PRECONFERENCE WORKSHOP 1 - WEDNESDAY, FEBRUARY 21, 2018 8:00 AM – 5:00 PM

MOCK TRIAL – FOR LAND SURVEYORS AND ATTORNEYS

A full day trial to address the flowing issues: property overlap, junior/senior rights, interpretation of descriptions, encroachments and performance of duties. The trial will have a real judge and practicing attorneys. Testimony will be heard from land surveyors, land owners and expert witnesses. The case will be moderated to layout the facts of the case, provide technical background and explain legal proceedings. ABOUT THE MODERATORS:

Curt Ledford, Esq. Mr. Ledford’s practice is focused on utility, administrative, corporate, cooperative, and regulatory law, as well as general matters affecting energy developments, generation facilities, renewable energy, and Nevada’s utilities. Prior to joining McDonald Carano as a Partner in the Energy & Natural Resources Group, Curt served as General Counsel for Valley Electric Association, Inc. (VEA), a Nevada non-profit cooperative utility that provides electric service to members in six counties throughout rural Nevada and California. Curt also assists the firm’s clients with state and federal permitting and environmental approvals, and Curt has represented both buyers and sellers alike in transactions involving renewable energy facilities. As a former utility employee, Curt is also intimately familiar with the various rules, regulations, and contractual requirements of local utilities,

and provides guidance to developer clients when navigating through the labyrinth of utility line extension and interconnection rules and requirements. Curt is active in various professional organizations, including his new role as Chairman of the Clean Energy Project and his on-going role as a Market Leadership Advisory Board Member for the US Green Building Counsel. Curt was also a founding member of the Energy, Utilities and Communication Law Section of the State Bar of Nevada. Curt received a J.D. from the University of Arizona in 2004, and a B.A. in Finance from the University of Arizona in 2001. He is admitted to practice law in Nevada. Awards and Recognition Nevada Business Magazine, “Legal Elite” 2017 40 under 40, finalist 2014.

Jason Paul Higgins, PLS Mr. Higgins is in charge of WMK’s Public Works and Utility Department. He is responsible for the management of all public works, permitting for easements and right-of-ways on state and federal lands, utility and energy projects. Additionally, Jason manages all water right projects for regulated utilities together with ranches and farming operations. Since 2006, Jason has provided expert witness services for a range of land surveying issues, including boundary issues, construction staking and water rights. Jason is a Past-President of the Southern Chapter of the Nevada Association of Land Surveyors. Since 2013, he has served as the Chairman of the Mojave-Southern Great Basin Resource Advisory Council for the Bureau of Land Management.

In 2016 Jason was appointed to the Nye-White Pine County Resource Advisory Council by the United States Department of Agriculture, representing Energy and Mineral Development. Jason has presented seminars and workshops on land surveying topics for law firms, land surveying associations, federal agencies and private corporations since 1999. PRECONFERENCE WORKSHOP 2 - WEDNESDAY, FEBRUARY 21, 2018 8:00 AM – 5:00 PM

BLM/CFEDS WORKSHOP

This one-day seminar includes GLO/BLM PLSS topics from Cadastral Offices in Washington DC, Arizona, Nevada, Utah and the CFedS Program. The five (5) presenters are experienced BLM Cadastral Surveyors. Curt Sumner, NSPS Executive Director will introduce the presenters and moderate the seminar. The five seminar topics are being combined and formalized into a 2-cedit hour CFedS Continuing Education Course. CFedS participants, who pass a post quiz, can earn 2 CFedS CE credits after the seminar is presented. All Conference attendees can attend the CFedS seminar as part of their Conference registration. Many recent boundary and landownership disputes are decided through court actions and passing new laws. This session will cover some current and past federal challenges where surveyors played an intricate role in attempting resolution.

Donald A. Buhler is the national Chief Cadastral Surveyor and Branch Chief of the Lands and Cadastral Survey for the Bureau of Land Management (BLM) of the Department of the Interior. The Cadastral Survey Program oversees the maintenance and propagation of the Public Land Survey System (PLSS), including all Federal interest lands and Native lands. The Lands Program of the BLM provides for realty actions, land tenure activities and special use permits for a variety of multiple use activities. Mr. Buhler is a Fellow and member of the National Society of Professional Surveyors and serves as a delegate for the United States contingency of the Fédération Internationale des Géomètres. Mr.

