Sealed Tenders are hereby invited on behalf of the Secretary, Indian Council ofAgricultural Research, New Delhi for HIRING OF 5 NOS DLY TAXIS (MINIMUMRUN OF 2000 KMS/MONTHNEHICLE) FOR OFFICIAL USE OF THE INDIANCOUNCIL OF AGRICULTURAL RESEARCH, KRISHI BHAVAN, NEW DLEHI-llOOOl.The terms and conditions of the contract which will govern any contract made are

those contained in the General conditions of contract applicable to the contracts placed

by the ICAR and by the Research Institutes of the Council and the special terms andconditions detailed in the Tenders form and its schedules. Please submit your rates inthe Tenders form if you are in a position to furnish the requisite services in accordance

with the requirements stated in the attached schedules.

2. An earnest money of Rs.25,OOO/- (Rupees twenty five thousand only) must bedeposited in the form of demand draft/pay order payable to Secretary, ICAR at New Delhi. The

particulars of the earnest money deposited must also be superscribed on the top of the

envelope by indicating the draft/pay order number and date, failing which the Tenders will notbe opened. The Tenders will not be considered if earnest money is not deposited with the

Tenders.

3. The Tenderer is being permitted to give Tenders in consideration of the stipulations onhis part that after submitting his Tenders, he will not resile from his offer or modify the termsand conditions thereof. If the Tenderer fail to observe and comply with the foregoing

stipulation the aforesaid amount of EMD will be forfeited by the Council. In the event of theoffer made by the Tenderer not being accepted, the amount of earnest money deposited by theTenderer will be refunded to him after he has applied for the same, in the manner prescribed

by the Council.

4. The Schedules of the Tenders form should be returned intact and pages should not be

detached. In the event of the space provided on the schedule form being insufficient for the

required purpose, additional pages may be added. Each additional page must be numbered

consecutively and be signed in full by the Tenderer. In such cases reference to the additionalpages must be made in the Tenders form. If any modification of the schedule is considerednecessary it should be communicated by means of a separate letter alongwith the Tenders.Overwriting/erasing in rates to be quoted by the Tenderer will not be allowed otherwise theTenders may be rejected.

5. The Tenders are liable to be ignored if complete information as required is not giventherein or if the particular asked for in the schedules to the Tenders is not fully filled in.Individual signing the Tenders or other documents connected with the contract may specifywhether he signs it in the capacity of (i) a sole proprietor of the firm of constituted attorney ofsuch sole proprietor, or (ii) a partner of the firm if it be partnership in which case he must haveauthority to refer to arbitration dispute concerning the business of the partnership whether byvirtue of the partnership agreement or power of attorney or (iii) constituted attorney of the firmif it is a company.

6. If Tenderer does not accept the offer, after issue of letter of award by ICAR within 15days, the offer made shall be withdrawn & Earnest money forfeited.

7. In case of partnership firms, where no authority to refer disputes concerning thebusiness of the partnership has been conferred on any partner, the Tenders and all other relateddocuments must be signed by every partner of the firm. A person signing the Tenders form orany other documents forming part of the contract on behalf of another shall be deemed towarranty that he has authority to bind such other and if, on enquiry it appears that the personsso signing had no authority to do so, the Council shall without prejudice to other civil andcriminal remedies cancel the contract and hold the signatory liable for all costs and damages.Each page of the Tenders and the schedules to the Tenders and annexure, if any, should besigned by the Tenderer.

8. The original copy of the Tenders is to be enclosed in double cover. The Inner covershould be sealed. The outer cover should be superscribed "TENDER FOR HIRING OF 5NOS DLY TAXIS FOR OFFICIAL USE OF THE INDIAN COUNCIL OFAGRICULTURAL RESEARCH, KRISHI BHAVAN, NEW DLEHI-llOOOl. with address ofthis office and of the Tenderer. Right is reserved to reject outstation Tenders. All Tendersshould be sent by Registered Post. Tenders to be hand delivered should be put in the Tenders

box, which will be kept in the Room No. 205, 2nd Floor, Krishi Bhawan, Dr. Rajendra Prasad

Road, New Delhi-l1000l not later than 3:00 PM on 22nd February, 2010.

9. The rates quoted by each firm for Transport services contract in Tenders be given bothin words and figures failing which the same is liable to be rejected. You are at liberty to bepresent or to authorize a representative to be present at the time of opening of the Tenders. Thename and address of the representative who would be attending the opening of the Tenders onyour behalf should be indicated in your Tenders. Please also state the name and address of

your permanent representative, if any.

