PROCEDURAL ORDER

Case No. 07-1209-PSD-X

On July 2, 2007, the Berkeley County Public Service Sewer District (Utility) petitioned the Commission to authorize the physical termination of public sewer service to forty-nine (49) customers. The Utility indicated that each of the customers received water service from private wells and that each of the customers have significant delinquencies, many of which are the subjects of civil judgements. For the forty-nine (49) delinquent accounts in Case No. 07-1209-PSD-X, the Utility indicated that the total delinquency was for $57,047.01. The Utility further indicated that it had a 25% delinquency rate for its 403 customers served by private wells.

On August 15, 2007, Staff moved the Commission to join, as a party to the proceeding, the Berkeley County Health Department (Health Department) and each of the forty-nine (49) customers at issue. Staff indicated that termination of sewer service could affect public health in Berkeley County. Staff indicated that the Health Department and each of the forty-nine customers should be required to file answers with the Commission indicating their response to the petition.

Case No. 07-1210-PSD-X

On July 2, 2007, the Utility filed a petition with the Commission to authorize the physical termination of public sewer service to an additional forty-nine (49) customers. The Utility indicated that the additional customers also received water service through private wells. The Utility indicated that these forty-nine (49) customers were at least thirty (30) days delinquent and had a total delinquent amount totaling $4,344.07.

On August 6, 2007, Staff indicated that the forty-nine (49) customers should be joined as a party to the proceeding and that the Health-Department should be also joined as a party to the proceeding.

Consolidated Cases

By Commission Order issued August 15, 2007, Case Nos. 07-1209-PSD-X and 07-1210-PSD-X were consolidated. The Commission referred the matter requiring a Recommended Decision to be issued on or before January 28, 2008.

The Health Department and the individual customers involved in this proceeding should be added as parties to the proceeding. All parties should be required to file answers to the Utility's petition to terminate sewer utility service.

ORDER

IT IS, THEREFORE, ORDERED that the Berkeley County Health Department be, and hereby is, made a Respondent to this proceeding. The Health Department is required to file its response to the Utility's pleadings within fifteen (15) days of the date of this Procedural Order.

IT IS FURTHER ORDERED that the following customers of the Berkeley County Public Service Sewer District are added as parties to this proceeding. The individual to with the pub^ date of this Procedural Order. The answers should include responses to the Utility's filing, including, but not limited to, whether they owe a delinquency, why they owe a delinquency and their intention on how and if they intend to pay off the delinquency.
