Historical background

Prior to 2001, rail infrastructure in Poland had been a part of the General Directorate of Polish State Railways PKP. The then PKP consisted of:

• Railway Infrastructure Directorate, • Rail Freight Transport Directorate, • Passenger Transport Directorate, • Rail Electro-Energetic Directorate, • Rail Tele-Informatics Directorate, • Centre for Training and Perfecting Staff Skills, • Sales and Acquisition Directorate, • Commuter Railways Directorate, • Rapid Urban Railways in Tricity, • Railway Security Guard.

The Act on Commercialisation, Restructuring and Privatisation of Polish State Railways was approved by the parliament in September 2000. It was aimed at helping PKP to fight the crisis and allowing it to operate as a profitable entity. Based on the reform, a PKP Group has been created. It consisted of the railway infrastructure manager PKP Polskie Linie Kolejowe S.A. (PKP PLK S.A.), rail passenger and freight carriers: PKP Cargo S.A., PKP Intercity S.A., PKP Linia Hutnicza Szerokotorowa Sp. z o.o., PKP Szybka Kolej Miejska w Trójmieście Sp. z o.o., and also various other companies, such as PKP Informatyka Sp. z o.o. - responsible for IT, PKP Energetyka S.A. - energy supplier, etc. Railway Security Guard was incorporated into PKP PLK S.A.

The length of railway lines operated by the rail infrastructure manager amounted to 24,100 km in 1990 and has been decreasing since then. (In 2015, PKP PLK S.A. was responsible for maintenance of 18,510 km of railway lines.) By 2001 the rail infrastructure in Poland had been short of investments and the quality of railway lines operated by PKP could be described as unsatisfactory. The state railways did not have any opportunity to invest in modern technical solutions, which might be one of the reasons why the maximum train speed on the Polish rail infrastructure increased only insignificantly in the 1990’s.

The year of 2003 was another important year for the railway sector in Poland as the new railway transport act liberalized the market and allowed the entities outside the PKP Group to render freight transport services and manage infrastructure. In 2003, Poland received pre-access funds from the European Union, which were used to cover the most urgent rail infrastructure investments.

The following year a discussion began on construction of high-speed railways (HSR) in Poland. A team responsible for creation of the project’s feasibility study got down to work in 2009, however after two years the HSR was withdrawn from the list of governmental priorities. The industry hopes that the concept will be re-introduced after the 2014-2020 EU budget.

In 2006, the European Commission allocated approximately EUR 35 billion to the development of Polish infrastructure for years 2007-2013 (EUR 5.6 billion for railway transport). The amount was copious, but so were the needs of Poland’s railways. At that time only 25% of railway lines managed by PKP PLK S.A. were in good technical condition and only 5% of those were adjusted to the speed of 160 kph. Even though, many experts of the railway market claimed that more funds should have been allocated in railways, it turned out that putting the whole amount to use was far more difficult than it had been expected. The lack of experience with implementing large rail infrastructure investments was the greatest impediment. In 2011, an idea was pushed forward at some point to move EUR 1.2 billion from rail to road projects. The following year, one of the largest Polish contractors, PNI – owned by the Budimex Group - was declared bankrupt.

Delays in the implementation of investments in the 2007-2013 budget forced PKP PLK S.A. to move some of projects to the next EU financial perspective (so-called “phased projects”). Moreover, some amounts, previously allocated for rail infrastructure, were finally spent on rolling stock. After these experiences, Polish rail industry notified the infrastructure manager and government officials that the projects under the 2014-2020 EU budget should start earlier. Unfortunately, it didn’t happen.

The priority for the coming years for PKP Polskie Linie Kolejowe S.A. as the main rail infrastructure manager will

be: reducing travel times between major Polish cities, improving rail lines important for the freight operators, and improving automatic control of traffic management.

There is also an ongoing debate on the model of the Polish rail infrastructure manager. The European Union expects that there will be no financial or administrative connections between the infrastructure manager and the rail operators using the infrastructure. At the same time in Poland the PKP PLK S.A. company is in the same capital group with such operators as PKP Cargo S.A., PKP Intercity S.A., PKP LHS Sp. z o.o., and PKP SKM Sp. z o.o. Before long the matter will have to be sufficiently dealt with.

Size of Polish railway infrastructure in the international context

Poland with over 19 thousand km of lines has one of the largest railway infrastructure networks in the European Union. Only German and French rail networks are considerably larger with respectively 37 and 29 thousand km. It shows the potential of the Polish railway market and the scope of works, that need to be done in order to renew the network.

Considering the density of the railway network compared with size of the country’s area Poland is in the EU average. With its size of 312,700 km2 the network density is bigger than in Lithuania (65,300 km2) or Romania (238,400 km2), but still smaller than in Germany (357,400 km2) or in Hungary (93,000 km2).

Characteristics and historyPKP Polskie Linie Kolejowe S.A. has been in business since 1 October 2001. The shareholders of the company include the State Treasury - which owns 86.5% of all the shares, and PKP S.A. which holds the remaining 13.5% of its shares. As at 31 December 2015, its share capital was PLN 16,684.8 million.

Rail infrastructure managers

Since 2016, all owners of railway sidings in Poland can be called railway infrastructure managers; this means that there are several hundred entities of this type. Given this substantial number of companies and their relatively small impact on the market, only the main railway infrastructure managers will be listed in this report, i.e. 14 entities.

