QUALIFICATIONS DUE DATE AND TIME: Monday, November 8, 2021, 3:00 pm (CST)
Sealed qualification packets shall contain four (4) hard copies and one (1) PDF file format on a
USB flash drive. The maximum number of pages may not exceed 30 PDF pages excluding this
RFQ, required City forms, the sample contract and any addendum response documents. All
electronic materials shall be submitted in searchable Adobe PDF format including the required
City forms. Proposals should clearly mark the firm’s name and indicate “Library in the Park –
CMAR/ RFQ‐2022‐100‐01” on the packet submission. All submissions must be received by the
City of Cedar Hill on or before 3:00 pm, CST, Monday, November 8, 2021, addressed and
delivered to Greg Pervis, Purchasing Coordinator, Cedar Hill Government Center, 285 Uptown
Blvd., Cedar Hill, Texas 75104.
The City will not provide compensation or defray any costs incurred by any firm related to the
response to this request. The City reserves the right to negotiate with any and all persons or firms. The
City also reserves the right to reject any or all Statements of Proposal (SOP) with or without cause; to
accept any SOP deemed, in the City’s sole discretion, to be most advantageous to the City; or to waive
any irregularities or informalities in any SOP received; and to revise the process schedule as
circumstances arise.

Section 1 – Introduction and Overview The City of Cedar Hill, Texas (“City”) is accepting qualifications for a Construction Manager at Risk
(CMAR) to provide preconstruction and construction services for its Library in the Park Project. The City
is seeking a Construction Manager at Risk in a two‐step process as outlined in Texas Government Code
“Chapter 2269 ‐ Contracting and Delivery Procedures for Construction Projects”. The CMAR will perform
pre‐construction and construction services working with the City staff, City Firms and the Design Team.
Sealed qualification packets from CMARs consisting of four (4) hard copies and one (1) PDF file format
on a USB flash drive, addressed to Greg Pervis, Purchasing Coordinator will be received at the 285
Uptown Blvd, City of Cedar Hill Texas until 3 p.m. CST on November 8th, 2021. Late submittals shall not
be accepted. All packages to be marked with the firm’s name and RFQ # 2022‐100‐01
Firms intending on serving as contractors, subcontractors, sub‐subcontractors, vendors, or material
suppliers should not submit qualifications in response to this request. The scope of services provided by
the selected CMAR candidate will include, without limitation, assistance to the City and the Design Team
during the process of preconstruction, construction, and the warranty period. Specific tasks to be
performed by the selected CMAR will be more clearly identified in the negotiation process.
The City reserves the right to reject all qualifications and re‐solicit for new qualifications, or to reject all
proposals and temporarily or permanently abandon the project. The City makes no representations,
written or oral, that it will enter into any form of agreement with any respondent to this RFQ for any
project and no such representation is intended or should be construed by the issuance of this RFQ. By
submitting qualifications in response to this RFQ, the respondent accepts the evaluation process and
acknowledges and accepts that determination of the “most qualified” firm(s) will require subjective
judgments by the City. Respondents acknowledge and accept that any costs incurred from the
respondent’s participation in this RFQ process shall be at the sole risk and responsibility of the
respondent. Respondents submit qualifications and proposals at their own risk and expense.
Project Information
The Library in the Park project will include:
The 42,000 Sf Library facility Site work required including landscaping, signage, fencing and lighting Site utilities including water, sanitary, storm sewer and detention, electrical, gas and
telecommunications
Driveways, sidewalks, and parking lots The Large Heart of the Park including a Great Lawn, Grand Promenade through Heart
of the Park and up to Library Social Café, Amphitheatre, and Children’s play spaces
Cedar Hill Road parking lot 1.2 miles of linear trail connecting Pleasant Run to Pioneer trail; Library project to
Uptown Blvd

Section 2 – Scope of Work
Preconstruction Services: The CMAR will work with the Design Team and the City during the design
process to ensure the feasibility and constructability of the building. The CMAR will also be responsible
for cost estimates during design development and construction document phases of the project. The
CMAR will work with the Design Team and City to ensure that the cost of construction of the Project is
within the estimated Construction Budget through the selection of construction systems and materials,
detailed CSI format cost estimating, scheduling, and other means.

