponthefaithfulperformanceofthecontractinaccordancewiththeplans,specifications,andconditionsofthecontract.SuchbondshallbesolelyfortheprotectionofCounty.1.22.2Thisbond,ifrequiredbyCounty,shallremainineffectforatleastoneyearafterthedateonwhichthiscontract,includinganyextensionsorrenewalshereof,isfinallyterminatedandceasestobeeffective.TheperformancebondshallbeexecutedbyoneormoresuretycompanieslegallyauthorizedtodobusinessintheStateofMaineandshallbecomeeffectiveupontheexecutionofthecontract.1.22.3TheContractorshallprovidetheaboveperformancebondwhereinSuretywaivesnoticeofanyandallmodifications,omissions,additions,changesinadvancepaymentsordeferredpayments,inoraboutthecontract,andagreesthattheobligationsundertakenbythebondshallnotbeimpairedinanymannerbyreasonofanysuchmodifications,omissions,additions,changes,andadvancepaymentsordeferredpayments.1.22.4Thesuretybondmustsetforthnorequirementthatsuitbeinitiatedpriortothetimestipulatedintheapplicablestatutesoflimitations.

IntroductionandBackgroundThebidisforhealthcareandrelatedservicesthatwillbeprovidedintheKennebecCountyJailinAugusta,Maine.
IntentItistheintentofCounty/KCCFtosolicitproposalsforaHealthServicesProgramatKCCFandselectaBidderwhichbestsatisfiestherequirementsforinmatehealthcare.ItisemphasizedthattheselectionofaninmatehealthcareContractorultimatelyresideswiththeKennebecCountyBoardofCommissioners.
ScopeofWorkandService2.3.1 TheBiddershallberesponsibleforeveryfacetofthehealthcaredeliverysystemat
KCCFandshallconductsaidprograminfullcomplianceandinaccordancewithrecognizedstandards,laws,ordinances,rulesandregulationsoffederal,state,andlocalauthoritiesthatmaybeapplicable.Ataminimum,ContractormustguaranteemaintenanceofMaineDepartmentofCorrectionsMedicalStandardsandfollowNCCHCstandardsforadultfacilitiesandACA4theditionstandardsforadultlocaldetentionfacilities.TheresponsibilityforprovidinghealthcarecommenceswiththecommitmentofaninmatetothecustodyofKCCFandendswiththedischargeoftheinmate.
2.3.2 Thehealthcaredeliverysystemmustconformtostatestandardsformedicalservices.
2.3.3 ThesuccessfulBidderwillberequiredtodeliverqualityhealthcarethatcanbe
auditedagainstestablishedstandards,inacost-effectivemanner,withfullreportingandaccountabilitytoCounty/KCCF.
2.3.4 TheBidderwillimplementawrittenhealthcareplanwithclearobjectives,policies,
procedures,andanannualevaluationofcompliance.
2.3.5 TheBidderwillensurethatappropriatestaffisavailabletoprovidethehealthcareservicesasdefinedinthisproposal.Bidder’sproposalmustincludethefollowingcriteriaforstaffing:
a. MaintainanopenandcooperativerelationshipwiththeadministrationandstaffofKCCF
b. Maintaincompleteandaccuraterecordsofcareandcollectandanalyzehealthstatisticsonaregularbasis

FullstaffingforKCCF,usingonlylicensedandprofessionallytrainedpersonneltoprovidehealthcarecoverageforthefollowingoptionsshallinclude:
2.3.5.1 NursingCoverage:
ProvideRNandLPNstaffwithappropriatesupervisiontoconductintake,dailynurse’ssickcall,reviewandtriageofmedicalrequests,diabeticcall,detoxprotocolconductmedicationadministration(see2.3.5.2below),andperformotherfunctionsrequiredbythecontract.Nursingcoverageshallbetwenty-four(24)hoursperday,seven(7)daysperweek.
2.3.5.2 MedicationAdministration:
a. MedicationsaretobeadministeredtotheinmatepopulationbynursingpersonnelorforuniquerequirementsmaybeKeptonPerson(KOP)bytheinmatesdependingonthemedicationinvolvedandtheassignedhousingunit.Nocontrolledsubstances,TB,HIVorpsychoactivemedicationsshallbeKOPbutratherbeadministeredonadose-by-dosebasisbylicensednursingstaff.
b. MedicationdistributiontoinmateswillbeprovidedwithinthescopeofMainestatelawandMaineDOCJailStandards.Qualityreviewauditswillbeperformedmonthly.
c. MedicationshallbedistributedinaccordancewithanyprotocolsestablishedbytheCountyasrequiredforsecuritypurposes.
2.3.5.3 MedicalSickCall:
AqualifiedMedicalProvider(physicianoraphysician’sassistant)willbeonsitetoprovideSickCallasreasonablyrequiredbytheneedsofKCCF,butinnoeventlessthantenhoursperweek.TheContractorshallestablishasystemtorespondtoinmaterequestsformedical,dentalormentalhealthservices.Individualsshallbeseenbytheappropriatelevelofhealthcareteammemberformedicalrequestswithinmedicallyreasonabletimeframes,orasprescribedbyNCCHCandACA,whicheverissooner.Dentalcomplaintsmaybescreenedbyahygienistornursingstaffifthedentisttrainsthestaffappropriately.Apsychiatricsocialworkershallscreenallmentalhealthrequestsincludingthoserequestingtobeseenbythepsychiatrist.Thelevelofproviderseenshallbeestablishedthroughthetriageprocessbynursingstaff.AqualifiedMedicalProvider(Physician,NursePractitioneroraPhysicianAssistantwithappropriatesupervision)willbeonsitetoprovidesickcalltwodaysperweek.Actualsickcallencountersshallbeconductedbynursingorphysicianstaffformedicalcomplaints,nursingordentalstafffordentalcomplaintsandaQualifiedMentalHealthProfessionalformentalhealthissues.Nursesickcall