In 2015, the length of all the railway lines operated in Poland (both standard and broad gauge) was 19,330.11 km , which was 36.22 km more than in 2014. The difference was caused by adding to the list the infrastructure managed by CARGOTOR was as well as Pomorska Kolej Metropolitalna.

The broad gauge lines in Poland are run by three managers: PKP LHS (owner of 394.65 km of broad gauge lines), PKP PLK (142.1 km) and Euroterminal Sławków (4.14 km).

In 2015, PKP PLK managed 20,850.7 km of railway lines, of which 2,340.8 km was not used. The company is the only manager of the rail infrastructure of state importance (66.5% of all railway lines operated by PKP PLK in 2015).

The number of electrified railway lines in Poland amounts to 11,866 km (61.4% of the total). 99.5% of the electrified lines are managed by the PKP Group (PKP PLK and PKP SKM).

PKP PLK is the railway infrastructure administrator rendering infrastructure access to licensed railway operators. The company’s objects are: • paid access to railway infrastructure for passenger and freight operators on equal terms, for a fee according to the rates

published in the price list approved by the Office of Rail Transport;• service activities supporting the availability, attractiveness and reliability of railway transport, in particular railway transport

and railway line management, keeping railway lines in a condition ensuring efficient and safe transport of people and freight, regularity and safety of railway traffic, fire service activities, and environment and property protection on railway premises;

• engineering activities and related technical consultancy, including surveying and cartographic activities;• work related to the construction of railway tracks, underground railways, roads and motorways, construction of

telecommunications and electricity lines ;• activities related to the general defence obligation, in particular preparation of railway facilities and lines for defence activities.

Characteristics and history• PKP Linia Hutnicza Szerokotorowa Sp. z o.o. was established

under the Act of 8 September 2000 on the Commercialisation, Restructuring and Privatisation of the State–owned Polskie Koleje Państwowe and started its operations on 1 July 2001.

• The company manages the infrastructure and carries out transport based on LHS line No. 65, which is Poland’s longest broad–gauge railway line (1,520 mm track gauge) intended for freight transport. It joins the Polish - Ukrainian Hrubieszów/Izow rail border crossing with Sławków in Silesia and is nearly 400 km long.

• The LHS line has a determined regional range (it runs through five Provinces: Lubelskie, Podkarpackie, Świętokrzyskie, Małopolskie and Śląskie). It is not connected to the conventional railway system (with 1,435 mm track gauge). Its primary aim is to meet the transport demands of South–western Poland, including the provision of resources for the Upper Silesian Industrial Region.

Rail lines

By the end of 2015 PKP Polskie Linie Kolejowe S.A. managed 18,510 km of rail lines, which gives 36,218 km of tracks. This includes 27,115 km of route tracks and mainline tracks at rail stations and 9,103 km of station tracks.

PKP PLK S.A. also managed 39,988 turnouts (17,894 turnouts in route tracks and mainline tracks and 22,094 turnouts in station tracks), as well as 14,889 level crossings including 12,744 on active rail lines.

The infrastructure owned by PKP PLK S.A. includes 25,303 engineering structures, including 6,400 bridges and viaducts, 6,160 buildings and 13,129 structures.

54.5% of all the railway tracks managed by PKP PLK S.A. can be graded as good in technical conditions. A good grade means that the infrastructure can be used with assumed parameters and only maintenance works are necessary. A satisfactory grade means that repairs are required, while an unsatisfactory one indicates railway tracks for comprehensive replacement.

Characteristics and historyThe company is active in the area of road, rail, energy, airport, and industry infrastructure, listed on the Warsaw Stock Exchange since 1995. The company’s strategic investor is the Spanish company Ferrovial.

Among Budimex’s largest railway contracts are: construction works on LCS Iława (value: PLN 698 million), design and construction of Pomorska Kolej Metropolitalna (value: PLN 547 million, more in section Rail Infrastructure Managers), PKP Wrocław Główny station (value: PLN 275 million). The National Railway Programme until 2023 lists all the investments that should take place on the railway infrastructure managed by PKP Polskie Linie Kolejowe S.A. in the coming years. The programme is a continuation of the previous document named “Long-term Programme of Railway Investments until 2015”.

The funds, which PKP PLK S.A. will receive in the EU budget for 2014-2020, amount to EUR 9.7 billion (over PLN 40 billion). To utilise these funds resources will have to be provided from the state budget and the Railway Fund along with own resources of PKP PLK S.A.

The whole railway programme for the years 2014-2023, including EU funding, amounts to PLN 67 billion. The PKP PLK’s railway infrastructure investments will be financed in the following way:

The National Railway Programme presents the list of planned investments based on the above-mentioned sources of financing. It assumes the that all the EU funds will be put to use. The listed investments are to be realised by 2023.

The main goal of the National Railway Programme is to improve the importance of railways in the integrated transport system by creating a modern and coherent rail network. The other goals include: improving railway transport’s effectiveness, improving safety of rail transport and improving quality of both passenger and freight transport.

The total value of allocated funds to all projects realised in Poland as the Operational Programme Infrastructure and Environment amounts to PLN 111.5 billion. This includes not only transport but also environmental, energy or health projects.