The CMAR will also review the project schedule and identify critical path and long lead items. Upon the
completion of the design development phase and prior to the completion of the 100% set of
construction documents, the CMAR will submit a proposal of a Guaranteed Maximum Price (GMP) for
the construction of the Project, which is within the City’s Construction Budget.
Bidding Services: Should the City exercise its option, the CMAR will serve as General Contractor to
complete all work for the bidding and construction of the project. The CMAR will be responsible for
coordination of all bids, advertisement, and solicitation, bid procurement, selection of sub‐Firms or
trade contractors as outlined in Texas Government Code Chapter 2269. CMAR will also be responsible
for issuance of pre‐purchase orders for long lead items, if required.
Construction Services: Should the City exercise its option, the CMAR will serve as General Contractor
to complete all work for the construction of the Project. The scope of Construction services will be
determined based on the final Drawings and Specifications but may include, but not be limited to, one
or more of the following areas of work: site clearing, excavation, fill, select fill and backfill; site utilities;
concrete sidewalks, paving and roadway / parking lot work, rough and finish grading, topsoil and grass
planting; fencing and gates, site lighting, retaining wall construction, landscape installation, irrigation,
concrete piers, concrete slab‐on‐grade, concrete masonry (CMU) interior walls, cast stone lintels,
limestone and plaster exterior veneer, concrete floor topping, masonry, structural steel frame (columns
and joists), metal roof deck, metal wall and roof panels, miscellaneous metals and metal fabrications;
rough and finish carpentry, millwork and casework; damp proofing and waterproofing, caulking and
sealants, thermal insulation, flashing and sheet metal, metal soffit panels, metal roofing, modified
bitumen roofing; other roofing, wood doors, metal doors and frames, aluminum doors and frames, glass
and glazing, finish architectural hardware, acoustical ceilings, resilient flooring and base, carpeting, tile
or wood flooring, metal studs and support systems, gypsum drywall, painting and special floor coatings,
interior and exterior signage; reinforced extreme weather structural walls and windows; reinforced
ballistic walls and windows; metal louvers and miscellaneous specialties; furnishings and appliances;
equipment and specialty equipment; sound enhancement systems; fire protection; lightning protection;
telecommunications, audio / visual and security systems and mechanical, plumbing and electrical
systems, and any other requirements set out in the Contract Documents.
Section 3 – Questions Any questions shall be submitted prior to the question deadline in writing and addressed to Greg Pervis
via email only at [email protected]. No oral question or inquiry about this RFQ shall be
accepted. The City reserves the right to provide questions and answers to all prospective respondents in
the form of an addendum to the RFQ. All addendums will be posted to the City’s website at
cedarhilltx.com/purchasing. Firms shall not attempt to contact City Council members, City staff or
Management directly during the pre‐proposal or post‐proposal period.

Section 4 – Proposal Submission Requirements There is no actual, express, or implied obligation for the City to reimburse responding Firms for any costs
or expenses incurred in preparing proposals in response to this Request for Proposal, and the City will
not reimburse responding Firms for these costs or expenses, nor will the City pay any subsequent costs
associated with the provision of any additional information or presentations, or to procure a contract for
these services. The City is not responsible for any cost(s) incurred by a Firm in preparing and/or
submitting a proposal in response to this RFQ. The City will not be responsible for any costs associated
with preparing and/or participating in any systems demonstrations requested of the Firm’s services.

Proposal Organization Guidelines The proposal must include the information noted in this section and be organized accordingly. The
submitted response to this RFQ should be as concise as possible while adhering to the format and
information requirements described below. Please limit your response to a maximum of thirty (30)
single sided pages, excluding the cover letter, resumes and attachments such as photographs or other
exhibits. Attachments are limited to five (5) pages. Font size of 11 or larger is required. Global page
numbers and a table of contents is recommended. Absolutely no fee or cost proposal should be
provided in response to the RFQ. The submitted response shall be divided into the following sections:

The submittal shall include at a minimum the following information:
Section I — Qualifications of the Team
Provide a brief overview of your firm, including years in business, dollar volume per year for the
last five years, and significant projects completed in that time.
Provide a description of the composition and management structure of your team. Provide a
description and separate graphic organizational chart complete with working titles. Identify the
lines of authority, responsibility and coordination.