shallbeavailableonsitedaily,includingweekendsandholidays.Providersickcallshallbeconductednotlessthantwodaysperweek.Itisexpectedthatthephysicianorphysician’sassistantwillremainonsiteforasufficientperiodoftimetocompletetheassessmentand/ortreatmentofallinmateswhoarescheduledtobeseenonagivenday.Itisexpectedthatmedicalsickcallwillbescheduledinadvanceandthattherewillbenochangestothescheduledmedicalsickcallunlessnecessitatedbyemergencycircumstances.Anychangeinthemedicalsickcallshallbeconveyedtothejailattheearliestpossibletime.TheContractorwillberesponsiblefortracking,monitoringandreportingonthestatusofrequests.
2.3.5.4 CounselingandReleasePlanning:
ALicensedSocialWorkerwillbeavailabletoprovidescreenings,referral,servicecoordination,andprereleaseplanningforinmateswithmentalillnessand/orinmateswhoneedtolinkwithhealthcareservicesinthecommunity.
2.3.5.5 HealthServicesAdministrator(HSA):TheContractor’sHealthServicesAdministratorisafull-time,on-sitehealthcareadministratorwhoshallhavethegeneralresponsibilityforsuccessfuldeliveryofhealthcarepursuanttothecontract.TheproposalshalladdresswhattheHealthCareAdministrator’sresponsibilitieswillberegardingstaffing,recruitment,in-servicetraining,policyandproceduredevelopmentandqualityassuranceprogram.TheHealthServicesAdministratorwillmeetwithJailAdministrationbi-weeklytodiscussanyinmateissuesorproblems.TheContractorshallindicatethequalificationsof,aswellastherangeandscopeoftheresponsibilitiesandactivitiesofthisposition.TheHealthCareAdministratorshallholdabaccalaureatedegreeinahealthrelatedfieldsuchaspublichealth,publicadministration,businessadministration,hospitaladministration,nursing,etc.orpossesseducationandexperiencewhichdemonstratescompetenceandsuccessinadministeringacomplexorganization,managingnumbersofpersonnelcomparabletotheKCCFhealthservicesprogram,complyingwithaccreditationstandards,anddisplayingacommitmenttocontinuousqualityimprovement,particularlyinahealthcarerelatedenvironment.
2.3.5.6 SubstanceAbuseTreatmentServices:
TheContractor’sproposalshallprovideaplanforatreatmentprogram,includingbutnotlimitedto,adetoxificationprogramfordrugand/oralcoholaddictedinmates.TheContractorwillindicatewhichdrugandalcoholassessmentinstrument(s)willbeused.ItisstronglyrecommendedthattheseinstrumentsincludeClinicalInstrumentWithdrawalAssessment–AlcoholRevised(CIWA-AR),theBenzodiazepineWithdrawalScaleforCorrections(BWS-C),andtheClinicalOpiateWithdrawalScale(COWS).WrittenprotocolandpolicieswillbeprovidedtoKCCFatthetimeofthesubmissionoftheproposal.Additionally,theContractorwill

providein-housesubstanceabusetreatmentservicesconsistentwithgenerallyacceptedmedicalprotocols.SubstanceabusetreatmentservicesasindicatedhereinshallincludeMedicationAssistedTreatmentforopioidusedisorder.Inmatesmustbeproperlydiagnosedforopioidusedisorder,andifsuchdiagnosisisrendered,mustbeassessedfortreatmentthroughaMedicationAssistedTreatmentprogrampriortoanydecisiontowithdrawanddetoxifyaninmate.a. Pregnantinmateswhoareenteringthestagesofwithdrawalshallbepromptly
triagedandevaluatedratherthanallowingthewithdrawaltomoveforward.TheContractorshallhavesystemsinplacetoidentifythepregnant,highriskinmateuponadmission,andforclinicalfollow-upduringincarcerationincludingroutineprenatalcareandmaternalcounseling.
b. Womenwhoarereceivedatthefacilityshallbequestionedduringtheintakereceivingscreeningbyhealthcarestaffregardingpotentialpregnancyandlastdateofmenstruation.Ifthereistheslightestindicationthattheindividualmaybepregnant,sheistreatedassuchuntilsheisruledoutthroughaurinepregnancytestandphysicalexamination/healthassessment.
c. TheContractorshallensureinmateshaveaccesstoachemicaldependencytreatmentprogram.Theclinicalmanagementofchemicallydependentinmatesshallinclude,ataminimum,thefollowing:
• Astandardizeddiagnosticneedsassessmentadministeredtodeterminetheextentofuse,abuse,dependency,and/orco-dependency.
• Anindividualizedtreatmentplandevelopedandimplementedbyamulti-disciplinaryclinicalteamthatincludesmedical,mentalhealth,andsubstanceabuseprofessionals.
• Pre-releaserelapse-preventioneducation,includingriskmanagement.
• Inmateinvolvementinaftercaredischargeplans.d. TheContractorshallestablishapracticefortheearlyidentification,assessment,
interventionandtreatmentofinmateswithalcoholordrugdependency.Intakehealthcarestaffconductingmentalhealthscreeningsandevaluationsatadmissionshallalsoworktoidentifyanyindividualinneedofinterventionfordrugand/oralcoholaddiction.
2.3.5.7 Behavioral/MentalHealthServices:
TheContractorwillprovidetwoqualifiedmentalhealthcareproviderswhichwillincludequalifiedandcurrentlyLicensedClinicalSocialWorkers,LCPC’s,psychiatricnurses,andpsychiatrists.Theywillberequiredtowork40hoursaweekwith7daysofcoverageprovided.

2.3.5.8 PharmaceuticalServices:
a. Allprescriptionmedicationand,wheneverpossible,nonprescriptionmedicationsshallbeinunitdoseformatandidentifiedbyinmatename,initiationandcessationdate.
b. Allunitdosemedicationsshallbeformulatedbyapharmacist.c. DistributionofmedicationshallbebyContractorstaffincompliancewithstate
standardsandthestandardsoftheACAand/orNCCHC.d. TheContractorshallmaintain,andmonitorrecordsofallmedicationsdispensed
oradministered.Furtherrequirementsaresetforthin§2.6.8,below.
Personnel
2.4.1 EmploymentApprovalContractormustrecruit,interview,hire,trainandsuperviseallhealthcarestaff.Suchhealthcarestaffmustbeadequatetomeetallconditionsandspecificationsofthiscontract.AllmedicalstaffprovidingservicesunderthiscontractmustbelicensedtopracticeintheStateofMaine.EmploymentoftheContractor’semployees,contractpersonnel,andsubcontractpersonnelshallbesubjecttoapprovalbytheKCCFauthorizedrepresentativeoritsdesignee.UponrequestoftheCounty,theContractorshallreplaceanyemployeeorsubcontractorwhentheKCCFauthorizedrepresentativeoritsdesigneedeemsitinthebestinterestsofKCCF.Thisreplacementshallnotbedeemedterminationoranyotherformofadverseemploymentaction,andContractorwilldefend,indemnify,andholdharmlesstothefullestextentpermittedbylawtheCountyforanyresultingactionthatmaybetakenbyanypersonorentitysoreplaced.TheCountyfurtherreservestherighttorefusetoallowanyemployee,agent,subcontractor,vendor,orrepresentativeofContractoradmittancetoKCCFforpurposesofparticipationunderthisagreement.ThedecisiontodenyadmittancetoKCCFshallbemadebytheKCCFauthorizedrepresentativeoritsdesignee.ThedecisiontodenyaccesswillnotcreateanyfinancialliabilityontheCounty,toincludereimbursementforlostwages,fees,services,orothercompensationofanysort.Thisrefusalshouldnotbedeemedterminationoranyotherformofadverseemploymentaction,andContractorwilldefend,indemnifyandholdharmlesstothefullestextentpermittedbylawtheCountyforanyresultingactionthatmaybetakenbyanypersonorentityrefusedaccess.