10. The Council does not pledge itself to accept the lowest or any other Tenders and also

reserve to itself the right of accepting the Tenders in whole or in part of the Tenders. You arehowever at liberty to Tenders for the whole or any portion or to state in the Tenders that therates quoted shall apply only if the Tenders are considered fully. Other conditional Tenders

will not be accepted.

11. An amount of Rs. 50,OOO/-(Rs. fifty thousand only) as security deposit for the contract is tobe deposited by the selected agency/successful tenderer only after receiving a communicationfrom the Council. The performance guarantee cum security deposit by way of FDR/BankGuarantee from a Nationalized Bank in favour of Secretary, ICAR, payable at New Delhi validfor 15 months. FDR/Bank Guarantee will be required to be furnished within two weeks fromthe date of award of contract, failing which the work order may be cancelled.

12. No interest on security deposit and earnest money deposit shall be paid by the Councilto the Tenderer.

13. The VAT or any other tax on material in respect of this contract shall be payable bycontractor and ICAR will not entertain any claim whatsoever in this regard. The service tax orany other tax which is as per the rule of the Govt. of NCT of Delhi shall be paid by the agencyitself to the concerned department. Council will deduct only IDS from the monthly bills of thesuccessful tenderer as per the rule! instructions made applicable from time to time byGovernment.

14. Secretary, ICAR reserves the right to reduce or terminate the period of contract or toextend its duration in the interest of the Council, for any justifiable reasons, not mandatory tobe communicated to the Tenderer.15. The contract will be initially for a period of one year extendable for a further period oftwo years (total three year) on year to year basis, subject to satisfactory performance of thevendor & his/her willing less to continue.

16. Decision of Secretary, lCAR will be final for any aspect of the contract and binding to allparties. Disputes arising, if any, on the contract will be settled at his/her level and will not bereferred to arbitration.

17. Acceptance by the Council will be communicated by FAX/Telegram, Express letter orany other form of communication. Formal letter of acceptance and work order of theTenders will be forwarded as soon as possible, but the earlier instructions in theFAX/Telegram/Express letter etc. should be acted upon immediately.

18. The following documents/vouchers are required to be enclosed with the Tenders formwhich are the terms and conditions of the Tenders document (for Technical Bid):-

a) Registration certificate of the firm under the work contract of the Govt. of NCTDelhi.! Transport Department.

b) Minimum turnover of the firm not less than Rs. 15 lakhs during the last financialyear.

c) Last five years continues experience of the firm in the field of providing such services in

Central Govt. establishments/Autonomous bodies of Govt. of India/ Corporations of

Govt. of India/reputed public or private organisations provide the details in enclosedtabular form.

d) Certified Balance Sheet of the firm for last year of the service contract by theChartered Accountant.

e) Duly certified copies of the satisfactory services where the Tenderer is providing theservices for the last three years.

f) Employee EPF registration certificate issued by local govt. etc.

g) Employee ESI registration certificate issued by local govt. etc.

h) The agency must have minimum 15 nos Leading fleet owner / luxury Cabs-AC/Non­AC Vehicles.

i) The agency must have certificate of service tax issued by the Govt. etc.

j) Whether the firm has any legal suit/criminal case pending against it for violation ofPF/ESI, Minimum wages Act or other laws (give details).The firm/agency mustenclose a certificate indicating that there is no criminal! legal suit pending orcontemplated against them.

k) Only those firms will be considered for financial bid who will qualify in the technicalbid.

1) Successful Tenderer will have to enter into a detailed contract agreement with ICARon non-judicial stamp paper of Rs. 50/- for each work.

Schedule-II

GENERAL INFORMATION & OTHER SPEaAL TERMS & CONDITIONS OF THECONTRACT FOR HIRING OF 5 NOS DLY TAXIS FOR OFFIaAL USA OF THEINDIAN COUNaL OF AGRICULTURAL RESEARCH, KRISHI BHAVAN, NEW

DLEHI-110001.

Indian Council of Agricultural Research is housed in Krishi Bhawan, Dr. RajendraPrasad Road, New Delhi-110001. It occupies ground plus 4 (four) floors in the'A'and 'D' wings of Krishi Bhawan. The vehicle can also be deployed at Krishi Bhawan,KAB-I & II, Pusa, New Delhi-110012.