Identify the firm’s roles, responsibilities, and relevant experience with projects of similar scope
and complexity, specifically focused on municipal public Library experience of a similar size
and/or budget.
Include the qualifications and relevant experience of the proposed project manager and
superintendent.
Describe how the team’s experience will relate to the success of this project.
Provide a description of how your team will meet the City’s 30% MWBE requirement.
Provide a description of how your team selects qualified sub‐contractors, gets vigorous
participation from them, and manages them effectively in a challenging construction
marketplace.
Provide your team’s CMAR’s Experience Modifier Rate (EMR) over the last five years and
describe your teams’ safety program. Provide the resume of the safety manager for your firm,
and a brief description of the unique features of your safety program.
Section II — Proven Success
Select your three (3) most relevant projects from the last five (5) years and provide, at a
minimum, the following:
The name of the project Library in the Park – CMAR/ RFQ‐2022‐100‐01
The amount of your firm’s original contract
The current contact information for the Owner
The current contact information for the Architect
Completion date
Submitted letters of reference from past clients
Total contract value at completion, together with a short description of change orders (e.g.,
owner initiated; design document ambiguity; unforeseeable condition; capricious building
official’s direction, etc.).
Brief description of each project including size, scope, type of building and budget.
Provide at least one example of a construction cost estimate prepared by your firm from 100%
Schematic Design (or earlier) documents in any format you believe appropriate. The example(s)
are not required to be of a library or park project, but examples of this type would be the most
illustrative of your team’s experience.
Provide your firm’s approach to cost and change management. In addition, list the average
percentage of change orders in your firm’s final project costs typically driven by changes that
were not owner initiated, or driven by unforeseeable conditions.
Section III — Firm’s Stability
Please provide your firm’s total bonding capacity for the last five (5) years. In addition, please
provide your firm’s bonding unused (available) capacity as of October 18th, 2021. The City
understands this amount may have changed since that date.
Provide the following financial information for your firm:
The most recent balance sheet, profit/loss statement, and income statement.
The most recent twelve month certified financial statement from a CPA; and
The contact information (including email) for the representative most familiar with your account
at the bonding and general liability insurance companies you propose to use, as well as the CPA.

Authorization to discuss your firm’s financial history with the CPA and bonding/insurance history
with the appropriate representatives of those firms.
Provide the contact information for three (3) additional municipal references and permission to
contact them.
Current workload and availability to perform the work
Provide information on any past, current, or anticipated claims (i.e., knowledge of pending
claims) on respondent contracts; explain the litigation, the issue, and its outcome or anticipated
outcome.
Section IV — Capability and Capacity to Perform Work
Describe the firm’s workload and availability to meet schedule
Describe the project management plan, including project organization chart and resumes
Describe the firm’s knowledge of Cedar Hill processes and procedures
Section V — Proposed Project Schedule Please provide a proposed project schedule which emphasizes key milestones and the proposed
completion date.

Section 5 – Evaluation All proposals will be evaluated by a City of Cedar Hill Selection Committee (Committee). The Committee
may be composed of City of Cedar Hill staff and other parties that may have expertise or experience in
the services described herein. The Committee will review the submittals and will rank the proposers.
The evaluation of the proposals shall be within the sole judgment and discretion of the Committee. All
contacts during the evaluation phase shall be through the City of Cedar Hill’s Purchasing Coordinator
only. Proposers shall neither contact nor lobby evaluators during the evaluation process. Attempts by
Proposer to contact members of the Committee may jeopardize the integrity of the evaluation and
selection process and risk possible disqualification of Proposer.
The Committee will evaluate each proposal meeting the qualification requirements set forth in this RFQ.
Any proposal that is unrealistic in terms of the technical or schedule commitments may be deemed
reflective of an inherent lack of technical competence or indicative of a failure to comprehend the
complexity of the project requirements as set forth in this RFQ.
The selection process may include oral interviews. Proposers will be notified of the time and place of
oral interviews and of any additional information that may be required to be submitted.

Final scoring for these criteria may be adjusted based on the results of reference calls, or other
supplemental information requests. In addition to the foregoing criteria, the award of a contract will be
based on the criteria responses and an evaluation of the best overall value and benefit to the City.
Note: It is the Firm’s sole responsibility to submit information related to the evaluation categories. The
City is under no obligation to solicit such information if it is not included in the Firm’s original proposal.
Failure to do so may result in your Proposal being disqualified from further review and consideration.
The City makes no guarantees or representations that any award will be made and reserves the right to
cancel this solicitation for any reason, including:
Reject any and all proposals received as a result of this RFQ, with or without cause.
Waive or decline to waive any informality and any irregularities in any proposal or responses
received.
Negotiate changes in the scope of services to be provided.
Withhold the award of contract(s).
Select Firm(s) it deems to be most qualified to fulfill the needs of the City. Firm(s) with the
lowest priced proposal(s) will not necessarily be selected, since a number of criteria other than
price are important in the determination of the most acceptable proposal(s).
Terminate the RFQ process.

