Sir,With reference to the above subject, it is to inform you that in the meeting of the Purchase

Committee held on 06-09-201-6 (Proceedings of the meeting issued vide memo no. 2161 Ni dated08-09-2016J with regards to tender notice no. 4811 (AnimalJ 2076-77, the rate quoted by your firmRs. 2.00/Pc. (Rs. two onlyl per pc. (lnclusive of all taxes and other expenditure) for 5 ml. disposablesingle use syringe along with 1B G, 1.50 inch long stainless steel needle was found to be the lowest

Therefore, you are hereby directr:d to supply 15,09,700 [Fifteen lakh nine rhousanci severihundred] pcs. 5 ml. disposable single use syringe along with 18 G, 1.50 inch long stainless steel needleat the abovementioned rate for use in FMD vaccination programme under "Foot and Mouth Disease -

Control Programme (FMD-CP) - a component of centrally sponsored scheme - Livestock Health &Disease Control (LH & DCJ" in the month ofApril 2017 in accordance with the technical specificationand terms & conditions of the said tender notice.

The terms and conditions ofthis supolv order are as follows:-

1- Your firm has to execute an Agreement on Indian non judicial stamp paper of appropriatedenomination (as stipulated by the State Govt. of Bihar) on or before 27 -03-2017. The saidAgreement will be signed both by the Authorized Representative of your firm and therepresentative of Animal and Fisheries Resources Department, Bihar IDr. Jageshwar Lal, fointDirector, Headquarter, Animal Husbandry Directorate, BiharJ. The EMD submitted by yourfirm will be forfeited ifyour firm fails to execute the agreement within stipulated time unlesstime extension is granted by the Director, Animal Husbandry, Bihar.

2- Your firm has to furnish the performance security deposit @ 50/o of contract value in the formof DD/BG of any nationalized bank in favour of Director, Animal Husbandry, Bihar, Patna &payable at Patna only. The EMD deposited along with tender documents may be adjustedtowards Security Deposit on receipt of request from your firm. [f your firm fails to furnish thefull security deposit after the issue of Letter of Award of Worh your bid security [EMD)shall be forfeited unless time extension is granted by Director, Animal Husbandry, Bihar.

3- The Security Deposit will be released & returned back to your firm after successful supply ofthe ordered goods. The Security Deposit shall be forfeited in case your firm fails to supply thegoods in stipulated time or fails to comply with any of the terms & conditions of thetender/supply order/agreement or the syringe-needles supplied is found to be of sub-

standard quality by the competent authority.

4- The syringe-needles are to be supplied to the concerned District Animal Husbandry Officel rrr

respective district head quarter on or before 15-04-2017 as per the attached distribution

chart. The syringe-needles will be received by the concerned District Animal Husbandry

Officer or his/her authorized representative after proper satisfaction.

5- The syringe-needles are to be supplied as per the terms and conditions mentioned in the

tender notice no. 4811 [AnimalJ 2016-77 .

6- No supply will be accepted after the due date as mentioned above unless and until specific

order is issued by the Director, Animal Husbandry, Bihar. In the event ofthe supply not made

in lull quantity on or before the due date, your firm will be levied penalty and your firm may

be blacklisted according to standard norms and procedures. The amount of penalty will be

decided by the Director, Animal Husbandry, Bihar and will be obligatory for your firm'

7- The technical specifications of the supplied syringe-needles must be in accordance with that

nlentioned in the tender notice otherwise the supply will not be accepted. Any deviation in

the technical specifications of the supplied syringe-needles will not be acceptable, and it will

be the sole responsibility ofyour firm.

B- All the packaging should be primary (NewJ. Your firm shall provide such packaging of the

goods as is required to prevent their damage or deterioration during transit to their final

destination. The packaging should be sufficient to withstand without limitation rough

handling during transit & open storage.

9, All the supplies should invariably display the particulars on its label and/or carton in a

distinct manner.

10- The manufacturing date, batch no. etc. must be displayed on the body of the packages- The

supplied syringe-needles should be labelled as "For Government of Bihar use-Not for sale".

11- The expiry date should be meniioneii ol thc body ofihe syriuge-rleedles pacli anC bodi/ ofthe

bills. The expiry period should be a minimum of 24 [twenty four) months from the date of

actual supply.

12- Copy of quality test report of each batch of the syringe-needles being supplied must be

submirted to the concerned District Animal Husbandry Officers and the Director, Institute of

Animal Health & Production, Bihar, Patna alongwith supply'

13- The Animal and Fisheries Resources Department, Bihar will not be held responsible for any

loss/damage during the transportation of the syringes-needles. 0nly the syringe-needles

properly supplied will be accepted-

14- Delivery challan in triplicate must be submitted along with the consignment. one copy ofthe

challan should be submitted to the office ofthe concerned District Animal Husbandry Officer,

the second copy should be submitted to the office ofthe Difector, lnstitute of Animal Health &

Production, Bihar, Patna and the third copy should be retained by the supplier'

15- The supplier firm has to obtain a certificate on the vouchers of the supplied syringe-needles

as mentioned below :-

16- If any adverse report on any batch of syringe-needles is received and proved, your firm will

have to refund the entire cost of syringe-needles supplied along with forfeiture of

EMD/SD. In case where payment is not recommended to be released the same shall be

forfeited by the Government. Besides the above, action will be initiated for black listine the

supplier firm on the report of the competent authority.

17- Payment against all the accepted supplies will be made by the Director, Institute of AnimalHealth & Production, Bihar, Patna. No payment will be made before completion of supply.Payment will be made at the rate approved by the Purchase Committee in its' meeting dated06-09-2016 and no other charges will be admissible. The VAT will be deducted at sources asper the prevailing norms issued by the Government of Bihar in this regard.

1B- If at any time during the period of contract, the price of any tendered item is reduced orbrought down by any law or act of the Central or State Government or your firm, yourfirm shall be morally and statutorily bound to inform the Director, Animal Husbandry,Bihar immediately about such reduction in the contract price. The Director, AnimalHusbandry, Bihar is empowered to unilaterally effect such reduction as is necessary in rate,in case your firm fails to notifu or fails to agree for such reduction of rate.

19- Your firm has to inform the Directorate of Animal Husbandry, Bihar and Institute of AnimalHealth & Production, Bihar regarding the supply schedule ofthe syringe-needles along with its'batch no. and other necessary information.

20- If any dispute arises at any time between the two parties in respect of or concerning anJ,thingherein contained or arising out ofthe agreement or as to the rights, liabilities or duties ofyourfirm and the Director, Animal Husbandry, Bihar, Patna, the same shall be referred to the soleArbitrator, the Principal Secretary/Secretary, Department of Animal & Fisheries Resources,Bihar, Patna. The decision of the Arbitrator shall be final and binding on all the parties. Thevenue of the arbitration shall be at Patna, (Bihar, IndiaJ. The arbitrator will give reasoneddecision.

21- Any Iegal dispute is subject to competent court ofJudicature at Patna only.It is, therefore requested to supply syringe-needles ccn;plying all the terms and

conditions as mentioned in the tender notice and this suppiy order within stipulated time.
