Instructions to Proponents The Corporation of the City of Dawson Creek requests written quotations for the provision of construction services to build the new RV sanitary dump station on 115 Avenue in Dawson Creek. All contract documents are available through the City of Dawson Creek website at www.dawsoncreek.ca . The Proponent is solely responsible for ensuring any addenda are downloaded, reviewed, and included in their quotation. Questions regarding specifications can be directed to Shawn Dahlen, Director of Infrastructure at 250-784-3624 or [email protected]. Quotations will be accepted up to 2:00 p.m. (local time), July 22th, 2016. Quotations must be sealed in an opaque envelope, clearly marked with the name and the project name/number and will be received by Brenda Ginter, Director of Corporate Administration at: Regular Mail: Box 150, Dawson Creek, BC V1G 4G4 Physical Address (Courier): 10105 – 12A Street, Dawson Creek, BC V1G 3V7. It is the sole responsibility of the Proponent to ensure that its quotations are received at the above location and by the time stipulated. Quotations received after the stipulated time will be rejected and returned to the Proponent unopened. Faxed quotations are not acceptable and will be rejected. The City reserves the right to accept or reject all or any quotation and to waive any informality, incompleteness or error in any quotation. Proponents must refer to the RFQ Documents for the terms governing the Bid process. All quotations received by the City of Dawson Creek become the property of The Corporation of the City of Dawson Creek and as such are subject to the Freedom of Information and Protection of Privacy Act. Once a contract has been awarded the name(s) of the successful proponent(s) will be posted to the City website. Copies of the Request for Quotation are available from the address listed above. Quotations transmitted by facsimile machine will not be considered. Definitions
a) ‘City’ means the City of Dawson Creek, the governing Body for the Municipality of the City of Dawson Creek
b) ‘Contract’ means the written agreement resulting from the Request for Quotation executed by the City and the successful Proponent
c) ‘Corporation’ means the Corporation of the City of Dawson Creek
d) ‘Proponent’ means an individual or a company that submits, or intends to submit, a quotation in response to
this Request for Quotation
e) ‘Project’ means the RV Sani Dump Station – Construction Services project

SPECIFICATIONS 1. Introduction The City of Dawson Creek is requesting quotations for the construction of a RV Sani Dump Station in Dawson Creek on 115 Avenue. This will include the completion of site grading, installation of all aggregate, a new concrete pad and island with four sanitary dumping stations complete with water and sanitary servicing. It also includes the removal of an existing chain link fence and installation of new chain link fence and gate. 2. Quotation Submission Quotations must be submitted on the bid form provided and attached hereto prior to the closing time noted above in a sealed envelope, clearly marked on the outside ‘Request for Quotation: RV Sani Dump Station – Construction Services. All costs incurred by proponents in the preparation and presentation of their quotation will be at their own expense.
3. Scope and Location of Work A. The successful proponent will be responsible for the following:
1. Site safety in its entirety as the succesfful contractor will be deemed prime contractor. 2. Mobilization and de-mobilization of any equipment and or tools to complete the necessary work. 3. Coordination with City staff and contractors as necessary including construction meetings as needed. 4. Traffic control as required. 5. Written notification of disruption to adjacent property owners a minimum of 48 hours prior to commencing
work. 6. Notification of road closures to emergency services as required. 7. Location and exposure of all underground utilities and structures in the area of the proposed work prior to
commencing the work and repair of any damaged utilites during construction at their own cost. 8. All construction equipment and materials to be supplied by the proponent. 9. Restoration of any excavated areas back to original condition is to be completed as per the most recent City of
Dawson Creek Subdivision & Development Servicing Bylaw. 10. Completion of all work to meet the specifcations as outlined in the Master Municipal Construction Document
(Platinum Edition). 11. Disposal of any waste material to a suitable disposal location as approved by Dawson Creek city staff. 12. Work is to be completed prior to October 31th 2016.
B. As per the contract drawings attached hereto as Appendix B, the work consists of completion of site grading, installation of all aggregate, concrete pad and island with four sanitary dumping stations complete with water and sanitary servicing. It also includes the removal of the existing chain link fence and installation of new chain link fence and gate. All specifications can be found in the contract drawings, Master Municipal Contract Documents, or City of Dawson Creek Subdivsion & Development Servicing Bylaw. The successful proponent is expected to enter into a formal contract with the City of Dawson Creek prior to commencement of this work. 4. Submission Requirements
• Deadline for submission of Quotations is 2:00 p.m. local time, July 22th, 2016. Quotations must be received by the Corporate Administrator at Dawson Creek City Hall prior to the deadline.
• Bid Form, completed in full, including all unit prices. • The quotation must be signed by a person authorized to sign on behalf of the Proponent. • The quotation must be in English. • The quotation must provide written confirmation of the Proponent’s independence and that the Proponent has
no conflict of interest with the City. The possibility of actual or perceived conflict of interest or lack of independence will be considered. If, in the opinion of the City of Dawson Creek a reasonable person would

