*380 POLICE AND EMERGENCY SERVICES—POLICE HOUSING—Mr Donnelly asked the Minister for Police and Emergency Services, Minister for the Hunter, and Vice-President of the Executive Council—

(1) How many houses are rented to police by the New South Wales Government?(2) How many houses rented to police by the New South Wales Government have the following issues:

(a) Leaking air conditioners?(b) Rising damp?(c) Cracked walls, either internal or external?(d) Rusty roofs?

Answer— The NSW Police Force has advised me:(1) There are approximately 650 residences available for rent within the NSW Police Force property

portfolio. (2) Maintenance calls for police housing are not recorded in sufficient detail to enable a response to the

Member's questions about particular maintenance issues.

*381 ROADS AND PORTS—SNOWY MOUNTAINS HIGHWAY ROADWORKS—Mr Veitch asked the Minister for Roads and Ports—

(1)(a) Have road works recently been completed on the Snowy Mountains Highway near Reka Road

at a location locally referred to as "The Gap"?(b) If so, what was the date of completion?

(2)(a) Have the recently completed road works deteriorated to a condition that will now require further

work?(b) If so,

(i) What is the scope of the repair work?

(ii) What is the estimated cost of the repair work?(iii) When will the work commence?

Answer— I am advised:(1)

(a) Yes.(b) Road works were completed on 31 May 2011, but this did not include the installation of the

safety barrier on the westbound lane. Due to geotechnical issues, the type of safety barrier was changed to wire ropes and this was installed on 8 August 2011. Line marking was completed in mid August 2011.

(2)(a) Yes.(b)

(i) Heavy patching work needs to be carried out on a section of the westbound lane. The condition of the road is being monitored regularly to ensure the safety of road users.

(ii) The estimated cost is $20,000.(iii) Work is expected to start in late September 2011.

*382 ROADS AND PORTS—KAPOOKA BRIDGE—Mr Veitch asked the Minister for Roads and Ports—

(1) Has there been a structural report or safety audit conducted on the Kapooka Road Bridge over the main south rail line?

(2) Has there been design work completed for construction of a new road bridge at Kapooka over the main south rail line?

(3)(a) Is there funding allocated for the construction of a new road bridge at Kapooka over the main

south rail line?(b) If so,

(i) How much funding has been allocated by the New South Wales Government?(ii) How much funding has been allocated by the Federal Government?

Answer— I am advised:(1) The Kapooka Bridge structure is owned by the Country Rail Infrastructure Authority and managed

under contract by Transfield. The RTA understands a risk analysis report was produced in June 2008. This followed a risk assessment of the bridge by Australian Rail Track Corporation in November 2006. A road safety audit and bridge inspection report was included as appendices in this document.

(2) Designs are well advanced for a concept alignment and new bridge.(3)

(a) Yes, there is funding allocated to the Kapooka Road Bridge for planning and detailed design work in 2011-12.

(b)(i) The NSW Government has allocated $750,000.(ii) The federal government has not allocated any funding towards the project.

*385 ROADS AND PORTS—DRIVING TEST BANS—Mr Veitch asked the Minister for Roads and Ports—

(1) How many Learner Permit Holders were banned from undertaking a driving test in each of the last two years?

(2) What are the reasons for a Learner Permit Holder being banned from undertaking a driving test?(3) What are the appeal mechanisms if a Learner Permit Holder is banned from undertaking a driving

test?

(4) How many people availed themselves of these appeal mechanisms?

Answer— I am advised:(1) Applicants may be banned from undertaking a driving test for six weeks for inappropriate

behaviour. In the period from July 2009 to June 2011, 170 people were banned.(2) Behaviour that could lead to a ban from undertaking a driving test for six weeks includes:

• Fraudulent logbook entries.• Bribing a testing officer.• Threatening, abusive, aggressive or violent behaviour.

(3) Applicants can make representations to the RTA to review the decision.(4) There is no record of anyone lodging an appeal.

