    REACH regulation Evaluation & Notification

    Evaluation : The European Agency checks of the registration files

    Notification: Notification of substances in articles is required when all conditions are met:(

    The substance is included in the candidate list for authorization and

    The substance is present in all articles produced or imported by one actor in an amount totalling over1 ton/year and1

    The substance is present in article above a concentration of 0.1% w/w0.1%

    If, however, one or both of the following conditions are met, no notification is required:

    1. The producer or importer can exclude exposure of the substance to humans or the environment

    during normal or reasonable foreseeable conditions of use.

    2. The substance has already been registered for that use.

    A notification is not required for a substance in articles which have been produced or imported before thesubstance has been included on the candidate list for authorization.

    A notification of substances in articles shall be made at the latest 6 months after it has been included onthe candidate list for authorization but only starting from June 1st, 2011.

    REACH regulation Consumer information

    Consumer information: at request of a consumer, every supplier of an article, containing a substance of thecandidate list with a concentration superior to 0,1% w/w, supplies to the consumer the sufficient

    information which allow the use of the article safely and including, at least, the name of the substance.

    The relevant information is supplied free of charge in forty five days which follow the reception of the demand.45

    It is mandatory to evaluate eco-toxicity of substances and to inform users, Starting with Substances ofVery High Concern SVHC (1500 substances)(, 1,500)

    REACH regulation Authorization & Restriction

    Authorization: if a manufacturer, producer, or importer uses a substance which is included in

    Annex XIV, he has to make sure that the use of the substance is authorized.

    If its not the case, he has to make a demand of authorization.

    The demand of authorization will begin only from 2012. 2012

    Restriction (Annex 17): The content of substances in articles can be restricted or banned under

    the restrictions procedure. Article producers and importers have to follow the conditionsoutlined in Annex 17 of REACH from June 1st, 2009.

    Preparations (liquid cleaner for sofa, glue tube, wax for furnitures, Desiccant..)

    Articles with substance intended to be released (perfumed candles, incense sticks, dryedflowers..)

    Be careful :

    All packaging (plastic film, paper, carton, palletts) are separate articles : so a furniture ina carton means 2 different articles !!!

    A liquid cleaner for sofa is a preparation BUT the glass bottle is an article !!!

    For the glue tube (shipped inside furnitures packaging) :

    The glue is a preparation

    1. The supplier has to sign a REACH declaration indicating that its products are inconformity with REACH regulation

    2. When the supplier proposes a product to SISL, he has to give the chemical data of theproduct by filling the REACH data collection file and he has to send the associated SDSSISL-SDS

    > So the supplier must have a clear view of the chemicals inside the product, and hehas to know if SVHC substances are present in the product

    The supplier must respect the REACH European regulation, starting in June 2007 in Europe.20076REACH

    The supplier warranties a full traceability of each chemical substance used during the sourcingof each raw material, and during its own production process.

    The supplier will have a full traceability management of its own suppliers.

    The MSDS (Material Safety Data Sheet) is the best tool to exchange chemical data betweensupplier and customer (during all the chain : from substance level to final product).

    SDS (Safety Data Sheet) is the best tool to know if the product contains dangerous substancesor/and SVHC.

    SDS()

    It avoids to the supplier to perform tests each time that the candidate list is updated.

    SDS has to contain the name of the substances, the CAS number, and the percentage of thesubstances inside the preparation.