perceive there to be a conflict of interest or lack of independence on the part of the Proponent, the Quotation will be rejected.
• Quotations be submitted in an opaque envelope and clearly marked “RFQ 2016-34 – RV Sani Dump Station” and must be submitted on the Bid Form provided with all sections completed.
• In the case of a lump sum price contract, if the Bid contains an error in adding lump sums, the total Bid price is the total resulting from correct addition by the City of the lump sums.
5. Additional Information The successful Proponent will be required to provide and maintain throughout the term the following documentation, which must be submitted prior to the issuance of a contract and no later than seven business days of being notified that they are the successful proponent:
• City of Dawson Creek Business Licence; • Proof of good standing with Worksafe BC, if applicable; • Commercial General Liability policy covering bodily injury and property damage liability in the amount of at least
Five Million Dollars ($5,000,000) from an insurance company licensed to carry out general insurance in the province of BC. The policy shall be in the name of the Proponent and have added as additional insured the Corporation of the City of Dawson Creek. The policy shall provide the City with 30 days’ notice of cancellation or material changes to the policy.
• Acceptance of Prime Contractor Designation. • 50% Labour and Materials Bonding or letter of credit. • 50% Performance Bonding or letter of credit.
6. Evaluation Evaluation of quotations and selection will be by City staff. 7. Requests for Clarification Proponents may inquire into and clarify any requirements of the RFQ. Questions must be communicated to the contact person at least five days prior to the closing date. Inquiries, in writing, must be directed to Shawn Dahlen, Director of Infrastructure, at [email protected]. It is the Proponent’s responsibility to clarify any details prior to submitting a quotation. The Corporation of the City of Dawson Creek will assume no responsibility for any oral instruction or suggestion. 8. Discrepancies or Omissions Proponents finding discrepancies or omissions in the Request for Quotation documents or having any doubts to the meaning or intent of any part thereof, should immediately notify Shawn Dahlen, Director of Infrastructure for the City of Dawson Creek, in writing. Responses, if not already addressed in the RFQ, will be issued in the form of addendum and posted to the City website at www.dawsoncreek.ca. No oral interpretations will be effective to modify any provisions of the Quotation, unless a written addendum has been issued by the City, prior to the advertised closing date and time. The Proponent is solely responsible for ensuring any addenda are downloaded, reviewed, and included in their Quotation. No responsibility will be accepted for oral instructions. Addenda or correspondence issued during the Request for Quotation period shall be considered part of this document and will become part of the final contract document. 9. Irrevocability of Quotations By submission of a clear and detailed written notice, the Proponent may amend or withdraw its Quotation prior to the closing date and time. Upon closing time, all quotations become irrevocable and may not be withdrawn for a period of 60 days following the Closing Date and Time. By submission of a quotation, the proponent agrees that should its quotation be deemed successful, the Proponent will enter into a contract with the City, the content and format of such contract to be determined by the City of Dawson Creek.