Section 7 – Terms and Conditions The following terms and conditions apply to this RFQ solicitation process and will be incorporated into
the resulting contract as applicable.
The successful/selected Firm will be required to enter into a written Construction Manager At Risk
Agreement (the “Agreement”) in a form substantially similar to the attached example. Such agreement
will be prepared by the City and approved by the City Attorney. Firms submitting a response to the RFQ
should make themselves fully aware of the terms and conditions in the attached example including, but
not limited to, the indemnification and insurance requirements, incorporated herein for all purposes.
This Request for Qualifications shall become part of the Agreement.
Term / Termination
The Agreement shall be effective upon the date it is executed by the City after execution by the Firm and
shall expire upon completion of the Services covered by the Agreement. The City reserves the right to
extend/renew the contract(s) awarded as a result of this solicitation. The Agreement may be terminated
by the City upon thirty (30) days written notice of such termination. In the event of termination by the
City there shall be no further obligation on the part of the City to the Firm to save and except for
payment of sums due and owing for expenses and work incurred by the Firm prior to the date of
termination, minus any City incurred damages if such termination is for cause. In the event of any
termination, Firm shall agree to cooperate in connection with any necessary transition services and shall
be reimbursed for such transition services at Firm’s standard rates. The beginning of the term of any
licensing or subscription fees for software may be subject to the negotiation of the City and the Firm,
such that they do not coincide with the contract execution date.
Payment Terms
Net 30.
No Obligation, Right of Rejection, and Multiple Award
The inquiry made through this RFQ implies no obligation on the part of the City. This RFQ does not
constitute an offer or a contract with any Firm or other party.
As previously stated, and to emphasize, the City reserves the right to reject any or all Proposals, in whole
or in part, or to accept or reject all or any part of any Proposal. Proposals deemed to be received from
debarred or suspended vendors will be rejected. The City may reject any Proposal that is not responsive
to all of the material and substantial terms, conditions, and performance requirements of this RFQ. The
City further reserves the right to award all, part, or none of the components/functional areas included in
this RFQ. In addition, the City reserves the right to make one or more awards to competing Firms for
subsets of functionality as a result of this RFQ. The City reserves the right to reject any Proposal
determined to be nonresponsive. The City reserves the right to negotiate with any or all Firms with
respect to any or all terms of a Proposal or Contract, including but not limited to the fees. The City also
reserves the right to refrain from making an award if it determines it to be in its best interest. The City
reserves the right to abandon the Project and/or to re‐advertise and solicit other Proposals.

Contract Changes
Written requests for price changes in a resulting term contract after the Firm price period must be
submitted in writing to the City at least one‐hundred eighty (180) days prior to the commencement of
any extension period. Any proposed price increase will be based on the Firm’s actual cost increase only,
as shown in written documentation provided to the City. All requests for price increases must be in
writing, must not constitute increases in profit, and must contain data establishing or supporting the
increase in cost. In connection with any request for price increases in term contracts after the Firm price
period, at the option of the City, (1) the request may be granted; (2) the contract may be cancelled by
either party; or (3) the contract may be extended without change with the consent of both parties.
Contract Approval
Proposers understand that this RFQ does not constitute an offer or a contract with the Firm. This RFQ
does not, by itself, obligate the City to award a contract. The City’s obligation will commence only
following City Council approval of a contract and the parties’ execution of the contract. Upon written
notice to the Firm, the City may set a different starting date for the contract. The City will not be
responsible for any work done or expense incurred by the Firm or any subcontractor, even if such work
was done or such expense was incurred in good faith, if it occurs prior to the contract start date set by
the City.
Contract Dispute
In the event of contract dispute, dispute proceedings will be held in Dallas County, Texas and pursuant
to and in accordance with the terms of the Agreement.
Confidential Information
Any written, printed, graphic, electronic, or magnetically recorded information furnished by the City for
the Firm’s use are the sole property of the City. This proprietary information includes, but is not limited
to, customer requirements, customer lists, marketing information, and information concerning the City
employees, products, services, prices, operations, security measures, and subsidiaries.
The Firm and its employees shall keep this confidential information in the strictest confidence and will
not disclose it by any means to any person except with City approval, and then only to the extent
necessary to perform the work under the contract or as may be required by law. These confidentiality
obligations also apply to the Firm’s employees, agents, and subcontractors and Firm shall be liable for a
breach of the confidentiality obligations by any such party. On termination of the contract, the Firm, its
employees, agents, and subcontractors will promptly return any confidential information in its
possession to the City.
Insurance Requirements
The insurance requirements applicable to the successful/awarded Firm are set for in the Agreement
included herewith.
Conflict of Interest
Firms shall at all times observe and comply with all federal, state, and local laws, ordinances, and
regulations including all amendments and revisions thereto, which in any manner affect Firms or the
services and/or items to be provided, specifically and not limited to any laws relating to conflicts of