2.4.2 BackgroundInvestigationAlloftheContractor’semployeesandsubcontractors/subcontractoremployeesmusthaveapre-approvedcriminalbackgroundcheckwhichwillbeconductedbytheKennebecCountySheriff’sOfficeoranotherlawenforcementagencydesignatedthereby.KennebecCountywilltakeallreasonable,usualandcustomarystepsnecessarytoscreenhealthcarepersonneltoensurethatsuchpersonnelwillnotconstituteorcreateasecurityrisktoKCCF,theinmatepopulation,orstaff.AllhealthcarepersonnelemployedbytheContractororitssubcontractorsmayberequiredtosubmitpriortoinitialemployment,drugscreening,andadditionaldrugscreeningduringemployment;allatthesolediscretionofKCCF.AnycostincurredinthisscreeningistheresponsibilityoftheContractor.
2.4.3 CompliancewithApplicableLaws,Regulations,andStandards
AllpersonnelprovidedbytheContractororitssubcontractorsshallcomplywithallfederal,state,andlocallaws,ordinances,rules,regulations,licensingrequirements,courtorders,andKCCFpolicies,procedures,anddirectives.Inaddition,allpersonnelprovidedbytheContractorshallalwaysconformtoapplicableACAandNCCHCstandards.KCCFshalldetermine,initssolediscretion,whichofthosestandardsareapplicable.ContractorshallnotifytheKCCFauthorizedrepresentativeofanyclaims,suitsorinvestigationsconcerningthelicensureofanyhealthcarepersonnelworkingwithintheKennebecCountyCorrectionalFacilitywithintwenty-fourhours.TheContractorwillprovidetoKennebecCountycopiesofallrequiredlicensesandcertifications,renewalsoflicensesandcertifications,andanymodificationtoorrestrictionsonanylicensesorcertifications,ofhealthcarepersonnelprovidingservicesunderthecontractbetweenCountyandtheContractor.
2.4.4 JobDescription
Contractorshallprovideeachemployeeandothermembersofitshealthcarepersonnelwithwrittenjobdescriptionsandperformanceexpectationswhichclearlydelineatetheassignedresponsibilitiesforeachhealthcareposition.ThesejobdescriptionsandperformanceexpectationsmustbeapprovedinadvancebyKennebecCounty.
a. TheContractorwillhaveonfileon-sitecopiesoflicensesandindividualplansofsupervisionforworkatKCCF,ofallmedicalstaffmembersassignedtoKCCFatthetimethestaffmemberisassigned.
b. TheContractorshallmaintainminimumstaffingrequirements.c. TheContractor’sappropriatemedicalhealthpersonnelshallattendand
participateinKCCFstaffmeetingsasindicated.d. TheContractorherebyagreeswiththeCountythatitiscontractingwiththe
CountyasanindependentcontractorandthatanypersonnelsuppliedtotheCountyhereunderarenotemployeesoftheCountyandareemployees,agentsorsubcontractorsoftheContractor.

e. InmatesshallnotbeemployedorotherwiseengagedbyeitherContractororKCCFintherenderingofanyhealthcareservices.
f. IntheeventContractor’spersonnelarerequiredtodevotetimeregardinglitigationorthreatenedlitigationbyoronbehalfofCounty,thisshallbeinadditiontotheirservicetimepursuanttothisagreement.Contractorshallnotbeentitledtoanyadditionalcompensation.
DelineationofSecurityResponsibilitiesTheprimaryresponsibilityforinmatecustodyandsecuritywithinKCCFrestswiththestaffofKCCF.TheContractorshallhaveprimaryresponsibilityinallmatterspertainingtomedical,mentalanddentaltreatmentandcareofinmates.EveryonewhoworksinKCCFhasaresponsibilityforsecurity.TheContractorshallberesponsibleforsecurityofallmaterialsandequipmentinContractor’sworkarea.Onmattersofmutualconcern,KCCFstaffshallsupport,assistandcooperatewithContractorandContractorshallsupport,assistandcooperatewithKCCFstaffwhosedecisioninnon-medicalmattersandmattersinvolvingsafetyofstaffandinmatesandsecurityforKCCFshallbefinal.Alldecisionsinvolvingtheexerciseofmedical,mentaland/ordentaljudgmentaretheresponsibilityoftheContractor.Allonsitehealthcarepersonnelwhoprovideservicesshallreceiveorientationinsecurityprocedures.
HealthCareServiceRequirements
2.6.1 GeneralHealthCareServiceRequirements
2.6.1.1 Contractorshallschedule,administer,andcoordinatemedical,mentalanddentalcarerenderedtoinmatesinsideoroutsideKCCF.ContractorshalladministeremergencymedicalcareatKCCFtoanyemployeeorvisitorwhorequiressuchcare.
2.6.1.2 TheContractorshouldestablishagreementswiththeindividualspecialistandsub-
specialistswillingtoassumetheresponsibilityforongoingcarewithaspecialtymulti-physiciangrouppracticeforspecialtyoutpatientservices.TheContractorshallestablishaworkingrelationshipand/oragreementwithatleastonelocalhospitaltocoordinatecareforhospitalizedinmates.Allagreementsforoff-siteservices,inpatientoroutpatient,aswellasallsubcontractoragreementsingeneral,shallbesubjecttotheapprovalofKCCF.TheContractorshallmaintainthesecontractsinafileonsitewithKCCFandthesefilesshallbeavailabletoKCCFuponrequest.
a. TheContractorshallensurethattheutilizationmanagement(UM)isconductedforall
inpatienthospitalizationstoensurethatthelengthofhospitalstayisnolongerthannecessary.TheDirectorofNursingorhis/herdesigneeshallbeincontactwithanyoutside