1 Scope of Works:

1. The Contractor shall provide the vehicle along with drivers, so as toensure twenty four hours availability of drivers. However, the normalrunning of vehicle will be about 10-14 hours per day. The hired vehiclesmay occasionally be required to travel out of Delhi on official tours also.

i) The Vehicle should be self-starting and in good condition.

ii) Model of the Vehicle should not be prior to 2008. In case condition ofvehicles is not found to be satisfactory and of acceptable standards, theoffer is liable to be rejected.

iii) The Vehicle should be registered as a commercial vehicle with roadtransport office and contractor should submit relevant papers ofregistration of vehicle before starting the work.

2. Contractor will be required to provide five WHITE COLOUR ACVehicles Tata indigo/Maruti Swift/SX4 or similar type vehicles.

3. The duty point would be Krishi Bhawan, KAB-I1II, Pusa or any otherplaces intimated by the Council from time to time and not from garage togarage.

4. The drivers :-

i) Should be experienced.

ii) Should possess an appropriate and Valid commercial Driving Licence.

iii) Should be courteous and well mannered.

iv) Will be required to maintain a daily logbook(Kms. run/day), which willbe signed by the officer using the vehicle or any other persons

authorized by him.

5. The drivers should be provided with a mobile phone by the contractor.

Mobile bill will be born by the agency.

6. The vehicle provided by the Contractor should have proper seat covers

etc. seat covers will have to be cleaned every 10 days or earlier (whenever

required).

7. The cost of hiring quoted by tenderer should include salary of driver,cost of diesel and other consumables, all repair and maintenance costs, alltaxes applicable on hired vehicles by road transport authorities (likeregistration charges, insurance charges etc.) mobile phone for driver etc. forwhich nothing extra will be paid.

8. The vehicles provided by contractor will be required to ply on all kindsof roads and surfaces, in all kinds of weather conditions. If required, hevehicles along with driver may have to stay out of station, as perrequirement.

9. Since the vehicle may be required to move out in any emergency in anycase at odd hours in the night, when petrol pumps remain closed the fueltanks must never be below the half way mark. The contractor must ensureavailability of fuel at any given time equal to half the capacity of the fueltank. When the fuel tank reaches the half way mark, it should immediatelybe arranged to be refilled to full capacity, by the contractor.

10. Nothing extra will be paid to the contractor due to fluctuation in cost offuel or any other consumable items, registration charges etc.

11. In case the vehicle breaks down or is required to be taken under repair,another vehicle of similar type and condition will have to be provided by thecontractor.

12. Necessary Registration Certificate, insurance of the vehicles should be

valid and complete in all respects.

13. All the taxes and duties what-so-ever leviable by the Government (State

or Central) or anybody, shall be borne by the contractor and will be

deducted from his account bill.

14. Subject to any deduction or recoveries which the Council may beentitled to make under the contract, the income tax, surcharge on income taxand sale tax (trade tax) as applicable form time to time by the government

shall be deducted from his bill.

15. Contractor has to submit power of attorney/affidavit in favour of onewho is authorized to sign various documents, bills, contract agreement etc.to enter into contract agreement & submit partnership.

16. Vehicles are to be supplied and work has to be executed strictly as perthe tender schedule and specifications given by the CounciL

17. Payment shall be made through E.C.S. mode direct into the Bank

Account.

18. ICAR administration shall not be responsible for any accident, damageetc. to the vehicle during the period of hire.

19. Council reserves the right to discontinue all vehicles or any vehicle or todiscontinue the contract, at any stage/time, after giving a one month's notice.

20. The Contractor/ Agency will furnish to the ICAR Hqrs., the fullparticulars of the Personnel, Driver sponsored, including details like Father'sname, Age, Photograph, Permanent Address, Telephone number etc. andthey will also ensure the verification of the antecedents of such personnelfrom their Ex-employer/police and also ensure that they possess the requisiteacademic/technical qualifications/ Driver (8th Pass) and experience forrendering the requisite services to the ICAR Hqrs.

21. The personnel provided shall be under the direct control and supervisionof the Contract/Agency. However, they shall comply with the oral andwritten instructions given on day to day basis, by the officer(s) authorized by

the leAR Hqrs from time to time. They will be bounded by office timings,duty, placement, locations, etc., as decided by the ICAR Hqrs.

22. The Contractor/Agency shall make payment of remuneration/wages toits Drivers before 7th of every month. After making the payment, theContractor shall raise the bill on the ICAR Hqrs for payment of the settledamount. They will submit to the ICAR a copy of the payment vouchers dulysigned by the Drivers for each month and a copy of deposit slip for deposit

of EPF & ESI etc. in concerned Govt. Deptts..23. Any loss, theft or damage to the life and/or property of the employees of

the ICAR Hqrs. and/or property of the ICAR shall be compensated by theContractor/Agency if the cause of such loss, theft or damage is on account ofdefault, negligence and lor lapse of the Drivers of the Contractor/Agency.

