WITNESSETH: WHEREAS, Declarant recorded that certain Declaration of Protective Covenants, Conditions & Restrictions on June 17, 1986, under Auditor's File No. 8606170433 in the records of King County, Washington (the "Declaration"); and WHEREAS, Declarant desires to amend and clarify the Declaration as follows: NOW, THEREFORE, Declarant hereby deletes Article III, Section 3.7 of the Declaration in its entirety and replaces Section 3.7 with the following: 3.7 Fences. No fence, wall or hedge shall be erected or placed on any Lot nearer to any street than the minimum building setback line, except that nothing shall prevent the erection of a necessary retaining wall, the top of which does not extend more than two feet above the finished grade at the back of said wall. Fences bordering green belt areas shall have the finished side facing green belt areas and all fences shall be of the same design and painted the same color, as has been approved by the ACC. No deviation in the design or color of fences shall be permitted, except by the prior written approval of the ACC. No chain link fencing shall be visible from any street or green belt area. This AMENDMENT NO. 1 TO DECLARATION OF PROTECTIVE COVENANTS, CONDITIONS & RESTRICTIONS, WEST CAMPUS DIVISION 7 (BARCLAY PLACE) (this "Amendment") is made as of this 20th day of July, 1989, by THE QUADRANT CORPORATION, a Washington corporation, (the "Declarant").

WITNESSETH:

WHEREAS, Declarant recorded that certain Declaration of Protective Covenants, Conditions & Restrictions on June 17, 1986, under Auditor's File No. 8606170433 in the records of King County, Washington (the "Declaration"); and

WHEREAS, Declarant desires to amend and clarify the Declaration as follows:

NOW, THEREFORE, Declarant hereby deletes Article III, Section 3.7 of the Declaration in its entirety and replaces Section 3.7 with the following:

3.7 Fences. No fence, wall or hedge shall be erected or placed on any Lot nearer to any street than the minimum building setback line, except that nothing shall prevent the erection of a necessary retaining wall, the top of which does not extend more than two feet above the finished grade at the back of said wall. Fences bordering green belt areas shall have the finished side facing green belt areas and all fences shall be of the same design and painted the same color, as has been approved by the ACC. No deviation in the design or color of fences shall be permitted, except by the prior written approval of the ACC. No chain link fencing shall be visible from any street or green belt area.

Except as expressly amended herein, the Declaration remains in full force and effect.
