AGREEMENT AND RELEASEAs a condition to acceptance of this registration, each applicant must read, agree to, and sign, the following Agreement and Release: I have read the Trip brochure carefully and agree to the itinerary for this Trip, the refund/cancellation policy and fees, and all terms and conditions on all pages of this registration form, all of which I have read and understand. I understand the requirements of this Trip as outlined in the Trip brochure and agree that I am able to meet the requirements as outlined in the Trip brochure. I certify that I am physically, mentally and emotionally fit and able to participate in this Trip. All travel involves risks, and travel to some parts of the world, involves a heightened risk to one’s health and safety, including risks from terrorism, civil unrest, criminal acts, and illness. I understand the nature and extent of all of these risks, and freely accept them.

I hereby release and hold harmless Dr. Bill Creasy, Logos Bible Study and Executours Inc., dba Devotion Travel and their officers, employees, affiliates, and agents, from any claims or liability for any delays, physical, mental, emotional, economic, or other injuries or damages whatsoever, or for the loss of or damage to my property, from any cause (including their negligence and however occurring, during any portion of, or related to the Trip.

I understand that the Trip I am purchasing is subject to supplemental price increases that may be imposed by suppliers and/or governments after I have completed my purchase. I agree that Devotion Travel may pass along such increases to me to offset increased taxes, fees, and fuel surcharges and agree to pay the additional charges to offset them.

CANCELLATION FEES PER PERSONCancellations must be received in writing to be effective. From registration until Jan 9, 2019, fee is $350.00. Jan. 10, 2019 - Feb. 5, 2019 fee is 100% of deposit.Final payment due: Feb. 6, 2019. Feb. 6, 2019 - Mar. 6, 2019 – cancellation fee is 50% of Trip price. Mar. 7, 2015 - Apr. 5, 2019 – cancellation fee is 75% of Trip price On/after Apr. 6, 2019 -- 100% cancellation fee (no refund). If final payment is not received by Feb. 6, 2019, a late payment fee will be assessed or we may cancel your registration and refund your payment, less applicable cancellation fee.

TRAVEL INSURANCE Executours Travel offers travel insurance, provided by Travelex. Travel insurance must be purchased prior to or along with final payment. This insurance provides insurance coverage that only applies for a covered trip. The purchase of travel insurance is not required to purchase this trip or any other product or service from Devotion Travel. You may already have coverage that provides similar benefits, and you may wish to compare the terms of this coverage with your existing coverage. If you have questions about your current coverage, call your insurer or agent. Devotion Travel is not qualified to answer questions about the benefits, exclusions or conditions of the travel insurance or to evaluate your existing coverage. Terms, exclusions, and limits are governed by the coverage documents (available on request). Travel insurance payment is non-refundable.

