REQUEST FOR PROPOSAL ERIE COUNTY SEWER DISTRICT NO. 3
FLOW MONITORING – I/I QUANTIFICATION REPORT
REQUESTS FOR CLARIFICATION
The following are the Division of Sewerage Management (DSM) response to each of the questions received.
(1. a) Who will be responsible for providing the installation, monitoring and downloading of the flow monitor data?
The Consultant will be the responsible party to provide, install, monitor and download the data. It is the consultant’s choice to perform the work by in-house staff or contract with a sub-consultant.
(1. b) Are you expecting the chosen consultant will provide that service or will the county?
The chosen consultant will perform the work as shown in (1. a), above. (1. c) If the county will perform these services, in what format will the data be presented to the consultant? The County will not be performing these services. (2. a) What is the expected window for the six (6) month monitoring period? At each identified flow monitoring node, a flow meter will be installed for a minimum of six (6) months with the intention of starting in time to capture peak flows during spring 2016. (2. b) Can we assume that will be sufficient for providing both wet and dry weather? Yes, the assumption to collect the wet and dry weather data in 6 months is good. However, the duration maybe extended by a change order, if needed. (3.) If the candidate selected would recommend rain gauges be installed at all 20 locations; again, who would be responsible for installing, monitoring and downloading the information and in what format would it be presented? The scope calls for rain gauges to be installed at key locations. The number of gauges should be proposed by the consultant. The consultant will be the responsible party to install, monitor, and download the data from all gauges installed.
(4. a) Should personnel man hours for flow monitoring be include in the “Provide a Draft Report to ECDSM” on the Manhour Summary Sheet (Exhibit C)? Yes, if the task to be performed in house staff. No, if a sub-consultant is utilized. (4. b) Similarly, should costs for flow monitoring be included in the “Provide a Draft Report to ECDSM” item on the Detailed Description of Compensation form (Exhibit D, Schedule D) Yes, and that should also be reflective of hours shown in Exhibit “C”. (5.) Is more detailed collection system mapping available for review, including maps depicting the contributing areas of the 31 mini-systems, pipe sizes, etc…? Yes, a PDF file depicting a more detailed map has been uploaded on the County web site www.erie.gov, under the request for proposal tab. (6) Given the M/WBE goal of 30% is there a reason why the “MBE/WBE Firm/Subcontractors” category is designated to have “NNR” (no numerical rating) in the Quantifications Review Rating Sheet (Exhibit B)? The 30% M/WBE is a State requirement for the grant. Therefore, the NNR was allocated as such, expecting all proposers will meet requirement. (7) Can ECDEP provide a copy of the grant document for the CFA grant that was obtained for this project? Yes, the PDF file has been uploaded to the County’s website www.erie.gov. The file can be found under Requests for Proposal tab. (8) Are higher quality resolution maps of the District 3 Flow Monitoring Meter Locations Maps 1 and 2 (pages A-3 and A-4) available electronically? Please see answer for question No. 5 above. END OF CLARIFICATION
2015 New York State DEC/EFC Wastewater Infrastructure Engineering Planning Grant Program - Overview Description The New York State Department of Environmental Conservation (DEC), in conjunction with the New York State Environmental Facilities Corporation (EFC), will offer grants to municipalities to help pay for the initial planning of eligible Clean Water State Revolving Fund (CWSRF) water quality projects. Up to $2 million has been made available for this program. The Wastewater Infrastructure Engineering Planning Grant will assist municipalities with a Median Household Income (MHI) of $65,000 or less with the engineering and planning costs of CWSRF-eligible water quality projects. Grants of up to $100,000 1 (with a 20% required local match) will be provided to finance activities including engineering and/or consultant fees for engineering and planning services for the production of an engineering report. The ultimate goal of this wastewater infrastructure engineering planning grant program is to advance water quality projects to construction for needy communities. Successful applicants can use the engineering report funded by the grant to seek financing through the CWSRF program or other funding entities to further pursue the identified solution. 2BEligible Types of Applicants
• Municipalities as defined in 21 NYCRR 2602 New York State Clean Water Revolving Fund Regulations; and
• Median household income (MHI) of the municipality is equal to or less than $65,000 according to the United States Census 2010, American Community Survey, http://factfinder2.census.gov/faces/nav/jsf/pages/index.xhtml. A summary of the 2010 MHI census data can also be found on the EFC EPG website, http://www.efc.ny.gov/Default.aspx?tabid=485.
Eligible Activities Funding can be used by municipalities for the preparation of an engineering report2 and planning activities to determine the scope of water quality issues, evaluate alternatives, and propose a capital improvement project. In addition, the costs to conduct an environmental review for the recommended alternative in the report are eligible. Priority will be given to municipalities proposing planning projects that are:
• required by an executed Order on Consent; • required by a State Pollutant Discharge Elimination System (SPDES) permit; • upgrading or replacing an existing wastewater system; • constructing a wastewater treatment and/or collection system for an unsewered area; or • identified in a Total Maximum Daily Load (TMDL).