hospitalwhereaninmateishousedonadailybasisandtheMedicalDirectorshallbeawareofeachindividual’shospitalstatusaswell.Whileutilizationmanagementisanimportantaspectofanymanagedcareprogram,itisalsocriticalthatpositiverelationshipswithlocalhospitalsorclinicsbemaintainedandthatthepatientcaresiteisclinicallyappropriatetotheuniqueneedsoftheindividualpatient.DespiteeitheroutpatientorinpatientutilizationmanagementinitiativesbytheContractor,thesiteMedicalDirectorshallberesponsibleforclinicaldecisionsinvolvinghis/herpatientswithinKCCF.FinalmedicalauthorityrestswiththeMedicalDirector.IndividualsreturningtoKCCFfollowingoff-sitetreatmentshouldreturnwithdocumentationofthetreatmentreceived;intheformofadischargesummary,consultfollow-uporotherprogressnote.Itiscriticalthatanypatientreturningfromaninpatienthospitalstaybeevaluatedbyaqualifiednursingstaffpriortoreturnplacementinhousingpopulation.Alldischargesummaries,treatmentrecords,progressnotes,etc.shallbereviewedbythephysicianassoonaspossibleaftertheinmatereturnsfromanoff-siteappointmenttoassureappropriateordersandfollow-up.
b.TheCountywillberesponsibleforthecostofoutsideservices.TheContractorwillbeexpectedtoidentifyvendorsandnegotiate,adjudicateandpaysuchcostsandwillthenbereimbursedbytheCounty.TheintentofthislanguageistomakecleartotheContractorthatitisnotliableoratriskforthesecosts.
2.6.1.3 Contractorshallschedule,coordinate,andadministerallphysicianservices
renderedtoinmatesinsideoroutsideKCCF.Ataminimum,Contractorshallidentifyaqualifiedmedicalprofessionalwhoshallconductsickcall(see§2.3.5.3,above)andgenerallyprovidesuchcareasisavailableinthecommunity.Acoveringphysicianoraqualifiedmedicalprofessionalshallbeoncallseven(7)daysperweek,twenty-four(24)hoursperdayforconsultationand/oremergencysituations,toincludeon-siteresponsetoKCCFifrequestedbyKCCFstaff.
2.6.1.4 Contractorshallschedule,coordinate,andadminister,allsupportingdiagnostic
examinations,proceduresandservicesforinmates,bothinsideandoutsideKCCF.
2.6.1.5 Contractorshallprovidethenecessaryfollow-upforhealthproblemsasmaybe
identified.Thisincludesinpatientoroutpatienthospitalization,appropriatemonitoring,prescriptionofmedications,consultationswithspecialtyphysicians,etc.
2.6.1.6 TheContractorwillberequiredtodrawbloodsamplesforsexoffenderregistration
(DNA)andotherpurposesasdeterminedbypolicyorstatute,exceptforpurposesofevidencecollection.

2.6.2 ExceptionstoTreatment2.6.2.1 TheContractorshallprovidehealthcareservicestopregnantinmates,buthealth
careservicesprovidedtoaninfantfollowingbirthwillnotbetheresponsibilityoftheContractor.
2.6.2.2 ElectiveMedicalCare:TheContractorwillnotberesponsibleforprovidingelective
medicalcaretoinmates.ForpurposesoftheAgreement,“electivemedicalcare”meansmedicalcarewhich,ifnotprovided,wouldnot,intheopinionofContractor’sHSA,causetheinmate’shealthtodeteriorateorcausedefiniteharmtotheinmate’swell-being.KCCFmustbenotifiedofanyreferralofinmatesforelectivemedicalcare,priortoprovisionofsuchservices.Carerequiredforconditionswhichhavebeendiagnosedasrequiringtreatment,orforwhichthenecessityoftreatmentisobvious,arenot“electivemedicalcare.”
2.6.2.3 InmatesoutsideKCCF.a. Healthcareservicesareintendedonlyforthoseinmatesintheactualphysical
custodyofKCCF.ThisincludesinmatesinhospitalsorothertreatmentoutsideKCCF.Suchinmateswillbeincludedinthedailypopulationcount.
b. Inmatesonanysortoftemporaryrelease,including,butnotlimitedto,inmatestemporarilyreleasedforattendingfuneralsorotherfamilyemergencies,inmatesonescapestatus,inmatesonpass,paroleorsupervisedcustodywhodonotsleepinKCCFatnight,willnotbeincludedinthedailypopulationcount.TheywillnotbetheresponsibilityofContractorwithrespecttothefurnishingofhealthcareservicesexceptfortheprovisionofmedicationstoprovideforcontinuityofcarepriortoascheduledrelease.
2.6.2.4 MaineDiversionarySentencingProgram(MeDSP)Therewillbefour(4)programsperyearwhichwilladdresstheneedsofjudicialsentencingrequirementsforlowrisk-offenders,whileprovidingvaluableservicewithinthecommunity.Duringtheseprogramstherewillbetheneedforatotalof100hoursofnursingcoverage.Thechartbelowisabasicoutlineofservicesforeachprogram.Specifictimetoperformeachservicemayvarydependingontheprogram,medicalneedsoftheparticipant(s)andthenumberofparticipantsineachprogram.Estimatedhoursincludetraveltime.

2.6.2.5 CriminogenicAddictionRecoveryAcademy(CARA)
Throughouttheyear,three(3)programswillbeheld-eachconsistingofseven(7)weeksofin-facilityintensivetreatmenttoaddresssubstanceabuseaddictionandcriminogenicbehavior.Participantsfromthroughoutthestatearehousedinaspecializedhousingunitduringeachprogramandreceivemorethanforty(40)hoursofprogramingeachweek.TheContractorwillberequiredtoprovideapersontointerviewanduseassessmenttoolstoscreenindividualstodetermineiftheyareacandidatefortheCARAprogram.TheContractorwillberequiredtoprovidetreatmentforeachCARAclassincludingcriminogenicthinking,SubstanceAbusetreatment,andone-on-onementalhealthservices.Thevendormustalsocoordinatewithavendortoprovidetheseindividualsafive-and-a-halfweekIntensiveOutpatientTreatment(IOP)whiletheyareinthecommunity.
2.6.3 ReceivingScreening
TheContractorshallperformaReceivingScreeningonallnewcommitmentstoKCCFbeforetheinmateentersthegeneralpopulationofKCCF.Followingthisinitialdeterminationofneed,theinmatesmustbereferredtothementalhealthstaffwhenclinicallyappropriate.Atminimum,theReceivingScreeningshallinclude:
a. Relevantpastmedicalandmentalhealthhistory,includingcommunicable
disease,cardiacandcirculatoryproblems,respiratoryproblems,allergies,muscular/skeletalproblems
b. Documentationofcurrentillnessesandhealthproblems,includingmedicationstaken,andspecialhealthrequirement
c. Behavioralobservations,includingstateofconsciousness,mentalstatus,andwhethertheinmateisundertheinfluenceofalcoholordrugs
d. Notationofbodydeformities,traumamarkings,bruises,easeofmovement,etc.e. Conditionofskin,includingtraumamarkings,bruises,lesions,rashes,and
needlemarksorotherindicationsofdrugabuse,shouldbenotedf. Forfemales,ahistoryofgynecologicalproblemsandpregnanciesg. Astandardformwillbeusedforpurposesofrecordingtheinformationofthe
ReceivingScreeningandwillbeincludedinthehealthrecordoftheinmateh. Referraloftheinmateforspecialhousing,emergencyhealthservices,or
additionalmedicalspecialtieswillbemadeasappropriate.
2.6.4 ComprehensiveHealthAssessmentContractorshallperformacomprehensivehealthassessmentonanyinmateconfinedatKCCFwithinfourteen(14)calendardaysofthearrivaloftheinmateatKCCF.Suchassessmentshallbeperformedbyaphysicianoraphysician’sassistant.Ataminimum,thecomprehensivehealthassessmentshallinclude:a. ReviewoftheReceivingScreening;

d. Reviewofphysicalexaminationandtestresultsbyaphysicianforproblemidentificationandinitiationoftherapywhenappropriate.Referraltomentalhealthproviderwhereindicated.
2.6.5 MedicalHealthCareServices2.6.5.1 TheContractorshallberesponsibleforallmedicalhealthcareorders.The
ContractorshallprovideappropriateandqualifiedhealthcareprofessionalstovisitKCCFasneededtoprovidecomprehensivemedicalhealthcare,i.e.diagnosis,treatment,prescriptionofappropriatemedicationsand/orothertreatmentasmaybeindicated.
2.6.5.2 TheContractorshallprovideaqualifiedhealthcareprofessionaltobeoncallasrequiredtoprovideemergencytreatmentandconsultationforinmatesatKCCFona24-hourbasis.