interest. Failure to comply with any applicable laws may result in: i) the termination of the contract; ii)
the forfeiture by Firms of all benefits of the Contract; iii) the retainage by the City of all Services
performed by Firm and iv) the recovery by the City of all consideration, or the value of all consideration,
paid to Firm pursuant to any awarded contract. The City will require the selected Firm to sign a Conflict
of Interest (CIQ) form and other vendor forms upon selection.
Pending and Recent Litigation
Firms must disclose any pending or recent litigation they are involved in as a company. Recent is defined
as the past three (3) years. Information provided should include the timeline of the litigation history, the
subject of the litigation, and the current status of the litigation. Proposals must also disclose any
pending litigation of any third‐party partners in the Proposal.
Contract Negotiation
After final evaluation, the City may negotiate with the offeror(s) of the highest‐ranked Proposal. If any
Firm fails to negotiate in good faith, the City may terminate negotiations and negotiate with the offeror
of the next highest‐ranked Proposal or terminate negotiations with any or all Firms.
If contract negotiations are commenced, they may be held at the City or via teleconference at a date
and time to be determined. If contract negotiations are held, the Firm will be responsible for all of Firm’s
costs including, without limitation, its travel and per diem expenses and its legal fees and costs.
Failure to Negotiate If the selected Firm:
1. Fails to provide the information required to begin negotiations in a timely manner;
2. Fails to negotiate in good faith;
3. Indicates it cannot perform the contract within the designated timeframes or within budgeted
funds available for the Project; and/or
4. If the Firm and the City, after a good‐faith effort, cannot come to terms; then the City may
terminate negotiations with the Firm initially selected and commence negotiations with the next
highest‐ranked Firm. At any point in the negotiation process, the City may, at is sole discretion,
terminate negotiations with any or all Firms.
Policy Compliance
The Firm shall, as a condition of being considered for award of the contract, require each of its agents,
officers, and employees to abide by the City policies prohibiting sexual harassment and smoking, as well
as all other reasonable work rules, safety rules, or policies regulating the conduct of persons on City
property at all times while performing duties pursuant to the contract. The Firm agrees and understands
that a violation of any of these policies or rules will constitute a breach of the contract and will be
sufficient grounds for immediate termination of the contract by the City.
Procurement Policy
The City of Cedar Hill Purchasing Policy and Procedures Manual March 2018 is pursuant to current State
of Texas and local purchasing laws.

Public Information
All Proposals, responses, inquiries, or correspondence relating to or in reference to this RFQ, and all
reports, charts and Proposals or referencing information submitted in response to this RFQ, shall
become the property of the City, and will not be returned. The City will use discretion with regard to
disclosure of proprietary information contained in any response but cannot guarantee information will
not be made public. As a governmental entity, the City is subject to making records available for
disclosure pursuant to applicable public record disclosure laws, and Proposers, including the Firm
ultimately awarded the contract, shall cooperate in complying with such public disclosure laws at no
additional cost to the City.
Ownership of Data and Transition
Any and all City data stored on the Firm’s servers, or within the Firm’s custody, is the sole property of
the City. The Firm, its subcontractor(s), officers, agents, and assigns shall not make use of, disclose, sell,
copy, or reproduce the City’s data in any manner, or provide to any entity or person outside of the City
without the express written authorization of the City. In the event resulting Agreement is terminated for
any reason, or upon expiration, and in addition to all other rights to property set forth, the Selected Firm
shall:
a) Incur no further financial obligations for materials, Services, or facilities under the Agreement
without prior written approval of the City;
b) Terminate all purchase orders or procurements and any subcontractors and cease all work,
except as the City may direct, for orderly completion and transition; and
c) Make available to the City, at no cost, all City data stored within the system, stored on the Firm’s
servicers, or within the Firm’s custody, within fifteen (15) days of termination or at the City’s
request.
d) In the event resulting Agreement is terminated for any reason, or upon expiration, and in
addition to all other rights to property set forth, the City shall retain ownership of all data, work
products, and documentation created pursuant to the resulting Agreement.