Smart Growth alternative(s) and green infrastructure alternative(s) must be considered and documented in the engineering report. In accordance with the laws, rules and regulations governing the CWSRF, projects defined in the federal Clean Water Act, Section 212 as treatment works must be publicly-owned. The following minimum alternatives need to be considered for projects with no existing wastewater infrastructure:
o decentralized systems; o new sewers and connection to regional wastewater treatment facility; and o new sewers and a wastewater treatment facility.
The following minimum alternatives need to be considered for projects with existing wastewater infrastructure:
o rebuilding existing wastewater infrastructure; and o connecting to regional wastewater treatment facility.
Ineligible Activities
• Projects that do not lead to the restoration or protection of a surface waterbody. • Projects that do not address improvements to a publicly-owned treatment works.3 • Projects and scope listed on the 2015 CWSRF Intended Use Plan Annual Project Priority List. • Design and construction costs for any projects.
Grant Award Details Option 1 - $30,000 Grant

o Type of Planning Project: any wastewater infrastructure-related. o Local Match: calculated based on 20 percent of the total project costs. o Example of Project Costs, Grant Award and Local Match Amounts.
Total Project Costs: $37,500 Grant Award: $30,000 (80% of total project costs) Local Match: $ 7,500 (20% of total project costs)

Option 3 - $100,000 grant
o Population of Municipality: no limit o Type of Planning Project: Only for wastewater infrastructure inflow and infiltration
issues as a result of an Order on Consent or SPDES Permit Compliance Schedule. o Local Match: 20 percent of the total project costs. o Example of Project Costs, Grant Award and Local Match Amounts:
Total Project Costs: $125,000 Grant Award: $100,000 (80% of total project costs) Local Match: $25,000 (20% of total project costs)
Match All grants require a local match equal to 20% of the total project costs. The match can include cash and/or in-kind services4. Other grants may not be used for local match. The applicant should identify the source of the match at the time that the application is submitted. The grant will provide up to 80% of the total eligible project costs. Grant Payment The grant will be disbursed in two payments. The municipality will be eligible to receive half the award amount, as an advance payment once the grant agreement is executed. The remainder of the grant award will be paid when the municipality’s engineering report has been completed and accepted by DEC and EFC. Project Term Completion Dates Grant recipients must submit a complete engineering report within 9 months of their grant agreement being executed. Long Range Program Goals The state encourages grant recipients to use the engineering report completed under this grant to seek financing through the CWSRF program or from other funding entities to further pursue the recommended solution.

Selection Criteria Projects will be scored and selected based on the following criteria.

