4. The interested Bidders should submit their tender applications on above locations along with duly signed copies of all relevant certificates, documents etc., in support of their technical & price bids. A copy of Physical Documents duly filled in shall also be deposited in the tender box provided in the Sub Regional Office, ESI Corporation,7-8-9 Palika Bazar, Mahesh Nagar ambala Cantt. by 1.00 PM on dt. 19.04.2018. The technical bids will be opened on dt. 19.04.2018 at 3:00 PM.

5. The Tenders are to be submitted as per two bid system i.e. Technical bid and Financial Bid. (A) Technical bid should contain the papers to fulfill all the eligibility criteria, relevent certificates etc., undertaking as per instructions.

(B) Financial bid should contain the rates quoted for the rented Building to be provided as per the instructions given in this tender document. Both the bids should be submitted in two separate sealed envelopes super scribed as Technical Bid

for Leased Accommodation and Financial Bid for Leased Accommodation. An Earnest Money Deposit of Rs. 20000/- (Rupees Twenty Thousand only) in the form of Demand Draft or

Bankers Cheque only of any nationalized Bank should be placed at the top of the technical bid.

Both the envelopes containing technical bid and financial bid should be put in a third sealed

envelope and should be super scribed Tender for Leased Accommodation. Sealed tenders should be addressed to the Deputy Director (I/C) ESIC Sub-Regional Office, Ambala.

. Interested bidders may submit the tender online https://esictenders.eproc.in in a two bid system in the prescribed proforma. Tenders to be submitted online only through e-procurement portal. All the supported documents shall also be required to be submitted physically along with EMD of Rs. 20000/- (Rupees Twenty Thousand only) in the form of Demand Draft/Banker Cheque drawn in favour of ESIC Fund A/c No.1, payable at Ambala Cantt.

The completely filled Tender should be dropped in the Tender Box kept at the Facilitation Centre,

ESIC Sub-Regional Office, Ambala (Haryana) by the stipulated date and time. Tender submitted or

received after the closing date and time will not be considered. In case the tender is so bulky/

voluminous that it cannot be dropped into the tender-box, the same may be handed-over to

Deputy/Assistant Director (General), ESIC, Sub-Regional Office, Ambala by the stipulated date and

time recorded on it.

The interested Bidders should submit their tender applications for above locations along with duly signed copies of all relevant certificates, documents etc., in support of their technical & price bids. 6 Any Corrigendum to this tender will be notified through the aforesaid website(s) only. Selection of the successful bidder will be at the sole discretion of the Deputy Director (I/c), Sub Regional Office, Ambala Cantt. who reserves the right to accept or reject any or all the proposals without assigning any reasons.

ESSENTIAL ELIGIBILITY CONDITIONS

1. The first part should be the Technical Bid which should contain technical parameters

like design parameters, type of construction, availability of parking space, air-conditioning etc.

the second part should be the Financial Bid which should indicate the rent proposed to be

charged and other financial terms and conditions. The Technical Bid will be opened in the first

instance and the Financial Bid shall be opened only in respect of those parties which are short

listed on the basis of their technical bids and their building being found suitable by ESIC.

2. Technical Bid should inter-alia contain details as follows: -

1. The location and address of the accommodation 2. The exact carpet area in Sq.ft of the accommodation 3. Detailed approved plan of the accommodation 4. Clearance / No Objection Certificate from all the relevant Central / State / Municipal

Authorities and fire department for use as Office Premises conforming to all Municipal Laws/Bye Laws; and

5. Facilities and amenities available in the building 6. Ownership details alongwith registration particulars with documentary evidence.

3. The Technical Bid should be accompanied by an Earnest Money Deposit (EMD) of Rs.20,000/- (Rupees Twenty Thousand Only) in the form of Demand Draft/Banker Cheque drawn in favour of ESIC Fund A/c No.1, payable at Ambala Cantt. In the absence of EMD, the tender will be rejected summarily. The earnest money shall be refunded to unsuccessful

Tenderers after finalization of the contract. No interest is payable on the EMD.