*387 HUNTER, POLICE AND EMERGENCY SERVICES—LOCATION OF GOVERNMENT STAFF—Mr Primrose asked the Minister for Police and Emergency Services, Minister for the Hunter, and Vice-President of the Executive Council—

*388 ENVIRONMENT—MEASUREMENT OF GAS LEAKS IN NEW SOUTH WALES—Mr Buckingham asked the Minister for Finance and Services, and Minister for the Illawarra representing the Minister for the Environment, and Minister for Heritage—

(1)(a) Does the Government hold information on the amount of fugitive emissions that leak from gas

infrastructure, including production, transportation and distribution in New South Wales?(b) If so, what is the information on the amount of extent of fugitive gas leakage?

(2) Are such fugitive leaks accounted for in New South Wales greenhouse emissions calculations?(3) How are fugitive emissions from gas infrastructure measured and calculated?(4) What regulations are in place to limit fugitive emissions from gas new and existing infrastructure in

New South Wales?(5) What programs are in place to reduce fugitive emissions in New South Wales?

Answer— I am advised as follows:(1) Yes.(2) Facilities that emit more than 25,000 tonnes of greenhouse gases in a financial year are required to

report their emissions under the Commonwealth's National Greenhouse and Energy Reporting Act 2007 (the NGER Act). The NGER Act sets out the provisions for making information reported under the Act publicly available and specifies that disaggregated data is not published. The latest data available from the National Greenhouse Gas Inventory shows that total fugitive greenhouse gas emissions from the Oil and Natural Gas sector in NSW are approximately 0.7 million tonnes carbon dioxide equivalent per annum, which is 0.4 per cent of all NSW emissions in the inventory.

(3) Yes.(4) The NGER Act and Regulations and determinations describe the methods available to entities to

estimate fugitive emissions from gas infrastructure.(5) The Protection of the Environment Operations Act 1997, the Environmental Planning and

Assessment Act 1979, and the Petroleum (Onshore) Act 1991 provide a range of mechanisms to manage emissions from gas infrastructure. While there are no environmental regulations specifically established to limit fugitive greenhouse gas emissions from gas infrastructure, these Acts work to maximise the protection of the environment and minimise air, water and land pollution from gas infrastructure. Additionally the Occupational Health and Safety Act 2000 and the Coal Mine Health and Safety Act 2002 operate to minimise gas releases that could represent a safety hazard by requiring the provision of safe workplace environments. The Environmental Planning and Assessment Act 1979 is administered by the Minister for Planning and Infrastructure, the Petroleum (Onshore) Act 1991 and the Coal Mine Health and Safety Act 2002 are administered by the Minister for Resources and Energy. The Occupational Health and Safety Act 2000 is administered by both the Minister for Finance and Services, and the Minister for Resources and Energy, in so far as it relates to a coal workplace or a mining workplace within the meaning of the Act. Occupational health and safety requirements and commercial imperatives both strongly drive control of fugitive greenhouse emissions. This is because leaks at high concentration would represent a safety hazard and a loss of products that could otherwise be sold.

*394 HEALTH—KAVA IN NEW SOUTH WALES—Mr Secord asked the Minister for Police and Emergency Services, Minister for the Hunter, and Vice-President of the Executive Council representing the Minister for Health, and Minister for Medical Research—

(1) Since 26 March 2011, has the Department of Aboriginal Affairs expressed any concerns about the misuse of kava in New South Wales?

(2) Does the Government have any plans to restrict the use of kava in New South Wales?(3) What is the Department of Aboriginal Affairs' response to calls for kava to replace alcohol in some

communities?

Answer— This matter should be referred to the Minister for Aboriginal Affairs (Dominello) for a response.

*396 AGEING—ACCOMODATION BONDS AND PRUDENTIAL ISSUES—Mr Secord asked the Minister for Finance and Services, and Minister for the Illawarra representing the Minister for Ageing, and Minister for Disability Services—

(1) Since 26 March 2011, has the Minister for Ageing received any complaints or representations from families about aged care providers in New South Wales and accommodation bonds?

(2) Since 26 March 2011, have any matters been referred to the NSW Police Force or the Minister for Fair Trading?

