AN ORDINANCE FORMULATING THE TAGBILARAN CITY HERITAGE CONSERVATION GUIDELINES AND CREATING THE TAGBILARAN CITY HERITAGE DISTRICT

SECTION 1 TITLE This ordinance shall be known as the TAGBILARAN CITY HERITAGE CONSERVATION ORDINANCE SECTION 2 SCOPE This ordinance shall apply to the preservation and conservation of heritage houses, institutions, monuments, and other historical and heritage assets in the designated TAGBILARAN CITY HERITAGE DISTRICT and other individual heritage structures and edifices within the territorial jurisdiction of Tagbilaran City, Bohol, Philippines. Tagbilaran City Heritage Conservation Ordinance involves heritage conservation policies and guidelines that cover:

(1) Tagbilaran City Heritage District – houses, institutional buildings, edifices and monuments within the designated heritage district, the boundaries of which are delineated in Section 6 (The Boundaries Defining the Tagbilaran City Heritage District), hereof;

(2) Tagbilaran Heritage District Core – which is a sub-set of the Tagbilaran City Heritage District, dubbed SITIO UBOS, as the “heart of the heritage district” that is comprised of centuries-old houses from the Hispanic times and is identified by historians as the site of the early settlements with existing houses dating as far back as 18th century, referred to by most people as the “Old Tagbilaran”;

(3) Tagbilaran City Heritage Houses and Structures–individual heritage houses, structures, and institutional edifices outside the Tagbilaran City Heritage District but within the territorial jurisdiction of Tagbilaran City which have been identified as such during the cultural and architectural mapping.

SECTION 3 DECLARATION OF POLICY

I. Tagbilaran City recognizes its vital role in the history of the Province of Bohol and realizes the historical importance of its heritage structures within its jurisdiction, especially the concentrated architectural heritage clusters in Poblacion 1,2, & 3;

II. Tagbilaran City realizes the need to preserve its remaining historical structures and sites from further destruction;

III. Tagbilaran City believes that the conscious effort to protect these built structures will further enhance its potential as a City and as the heritage capital of Bohol, especially in terms of eco-cultural tourism;

IV. Tagbilaran City, in enacting the TAGBILARAN CITY HERITAGE DISTRICT, understands that such a move will increase its investments and tourism potential, being identified as an eco-cultural tourist destination and the only locality that has declared itself as a heritage conservation area;

V. Tagbilaran City also acknowledges its duty to instill among future generations of the people of Tagbilaran and the nation as a whole, the need to preserve its tangible and intangible heritage;

VI. And pursuant to the Implementing Rules and Regulations of RA 9593, otherwise known as, The Tourism Act of 2009, Tagbilaran City encourages activities and programs which promote tourism awareness, preserve the country’s diverse cultures and heritage, and instill the sense of history and a culture of tourism among the youth and the populace through the provision of full government assistance by way of competitive investment incentives, long-term development fund and other financing schemes extended to tourism-related investments.

SECTION 4 DEFINITION OF TERMS and ACRONYMS

1. HERITAGE– denoting or relating to things of special architectural, historical, cultural or natural value that are preserved for the nation;

2. CONSERVATION – refers to all the processes and measures of maintaining the cultural significance of a cultural property including, but not limited to, preservation, restoration, reconstruction, protection, adaptation or any combination thereof. It allows for the introduction of preservative agents even replacement materials to ensure an artifact’s sustainability;

3. PRESERVATION – maintain (something) in its original or existing state. It means an artifact is safe from further deterioration but with minimal intervention to it.

4. ADAPTIVE REUSE - shall refer to the utilization of buildings, other built-structures, and sites of value, for purposes other than that for which they were intended originally, in order to conserve the site, their architectural and engineering integrity and authenticity of design;

5. BUILT HERITAGE - shall refer to architectural and engineering structures, such as but not limited to bridges, government buildings, houses of ancestry, traditional dwellings, quartels, train stations, lighthouses,small ports, educational, technological and industrial

complexes, and their settings, and landscapes with notable historical and cultural significance;

6. INTANGIBLE CULTURAL HERITAGE - shall refer to the practices, representations, expressions, knowledge and skills, as well as the instruments, objects and artifacts associated therewith, that communities, groups, and individuals recognize as part of their cultural heritage, such as: (1) oral traditions, languages and expressions; (2) performing arts; (3) social practices, rituals and festive events; (4) knowledge and practices concerning nature and the universe, and (5) traditional craftsmanship;