RIGHT TO CHANGE TRIP LEADER: Should the Leader of your Trip be unable or fail to lead all or part of the Trip for any reason, another Trip Leader may be substituted without notice. There will be no refunds or credits.HEALTH/MOBILITY: Trip members are urged to consult their personal physician for individual assessments and recommendations. Each Trip member certifies that he/she is fully fit and able to participate in the Trip as described in the Trip brochure and all related activities and has no physical, mental or emotional condition that would create a hazard or detract from the Trip for him/herself or other passengers. Some sights and accommodations are not handicap-accessible.AIR TRANSPORTATION: If the Trip price includes group air transportation, the price includes U.S. departure tax. Scheduling, taxes, government fees and regulations are subject to change without notice, may increase trip cost, and require additional payment, to which you consent. Airlines and flights are subject to change. Executours is not responsible for any air travel arrangements made by Trip members or third parties. Airline baggage fees are not included in the Trip price and are the responsibility of the Trip member. Deviation from the Group air will incur a minimum $100.00 deviation fee.ACCOMMODATION: Prices are based on double occupancy. Executours reserves the right to substitute hotels. Traveler must pay all incidental/personal hotel charges, which will be charged to traveler’s credit card if not paid. SINGLE ACCOMMODATIONS: If available, single supplement surcharge will apply and is subject to limited availability. If requested, Executours will attempt (but cannot guarantee) to arrange a roommate. If a roommate fails to take the Trip or cancels for any reason, single supplement charge applies and is payable. MEALS: Trip price includes breakfasts and certain other meals as listed on the itinerary. Beverages and all other meals not listed as provided (including lunches) are self-hosted and are the responsibility of Trip members.VISAS: Where required, visa fee for U.S. citizens is not included in Trip price. Non-U.S. citizens must make their own arrangements for any required visas. Executours is not responsible for applying for or obtaining any visas for any Trip member. Passports must be valid for at least six months after the Trip return date. TRANSFERS: Group transfers are provided only in conjunction with group Trip flights to/from group hotels or cruise ship. Trip members arriving or departing via other arrangements are responsible for their own transfers. Local transportation other than group transportation on the itinerary is the responsibility of the Trip member. TRAVEL INSURANCE: Trip participants are offered coverage provided by Travelex. Executours is not an insurance agent or broker and makes no representations concerning the scope, terms, or conditions of coverage of such insurance, which can only be made by the insurer. Various exclusions and limitations apply. Coverage is governed by the coverage documents provided by Travelex, which is solely responsible for their content. Each Trip participant should review the coverage documents carefully to confirm the coverage meets your expectations.SIGHTSEEING/TRANSPORTATION: Transportation for sightseeing described in the Trip brochure is provided by motor coaches or other vehicles, depending upon circumstances at the time of Trip operation. Entrance fees to places listed in the itinerary are included.LUGGAGE LIMITS: Trip logistics limit each person to 1 checked suitcase (not to exceed 50 lbs.), 1 camera case or purse, and 1 carry-on bag (not to exceed 18 lbs.) such as a backpack. Airline baggage charges are extra and the traveler's responsibility. GRATUITIES AND TAXES: Local/government taxes and fees at time of booking on included hotels, meals and services listed in the itinerary and normal base gratuities to the guide, bus driver, hotel porterage, and/or cabin stateroom are included. Post-booking increases in taxes and fees will result in surcharges payable by the Trip member. CANCELLATION PENALTIES & REFUNDS: The refund/cancellation policy is set forth on the preceding page. Any additional costs, change fees and penalties charged by airlines, tour operators, hotels, or other vendors for cancellations or changes are the traveler’s responsibility and may be deducted from any refund. UNUSED PORTIONS/ NO REFUNDS: There are no refunds for unused services or air tickets or portions of the Trip not taken. No refunds will be made to anyone who does not complete any part of the Trip for any reason. LOSSES/ INJURIES: Executours is not responsible or liable for loss, damage, or theft of personal baggage and belongings and is not liable or responsible for personal injury, accident, or illness from any cause, including Executours’ negligence. The Trip member assumes all risks of the foregoing.NO SMOKING: This is a nonsmoking Trip. Smoking is not permitted in aircraft, vehicles, anywhere the group is gathered, or where prohibited by local law or hotel/ carrier/cruise line/vendor policy. CHANGES: Although Executours and the Trip Leader will use reasonable efforts to adhere to the printed itinerary, it may be necessary to adjust or change arrangements or to eliminate, shorten, or limit certain aspects of the itinerary as circumstances warrant in their sole discretion. Changes or deletions also may be made by air carriers, cruise lines, ground operators, or other operators/providers. Executours and/or the Trip Leader also reserve the right to cancel the Trip before departure for any reason, including but not limited to failure to meet minimum number of travelers.REMOVAL FROM TRIP: Executours and/or the Trip Leader reserve the right to decline or remove any person from participating in all or any part of the Trip, before departure or during the Trip, should in their sole judgment such person’s physical, mental or emotional health, behavior or general deportment create risks to health or safety, tend to impede or affect the normal operation of the Trip, or impose on the rights or comfort of other Trip members or fellow passengers. The decision to remove any person from the Trip will be at the sole discretion of the Trip Leader. All costs associated with removal will be the responsibility of the person/persons removed. No refunds will be provided for persons removed from any part of the Trip.