Answer— (1) The Minister has not received any complaints in relation to aged care accommodation bonds.(2) N⁄A

*400 POLICE AND EMERGENCY SERVICES—ASBESTOS AND POLICE STATIONS OR PROPERTIES—Mr Secord asked the Minister for Police and Emergency Services, Minister for the Hunter, and Vice-President of the Executive Council—

(1) What is the NSW Police Force doing about the 460 police stations and properties found to have asbestos or lead paint, as reported this month?

(2) How many police officers and other staff would come into daily contact with these contaminated properties?

(3)(a) What is the timetable to remove asbestos from the 460 police stations and properties affected?(b) Please provide a full list of the 460 police stations and properties affected.

Answer— The NSW Police Force has advised me that work is underway to remediate sites that may be subject of low level risk from hazardous materials. A significant amount of work has already been undertaken at a number of sites. A health and safety plan has also been developed to outline the support and follow-up available for any affected officer or staff member.

*403 ROADS AND PORTS—KIRKWOOD ROAD—Mr Secord asked the Minister for Roads and Ports—

(1) Does the Government intend to extend Kirkwood Road in South Tweed to alleviate traffic flow on Minjungbal Drive?

(2) How many cars travel on Kirkwood Road each day?(3) How many cars travel on Minjungbal Drive every day?(4)

(a) Since 26 March, 2011, how many accidents have occurred on Kirkwood Road?(b) How many of these accidents have been determined to have been related to congestion?

(5)(a) Since 26 March, 2011, how many accidents have occurred on Minjungbal Drive?(b) How many of these accidents have been determined to be related to congestion?

(6)(a) How much is the extension currently estimated to cost?(b) How much was the extension first estimated to cost?(c) How much of this cost will be provided by the New South Wales Government?

Answer— I am advised:(1) Kirkwood Road is being extended to provide an additional route for access between the Pacific

Highway and Minjungbal Drive at South Tweed Heads.(2) The review of environmental factors prepared by Tweed Shire Council showed that an average of

2,115 vehicles used Kirkwood Road west of Minjungbal Drive each day in 2009. When connected to

the Pacific Highway and Fraser Drive, an average of around 7,000 vehicles per day are expected to use Kirkwood Road in 2015.

(3) RTA traffic counts have shown that an average of 27,667 vehicles per day used Minjungbal Drive, south of Kirkwood Road, in 2007.

(4)(a) The RTA has only a limited record of crashes since March 2011, as most police reports have not

yet been processed. There are currently no crashes on the RTA's records on Kirkwood Road for this time period.

(b) This information is not available at this time. Refer to answer 4(a) above.

was $10.9 million.(c) The RTA has advised Tweed Shire Council that it would contribute in the order of $4 to $5

million, subject to final agreement.

*407 POLICE AND EMERGENCY SERVICES—CLUB 209—Mr Secord asked the Minister for Police and Emergency Services, Minister for the Hunter, and Vice-President of the Executive Council—

(1) Since 26 March 2011, how many times have police been called to the Club 209 in Campbelltown? (2) How many assaults have occurred near or at the Club 209 Campbelltown since 26 March 2011? (3) How many robberies have occurred near or at the Club 209 Campbelltown since 26 March 2011?

Answer— The NSW Police Force has advised me:(1) The Campbelltown Local Area Command has no record of police being called to Club 209 between

26 March 2011 and 16 August 2011.(2) Records indicate that 15 assaults occurred between 26 March 2011 and 14 August 2011 within 50

metres of Club 209.(3) There are no records of robberies on the club premises since 26 March 2011. Two robberies are

recorded as having occurred at nearby commercial premises since that date.

*409 AGEING—AGED CARE ACCOMMODATION BONDS—Mr Secord asked the Minister for Finance and Services, and Minister for the Illawarra representing the Minister for Ageing, and Minister for Disability Services—

(1)(a) Since 26 March 2011, has the Minister for Ageing held any meetings with the Aged Care

Association of Australia; Aged and Community Services NSW, Aged and Community Services Australia, the Aged Care Industry Council or other aged care associations and industry bodies for New South Wales or Australia?