2.6.6.2 Thementalhealthevaluationshallbeonekeycomponentofthecomprehensivejail
mentalhealthprogramestablishedbytheContractor.Theclinicalservicesprovidedshallbeconsistentwiththecommunitywhileemphasizingprevention,identification,earlyinterventionandaggressivetreatmentofmentaldisorderswiththegoalofreducingthefrequencyanddurationofepisodesofseriousmentalillness.Thegoalshallbetoprovideservicestotheinmatesuchthatshe/heisabletofunctiontothebestoftheirpotentialability.Allinmatesshallbeconsideredaseligibleformentalhealthservices,withtheprioritygiventothoseindividualsidentifiedasmostseverelyimpairedbyseriousmentaldisorder,themostdangeroustothemselvesorothers,andthosewhoexhibitaninabilitytofunctionwithinthegeneralpopulationsettingofdetentionfacilities.TheexistenceofamentaldiseaseordisorderascategorizedwithintheAmericanPsychiatricAssociation’sDiagnosticandStatisticalManual(4)ofMentalDisordersshallbethebasisforserviceconsideration.AxisIIdisorders,includingantisocialandborderlinepersonalitydisorders,shallbeevaluatedforgroupinterventionbasedonindividualneed.Thementalhealthteamshallalsoworkwithpreventativeorpromotiveprogramsincludingpsycho-educationalorcognitivebehaviorprograms,focusingontopicssuchasangermanagement,impulsecontrol,orsubstanceabuseasexamples.
2.6.6.3 TheContractorshallestablishaprocessforthesystematicmentalhealthevaluationifinmateswithinthetimeframesprescribedbyNCCHCandACA,whicheverissooner.
2.6.6.4 Anyinmatefoundtoneedurgentfollow-upisidentifiedbythementalhealth
professionalatthetimeoftheintakescreeningormentalhealthevaluationunlesspreviouslyreferredbymembersofthesecurityorhealthcarestafforotherjailstaffperson.Iftheinmateneedsimmediateintervention,thequalifiedmentalhealthprofessionalshalldeterminetheappropriatedispositionamongtheoptionsavailable;emergencyinpatientmentalhealthtransferthroughcivilcommitment(limitedavailabilityoruse),placementinamentalhealthspecialneedsarea(wheresuicidewatchortherapeuticrestraintcanoccur),orplacementinmentalhealthhousingforthemorechronicmentallyill.Writtencriteriaandprotocolshallbeimplementedforeachpotentialmentalhealthplacementoptionandareferralprocessdelineatedindetail.
2.6.6.5 Thementalhealthevaluation/appraisalshallbeinaccordancewithNCCHCandACAstandardsandminimallyconsistofastructuredpatientinterviewwithamentalhealthprofessional(mentalhealthprofessionaldefinedprimarilyasindependentlylicensedclinicalsocialworker,qualifiedmentalhealthprofessional,butmayalsoincludepsychiatryorlicenseddoctorallevelpsychologystaff,oradvancedpracticeregisteredwithapsychiatricclinicalspecialty)priortothe14thdayofinmate

2.6.6.6 Ifaninmateisidentifiedaspotentiallymentallychallenged/developmentally
disabledduringthebookingprocess,receivingscreening,mentalhealthevaluation,orotherwise,theinmateshallbereferredtoamentalhealthprofessionalforassessment.Mentalhealthstaffshallworktogetherwiththeeducationstaffinbasicscreeningforintelligenceandinobtainingpriordocumentationfromacommunitysettingregardingtheseneeds,schoolorstate’smentalretardationagency.Iftheinmatehasdifficultyinfunctioningwithinthegeneralpopulationduetohis/herlimitedintelligenceormaybevictimized,thisinmateshallbeconsideredbythementalhealthstaffforplacementintooneofthementalhealthhousingunitsthatprovideamoreshelteredandprotectedenvironment.
2.6.6.7 TheContractorshallensureinmatesreferredformentalhealthtreatmentreceivea
comprehensiveevaluationbyalicensedmentalhealthprofessional.Theevaluationshallbecompletedwithin14daysofthereferralrequestdate.
2.6.6.8 TheContractorshallberesponsibleforplacinginmateswhoareatriskforsuicide
onanappropriatewatch/observationstatuswithdocumentedcheckstobeperformedatintervalsspecifiedbytheContractor.KCCFstaffshallbepermittedtoincreasethefrequencyofsuchobservationintervals,butonlyContractororaproperlylicensedmentalhealthprovidermayreducethefrequencyofsuchobservationintervalsand/orreduceorremoveaninmatefromadesignatedwatchstatus.

2.6.6.9 TheContractorshallhaveallinmatesscreenedbyamentalhealthprofessional;
executereleasesofinformationsothatpriormedicalandmentalhealthrecordscanbereviewedtoensurecontinuityofcare.
2.6.6.10 IfanyinmateisreferredtoContractorbyKCCFstaffformentalhealthevaluation
orcare,theinmateshallbeexaminedbyamentalhealthprofessionalimmediatelyifContractor’smentalhealthstaffisonsite.Otherwise,Contractorshallcontactaqualifiedmentalhealthprovider.
2.6.6.11 Psychotropicmedications,incrushedorliquidform,willbeusedwhereclinically
appropriate.Tomaximizetheeffectivenessofpharmacotherapyandtoreducethetoxicityandsideeffectsofmedication,anintensiveprogramofdrugmonitoringshallexist.Allinmatesplacedondrugtherapyformentalillnesswillhaveappropriatefollow-upasdeterminedbyContractor.
2.6.6.12 Contractorshallprovideapsychiatristthroughon-callavailabilityatKCCFtwenty-four(24)hoursperday,seven(7)daysperweek.
2.6.6.13 Contractorshallimplementaprogramofmentalhealthcareavailabletoall
custodialinmates,whichincludesatleastthefollowing:a. Psychotropicmedicationsb. Casemanagement,individualizedtreatmentplanning,andsupportivegroup
and/orindividualcounseling,allprovidedbydulylicensedqualifiedmentalhealthprofessionals
c. Psychiatricconsultationforidentifiedinmatesd. Laboratorystudiesasindicatede. Dischargeplanningtoincludeaminimumofseven(7)daysofprescription
medications,ifindicatedf. Crisisinterventiong. Dualdiagnosistreatmenth. MedicationAssistedTreatmentforopioidusedisorder.Inthisregard,Contractorshall
collaborateandcooperatewithCountytodevelopandimplementmedicationdispensationprotocolsdesignedtoreduce,totheextentpossible,thediversionofdrugsusedaspartofMedicationAssistedTreatment.TheobligationtoprovideMedicationAssistedTreatmentshallincludeworkingcollaborativelywithothervendorswithwhomCountyhasormaycontracttoprovidesimilarservices.
2.6.6.14 TheContractormayrequiremorethanseven(7)daysofmedicationstobe
filledupontheinmate’sreleaseifitisclinicallyindicatedthateither/ora. Theprescriptionbefilledinasufficientquantitytoensurethattheinmatecan
continuethemedicationuntiltheinmateisabletobeseenbyanoutside

