In the event of a loss, REP will cover the replacement or repair of the damaged equipment. Account customers may opt out of this program if proof of insurance is provided. RENTAL TERMS AND CONDITIONS

RENTAL TERMS AND CONDITIONS: (see rental agreement for complete terms and conditions)

Lessee agrees to return machine clean and in good condition, less normal wear and tear with a full tank of fuel. If machine is returned dirty or low of fuel, cleaning and fuel servicing charges will apply.

Standard rental rates based on single shift at 176 hours a month, 40 hours a week and 8 hours a day. Additional hours accumulated will be billed accordingly. Rates do not include sales tax, insurance or freight.

OVERTIME RATES

Daily Rental – Rate divided by 8.Weekly Rental – Rate divided by 40.4-Week Rental – Rate divided by 176.

RENTER’S RESPONSIBILITIES:• Normal maintenance and service of machine, including changing all lubricants and fluids at

required intervals. Wheeler Machinery Co. offers on-site lube and oil service at an additional cost.

• Replacing teeth and cutting edges as needed

• All wear or damages to rubber tires

• Maintaining physical damage insurance coverage on rental machines, or accepting the terms and conditions of Wheeler Machinery Co.’s Rental Equipment Protection (REP) and paying a charge of 16 percent of the gross rental charges. Wheeler Machinery Co.’s REP is not available for trucks licensed for use on public highways. The customer must maintain auto liability and physical damage coverage for on-highway vehicles rented from Wheeler Machinery Co.

CUSTOMER INSURANCE REQUIREMENTS: (for Rented/Leased Equipment) All customers are required to have general liability insurance and Rental Equipment Protection as outlined below:

ON-HIGHWAY CONSTRUCTION EQUIPMENT (Licensed for use on public highways)1. Business auto liability insurance: $1,000,000 per occurrence.2. Auto physical damage insurance: Full value of trucks: • Specify trucks rented or leased from Wheeler Machinery Co. • Include coverage for hired and non-owned autos • Name Wheeler Machinery Co. as an additional insured and loss payee

OFF-HIGHWAY CONSTRUCTION EQUIPMENT1. Commercial general liability insurance: $1,000,000 per occurrence, covering: • Customer’s operations • Wheeler Machinery Co. as an additional insured2. Physical Damage Insurance: Full value of equipment, covering: • Rented or leased equipment using a contractor’s equipment floater form or comparable form • Name Wheeler Machinery Co. as loss payee • The Physical Damage Insurance requirement shall not apply if customer participates in and pays for Wheeler Machinery Co.’s Rental Equipment Protection

EVIDENCE OF INSURANCE1. Customer must provide Wheeler Machinery Co. with a certificate of insurance confirming: • Appropriate coverage is in full force and effect • Such insurance may not be canceled or materially modified except by first giving Wheeler Machinery Co. 30 days prior written notice2.
