MOOT PROPOSITION Vikram Agnihotri, aged 28 years, a native of Paschim Vihar, New Delhi lives with his parents, grandmother and one younger sister. He completed his MBA following his B.tech in C.S.E from Sankalp Puran University, Noida on 04.05.2013. His family, teachers and well wishers praised his efforts. He received his appointment letter on10.02, 2015 and was intimated to join at the Dwarka Branch, New Delhi for initial training of new appointees. He started working with great zeal and enthusiasm towards advancing his professional career. Like his academic days, Vikram started to make commendable deliveries in comparison to his peers at training as well joining. Meanwhile, his parents began to look for a suitable girl for his marriage. On 26.05.2016, Vikram along with his family visited to Noida to meet a girl namely Bhavana Sharma on suggestion for marriage proposal by a near relative. Vikram and Bhavana were asked to converse amongst themselves by their elders at the girl’s home. They were shy initially but ended up liking each other following a brief conversation about their hobbies, likes, dislikes etc. Bhavana, aged 22 years had completed her B.Ed from Rani LaxmiBai University, Noida and worked as a Teacher in a nearby Vinayaka Coaching Institute. Thereafter, Vikram and Bhavana went on a coffee date and confessed liking each other. On 04.07.2016, they got engaged and subsequently married in Radha Banquet, Pachim Vihar on 05.07.2016. Friends and relatives blessed the new couple and showered them with gifts. Bhavana’s parents had gifted to Vikram a new Hyundai i20, apple Ipad, air conditioner, a sofa set, and a sum of Rs 5 Lakh rupees on grounds of generous affection. MOOT PROPOSITION
Vikram Agnihotri, aged 28 years, a native of Paschim Vihar, New Delhi lives with his parents,
grandmother and one younger sister. He completed his MBA following his B.tech in C.S.E from
Sankalp Puran University, Noida on 04.05.2013. His dream in life is simple and just like most of
people, i.e., to secure a government job like his parents who are retired railway officials. His
college best friend Rakesh Madan advised him to join a crash course at Acheiver’s Academy,
Nirman Vihar to help him prepare methodically. With sincerity and devotion Vikram prepared
for upcoming exams. His hardwork resulted in his selection in the very first attempt as a
‘Specialist Officer- IT cadre’ with Jan Sewa Bank of India (J.S.B.I) on 10.10.2014. His family,
teachers and well wishers praised his efforts. He received his appointment letter on10.02, 2015
and was intimated to join at the Dwarka Branch, New Delhi for initial training of new
appointees. He started working with great zeal and enthusiasm towards advancing his
professional career. Like his academic days, Vikram started to make commendable deliveries in
comparison to his peers at training as well joining. Meanwhile, his parents began to look for a
suitable girl for his marriage. On 26.05.2016, Vikram along with his family visited to Noida to
meet a girl namely Bhavana Sharma on suggestion for marriage proposal by a near relative.
Vikram and Bhavana were asked to converse amongst themselves by their elders at the girl’s
home. They were shy initially but ended up liking each other following a brief conversation
about their hobbies, likes, dislikes etc. Bhavana, aged 22 years had completed her B.Ed from
Rani LaxmiBai University, Noida and worked as a Teacher in a nearby Vinayaka Coaching
Institute. Thereafter, Vikram and Bhavana went on a coffee date and confessed liking each other.
On 04.07.2016, they got engaged and subsequently married in Radha Banquet, Pachim Vihar on

distributed sweets at his office and decided to give his colleagues a party after office hours at
Aura Kitchen and Spirits, Max O23 Mall, New Delhi. The party was attended by his close
colleagues Raghav, Saransh and his wife Kavita, Abhijeet and his wife Meenal, Rishabh, and
Jayant, . All of them had a great time enjoying singing, dancing and a fine dining. Vikram and
Bhavana consummated their marriage and Bhavana gave birth to a baby girl on 24.05.2017 at
Srikanth Nursing home, New Delhi. The couple took blessings of their elders and conducted the
Naam karan ceremony for their newborn baby girl on 21.07.2017. She was named Sukanya with

