POLICY AND CONDITIONS OF SALE

PRICE: Prices quoted are one each (not pairs) unless otherwise specified. The prices quoted are based on current all inclusive manufacturing costs and are subject to variation without notice if such costs increase or decrease either before or after acceptance of any order. All orders are accepted for delivery on the condition that goods will be invoiced at the prices ruling at the date of despatch.

DELIVERY:

Unless otherwise specified, all goods are quoted free in store within the appropriate capital city, metropolitan area, or to the appropriate mail or transport terminal. All goods despatched per rail or customer's carrier are at customer's risk. Freight costs beyond rail or transport terminal are customers responsibility; no responsibility will be accepted for breakage, damage, or loss in transit.

DELAYS IN DELIVERY:

Any times quoted for delivery are to be treated as estimates only and involving no contractual obligation. SURCHARGE:

A surcharge of $50.00 will apply to all orders of invoice value less than $200.00. This surcharge will not apply to back-orders if the original value exceeded the limit.

CLAIMS:

All goods shall be deemed to have been inspected by the buyer as being in accordance with the contract unless notification to the contrary is received in writing within ten (10) days from the date of invoice. Goods accepted as faulty will be credited at invoice value or replaced. No responsibility will be accepted for the cost of any repairs or alterations executed without previous consent in writing. No claim will be recognised unless invoice and / or delivery number is quoted.

LIABILITY:

Unless specifically agreed in writing, under no circumstances do we undertake liability for any loss or damage to persons or property of any nature or due to any cause or any amount as a result, direct or indirect of any defect, deficiency, or discrepancy in goods or materials sold or supplied by us in this respect, all conditions, warranties, and liabilities, expressed or implied, statutory or otherwise not contained herein, are expressly negatived. It is the buyer's sole responsibility to ensure that the goods are sufficient and suitable for this purpose.

SERVICE:

Ramtaps provide fully trained service staff under contract to ensure satisfaction. Where it eventuates that the problem to be serviced by our staff arises from an initial faulty installation or products of another brand, a service charge of $ 60.00 per hour, including traveling time and plus materials used, will apply.

CANCELLATION:

Orders cannot be cancelled except with our consent and upon terms that will indemnify us against all losses. Goods or materials ordered in error or in excess cannot be returned to us for credit or exchange except by special arrangements. Orders or balances of orders may be cancelled at our option in the event of any failure by the buyer to adhere to the terms of the contract.

RETURNS:

Standard goods will not be accepted for return unless with prior agreement. Original invoice numbers must be quoted. Goods and packaging must be in original condition, free from damage and blemishes. All goods returned will be subject to a handling charge of 15% of the value of the goods. Goods classified as "M.T.O." (Made to order) and not listed in our standard price list are not returnable.

ALTERATIONS:

Ramtaps reserves the right to alter product or price without notice.

PRODUCT RANGES: Ramtaps reserves the right to delete, add or modify products offered without notice.

POSSESSION:

All goods supplied shall remain Ramtap’s property until paid in full but the buyer accepts the risk of loss or damage to the goods on delivery. Until paid in full for the goods the buyer shall hold them as bailee for Ramtaps and shall store them apart from any other goods, clearly identified as Ram tap’s property. If the buyer defaults in paying for the goods the buyer authorises Ramtaps and it's authorised agents to enter on any property on which Ramtaps reasonably believes the goods to be located for the purpose of re-taking possession of those goods. This clause is for the sole benefit of RAMTAPS PTY LTD which may at any time waive same and deem the goods sold and delivered to the buyer. Ramtaps may sue and recover from the buyer the price of the goods sold and delivered as a liquidated debt.

PAYMENT:

The price of the goods as specified in the invoice shall be paid within 30 days of the last day of the month on which the goods are despatched to the buyer ("credit period"). Not withstanding any of the other provisions of the conditions of sale Ramtaps shall be entitled to sue the buyer for the price of the goods specified in this invoice as a liquidated debt at any time after delivery of the goods and expiry of the credit period.

JURISDICTION:

Any legal proceeding arising under these conditions of sale shall at RAMTAPS option be instituted, heard and determined in a court of competent jurisdiction at Brisbane in the State of Queensland and such court shall possess territorial jurisdiction to hear and determine such proceedings.

Technical Information W.E.L.S - Water Efficiency Labelling and Standard s New Federal legislation covering the water efficiency of tapware will become mandatory in Australia from July 2006 . These regulations are contained in Australian Standard AS/NZS 6400 : 2005. Where applicable, Ramtaps will phase in compliance with this standard over the months leading up to July 2006. Tapware designed for use with Baths is not rated under the WELS scheme. Un-labelled WELS products sold to retailers before July 2006 may be sold to customers up until the 31st of December 2006. Products nominated as having flow-control installed are suitable for water-saving installations. This pricelist will be re-issued when WELS compliance is complete.

General Installation Ramtaps recommends a licensed plumber carry out all tapware installations. All installations should comply with the relevant requirements of AS/NZS 3500.

• Maximum Hydrostatic Pressure – 800 kpa (Unless specified otherwise in accompanying instructions) This pressure may be exceeded only under test conditions as per AS/NZS 3500. Where hydrostatic pressure exceeds the maximum stated above, pressure-limiting valves should be installed.

• Recommended Minimum Hydrostatic Pressure – 100 kpa • Maximum Water Temperature - 80۫۫ C

Note: For optimum performance, hot and cold inlet water pressure should be equal. Note: Installation of aerators containing flow regulators Upon re-installation of the aerator after flushing, the aerator casing should be tightened to prevent removal by hand. Note: Ceramic Cartridges - Warranty claims will not be honoured where the ceramic cartridge has malfunctioned due to the presence in the water supply of;

• copper tube pieces • sand, dirt or stones • thread tape • other objects not normally present in potable water supplies.

Note: Flow restrictors may be fitted in place of the standard aerator, however this tap should not be attached via the end of the spout to any additional water control device eg. Dishwasher, water filter with shut-off device. Ramtaps mixers are suitable for all installations as long as the above specifications are met. Where appropriate, Ramtaps recommends the installation of Stop Cocks and In-line Filters in conjunction with Single Lever Mixer products.