Buhler is Co-Chair of the Cadastral Subcommittee of the Federal Geographic Data Committee. He has worked in Washington, D.C for over 20 years under the BLM Assistant Director of Energy, Minerals and Realty Management.

9:45 - 11:00 AM Allotment Surveys and Resurveys Gerald T. Davis, Chief Cadastral Surveyor, BLM, Arizona State Office

A review of the early 1900s allotment surveys conducted on the Navajo Indian Reservation and elements of how they fit into modern dependent resurveys. Discussion of recent research efforts, the question of authority, conflicting boundary evidence, and what it all (might) mean to the retracement surveyor.

Gerald Davis began his surveying career with the U.S. Marine Corps as a Geospatial Intelligence Specialist. After his retirement from the Marines, he spent a decade working in the private sector on diverse projects spanning the west coast. In 2011, he started his civil service career surveying for the Bureau of Reclamation in Oregon, California, and Nevada. Since 2014, he has been the Chief Cadastral Surveyor for the Bureau of Land Management in Phoenix, Arizona where he is responsible for providing land surveying services to government agencies, tribes, and individual Indians. He is currently a licensed Professional Land Surveyor in Arizona, California, Nevada, Oregon, Utah, and Washington, a CFedS panel member, and has served as a technical consultant on examination and licensing activities.

11:00 - 12:00 PM John Benson & Crew 1874-1879 Steve Parrish, PLS, CFedS Training Coordinator

The infamous John Benson was a reasonably descent GLO contract surveyor before he began his “Fraudulent schemes” when the “Special Deposit Survey” system began. His cohorts in crime were not all bad and often surveyed most, if not all, of their township and section lines. A study of GLO plats and field notes, coupled with a thorough dependent resurvey, can reveal many of the customary shortcuts that pre-1910 GLO contract surveyors applied to their original survey efforts. This study of two townships, surveyed by Benson-Glover-Putnam (1874-1879), and dependently resurveyed by GLO/BLM (1945-1989), will provide insight into a few of the many shortcuts applied during their pre-1910 original government survey efforts

Steve Parrish began surveying with the USFS in 1963, transferred to the BLM in 1985 and served as the BLM Nevada Cadastral Chief (1989-1995). Steve worked for Tri State Surveying (1999-2012), taught a course on the “Manual” for Great Basin College (2004-2016), acquired CFedS Certification in 2007 and a BAS degree in 2009. Ron Scherler is a 1973 graduate of Oregon Technical Institute with a Bachelor of Survey Engineering Technology degree. He began his career with BLM’s Western Field Office moving to the Oregon State Office in 1983, the Alaska State Office in 2003, BLM’s National Training Center in 2005 and completing his career back in the Oregon State Office where he retired in 2011. In addition to his normal duties, he regularly instructed classes on the Public Land Survey System for BLM and professional surveyors throughout the county. Ron served as the original CFedS Program Manager, working with Dennis Mouland on development of the CFedS training material, certification exam and

Kristopher M. Kline, president of 2Point, Inc., has a four-year degree (class of '84) in general science from Bridgewater College of Bridgewater, Va. and he has been involved in the surveying profession since graduation. In the summer of '84, he moved to Brevard, N.C., and took his first N.C. surveying position as crew chief for William Leonard, P.L.S. Kris became licensed in 1991 (P.L.S. L - 3374). He has attended numerous seminars on topics including Rights of Way, Adverse Possession, Ethics, Real Estate Law and various technical aspects of surveying. He is a 1999 graduate of the North Carolina Society of Surveyors (N.C.S.S.) Institute, a three-year continuing education program that has drawn national attention for the quality of its curriculum and instructors. Kris served for a year as the Chairman of the Standards of Practice Committee for N.C.S.S., followed by 3 years as Chairman of