(b) If so, when and where did those meetings occur?

(2)(a) Has the Minister received any representations from those or other organisations supporting

accommodation bonds in high care?(b) If so, what was the Government's response to accommodation bonds in high care?

(3) What is the Government's position on accommodation bonds in high care?

Answer— The Australian Government is responsible for policy and operational matters with respect to residential aged care services and accommodation bonds.

*413 FAIR TRADING—ONLINE PURCHASE COMPLAINTS—Mr Secord asked the Minister for Finance and Services, and Minister for the Illawarra representing the Minister for Fair Trading—

(1) Since 26 March 2011, how many complaints has the Department of Fair Trading received from the community about internet and online purchases?

(2) What are the top five complaints by category?(3) What is the Government doing to protect consumers from internet rip-offs?(4) Since 26 March 2011, how many farmers have been duped into purchasing cheap online fertiliser

from China?(5) According to the Department of Fair Trading, what are the top ten online rip-off schemes?(6) Since 26 March 2011, has the Department of Fair Trading referred any matters involving online

purchases to the Australian Competition and Consumer Commission?(7) Does the Government support a call for mandatory Australian product standards to be enforced on

overseas online retailers by Australian regulators?

Answer— I am advised that:(1) Since 26 March 2011, NSW Fair Trading has received a total of 1,511 complaints where

the method of sale was online.(2)

• The most common types of online purchases complained about are: (i) general household consumer goods;(ii) travel and tourism services;(iii) discount voucher and coupons;(iv) computer and communication goods and equipment; and(v) entertainment.(i) general household consumer goods;(ii) travel and tourism services;(iii) discount voucher and coupons;(iv) computer and communication goods and equipment; and(v) entertainment.

(3) Consumers who purchase online are protected under the Australian Consumer Law (ACL) which applies to all internet and online selling which has a connection with Australia. Fair Trading can enforce the ACL, along with other Commonwealth, State and Territory regulators. Using the ACL, the NSW Government alerts consumers about 'internet rip-offs', takes complaints from consumers about unsatisfactory purchases of goods and services, investigates alleged breaches of the ACL, undertakes compliance operations targeting known and emerging markets, shares information with other ACL regulators to

assist national education and compliance activities, and takes enforcement action against traders suspected of having breached the ACL. In addition, Fair Trading raises consumer awareness through community education and community and regional access programs as well as proactive media campaigns.

(4) Since 26 March 2011 there have been no complaints recorded in relation to the online purchase of fertiliser.

(5) Fair Trading is aware of a variety of internet based scams that target consumers and businesses. Examples include offers of money and refunds under the guises of Nigerian funds transfers; Australian Tax Office refunds; banks purporting to seek updated personal details; computer virus technicians who seek personal information; and ebay sellers who seek up front deposits or international funds transfers for products that do not exist. Internet scams change frequently, and often originate from overseas.

(6) Along with all Australian State and Territory consumer agencies, Fair Trading routinely refers consumers who believe that they have been the subject of an online scam to the Australian Competition and Consumer Commission's Scamwatch website.

(7) Under the Australian Consumer Law, the Commonwealth Government is responsible for imposing mandatory product safety and information standards on consumer products and services. The enforcement and administration of the ACL is shared between the Australian Competition and Consumer Commission and State and Territory regulators including Fair Trading. There has been increased monitoring and surveillance activity with regard to imported goods and enforcement action taken for breaches of product safety laws by online traders.

(1) Since 26 March 2011, what steps has the Government taken to remove or control the fruit bat colony at Burdekin Park in the Singleton Shire Council area?

(2) Is the Government aware of concerns expressed by the Singleton Mayor about the possible spread of the Hendra virus due to the fruit bat colony?

Answer— I am advised as follows:(1) Since 26 March 2011, I have met with the Member for the Upper Hunter, the Hon George Souris MP,

and the Mayor of Singleton Council, Cr Sue Moore, to inspect Burdekin Park and to discuss options for the management of the flying-fox colony on site. As an outcome of this meeting, I have written to my Australian Government counterpart, the Minister for Sustainability, Environment, Water, Population and Communities, the Hon Tony Burke MP, asking that he consider the development of a coordinated and comprehensive approach to the management of the Grey-headed Flying-fox, including the issue of dual approvals for actions taken under NSW and Commonwealth legislation. The Office of Environment and Heritage has not received any request for approval to relocate or otherwise control the flying-foxes at Burdekin Park.