Other Terms and Conditions

4. Facilities required to be provided by the Owner / Lessor

(a) Carpet area 1000 sq.ft (Approx) in and around areas preferably in approved

commercial areas. The accommodations situated on the main road &/or on the

Ground Floor and ready for possession, with adequate parking space shall be

preferred. In case of building at 2nd floor or above provision of lift is essential.

Offers are invited directly from the owners(s) of the premises.

(b) Preference will be given to premises owned by Public Sector/ Government

Departments.

(c) The designs and construction of the premises offered shall be in conformity with

the established standards. The premises offered shall be safe, strong, stable

sound and durable with remaining useful of life, more than 20 years. The building

should be fit for office use. Physically Qualified / Physically Suitable / Site

Readiness / Fit for Possession means the building / premises should be ready

to shift in all aspects within 60-90 days of issue of award letter, as per the

specification/requirement.

(d) Easy accessibility The approach road of building should be at least 24 ft. wide.

(e) The office space should have electrical fixtures/fittings such as switches, power

points, fans, tube lights/ LED lights etc.

(f) Space be equipped with Modular furniture and work stations, marble / vitrified

tile/vinyl flooring, channel for data and electrical cables, etc.

(g) There should be a provision for 24 hrs electricity supply with power backup.

(h) The area proposed to be given on rent should be on the same floor. Preference

would be given to exclusive building with a secured boundary wall.

(i) The owner shall undertake to carry out annual repairs and maintenance such as

white washing, painting, minor repairs, plantation, pest and rodent control every

year. No additional charges for the same shall be payable.

(j) The building should have adequate numbers of exclusive toilet facilities

separately for ladies and gents.

(k) The building should be made ready to use within 60-90 days of issue of award

letter, as per the specification/requirement with Air Conditioners, electricity, water,

lifts, sewerages and fire fighting equipments. The electrical power load

sanctioned / available should also be indicated.

(l) All mandatory clearances required should be available for the building. Bids

without these documents shall be summarily rejected.

(n) The Finance bid will be opened only of the technically and physically qualified

(Building being found suitable by ESIC) bidders and successful bidder shall

provide the building in ready to use condition within 60-90 days of issue of award

letter, as per the specification/requirement of ESIC.

5. After screening of the technical bids, short-listed landlords will be informed by the ESI

Corporation for arranging site-inspection of the offered premises. After site inspection, the

financial bids of the offers considered to be suitable for the ESI Corporation shall alone be

opened. The date, time and venue of opening of price bid will be intimated separately. The

owner/landlords(s) shall enclose approvals from the local authorities as applicable; especially

Completion/Occupation certificate before opening the price bid.

6. The monthly rent quoted should include all applicable taxes including service tax/GST,

other charges/taxes and assessment as applicable at the time of closing of the bid and nothing

beyond the quoted rent mentioned in the bid shall be paid by the ESI Corporation.

7. The owner / landlord will have to construct store room / record room, toilets etc as per

ESI Corporations requirement / ESI Corporations plan and make modifications / alternations in

the premises if so desired by the ESI Corporation at his own cost before handing over

possession to the ESI Corporation. Permission / approval required if any regarding

additions/alterations/modifications of the premises shall be obtained by the owner / landlord at

his own cost from the concerned local authorities.

8. The premises offered shall have proper flooring acceptable to the ESI Corporation viz.

marble/vitrified tile/vinyl flooring of the premises (except toilet and pantry) and ceramic tiles

flooring and dado in toilet & pantry. Superior finish would be acceptable. If proper flooring is not

already done, the owner/landlord will have to lay vitrified tile flooring of the premises as per ESI

Corporations choice at his own cost. Finishing works of the premises such as melamine

polishing or enamel painting of doors, windows, grills, ventilators, gates and plastic emulsion

painting of walls and ceiling etc. will also have to be done by the owner/landlord as per ESI

Corporations instructions at his own cost before handing over possession to the ESI

Corporation.

9. The owner/landlord shall provide separate electric meter, separate water meter and

sewerage connections at his own cost before handing over possession to the ESI Corporation.

These connections should be in the name of the owner/landlord and the consumption charges

of Water supply, Electricity and Sewerage shall be paid by the ESI Corporation on production of

documentary proof/separate metering basis.