Agency Priority 4 points Alignment with DEC and EFC priorities Multiple Application Submissions Only one project per municipality may be awarded in this Round. If an applicant is submitting multiple applications for their municipality, they are asked to prioritize their applications. Successful Applicant Requirements Documentation: Recipients must provide documentation of the following requirements before entering into a grant agreement for the planning project.
• Legal right to own, operate and maintain the project for the duration of its useful life. • Compliance with the New York State Smart Growth Infrastructure Policy Act of 2010. • Compliance with the New York State’s Minority/Woman-owned Business Enterprises (M/WBE)

• Designation of an Authorized Representative for the project. • Executed Engineering Agreement that includes Minority and Women Owned Business
Enterprises (MWBE) contract language provided by EFC. An MWBE Work Plan and approved Utilization Plan will be required if the Engineering Agreement exceeds $25,000.
• A local resolution declaring State Environmental Quality Review Act (SEQR) findings or determinations for the planning activities associated with the grant.
• Acknowledgement of project review by the New York State Office of Parks and Historic Preservation’s State Historic Preservation Office (SHPO). EFC expects to obtain this on behalf of the recipients.

Key Definitions Engineering Report - means the document or documents, which determines the technical and economic feasibility of a CWSRF eligible project. [Reference: 21 NYCRR 2602.2(a)(22) New York State Clean Water Revolving Fund Regulations] Please refer to Appendix G of the 2015 CWSRF Intended Use Plan or the EFC EPG website (http://www.efc.ny.gov/Default.aspx?tabid=485) for a detailed template of the required engineering report components. The template outline is included below. In particular, the report must recommend a capital improvement project and consider both Smart Growth alternative(s) and green infrastructure alternative(s). Reports must be submitted both electronically and in hardcopy. Required Engineering Report Components: 1. Problem Defined – Description of the existing system, condition and problems needing correction. 2. Flow and Organic Load – The existing, design average and peak flows and waste load. 3. Impact On Existing Wastewater Facilities – Include location map, history, financial status, waste,
energy or water audits. 4. Project Description – A written description of the project and the need for the project. 5. Drawing/ Site Plan –Drawings of the project site and anticipated location of proposed facilities. 6. Site Information – Include topography, soils, geologic conditions, depth to bedrock, groundwater
level, floodway or floodplain considerations. 7. Engineering Criteria – Engineering criteria to be used in design of the project shall be included.

Alternatives Considered and Alternative Selection – Alternatives that comply with NYS’ Smart Growth Act and include green infrastructure, water efficiency, and energy efficiency attributes need to be considered. 11. Conclusion and Recommendations
In-Kind Services - means services performed by capable and qualified employees of the grant recipient for technical and administrative force account that are directly related to and in support of the development of the Engineering Report and are deemed reasonable by the Environmental Facilities Corporation. Municipality - means any county, city, town, village, district corporation, county or town improvement district, Indian reservation wholly within New York State, any public benefit corporation or public authority established pursuant to the laws of New York or any agency of New York State which is empowered to construct and operate a project, or any two or more of the foregoing which are acting jointly in connection with a project. Planning - means the orderly development of a project concept from the original statement of need or purpose through the evaluation of alternatives to a final recommendation on a course of action and measures to implement the selected alternative, including completion of the environmental review process. [Reference: 21 NYCRR 2602.2(a)(51) New York State Clean Water Revolving Fund Regulations] Treatment Works (Publicly-Owned) – means eligible activities identified in section 2.1.1.1 of the Clean Water State Revolving Fund Final Intended Use Plan (IUP) for Federal Fiscal Year 2015.

Prepare an Engineering Report for the flow monitoring of the Erie County Sewer District No. 3(ECSD #3) mini systems. The Report will summarize the findings of the flow monitoring insuch manor that Infiltration/Inflow (I/I) will be quantified for each mini system. Based on theflow monitoring findings in the mini systems, rehabilitation projects will be prioritized. Furtheridentification of sanitary sewer replacement and rhabilitation needs will be performed underseparate project. Precise locations of deteriorations will be identified to produce necessaryconstruction documents. The outcome of this effort will prolong the integrity of the sanitarysewer pipes and reduce or eliminate I/I in the system.

The ECSD #3 includes in its annual operating budget a line item for I/I identification, designand remedial work.