24. The Transport services staff should follow strict attendance andalternative arrangements are to be made by the agency whenever anyone ofstaff! Drivers is to go on leave under intimation to this office.

25. Changing of Drivers should be intimated to Estt. V Section, ICAR, KrishiBhawan. New Delhi

26. The Secretary, ICAR reserves the right to reject any or all quotations inwhole or in part without assigning any reason therefore. The decision ofSecretary, ICAR shall be final and binding on the Contractor/Agency inrespect of clause covered under the contract.

27. The Drivers provided should also maintain secrecy and discipline in thepremises of ICAR Hqrs., Krishi Bhawan. KAB-I, KAB-II, New Delhi

28. The Drivers provided should be capable of reading and writing Hindiand English with a minimum qualification of Middle Standard.

29. The contractor shall keep a complaint register with his Drivers, and itshall be open to verification by the authorised officer of ICAR for thepurpose. All complaints should be immediately attended to by the Agency.

30. White Uniform with cap should be supplied by the contractor to theDrivers at his own cost and it would be ensured that the Drivers etc., are inproper uniform while on duty.

31. The agreement is terminable with one month notice on either side.32. The contractor shall not sublet the work to any other agency.33. The contractor or his Drivers shall not misuse the premises allotted to

them for any purpose other than for which the contract is awarded.34. The selected agency shall provide the Drivers for at ICAR Hqrs. as per

labour acts prevalent in NCT of Delhi and with having valid CommercialDriving Licence. The agency shall employ good and reliable persons withrobust health of age group of 21 to 45 years. In case any of the Drivers soprovided is not found suitable by the Council, the Council shall have theright to ask for his replacement without giving any reason thereof and theagency shall on receipt of a written communication will have to replace suchpersons immediately.

35. The persons so provided by the agency under this contract will not be theemployee of the Council and there will be no employer-employee

relationship between the Council and the person so engaged by the

contractor in the aforesaid services.36. Payment for service contract will be made monthly upon submission of

pre-receipted bill.37. The rates to be quoted should include cost of each and every item

including transportation cost, manpower cost and taxes etc. The ICAR shallnot bear any extra charge on any account whatsoever i.e. EPF contribution,Uniform, Liveries, etc.

38. The contractor will discharge all his legal obligations in respect of theDrivers to be employed/ deployed by him for the transport services inrespect of their wages and service conditions and shall also comply withall the rules and regulations and provisions of law in force that may beapplicable to them from time to time. The contractor shall indemnify andkeep indemnified the Council from any claims, loss or damages that maybe caused to it on account of any failure to comply with the obligationsunder various laws. In case of any dispute, the decision of Secretary,ICAR shall be final and binding on the contractor.

39. Income Tax will be deducted from the payments due for the work doneas per rule.

40. The contract is subject to the condition that the tenderer will comply withall the laws and acts of Central Govt., State Govt. relating to this contractmade applicable from time to time.

41. Rick Clause: ICAR reserves the right to discontinue the service at anytime, if the services are found unsatisfactory by giving a show-cause to bereplied within a week and also has the right to award the contract to anyother agency at the risk and cost of current agency and excess expenditureincurred on account of this can be recovered from SD or pending bills or byrising a separate claim.

42. The Tenderers should indicate only the rates proposed on the basis ofman power rate list of the contract. No request for alteration in the ratesonce quoted will be permitted within one year.

43. The financial bid showing total monthly amount on Job Contract basiswith item-wise breakup which will include all mandatory paymentsincluding other percentage/expenses as per Annexure-I should beprovided.

44. The tender document duly signed on all pages shall be submitted alongwith the technical bid, failing which the technical bid shall not be considered.Outsider firms shall not be considered for technical bids.

45. In the financial bid the bidder must quote the rates in figures as well as inwords. The amount of each item should be worked out and total should begiven.

46. They should not give lenient or casual impressions in the duties and theyshould be alert and attentive.

Penalty clause for Non- Compliance:-1. That the contractor shall be responsible for the faithful compliance of the work

award order. Any breach or failure to perform the same may result in

termination of the work order and forfeiture of the security deposit.

2. Any misconduct/misbehavior on the part of manpower deployed by the agency

will not be tolerated and such persons will have to be replaced immediately.