10. The owner / landlord shall provide 8 KW (single/three phase) electric power load as per requirement of the ESI Corporation at his own cost before handing over possession to the ESI Corporation. If additional electric power load is required by the ESI Corporation later on

(i.e. after taking over possession with electric load of required capacity) within the lease period,

the same shall be arranged by the owner / landlord at ESI Corporations cost.

11. The owner/landlord will provide sufficient frontage and adequate parking space in front

and rear of the building, without any additional rental overheads, for the use of the ESI

Corporations visitors and employees/employers etc.

12. All statutory clearances and permissions required for construction / modification /

additions / alterations and leasing of the premises to the ESI Corporation shall be obtained by

the owner / landlord at his own cost.

13. Lease agreement will be executed after legal verification of all document related to the

Property to the entire satisfaction of ESI Corporation. The registration charges, stamp duty for

Registration of lease deed will be borne by the owner / landlord only.

14. ESI Corporation shall have the right to carry out necessary alternation / modification or

make such structural or other changes to / in the premises as may be required by it for the

purpose of its work. Provided always that the ESI Corporation shall not make any permanent

structural alterations incapable of being reversed or which would render incapable the

restoration of the premises to its original positions without the consent in writing of the

owner/landlord(s) but such consent shall not be unreasonably withheld in the case of such

alternation as shall be necessary or required by ESI Corporation for the purpose of better

amenities and carrying on its working effectively. But the ESI Corporation shall have all rights to

make temporary alteration in the demised premises and to erect temporary partitions, cabins,

counters etc. as are necessary to carry on its working effectively.

15. ESI Corporation shall have the right to install satellite dishes/communication towers and

other communication equipments etc. as deemed necessary by the ESI Corporation for

facilitating electronic communication as also installation of power generating / amplifying

devices including but not restricted to Power transformers, Power Generators etc. as well as

placing of sign boards, ESI Corporations hoardings / publicity materials, ACs etc on the

terrace/premises/faade for its working activities and the owner/landlord will have no objection

of any kind whatsoever and shall not claim any compensation or additional rent but however if

any damage is resulted upon the demised premises due to such activities, the ESI Corporation

would be liable to repair the damage so caused, normal wear and tear is however excepted.

16. Since ESI Corporation is the lessee/tenant and has no insurable interest in the building,

the owner/landlord hereby has to ensure the premises/assets rented/hired against risks like

burglary, fire or natural calamity at his (owners) own cost and the ESI Corporation will not be

responsible for and liable to make good any losses that may be sustained in any future date in

respect of such premises / assets.

17. Painting of the premises including front and back verandahs, kitchen, bath rooms, toilets,

boundary wall, the entire exterior faade and painting or polishing of all doors, windows,

ventilators, grills etc. as may be desired by the ESI Corporation will be carried out by the

owner/landlord every year within the lease period. In case the owner/landlord fails to do so, the

ESI Corporation shall have the right to arrange it at the cost of the owner/landlord and deduct

the amount from the rent payable or that may become payable, or otherwise recover from the

owner/landlord.

18. Whenever necessary, the owner/landlord(s) will carry out necessary repairs of the

building from time to time within reasonable period and in the event of failure or neglect or

default on the part of the owner/landlord to carry out or effect necessary repairs, it will be

optional for the ESI Corporation either to terminate the lease or to retain the occupation of the

demised premises or part thereof or to make or effect or carry out the necessary repairs of the

premises, after a due notice to the owner/landlord and to deduct, the expenses so incurred

along with interest etc. from the rent which is payable or become payable or otherwise recover

from the owner/landlord. No rent will be payable for the period during which the ESI Corporation

is deprived of the use of the demised premises or part thereof due to the failure, neglect or

default of the owner/landlord to carry out the necessary repairs of the demised premises.

19. The possession of the premises will be given to the ESI Corporation after completion of

entire work as per ESI Corporations requirement and specifications. After taking possession, if

it is found that any item or work remains unattended or not according to ESI Corporations

specifications, the owner/landlord has to complete the same within a reasonable time from the

date of possession of premises and in case of default, the ESI Corporation will have right to get

the above unfinished jobs/works/items completed by availing the services of other agencies and

recover the amount so incurred from the rent payable to the owner/landlord.

