the Teachers' Fetirement System, in the amounk of 1,645,100 dollars.

The reason for this is the 1961 General Assembly provided

supplementary benefits to certain teachers in retirement at that

time. Approximately 550 annuitants were affected by that 61

Legislafion. Of the orginal group, approkimatety 2500 are still

eligible for the supplementary benefiks. And, I would ask for a

Senator Knuppel, it is still acting as the hearing agency

to handle the claims against the State. This particular appropriation

is ko handle and pay immediately those claims of under a

thousand dollars and to handle the new compensation for the Victims

of Crimes Act. Uh, it was felt that even with the new

Constitution, this was still the proper form too..in one clear

place have all claims brought against the state so that we can

have the expertise necessary for khat type of action.

of kime in 1962 to get an inkegraked court, to ga: rid of things

like JP Courks, 'and all of those types of courts, and to gek one

court, and then the new Constitution, state immunity has been

abolished and the only way I can see to get rid of the Court of

Claims is to refuse to finance ik. These claims cano..can and

should be brought by Legislature, they should be brought

in the regular Circuit Court where the people gek a fair shake

like they do anywhere else. And, therefore, 1:11 have to voke

against the appropriation: because feel that the çourt of Claims by

everything that's holy. is as useless as teats on a bull.

involves the concept of full funding of the school aid formula.

This is the amount necessary to fully fund the school aid forsula

for the current year ending this June 30th. Last year we appro-

i ted $945 00û 000 for the school aid formula. It was reducedpr a , ,

by gubernatorial veto to $90û:000,000. :oen tho actual cost

fiqures were available after we had adjourned the Session, the

costs Were determined to be $912:000:000. This is the addikional

$12,000,000 to fully fund the school aid formula. Within the

next two weeks, probably, we will be seeing the full funding

appropriation bill for Ehe formula for Fiscal 175. the upconing

fiscal year. Many of us have gone on support.o.gone on record

in support of this appropriation bill and the subsequent one for

the coming fiscal year. The bill vas unanimoualy endorsed by

b0th the.school Problems Commission and the Senate Education

Committee and I would urge favorable support of it.

between the lllinois Constitution and having sat on the Legis-lative Commiktee and llstened to the debakes, and with the knov-

ledge that the convention did noE feel that the General Assembly

would effectively chanqe any of the rrocedures, so in...which

it was so entrenched that they left tàe public this opportunity.

I feel to pass such a resolution at this tine would be inappro-

priate of usp it would be an attenpt by us to protect something

we believe in? after the people bad spoken by puto..having it'

put on the ballot. I think it would ereate a11 kinds of legal

pkoblems. I don't think it would be effeckive, I think it)

would be nugatory because because I don't see how the General

Assembly can limit the effective date or place effective dates

on conskikutional Amendments. And, I think khat..othat absent

a legat opinion, and we could get such legal opinion and we could

have our staffs work on this as a thing with the usual route. At

this late date, I think itls an attempt by some .member of the

House by introducing this bill, or members of tùe House, to

protact themselves. To prokect themselves against the very

things that the people in the Constitutional Convention felt

khat the people ouqht to have an opportunity to speak on. We

wouldn't have any effective answer to this, maybe for years. I

think we let the thing..oif they get the signatures and they're

I think the Legislature shouid not be involvod in reapportion-

ment because it is a time consuming and demanding procedûre and

that ought to be deferred until 1980. And, further think that,

even if you disagree with that, the people ought to be given an

opportunity to vote on khat question, on whether they wish ko

have the redistricting single member districks, if thak does get

on the ballot, have that go into effect immediately or after

1980. so, for both of those reasons, I think it's a good

ing. question as to whether or not, ue, by a legislative oriqin-

a'ted Conskitutional Amendment: can frustrate a Constitutional

Aiendment that comes from khe initiative article. I think, first:

o'f all, letlso..let's kind of look add see what would be before:

the voters if b0th of them got on khis Pall. If the public ini-

kiated referendum for reductian of size, got on the ballot this

'all, some people might be attracted to vote favorably for that,

unless ik was pointed out to them khat its effect was that the...

reapportionment had to take place in a certain year prior to the

end of l9Q0. And, an argumenk may be raised among the people,

yes, wedre for reduction in size, but we don't want to disrupt

existing legislative...legislative districts. And, therefore,

many people who might be for reduckion of size would vote no on

the proposition because they%re siek and tired of not knowing who

is their Senator? the 'identities of their three legislators in

it could be a reasonable construction by the courts construing the

action of the voters in the event this situation happens. In the

event, the reduction of size amendment, the people initiative

amendment dkd pass, and the same voters at the same election Sayz

yes, it passed, but we don't wank it to take effect mntil after

1980, it would strike me that the public had spoken on the question.

Yes, we vant reduction of size but we do not want to disrupt the

legislative districts part way through the decennâal period. So,

I think thak, perhaps, is an answer that comes to me on the

question that Senator Knuppel prepondered to Senator Glass. Insofar

as the amendment itself is eoncerned, I'm inclined to think that

the people backing the people, or the public initiative amendment,

uld welcome this type of amendment because it would attractwo

voters to their proposition for the reasons heretofore stated.

Second practical reason is, I think wé owe it to the voteào to

put this before them because of the disruption that has taken

place in district lines: continuously since Baker vs. Carr and

Reynolds vs. Sims in 1964. That's enough, I think to explain

my position but I would urge a favorable vote on taking this

from the Execukive Comnittee.

the immediake consideration of this resolution. Miss Peotrauski

as the resolution had poinked out, wa3 a lady who was very com-

passionate and who had worked for many, many years with Social

Welfare and to help people. She was a greak leader in fighting

for the many causes, including better housing, health, and job(

o/portunities in recreation. The people of her wardp the peopleo'f her district, the people of Cook dounty and the State of Illinois,:J 'who she servéd her entire life- -and dedicaked her entire life for,2

will sorely niss her. She's been a woman who continually, day in

and day out, felt a real need to help paople, a real need to work

for people, and she dedicaked, as I've said befgrc, her lifa in

this cause. Ifm sure that the Lord Almight upstairs for Lil has

opened the Gates so that she can help a litkle bit up there and

that He will take His arms and grap His arms around her So that

she can spend eternity with Him.