10. Alterations to Quotation Prior to the time and date of the Request for Quotations Closing, any proponent may withdraw or change their quotation without penalty or forfeiture, by giving notice in person at City Hall, or in writing, email or fax to: Brenda Ginter, Director of Corporate Administration for the Corporation of the City of Dawson Creek, P.O. Box 150, Dawson Creek, BC V1G 4G4. Any amendment submitted which results in the disclosure of pricing or other salient points of the original quotation will result in disqualification of the Proponent. Proponents may amend their quotation via fax to 250-782-3203. Fax changes must be received prior to the closing time of 2:00 pm local time, July 22, 2016. Any quotation change should disclose only price changes and any change that discloses a lump sum price, a unit price, an extended total, or total price will result in the entire bid being rejected. If a Proponent faxes a change to the quotation, the Proponent accepts all risk associated therewith, including lost or misdirected fax and any malfunction of the City’s fax machine.
The Proponent will not change the contents or price of its quotation after closing and no words or comments will be added to the comments unless requested by the City for purposes of clarification. 11. Liability for Errors While the City used considerable efforts to ensure an accurate representation of the information in this Request for Quotations, the information contained in the Request for Quotations is supplied solely as a guideline for Proponents. The information is not guaranteed or warranted to be accurate by the City, nor is it necessarily comprehensive or exhaustive. Nothing in this Request for Quotations is intended to relieve Proponents from forming their own opinions and conclusions with respect to the matters addressed in the Request for Quotations. 12. Agreement with Terms By submitting a quotation, the Proponent agrees to all the terms and conditions of this Request for Quotations. Proponents who have obtained the Request for Quotations must not alter any portions of the document, with the exception of adding information requested. To do so will invalidate the Quotation. 13. Modification of Terms The City reserves the right to modify the terms of the Request for Quotation at any time at its sole discretion. 14. Proponents Expenses Proponents are solely responsible for their own expenses in preparing a quotation and for subsequent negotiations with the City, if any. If the City elects to reject all Quotations, the City will not be liable to any proponent for any claims, whether costs or damages incurred by the Proponent in preparing the quotation, loss of anticipated profit in connection with any final Contract or any other matter whatsoever. 15. Acceptance and Rejection of Quotations The Corporation may not necessarily accept the lowest priced quotation. At its sole discretion, the Corporation reserves the right to reject any or all quotations received and to accept any quotation which it considers advantageous, whether or not it is the lowest priced submitted. The Corporation is not under any obligation to award a contract, and reserves the right to terminate the Request for Quotations process at any time, and to withdraw from discussions with all or any of the Proponents who have responded. The Corporation shall not be obligated in any manner to any Proponent whatsoever until a written agreement has been duly executed relating to an approved Quotation. 16. No Contract is Formed as a Consequence of this Invitation to Submit Quotation. The Corporation reserves the right to accept the proposed offer in total or in part, to reject any or all offers, to waive any minor informalities, irregularities or technicalities, and to accept the offer deemed most favourable to the Corporation. Quotations must meet all the requirements stated herein to be eligible for consideration. Quotations that are unsigned, incomplete, conditional, illegible, unbalanced obscure or that contain additions not called for, reservations, erasures, alteration or irregularities of any kind, may be rejected.

The Corporation reserves the right to obtain additional information from the Proponents to clarify the information in their submission. In the event that only one quotation is received, the Corporation reserves the right to return the quotation unopened. Quotations received after the closing time will not be opened. 17. Contract Negotiation The Corporation reserves the right to negotiate specific terms of the contract with the short-listed proponents prior to the final award of the contract. The Corporation also reserves the right to negotiate specific terms of the contract with the Contractor as the contract progresses. 18. WorkSafe BC For the purpose of the contract, the successful proponent must provide to the City proof of coverage under the Worker’s Compensation Act and a letter/proof of good standing with WorkSafe BC and this good standing must be maintained for the duration of the contract. 19. Business Licence As a condition of entering into a contract with a proponent, the selected proponent will be required to provide proof of a current City of Dawson Creek business licence. 20. Failure to Comply If the proponent is awarded the contract proposed and fails or refuses to enter that contract, the Proponent shall without limitation be liable to the Corporation in securing a substitute proponent.
21. Contract Documents
The RFQ Documents consist of the following: (i) Request for Quotes and Specifications; (ii) Bid Form; (iii) Appendix A – Contract Drawings; (iv) Addenda, (if any)
All of the above referenced documents form part of the RFQ, and it is the Proponents responsibility to become familiar with these documents prior to the completion and submission of a quotation.

CITY OF DAWSON CREEK CODE OF CONDUCT – CONTRACTORS
The relationship between City employees and representatives of contractors providing service to the City is critical to achieving the goals and objectives of the Corporation of the City of Dawson Creek. In providing the highest level of service possible, it is essential that all representatives of the Contractor work together with City staff in a co-operative and congenial manner, always respecting established lines of authority. The efficiency of City operations and the image the Corporation presents to the public may be influenced by any breakdown in the relationship between the Contractor’s representatives and City employees. Therefore, the Contractor’s representatives are expected to convey a friendly, approachable, positive and helpful attitude to City employees and to be honest, trustworthy, reliable, dependable and punctual in all workplace activities. Contractors unable to demonstrate an ability to meet this standard may be disqualified from the bidding process. Successful bidders subsequently failing to meet this standard should expect termination of any contractual relationship with the City.