2.6.6.15 TheContractorshallensurethatallcontractedpersonnelreceivespecialized
traininginmentalillness,substanceabuse,suicidepreventionandintervention.
2.6.6.16 TheContractor’smanagementstaffwillattendmulti-disciplinarymeetingsandcoordinationofcaremeetings.
2.6.7 DentalServices
TheContractorshallprovideanappropriatedentalprogram.Thisshall includeoralcare,includingemergencycare,underthedirectionofalicenseddentistasneededtoall inmates.Oralscreening isdoneonall inmateswithin14daysofadmission.
2.6.7.1 Thedentalprogramshalluseaqualifiedhealthcareprofessional,trainedbya
dentist,toscreensickcalls.
2.6.7.2 TheContractorshallmaintainasystemfortheoralscreeningofinmatespriortoorinconjunctionwiththehealthassessment/physicalexamwithin14daysofreceivingthescreening.Thisoralscreeningmaybeconductedbynursingstafforotherhealthstaffwhoaretrainedbythedentisttovisuallyidentifygrossabnormalitiesoftheteethandgums,toidentifyswellingandinfectionandtorespondtoaninmate’scomplaintofacutedentalpain.Antibioticandanalgesicordersmaybeinitiatedbynursingbaseduponverbalordersortelephoneorderbythedentistorphysician.Nursingmaynotinitiatelegendmedicationsfromagenericstandingorder.Thedentistshallalsoparticipateinthedevelopmentoftheformularytoensurethatdentalisrepresentedintheareasofantibiotics,analgesic,andotheritemssuchasrinsesthatmaybeprescriptiononly.
2.6.7.3 Dentalservicesshallbefocusedonemergencytreatmentforacutepain,swelling
andinfection.Restorativecaresuchasroutinefillingswillbeavailableonalimitedbasisdependingontheavailabilityofthedentist.Prophylacticcaresuchasroutinecleaningisunavailableinthedetentionsettingduetotheshortlengthofstay.Individualswithprolongedlengthsofstaythatmaybeuptooneyear,orrarelymore,shallbegivenpriorityforrestorativecare.Anoralexaminationshallbeperformedbyadentistwithin12monthsofadmission.DentallabservicesshallbeavailablethroughtheContractor,bututilizationwillbeminimalwiththefocusonthoseindividualswithoutteethorwithaninsufficientnumberofteethinoppositiontomasticateproperly.Partialswillbegivenpriorityformasticationratherthanaestheticsandtemporarydevicesmaybeprovided,e.g.a“flipper.”

2.6.7.4 AllotherNCCHCandACAstandardswillbefollowed.
2.6.8 PharmaceuticalServices:2.6.8.1 Contractorshallprovideawrittenprotocolforprovisionsforpharmaceutical
servicestoassuretheavailabilityofprescribedmedicationswithintwenty-four(24)hoursoftheprescriptionbeingwrittenaretobeinplace.Contractorshallensurethatprescribedmedicationsareprovidedtoinmateswithintwenty-four(24)hoursoftheprescriptionbeingwritten,unlesstheprescriptionisforSTAT,inwhichcasetheprescribedmedicationwillbeprovidedtotheinmatewithinfour(4)hoursoftheprescriptionbeingwritten.
2.6.8.2 TheContractormanagementofpharmaceuticalsshallinclude:
a. Aformalizedmethodforobtainingmedicationsb. Prescriptionpractices,includingrequirementsthatmedicationsareprescribedonly
whenclinicallyindicatedasonefacetofaprogramoftherapy,andaprescribingproviderre-evaluatesaprescriptionpriortoitsrenewal
c. Medicationprocurement,receipt,distribution,storage,dispensing,administrationanddisposal
d. Securestorageandperpetualinventoryofallcontrolledsubstances,syringes,andneedles
e. Administrationandmanagementinaccordancewithstateandfederallawandsupervisionbyproperlylicensedpersonnel
f. Administrationofmedicationsbypersonsproperlytrainedandunderthesupervisionofthehealthauthorityandfacilityorprogramadministratorordesignee
g. Accountabilityforadministeringanddistributingmedicationsinatimelymannerandaccordingtophysicianorders
2.6.8.3 TheContractorshallensuretheavailabilityofpharmacyservicessufficienttomeet
theneedsoftheinmatepopulationsassignedtoKCCF.Contractorsshallestablishacontractforthesupplyofallpharmaceuticals.TheContractorshallcomplywithallapplicablestateandfederallaws,rules,regulationsandguidelinesregardingthemanagementofpharmacyoperations.
2.6.8.4 AconsultantpharmacistutilizedthroughtheContractor’spharmacycontractshall
conductinspectionsonaquarterlybasisbyaPharmacist.ThePharmacistshallgenerateaprofessionallyprepared,legiblereportfromeachinspection,andtheContractorshallthendeveloparesponsewithaplanofcorrectiveactionforanyproblematicareas.ThesecompletereportsshallthenbedeliveredbytheHealthServicesAdministratortotheContractMonitorandSheriff.TheContractorshallensuretimelyfollow-upandresolutionofalloutstandingpharmacymanagement