7. HISTORICAL FABRIC - is the evolution of accounts in history which dates back from the Malays, Chinese, Indochinese, Japanese, Mexicans, Spanish and Americans, who have influenced early settlers of Tagbilaran;

8. CULTURAL FABRIC- is the fusion of practices, arts and crafts,morals, customs, traditions and any other habits acquired by the Boholanos though the influences from different nations;

9. ARCHITECTURAL FABRIC - merging of Asian Building design and construction with European colonial architecture and planning;

10. TOWN FABRIC - historical buildings, landmarks, monuments, shrines, streets, plazas, open spaces, rivers identified of cultural significance found within;

SECTION 5 THE NATURE & PURPOSE OF THE TAGBILARAN CITY HERITAGE DISTRICT The Tagbilaran City Heritage District has the following objectives:

A. To promote the preservation and conservation of the historical and cultural heritage and resources of Tagbilaran City for the appreciation of its cultural and historical fabric.

B. To raise the awareness and level of appreciation of Filipinos and people of Tagbilaran of the history of Tagbilaran City and its significance of its own fabric in the history of the Republic of the Philippines, and the various local personages who have contributed to the history of Tagbilaran City and the Republic of the Philippines.

C. To create deep appreciation of the Architectural Fabric and the intricate House Fabric of the identified heritage buildings within Tagbilaran City especially the century-old ancestral houses in the HERITAGE CORE, SITIO UBOS;

D. To develop tourism and business along the lines of conserving the socio-cultural heritage, preserving the environment and sustaining development and in keeping with the town fabric;

E. To contribute to the enhancement of the quality of life and sense of distinction of all the inhabitants of Tagbilaran City.

The Heritage District is comprised of an area of approximately 20.75 hectares located in Barangays Poblacion 1, Poblacion 2 and Poblacion 3, specifically bounded by the following streets as illustrated in Figure 2; to wit: On the northeast by S. Matig-a Street with coordinates 9°38’16.81”N 123°51’27.92” E On the north-west by Miguel ParrasStreet with coordinates 9°38’29.74” N 123°51’34.50” E; On the south-west by F. InglesStreet and H. Grupo Street with coordinates 9°38’35.09” N 123°51’26.80” E;

Onthesouth-east by C. Gallares Street with coordinates 9°39’29.02” N 123°51’16.60” E; Onthesouth-west by J.S Torralba Street with coordinates 9°38’23.04” N 123°51’9.12” E;

On the south-east by T. ButalidDrive with coordinates 9°38’21.08” N 123°51’17.58” E;

On the south-east by Franklin Street to the point of beginning 9°38’17.65” N 123°51’18.66” E. This is an area in the city that showcases the historical, anthropological, archaeological, sartistic geographic areas and settings that are culturally significant to the country, as declared by the National Museum and/or the “National Historical Commission of the Philippines ”. The HTG-OZ is applied in areas with historic centers/heritage zones, including heritage houses 50 years and above. This can be best seen in Figure 2.

SECTION 7 CLASSIFICATION AND DECLARATION OF HISTORICAL STRUCTURES AND SITES AND OTHER EDIFICES IN TAGBILARAN CITY. The different historical structures and sites at least fifty (50) years of age, which include private residences, heritage buildings, institutions and other edifices, monuments, and bridges, shall be classified and declared by the Sangguniang Panlungsod as follows:

A. CITY HERITAGE TREASURES – those structures, edifices or places that are of natural historical and cultural significance, strongly associated with important historical events and illustrious Filipinos, or those whose owners have achieved an enduring contribution toward the enrichment of Filipino cultural heritage, where structures, edifices, and places which are declared and protected by the National Commission for Culture and the Arts, the National Historical Commission, the National Museum or any other pertinent national body, are also automatically declared as City Heritage Treasures;

B. CITY HISTORICAL SITES - those structures, edifices, or places that are of city or provincial historical and cultural significance, strongly associated with important historical events and illustrious Boholanos, or those whose owners have achieved an enduring contribution toward the enrichment of Boholanos’ cultural heritage, or properties which were the sites of first establishments in Tagbilaran City, or the Province of Bohol, such as the old port, churches and religious sites, monuments, cemeteries and memorials, etc.;

C. CITY HERITAGE EDIFICES - those structures of architectural and social significance, including those that bear long foreign architectural influences such as American or Spanish, that stand out as monument to the artistry, craftsmanship and industry of Filipino artisans and laborers who were responsible for their construction and serve as mute witnesses to the heroic spirit of the Filipinos of yesteryears.