the N.C.S.S. Education Committee. He has appeared as an expert witness in court on numerous occasions, and has spent the last several years expanding his expertise on legal aspects of boundary retracement. Kris is an experienced boundary consultant and has been teaching classes in North carolina since 2001 on subjects including Boundary Retracement, Intent of the Parties, Riparian (water) Boundaries, and Adverse Possession. 10:00 AM – 5:00 PM Advanced Topics in Mineral Surveys and Dependent Resurveys (Kooper) For attendees desiring a general review of mineral surveys, reading materials in digital form will be provided to attendees prior to the conference. The course begins with an overview of federal mining laws, GLO Circulars, Departmental decisions, and mineral survey instructions. In June of 1899, the GLO adopted a policy where the patent description position of prior official mineral surveys controlled over the position monumented by the mineral surveyor. The course will discuss ways to detect when a mineral surveyor falsified their field notes and how the retracement surveyor should address theoretical exclusions in mineral lands patents. Congress enacted legislation in 1904 and the GLO issued several DOI Land Decisions that overturned the policy. The Act and Departmental Decisions reaffirmed the long-standing legal principle that, “monuments control over course and distance.” Chapter X of the 2009 Manual of Surveying Instructions is the first manual to provide instructions on the resurvey of mineral surveys. One of the topics covered in Chapter X is, “Gaps and Overlaps” Not of Record. Scenarios that the resurveyor should consider prior to bending a line through an intermediate monument will be discussed. Various methods of how to reestablish lost mineral survey corners will also be covered.

Gene Kooper: C. Eugene Kooper, PLS, is a licensed Professional Land Surveyor in the state of Colorado since 1985. Mr. Kooper is self-employed as a land surveyor and geologist specializing in mineral survey retracements, underground mine surveying, conventional and GPS control surveys, and satellite image processing for mineral and oil and gas exploration clients. Mr. Kooper has conducted research on mineral surveys and U.S. mining laws since 2001 and given presentations on mineral surveys at several state and national conferences. Emphasis is placed on the professional standards in effect. 1:30 PM – 5:00 PM Unwritten Rights – More than Just Adverse Possession (Wilson) When one or more things fail to agree with a record description, people usually immediately think of adverse possession, not realizing its complex requirements. However, situations such as this are often NOT adverse possession, but are attributable to some other doctrine, either title or boundary location. There are sixteen ways that title to, and rights in, land may be acquired or transferred, nine of which are not part of any written record. This program takes a brief look at the sixteen categories, and presents examples for each, so that various possibilities may be considered when discrepancies between the record and occupation.

Don Wilson is President of Land and Boundary Consultants, Inc., based in southeastern New Hampshire, and has been in practice as a land boundary consultant since 1974 and surveying since 1962. Don is both a licensed land surveyor and professional forester and has presented seminars on a variety of topics including description interpretation, boundary evidence, surveying law, and various aspects of forensic science.

In addition to over 200 technical publications in several disciplines, Don has been involved with writing more than 60 books. The latest editions of Evidence & Procedures for Boundary Location and its companion title, Boundary Control and Legal Principles, both of which he is a co-author, are the leading surveying textbooks. Two of his more

recent publications, Interpreting Land Records and Forensic Procedures for Boundary & Title Investigation, are proving to be a favorite among attorneys, title examiners and surveyors. His latest book, Easements Relating to Land Surveying and Title Examinations, will be a desk-top favorite for many. He has written six other boundary-related texts as well as researched and compiled the subject matter for seven state boundary and surveying law books. Don is a former faculty member of the University of Maine where he taught surveying in the School of Forestry and the Department of Civil Engineering. He is also a former faculty member at the University of New Hampshire where he continues to teach courses for the UNH Professional Development & Training Program. He is a member of the Professional Surveyor/Red Vector “Dream Team” providing on-line education for surveyors and related professionals. Presently this cooperative is offering twelve separate courses authored by Don with more currently being developed. Don is a member of and has been active in many surveying, mapping and forestry organizations. He is past president of both the Maine Society of Land Surveyors and the New Hampshire Land Surveyors Association. FRIDAY, FEBRUARY 23, 2018 (Continued) 8:30 AM – 12:00 PM Best Practices for GPS Today (VanSickle) Most, not all, GPS surveying relies on the idea of differential positioning. The mode of a base or reference receiver at a known location logging data at the same time as a receiver at an unknown location together provide the fundamental information for the determination of accurate coordinates. Now, the most commonly used methods utilize receivers on reference stations that provide correction signals to the end user via a data link sometimes over the Internet, radio signal, or cell phone and often in real-time. Real-time kinematic (RTK) has become routine in development and engineering surveys where the distance between the base and roving receivers can most often be measured in thousands of feet. However, while RTK dominates the GPS surveying applications the requirements of setting up a GPS reference station on a known position, the establishment of a radio frequency transmitter and all attendant components before a single measurement can be made are both awkward and expensive. Real-Time Networks, RTN services have arisen around the world to provide RTCM real-time corrections to surveyors by a different means. There are definite advantages including the elimination of individual base station preparation and the measurement of longer baselines without rapid degradation of the results. This seminar is about making explaining some elements important to RTN operation and proposing some practical real-time best practices. 1:30 PM – 5:00 PM GIS and GNSS (VanSickle) GIS is a representation of reality that has the remarkable ability to answer questions about itself. It can tell you almost anything you want to know about what you’ve done, what you’re doing or what you intend to do, but there are a couple of catches. For example, you have to point it at the information it needs to answer your questions. And if you want the answers to be right, the information has to be right. Here’s another catch, GIS will only do what it’s told if the software and hardware are in place to carry the information you asked for in the form you want to see. This presentation is about some real-world examples of the processes necessary to achieve these things. One of the case studies involves a GIS for the management of an international utility and another is about right-of-way acquisition for and construction of a gas gathering pipeline in Texas.