issuesasahighpriority.
2.6.8.5 TheContractorshallestablishastocksupplyofcommonlyusedmedications(over-the-counter,legendandcontrolledsubstances)foradministrationtoinmatespriortoreceiptoftheiractualpatient-specificprescription.Thisstockshallbemanagedandmaintainedinasafeandsecureenvironmentwithaperpetualinventorytrackingsystemtoensureaccountability.ThemedicationsshallbedeterminedbytheMedicalDirectorandDirectorofNursingwiththeapprovalofKCCF(andthestatepharmacyboardifnecessary).Volumeshallbemonitoredcloselytoensurethatnomedicationsarebeingdiverted.
2.6.8.6 Thisstocksupplyshallincludeemergencydrugsfortheemergencysuppliesas
determinedbytheMedicalDirector.Additionally,stockshallincludeitemsforpoisoncontrol,antidoteandoverdosemanagement,againdeterminedbytheMedicalDirector.Allstaffthatworkwithmedicationsshallbeorientedfullytothepharmacyproceduresandtopoisoncontrolnumbers.Thesenumbersshallbepostedconspicuouslyinmedicationareaandintheclinicandintakeareas.
2.6.8.7 Medicationsaretobeadministeredtotheinmatepopulationbynursingpersonnel.
Itisexpectedthatitemsofcriticalandemergentnature,suchasnitroglycerinoraninhaler,willbeallowedKOP.
2.6.8.8 TheContractorwillcoordinatewiththeircontractedPharmacytoestablishaformal
process,inconcertwithstateandfederallaws,regardingthedestructionordisposalofmedicationsincludingpatient-specificdispensedmedications,stockmedications,controlledsubstances(whetherstockordispensed),andpsychotropicmedications.Medicationsshallbepurgedroutinelysothattheonsitequantitydoesnotbuildup.Documentationofalldestructionanddisposalshallbecomplete,thoroughandavailableforreviewuponrequest.
2.6.8.9 TheContractorshallnotuseanysortofformularyorotherpredeterminedlistof
medications.Medicationsselectedforinmatecareshallbethosewhicharemedicallyindicatedandmostappropriateforthetreatmentofindividualinmatesasassessedonacase-by-casebasis.
2.6.8.10 TheContractorshallestablishaquarterlyPharmacyandTherapeuticsCommittee
meetingtoincludereviewoftheformularyandnon-formularyusage,providerprescribingpractices,drugutilizationreview,educationalinformation,drugcostsandotherrelevanttopicstopharmacyoperations.

2.6.9 ConsultationServicesContractorshallprovideaconsultationservicetoKCCFstaffonanyaspectofthehealthcaredeliverysystematKCCF.Thisshallincludeevaluationsandrecommendationsconcerningnewprograms,architecturalplans,staffingpatternsfornewfacilities,alternatesupplysystemsandanyothermatterrelatingtohealthcareservices(e.g.Transgender,PREA,Vivitrol)uponwhichthestaffseekstheadviceandcounseloftheContractor.
2.6.10 TrainingbyContractorforKCCFStaffandInmatesContractorwillworkwithKCCFstaffandinmatestoprovideeducationalmaterialandinstructiononavarietyofhealthcareissues.Theseshallincludebutnotbelimitedto:CPRandFirstAid;responsetoanemergencyordisastercondition;signsandsymptomsofmentalillness;alcoholanddrugwithdrawal;chronicillness;completionofintakescreenings;blood-bornepathogensanduniversalprecautions;basicmedicalsituations;suicideassessmentandprevention;transmissionofcommunicablediseases;andothercoursesasdeemedappropriatebytheContractorandtheCounty.KCCF’semployeesmaybeincludedinanyin-serviceofferingsavailabletothemedicalstaff.
2.6.11 WasteManagement
Contractorwillestablishandimplementamethodofappropriatedisposalofcontaminatedand/orregulatedmedicalwasteincludingneedles,syringes,biohazards,andothermaterialsusedinthetreatmentofinmates.TheContractorwillberesponsibleforremovalofsuchwaste.
2.6.12 Staffing
ContractorwillproposeastaffingplanthatmirrorsthecurrentcontractedstaffingplanatKCCFwhichwillbedistributedatthepre-bidtouronJune7,2019andisstronglyencouragedtosubmitanalternativeproposedstaffingplan.
PoliciesandProcedures2.7.1 PoliciesandproceduresoftheContractorrelatingtotheprovisionofhealthcare
(includingmedical,psychiatric,psychological,anddentalcare)aregenerallytobeestablishedandimplementedsolelybytheContractorincooperationwiththeCounty.TheContractorshalldevelopandimplementpolicieswhichensureappropriatecomprehensivehealthcareincompliancewithrecognizedstandards,laws,ordinances,rulesandregulationsoffederal,state,andlocalauthoritiesasmaybeapplicable.AllsuchpoliciesandproceduresmustbeinstrictcompliancewithACA,NCCHCandMaineDOCstandards.ThepoliciesandproceduresoftheContractoraresubjecttoapprovalofKCCF.TheContractorwillprovideKCCFwithatleastonecopyofthepolicyandproceduremanualwithin60daysoftheimplementationofthecontract.

2.7.2 TheContractorshallmaintaincomplete,accurate,andconfidentialmedical,mentalhealthanddentalrecordsseparatefromKCCFconfinementrecordsoftheinmateincompliancewithalllawsandregulations.Inanycriminalorcivillitigationwherethephysicalconditionofaninmateisatissue,orwheremedicalcareisatissue,ContractorshallprovidetheJailAdministratororhisdesigneewithaccesstosuchrecords,anduponrequest,providecopiesasauthorizedbylaw.ThehealthcarerecordsshallbeconsideredpropertyofCounty.a. NCCHCandACAstandardsmustbefollowedregardingmedicalrecords.KCCF
policies,DOCstandards,andHIPAAstandardsmustalsobefollowedwhenapplicable.TheContractorwillcooperatewithallinternalinvestigationsofKCCF.
2.8 QUALITYASSURANCE
2.8.1 ProposedBidder/Contractorwillprovideadetailedproposalforaqualityassuranceprogramwhichincludesthedesignandhowtheprogramwillbeimplementedandmaintained.Ataminimum,Bidder/Contractorwilladdressinitsproposalthefollowingitems:adescriptionofrolesandresponsibilitiesofstaff,areastobemonitoredandaddressedthroughthequalityassuranceprogram,theroleofthequalityassuranceprogramintrackingandmonitoringutilizationofservices,programstobeimplementedaspartofthequalityassuranceprogram,andtechniquestomonitorcompliancewiththecontract.
2.8.2 Complaints Bidder/Contractormustdetailinitsproposalaplanforhandlingandresolvingcomplaints
frominmatesandKCCFstaff.2.8.3 AnnualAudit Bidder/Contractormustsubmittoanannualindependentauditduringeachyearofthe
contract.KCCFwillcommissionanindependentauditorofitschoosingforthepurposeofauditingandmonitoringcompliancewiththecontractbysuccessfulBidder/Contractor.Bidder/Contractoranditssubcontractorshallcooperateineveryrespectwiththeindependentauditor,includingprovidinginformationanddocumentationrequestedbytheauditor.Bidder/Contractorshallbeartheexpenseoftheannualaudit,nottoexceedThreeThousandDollars($3,000.00).
2.8.4 TheContractorshallalwaysprovideastandardandqualityofhealthcarewhichshall
satisfythosestandardsdevelopedbytheACA,NCCHC,PREA,andMaineJailStandards,CountyandMunicipalDetentionFacilities,andthestandardsofhealthcaredictatedbystateandfederalcourtdecisionsregardingthequalityofcareforpersonsincarceratedinpubliccorrectionalfacilities.FailurebyContractortomaintainaccreditationorcertificationwillresultinliquidateddamagesof$50,000.00.IfContractorfailstoobtainmaintainre-accreditationbecauseoftheSheriff’sOfficebeingnon-compliant,theContractorwillnot