Other structures that do not fall under the above-mentioned classification shall be classified as follows:

D. HERITAGE-INSPIRED EDIFICE - a structure or edifice that follows the architecture prevalent during the Spanish and American colonial periods, not listed as a heritage structure, but also serves as mute witnesses to the heroic spirit of the Filipinos of yesteryears;

E. NON-CONFORMING STRUCTURES - a structure that is of NO architectural, historical nor cultural significance to Tagbilaran City.

SECTION 9 TAGBILARAN CITY HERITAGE DISTRICT COUNCIL (TCHDC) The Tagbilaran City Heritage District Council, hereinafter referred to as TCHDC, is hereby created as the governing body of the Tagbilaran City Heritage District with the following powers and functions :

A. To assist in the implementation of Republic Act No. 10066, otherwise known as the “ NATIONAL CULTURAL HERITAGE ACT of 2009 “ and other National and Local Laws relative to Heritage Preservation and;

B. To formulate, recommend, evaluate and approve developmental plans, policies, and programs relative to the protection, conservation and/or promotion of the heritage structures in the HERITAGE DISTRICT especially the ones in the HERITAGE CORE of Tagbilaran City;

C. To manage the TAGBILARAN CITY HERITAGE CONSERVATION FUND and ensure proper usage of such on worthwhile projects, programs and activities pertaining to heritage conservation and promotion.

D. To serve as an advisory council to the Sangguniang Panlungsod on Heritage conservation matters;

E. To assist the TWG composed of building official/city engineer in the implementation of laws, ordinances, and policies relative to the protection of the heritage houses and other historic structures with the HERITAGE DISTRICT and the other declared heritage houses within Tagbilaran City;

F. To exercise all powers necessary or incidental to conservation objectives including power to review, recommend the approval or disapproval of construction projects within the Heritage District and within the jurisdiction of the scope of this ordinance;

G. To serve as a clearing house for ALL applications of Building Permit within the HERITAGE DISTRICT;

H. To serve as a clearing house for ALL applications for the repair, renovation, addition, and maintenance of the heritage structures within the HERITAGE DISTRICT and the other individually declared heritage edifices in other parts of Tagbilaran City;

I. To issue the “ TCHDC Clearance” prior to the issuance of the “Certificate of Occupancy” by the Building Official;

J. To initiate, plan, undertake and supervise the restoration, upkeep and maintenance of public places or areas, streets, and other local government properties in the Tagbilaran City Heritage District;

K. To adopt, issue, promulgate and implement regulations pertaining to building height, dimensions, architectural style and designs, commercial signages, and other specifications of the building construction to be undertaken in the area based on the recommendation of its TWG

L. To recommend traffic, street usage, and other related matters in the area; M. To serve as an advisory council to the Sangguniang Panlungsod on conservation and

preservation matters within Tagbilaran City; N. To monitor the conservation, upkeep and maintenance of historical buildings, public areas, open

spaces & streets found within the Heritage District and recommend appropriate actions to be taken thereof;

O. Other functions as may be provided by law. SECTION 10 AUTHORITY TO MAKE TECHNICAL GUIDELINES, IMPLEMENTING RULES AND REGULATIONS Authority is hereby given to the Tagbilaran City Heritage District Council (TCHDC) and its TWG to formulate technical guidelines, implementing rules and regulations in accordance with this ordinance. SECTION 11 – COMPOSITION OF THE TAGBILARAN CITY HERITAGE DISTRICT COUNCIL (TCHDC) The TCHDC shall be composed of the following: A. Chairman must be a government official/SP Chairman on Tourism B. Vice-chair person from the association of architects; C. City Administrator, as member; D. City Planning and Development Coordinator, as member; E. City Treasurer, as member; F. City Legal Officer, as member; G. City Engineer, as member; H. City Tourism Officer, as member; I. City Environment and Natural Resources Office, as member; J. United Architects of the Philippines (Bohol Chapter), as member; representative K. Chairman of the Bohol Provincial Tourism Council, as member; L. Office of the Building Official, as member; M. Academe, as member; DEPED & 3 Universities (bisu, hnu, ub) N. Chairman of the Tagbilaran City Council for Culture and Arts, as member; O. 2 Individuals/Heritage advocates or representative for the heritage sites association. P. SP Chair on public information and public works SECTION 12 FUNCTIONS OF THE TECHNICAL WORKING GROUP (TWG)

1. To formulate technical guidelines on heritage conservation for approval by the TCHDC. 2. To implement the Conservation Guidelines and to propose amendments for the consideration of

the Sangguniang Panlungsod. 3. To review and endorse for approval to the tagbilaran city council all architectural plans for the

construction, and/or restoration of all structures within the HERITAGE DISTRICT and the individually declared Heritage structures outside the Heritage District but within the jurisdiction of Tagbilaran City.