Jan VanSickle has many years of experience in GIS, GPS, surveying, mapping and imagery. He has advised Anadarko, IHS Energy, Chesapeake, Microsoft, Intermap, Jeppesen, Geoeye and others in geospatial matters. He began working with GPS in the early 1980s when he supervised control work using the Macrometer, the first commercial GPS receiver. He created and led the GIS department at Qwest Communications for the company’s 25,000-mile worldwide fiber optic network. He also led the team that built the GIS for natural gas gathering in the Barnett Shale. He has led nationwide seminars based on his three books, GPS for Land Surveyors, Basic GIS Coordinates and Surveying Solved Problems. Jan earned his Ph.D. in geospatial engineering from the University of Colorado. He has been a licensed professional Land Surveyor for thirty-one years is a member of the Royal Institute of Chartered Surveyors and is currently licensed in Colorado, California, Oregon, Texas, North Dakota and West Virginia.

Steven Silva, Esq. focuses his practice on eminent domain, real property, commercial litigation, appeals and foreclosure, throughout Nevada and California. Steven previously served as a Staff Attorney in the Civil Division of Central Legal Staff for the Supreme Court of Nevada. 8:30 AM – 12:00 PM The Seven F’s of Land Surveying Plus One (Wilson) A philosophical discussion of how land surveying is sometimes perceived and an attempt to place understanding in its appropriate category: fantasy, folklore, fiction, folly, figment, foolishness and fairy tales. What is frequently ignored is fact.

Don Wilson is President of Land and Boundary Consultants, Inc., based in southeastern New Hampshire, and has been in practice as a land boundary consultant since 1974 and surveying since 1962. Don is both a licensed land surveyor and professional forester and has presented seminars on a variety of topics including description interpretation, boundary evidence, surveying law, and various aspects of forensic science. In addition to over 200 technical publications in several disciplines, Don has been involved with writing more than 60 books. The latest editions of Evidence & Procedures for Boundary Location and its companion title, Boundary Control and Legal Principles, both of which he is a co-author, are the leading surveying textbooks. Two of his more recent publications, Interpreting Land Records and Forensic Procedures for Boundary & Title Investigation, are proving to be a favorite among attorneys, title examiners and surveyors. His latest book,

Easements Relating to Land Surveying and Title Examinations, will be a desk-top favorite for many. He has written six other boundary-related texts as well as researched and compiled the subject matter for seven state boundary and surveying law books. Don is a former faculty member of the University of Maine where he taught surveying in the School of Forestry and the Department of Civil Engineering. He is also a former faculty member at the University of New Hampshire where he continues to teach courses for the UNH Professional Development & Training Program. He is a member of the Professional Surveyor/Red Vector “Dream Team” providing on-line education for surveyors and related professionals. Presently this cooperative is offering twelve separate courses authored by Don with more currently being developed. Don is a member of and has been active in many surveying, mapping and forestry organizations. He is past president of both the Maine Society of Land Surveyors and the New Hampshire Land Surveyors Association. In addition to the writing and lecturing about surveying, Don is the fourth generation of a family that owned and operated the sporting camps, Wilson's on Moosehead Lake, for over 109 years. He is a registered Maine Guide, avid fly fisherman and has maintained an interest in the sporting and resort history of Maine.