berequiredtopayanyliquidateddamages.
2.9KCCFRequirements
2.9.1BuildingandEquipment2.9.1.1 Countywillprovide,install,maintain,repair,replacewhennecessary,andpermit
theContractortouseallmedicalequipmentwithinKCCF.Countywillprovide,maintainandrepairthebuildingstructureinareasassignedtoContractor,includingnecessarypainting,maintenanceofwater,steam,refrigeration,sewer,electricallines,ventilation,airconditioning,lighting,heating,ductwork,floorandfloorcovering,wallsandceilings.However,theContractorshallbeartheexpenseofrepairsnecessarybecauseofthenegligenceofContractor,itsemployees,orsubcontractors.
2.9.1.2Countywillprovideallsecurity,pestcontrol,housekeeping,sanitation
(includingwalls,floors,andfixturesbutexcludingsanitationofmedicalequipmentandnon-disposablesupplies),andutilities.CountywillprovidelocaltelephoneservicebutContractor’slongdistancechargeswillbereimbursedtotheCountymonthly.
2.9.1.3AspartoftheRFPprocess,Bidderhasinspectedorhadtheopportunityto
inspectKCCFandagreesthatsuchspaceandfacilitiesaresufficientforitsagents,employeesandsubcontractorstoperformalltheobligationsrequiredunderthisAgreement.
2.9.1.4Countywillcontinuetomaintainallhealthcareequipmentnecessaryforthe
performanceofthiscontractduringthetermofthisAgreement.IfadditionalequipmentisdesiredbyContractor,itshallbetheresponsibilityofContractortonotifyKCCFofaneedforsuchequipment.TheequipmentwillbeprovidedifKCCFstaffagreeandthebudgetallows.Singleequipmentitemswithavalueofgreaterthan$250.00willrequireapprovalbytheSherifforhisdesigneepriortopurchase.
2.9.2Pre-ContractInventory

2.10 ReportsProvidedtoCountybyContractor2.10.1TheContractorshallsubmitmonthlyclinicalandfinancialreportstoKCCF
designatedrepresentativesconcerningtheoveralloperationofthehealthcareservicesprogramandonthegeneralhealthofpersonscommittedtothecustodyofKCCF.Thereportswillbeduenolaterthanthe15thofeachmonthunlessotherwisenegotiated.
2.10.2TheContractorshallregularlyconferwithKCCFstaffconcerningexistinghealth-
relatedprocedureswithintheinstitution,anyproposedchangesinproceduresandothermattersaseitherpartydeemsappropriate.
2.10.3Periodicmeetings(atleastsixtimesayear)shallbeheldbetweenContractorand
designatedKCCFrepresentativeandContractMonitor.
ContractorCompensation
2.11.1 CompensationTheCountyshallreimbursetheContractorforitscostsandexpensesassociatedwithprovidingservicesinadditiontoamanagementfee.Thebudgetforthefirst-yearcontractshallbenegotiatedwiththesuccessfulbidder.Themonthlybasecompensationwillbetheannualbudgetplusthemanagementfeedividedintotwelve(12)equalpayments.TheContractorshallinvoicetheCountyforthemonthlybaserateonthefirstdayofthemonthinadvanceofthemonthinwhichservicesaretobefurnished,e.g.,July1forservicestobefurnishedinAugust.TheCountywillremitpaymentbythefifteenthdayofthemonthinwhichservicesareprovided,e.g.,byAugust15th.IntheeventthisAgreementshouldcommenceorterminateonadateotherthanthefirstorlastdayofanycalendarmonth,compensationtoContractorwillbeproratedaccordinglyfortheshortenedmonth.TheContractorshalldevelopabudgetontheassumptionthattheaveragedailyinmatepopulationisestimatedtobe166
2.11.2 ThirdPartyReimbursement
Contractorwill,wherepossible,seekand/orcoordinatethirdpartyinsurancereimbursementforinmatemedicalservicesperformedbytheContractororotheroutsideprovider.Third-partysourceorsourcesincludebutarenotlimitedto,workers’compensationinsurance,commercialmedicalinsurance,MaineCaremedicalassistanceprogramforinpatienthospitalizations.TheContractorwillsharealldocumentationreceivedonthirdpartyclaimswiththeCounty.TheContractorwillmakeeveryeffortandestablishoperationalprocedurestoroutinelypursueallinsuranceclaimsand/orgovernmentreimbursementformedicaltreatmentprovided.

HealthCareCostControlSuccessfulBidderwillbeexpectedtoprovidehealthcareatper-inmatecostlevelstocommensuratewithprioryears,adjustedforinflationandanyenhancedservicesrequiredbytheREPandcontract.
SECTION3-PROPOSALPREPARATIONINSTRUCTIONS,FORMATANDFORM
ProposalPreparationInstructions3.1.1 Allproposalsshallbecompleteandcarefullywordedandmustconveyallthe
informationrequestedbytheCounty.IfsignificanterrorsarefoundintheBidder’sproposal,oriftheproposalfailstoconformtotheessentialrequirementsoftheRFP,theCountyandtheCountyalonewillbethejudgeastowhetherthatvarianceissignificantenoughtorejecttheproposal.
3.1.2 Proposalsshouldbepreparedsimplyandeconomically,providingastraightforward,
concisedescriptionofBidder’scapabilitiestosatisfytherequirementsoftheRFP.Emphasisshouldbeoncompletenessandclarityofcontent.WhenrequestedtoaddressspecificsectionsoftheRFP,BiddershallreferencetheresponsewiththeRFP’ssectionnumberandtheresponsesshallbeinthesamenumericalorderastheRFPsections.
3.1.3 One(1)originalandthree(3)copiesofthecompleteproposalarerequired.The
originalandeachcopyshouldbeinindividualthree(3)ringnotebooks.Eachnotebookshouldcontainalldocumentation.Additionally,adigitalcopyoftheProposalmustbesubmittedinPDFformat.
3.1.4 TheoriginalProposalandtherequiredthree(3)copiesofthecompleteproposalshall
besubmittedtotherecipientsattheaddressonthetitlepageofthisRFP,inasealedpackage.Theoutsideofthepackageshallindicatethenameofthecompanysubmittingtheproposalandbemarked,"INMATEMEDICALSERVICESPROPOSALKENNEBECCOUNTYJAIL”.