20. During the currency of the lease agreement the owner/landlord shall not transfer,

mortgage, sell or otherwise create any interest in the premises leased to the ESI Corporation

with any party affecting ESI Corporations right of occupation and any of the terms of the lease

without written consent of the ESI Corporation.

21. That if the landlord is desirous of making any addition to the building it shall be ensured

by him that no access/approach by whatever means is made from the demised portion or by

encroaching upon the open spaces which have been herein above made available for the

exclusive use of the ESI Corporation.

22. That in the event of the owner/landlord deciding to sell the demised premises during the

period of tenancy or at the expiration of the same he shall in the first instance offer them to the

ESI Corporation at the lowest price which he is prepared to accept for them and the ESI

Corporation shall within one calendar month from the date of receipt of such offer, accept or

reject such offer.

23. If the demised premises at any time during the said terms or any extension thereof are

damaged, destroyed or rendered uninhabitable by fire, earthquake, cyclone, tempest, flood,

violence of any army of people or mob or other irresistible force or act of God, and be not

caused by the acts or neglect or fault of the ESI Corporation, then in such case it shall be

optional with the ESI Corporation to determine the lease period or to retain occupation of the

demised premises, if the ESI Corporation so desires without any diminution of rent hereby

reserved.

24. The ESI Corporation shall have the right to terminate the lease prematurely or surrender

whole or any part of the premises to the owner / landlord by giving two months notice in writing.

The owner / landlord shall not claim / be entitled for any compensation / rent for the unexpired

period of lease. The right to terminate the lease before the expiry of lease period will vest only

with the ESI Corporation. However, ESIC shall exercise this right only in case it is ready to

move into its own building or that of any of its sister organizations or associated State

Government entity or other private rented premises if the premises is rendered inhabitable or

closes down its business in the area for whatsoever reasons

25. That the ESI Corporation will at the expiration of the said term or any extension thereof

(if agreed to mutually) peacefully and quietly yield and deliver the possession of the demised

premises to the owner/landlord in the nearly same condition as at the time of commencement of

initial lease, fair wear & tear, and damage by fire, earthquake, cyclone, tempest, flood, violence

of any army of people or mob or other irresistible force or act of God excepted. But this

condition shall not be construed to render the ESIC liable to do any repairs of any kind to the

demised premises.

26. The ESI Corporation shall be at liberty to remove at any time or at the time of vacating

the premises, all furniture, fixtures and fittings belonging to ESIC installed in the premises and

the owner/landlord shall not claim any compensation.

27. After receipt of ESI Corporations confirmation for leasing of the premises which is

considered to be most suitable / reasonable and its acceptance by the owner / landlord(s)

he/they is/are liable to pay the ESI Corporation the full expenditure incurred by the ESI

Corporation from releasing of advertisement to finalizing the premises and other incidental

expenditure incurred in the process, if he/they denies/deny the possession of the premises to

ESIC on any grounds whatsoever.

28. The Financial Bid will inter-alia include:

i. The rent demanded per sq. ft (carpet area ) and also total rent for the entire space

offered. The rent offered should be inclusive of property tax or any / all the other

tax required to be paid by the property owners as on the date of closing of bid. The

Rent demanded should be inclusive of property tax or any other tax required to be

paid by the property owner, whether levied by the Central Government or State

Government or any Local Body, in the nature of having a material bearing on the

liability to foot incremental enhancement in effective rent, not excluding reverse

charge mechanism, etc.

ii. The period of lease will be for 5 years duration extendable up to a further period 03

years. Rent enhancement after expiry of agreement period is subject to mutual

consent of land lord & ESIC.

29. The rent of the accommodation offered shall be inclusive of all taxes/charges excluding

water/electricity charges. The monthly rental rate per sq. ft in Rupees of the carpet area of the

accommodation offered should be quoted. Income Tax/TDS will be deducted on the same at

prevailing rate.

30. ESI Corporation reserves the right to accept or reject any or all the offers without

assigning any reason thereof.
