The attached agenda is complete at the time of issuance, but other items may be added, and
some stricken without further notice.
The listing of an item on the agenda does not necessarily mean that the Commission will take
final action on it at this meeting. When the Commission does take final action, its decision---except
on routine, uncontested tariff filings---will be put in writing and served on the interested parties and
made public at the time it is entered and served.
All public documents---such as orders, opinions, hearing transcripts, comments, initial and
recommended decisions, and the like---relating to items on the agenda, may be examined in the

Section 7.8(a) of Act 50.

Commission granted, in part, and denied, in part, PECO’s Prepay Petition subject to PECO’s compliance with
certain terms and conditions as delineated therein. On 7/3/19, the Office of Consumer Advocate (OCA) filed its
Petition for Reconsideration, and the Coalition for Affordable Utility Services and Energy Efficiency in
Pennsylvania (CAUSE-PA) and Tenant Union Representative Network and Action Alliance of Senior Citizens
of Greater Philadelphia (TURN et al.) filed their Joint Petition for Reconsideration and/or Clarification
(collectively, the Petitions). The Petitions requested reconsideration and/or clarification of specified portions of
the June 2019 Order, regarding several pilot program components. On 7/11/19, the Commission granted the
Petitions pending further review of, and consideration on, the merits. PECO filed its Answer to the Petitions on
7/15/19.

meter at her service property, that the universal installation of smart meters was, inter alia, in violation of the
Public Utility Code, and presented a health risk. Complainant further alleged fire safety concerns. The matter
was assigned to ALJ Barnes. Evidentiary proceedings were conducted. An I.D. was issued 11/15/18, in which
ALJ Barnes recommended that the Complaint be dismissed. Exceptions and Replies to Exceptions were filed
by the Parties. On 5/23/19, a final Order was entered denying the Exceptions and dismissing the Complaint. On
5/27/19 Complainant (pro se) filed a Petition seeking supersedeas. On 6/6/19, PPL filed an Answer.

authority to transport property between points in Pa. On 12/14/18, The Commission’s Bureau of Investigation
and Enforcement (I&E) filed a Complaint against the Mr. Leventan, alleging failure to maintain cargo
insurance with the Commission. On 5/8/19, the Commission issued a Secretarial Letter cancelling Mr.
Leventan’s Certificate for failure to respond to the Complaint, and consequently, admitting to the allegations
therein. On 6/28/19, Mr. Leventan filed his Petition for Rescission of Staff Action.
RECOMMENDATION: That the Commission adopt the proposed Opinion and Order.

Complaint filed on 3/29/19, alleging that John F. Fluehr Jr, John F. Fluehr III, & Theodore Fluehr, T/A John F.
Fluehr & Sons (Fluehr) failed to maintain evidence of insurance on file with the Commission. Bureau of
Investigation & Enforcement (BIE)requested a civil penalty of $500 for the alleged violation. Fluehr did not
file an Answer to the Complaint. By a Secretarial Letter issued on 7/02/19 (July 2019 Secretarial Letter), the
Commission found that the allegations in the Complaint were deemed admitted, and a $500 civil penalty was
assessed against Fluehr for failure to maintain evidence of insurance on file with the Commission. On 7/16/19,
Fluehr filed a Petition for Reconsideration of Staff Action (Petition) in response to the July 2019 Secretarial
Letter.
RECOMMENDATION: That the Commission adopt the proposed Opinion and Order.

NAME AND SUBJECT: LYTLE PROPERTY LLC
On 5/6/19 a letter request (Petition) was filed seeking reconsideration of the Commission Secretarial Letter
issued on 4/24/19, that denied and dismissed Lytle Property LLC (Applicant or Petitioner) Application for a
Certificate of Public Convenience (Certificate) authorizing it to operate as a transporter of household goods in
use based on the failure to provide evidence of a minimum of two-years’ experience with a licensed household
goods carrier as required by Commission Regulations. 52 Pa. Code §3.381(c)(1)(iii)(A)(II) (-l-). The Petition
was submitted pursuant to 52 Pa. Code § 5.44 and included documents proffered by the Applicant to establish
his experience.
RECOMMENDATION: That the Commission adopt the proposed Opinion and Order

NAME AND SUBJECT: ACT 129 TOTAL RESOURCE COST (TRC) TEST
The Commission is required to analyze the benefits and costs of Energy Efficiency and Conservation (EE&C)
Plans that electric distribution companies (EDCs) are required to file pursuant to 66 Pa. C.S. § 2806.1. The
Commission uses a TRC Test to analyze the EE&C Plans. A proposed 2021 TRC Test was proposed for
stakeholder comment. This Final Order establishes the 2021 TRC Test for use if the Commission determines
that there will be a Phase IV set of EE&C Plans.
RECOMMENDATION: That the Commission adopt the proposed Order.