4. To submit its findings and recommendations to the TCHDC prior to the issuance of the “ TCHDC Certificate of Favorable Recommendation“.

5. To conduct regular inspection within the Heritage District to ensure compliance and observance of the ordinance;

6. To perform such functions as may be assigned by the TCHDC. SECTION 13 THE TCHDC’s TECHNICAL WORKING GROUP ( T W G ) The Technical Working Group of the Tagbilaran City Heritage District Council shall be composed of the ff:

1. Head/OIC, Office of the Building Official - Team Leader 2. City Tourism Officer - Head of Secretariat 3. Architect from UAP-Bohol/with Heritage background - Member 4. Architect/Expert on Heritage Conservation - Member 5. City Assessor - Member 6. City Zoning Officer - Member 7. Architect from the CEO - Member 8. Holy Name University - Member 9. University of Bohol - Member 10. Bohol Island State University - Member 11. BPLO - Member

SECTION 14 TCHDC’s CERTIFICATE OF FAVORABLE RECOMMENDATION

A. The exteriors of structures in the Heritage District must follow the architecture prevalent during the Spanish and American colonial periods as provided for in the IRR;

B. Existing non-conforming structures in the Heritage District will be requested but not be compelled to renovate their exteriors.

C. Existing Non-conforming Structures in the Heritage District will, however, be compelled to follow the architecture prevalent during the Spanish and American colonial periods when they apply for a permit for construction, addition, repair, or renovation for house exteriors.

D. No permit for construction, addition, repair, or renovation within the Heritage District shall be issued until the TCHRC recommends the approval of the design of the exterior of the structure, and no structure of at least fifty (50) years old based on the history of the building for tax declaration within the Heritage District shall be granted a permit for demolition without the approval of the TCHDC.

E. No structure shall be erected, restored, reconstructed, repaired, adapted for re-use, moved or dismantled within the heritage district without first obtaining a Certificate of Favorable Recommendation from the TCHDC.

F. No structure inside the Heritage District, classified as A, B or C in Section 7 of this ordinance, shall be granted a permit for construction, addition, renovation or demolition without the Certificate of Favorable Recommendation of the TCHDC.

G. No structure outside the Heritage District that has been identified in the registry or included in the listing of Heritage Structures in this ordinance under A, B, or C in Section 7 shall be granted a permit for construction, addition, renovation or demolition without the certificate of favorable recommendation of the TCHDC.

SECTION 15 INCENTIVES

1. A REAL PROPERTY TAXrelief for one (1) year for structures classified as A, B, C and D in Section 7 of this ordinance, as a form of incentive for the preservation of the various historical structures withinTagbilaranCity.(not applicable as per sir livio/to be checked with finance Committee)

2. Should the homeowner opt to use the structure classified under A, B, C and D for tourism-

related businesses as ADAPTIVE RE-USE of the place, a business tax incentive of (___ % TBD in the future) for 1 year shall apply with restrictions.(percentage to be based on tax code)

3. The incentives shall take effect upon the approval of this ordinance and shall only be granted to

property owners without any tax liability or delinquency with the City Government.

4. Those HERITAGE STRUCTURES and SITES listed in Section 8 hereof, shall be exempted from the setback ordinance if they apply for renovation, addition, or repair as long as they comply with the recommendation of the TCHDC and their original building remains.(ask engineering/OBO) leave for SP Discussion (Section 8 need to be verified)

SECTION 16 TAGBILARAN CONSERVATION HERITAGE FUND A TAGBILARAN CONSERVATION HERITAGE FUND in the amount of One Million Pesos (P1,000,000.00) shall be included in the annual budget of the City Government and shall be allocated for projects, programs and activities pertaining to the heritage conservation and promotion. SECTION 17 HONORARIUM Members of the TCHDC and its Technical Working Group who are not employees of the City Government are hereby entitled to receive honoraria as may be determined by the Local Chief Executive. SECTION 18 REPEALING CLAUSE All Local Executive Orders, Ordinance, Policies, and Regulations found inconsistent with this are hereby repealed or modified accordingly.

SECTION 19 EFFECTIVITY CLAUSE This ordinance shall take effect ten (10) days, after publication in 2 newspapers of general circulation in Bohol and of posting the same in bulletin boards at the City Hall, and in at least two (2) conspicuous places in Tagbilaran City. ENACTED on ___________ , 2017