DISCLAIMER/RELEASE OF LIABILITY: Executours and the Trip Leader, and their affiliates, officers, employees, and designees (i) are only agents for airlines, cruise lines, hotels, and ground/tour contractors and providers, including the ground tour operator, airline(s) and local air carrier(s) (airlines and flights are subject to change); (ii) are not liable or responsible for personal injury or damages of any kind in connection with the service of any airplane, vessel, train, automobile, coach, bus, carriage or other conveyance, hotel, restaurant, or food/beverage provider that is used in carrying out the Trip or provides goods, services, beverages, or meals; (iii) are not liable or responsible for any breach of contract or other acts or omissions on the part of such suppliers or for any acts, omissions, misconduct or negligence by other Trip members or third parties; and (iv) are not liable or responsible for any delay, accident, illness injury, damage, sickness, loss of personal property, or other injury or claim of any kind related to or arising from strikes, armed conflicts, social or labor unrest or strikes/work stoppages, war or acts of war, terrorism or terrorist acts, acts of God, mechanical or construction failures or difficulties, diseases, local laws or acts of local or government authorities, criminal acts, weather or climatic conditions, volcanic eruptions, earthquakes, disruption of advertised schedules, refusal of visas, or any other causes beyond their direct control. Austrian Airlines and Lufhansa Airlines is expected to be the air carrier and and Imagine Travel and Tours is arranging and/ or providing ground services.

The operation of vehicles/vessels/aircraft used in the Trip is the sole responsibility of the companies and individuals engaged in conveying passengers; those companies or individuals are governed by laws of the country of operation or registration and claims for any accident or injury must be filed in that country.

Conditions may require Trip changes and the right is reserved to make such changes as deemed advisable in the Trip Leader's sole judgment. Trip members voluntarily assume full responsibility for all risks of travel and of participating in the Trip; have been advised to obtain appropriate travel insurance or other insurance; and hereby release Executours from any duty of checking or verifying any and all passport, visa, vaccination or entry requirements and all safety or security conditions of any Trip destination or the Trip itinerary.

Participating in the Trip (i) constitutes acceptance by the Trip participant of all above noted terms and conditions and risks and (ii) releases Executours, the Trip Leader and their affiliates, officers, employees, and designees from any and all known and unknown claims and liabilities, including claims based on their own negligence.

SELLER OF TRAVEL DISCLOSURES/POLICY ON CANCELLATION FEES AND REFUNDS:

Cancellations must be received in writing by Executours. Cancellation fees/penalties and refunds are per person and as specified.Travel insurance payments are non-refundable.

To be effective, cancellations must be received in writing by Executours on or before the dates(s) specified. If the Trip member cancels the Trip in compliance with this policy and is not at fault, then sums paid to Executours for services not provided (less the partial or full deductions and fees provided for in the policy) will be promptly refunded as per the policy unless the Trip member otherwise advises Executours in writing. (This provision does not apply where Executours has remitted the payment to another seller of travel or a carrier, without obtaining a refund, or where the wholesaler or provider defaults in providing the agreed-upon transportation or service.) Any additional costs, change fees and penalties charged by airlines, ground operators or vendors for cancellations or changes are the responsibility of the traveler and will be deducted from any refund otherwise due.

Travel Consumer Restitution Fund (TCRF): This transaction is covered by the California Travel Consumer Restitution Fund (TCRF) if Executours was registered and participating in the TCRF at the time of sale and the Trip member is located in California at the time of payment. Executours currently is a registered participant in the TCRF. Eligible Trip members may file a claim with TCRF if the Trip member is owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one Trip member is the total amount paid on behalf of the Trip member to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove the claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which a TCRF claim was filed. This transaction is not covered by the California Travel Consumer Restitution Fund if the passenger is purchasing from outside California.

TRUST ACCOUNT: California law requires certain sellers of travel to have a trust account or bond. Executours has a trust account.