(2) The NSW Government is aware of the Singleton community's concerns regarding the Hendra virus. There have been no reported cases of Hendra virus in the Hunter Valley this year. However, on 27 July 2011, the NSW Premier committed $3 million towards research to understand how the infection is maintained in flying-fox populations and the factors that are associated with the spread of the virus to horses.

(3) In June this year, the Hunter-Central Rivers Catchment Management Authority approved an investment of $26,090 during 2011⁄2012 for Singleton Council to complete riverbank vegetation rehabilitation works at Clysedale Reserve near Singleton. This project will include the planting of native species which are known to provide suitable habitat and food sources for the Grey-headed Flying-fox. The establishment of suitable alternative habitat may be of benefit to any future proposal to relocate the Burdekin Park colony.

Answer— The NSW Police Force has advised me:(1) None of the relevant Commands consulted are aware of such concerns having been expressed since

26 March 2011.(2) A search of the COPS system has revealed no records of such incidents in the nominated timeframe.(3) Kava is a restricted substance in NSW and is listed as a Schedule 4 drug under the Poisons and

Therapeutic Goods Act.(4) On 10 August 2011, the NSW Police Force seized 200 kgs of kava in Bourke.(5) Kava is a mood altering substance which, when used outside of its cultural context, has the potential

for misuse. Police would prefer to see the demand for alcohol reduced rather than simply replacing it with another substance which may have negative health and social ramifications.

Mowbray Park Farm attended Sydney Product Showcase at Destination NSW on 19 July 2011. Destination NSW undertook a site inspection of Mowbray Park Farm, the Trainworks and The Rail and Transport Museum on 28th July 2011. Destination NSW also received application for funding of the Picton Harvest Festival under the Events Stream of the Sydney Tourism Precinct Funding Program and funding is being considered to market this event.

Answer— I am advised as follows:(1) Koalas occur in the eastern third of NSW, with the main populations being on the North Coast.

Koalas occur to a limited extent in the north west, particularly Gunnedah and the Liverpool Plains, and there is a scattering along some western rivers. Koalas do not live in colonies and are solitary animals except for mother and young.

(2) Some koala conservation activities are conducted as part of the Office of Environment and Heritage's (OEH) management of national parks and therefore are not separately costed. It is estimated that at least $200,000 of OEH staff time has been allocated to koala conservation activities since 26 March 2011. In addition, since 26 March 2011, $40,000 has been provided to Byron Shire Council to assist in koala surveys and habitat mapping.

(3) and (4) These questions should be referred to the Minister for Primary Industries.(5) and (6) OEH has not received any reports of koalas being killed by dogs or harmed by hunters within any NSW national parks or reserves since 26 March 2011.(7) to (13) OEH has not undertaken any counts of koalas in the listed locations since 26 March 2011.

This commitment has been further demonstrated through significant frontline workforce investments announced in the NSW State Budget. (3) 'Stockton Hospital' is not a NSW Health facility. It is now known as the Stockton Centre and is managed by the Department of Ageing, Disabilities and Home Care.

(a) and (b) RailCorp estimates the Easy Access upgrade of Sydenham Station will be completed in December 2013.Lifts are estimated to begin operation in December 2013.

(2)(a) and (b) The completion date for this project has not changed since the beginning of

construction.

(3)(a) to (d) The kiosk closed on 31 March 2011. At the time of the closure, the lessee was paying

RailCorp an annual rent of $49,612. The loss of revenue to date is approximately $20,700.As the lease was terminated in accordance with Clause 22.1 (c) of the lease agreement related to the "Holding Over" provisions, and the termination request was stated in a letter to the tenant dated 13 July 2010, no compensation was due to be paid to the lessee.No amount was paid to the lessee.