consultations from Pandit. After few months Vikram completed his probation period and was
elevated as a permanent S.O assigned with more duties and responsibilities at the bank. His
consistent assiduous at bank earned him an early raise and recommendation from the Branch
Manager of J.S.B.I, Dwarka Branch as a consequence of which he was transferred to the Jaipur
Branch where he had to join by August, 2017. He decided to shift to Jaipur alone, leaving his
wife and baby at his home along with his parents and grandmother.
Vikram shifted to Jaipur on 30.07.2017 and reached out to his friend from College, Anirudhh
Bakshi, who was working as an Associate Professor at Scholar Home University, Jaipur. After
meeting they decided to rent1 and stay together in a 2BHK apartment at race course colony.
Vikram and Bhavana spoke on the phone everyday to curb the new experience of long-distance
effect in their relation but Vikram started to get busy after passing of few months due to change
in bank policies that were regularly amended in accordance with post-demonetization and RBI
circulars.. The calls to home shifted from daily-call to alternate-day to only weekend calls.
Vikram visited his home after 4 months during a long weekend on the occasion of Christmas and
New Year in December 2017. He explained his family the extent of work load and his reasons
for not being able to be present like earlier time. After a short leave, Vikram joined back to his
newly accustomsized mundane lifestyle by 02.01.2018.
One Ms Riya Devi Kumari, aged 31 years, joined the Jan Sewa Bank Of India, Jaipur branch as
newly transferred Assistant Bank Manager (A.B..M) in January 2018. She was a pretty and smart
woman who had received quite few laurels owing to her expert management and administration
skills in her previous tenures by All India Bank Founders Association. One day, while Riya was
assigning different teams for assessment and rotational desk changes in functioning of various
P.O and S.O staff at the bank, Vikram learnt that his task was to assist the Assistant Bank
Manager in monitoring day to day operations, working under her. The new A.B.M motivated and
asked all her staff to increase their valued efforts at work so as to maintain their reputation as the
best branch of Jan Swea Bank of India in Rajasthan. Vikram dedicatedly started working and
was keen on learning rich experience from his senior Ms Riya., Often the A.B.M while
appreciating Vikram’s work casually brushed his arm and Vikram started to feel infatuated
towards her. He worked closely with Riya and eventually developed feelings for her. On a fine
weekend 18.05.2018 Riya invited Vikram to attend her friends’s wedding in neighborhood. After
having a lot of conversations regarding their work they started to talk about other things. Vikram
could no longer after seeing Riya dressed in a beautiful beige saree dismiss the fact that he was
very much attracted to her and wanted to spend much more time with her. He was head over
heels to learn from Riya that she too wishes to reciprocate the same feeling and told him she
wanted to be a part of his life. They started seeing each other but maintained a low profile and
strictly adapted to office rules. Vikram started dropping Riya every day to her home in Vasant

Vihar after work. They started going on casual dates, movies and restaurants while taking out
time from their time constrained schedule. Meanwhile Vikram’s calling to his parents and wife
had reduced to a great extent. He used to tell them of his busy routine and began to ignore their
calls. One day he was so irritated seeing the number of missed calls from his home that he told
them not to call him again and again. Further he also re-iterated that he will only call them
whenever he gets time.
Riya gifted Vikram a branded watch2 on his birthday on 22.11.2018 and planned to go for dinner
after work. She told him about her family and friends and asked him about same. It was on this
day that for the first he confessed her that he was in love with her and wanted to spend his life
with her. He also said. “I am so lucky to finally have met my soul-mate who understands me for
the way I am.” Vikram also told Riya that he was married to Bhavana whom he did not feel
connected to and had married only to satisfy and respect his parent’s wishes. Riya became
hesitant towards advancement of their bond due to her learning about his marriage but confessed
that she was in love with him as well. He said he was willing to spend his life with her and that
has initiated a divorce proceeding against his wife in New Delhi. Vikram suggested to keep a
low profile till his divorce proceeding conclude and post it, they would marry and live happily
like present time. After dinner Vikram dropped Riya to her apartment3. It started to rain heavily
so she invited him for a drink to her house till the rain stopped., eventually after a couple of
drinks and conversations, closeness developed between both of them and they started embracing
each other. Riya raised the concern of their acts as being improper and unjustified but Vikram
convinced her that he loved her very much and intends to marry her after divorcing his wife
anyway. They for the first time engaged in sexual intercourse on that night and discussed their
future plans. Meanwhile Vikram began to ignore his family-calls more than ever but used to
send timely money to his wife for her and child’s needs. He even apologized to his family for not
being able to give much time as expected and sent them sweets or other goodies once in few
months.
The bond between Riya and Vikram grew closer. Vikram also started to stay at Riya’s flat during
weekends and engaged in physical relations at various occasions. Whenever Riya inquired from
Vikram about their plans of future he said “Don’t worry my darling I just need some more time
to figure things out.’’ He also assured her that her being from a different caste would not cause
hindrance to their marriage. Soon Vikram shifted from his previous apartment to live with Riya
at her apartment. He informed Anirudh that he is shifting with a colleague for some time in a
locality near to his workplace to reduce his travel time. They started living as a couple and were
started to be recognized by their fellow neighbors as well including Mr. Atul Bhargava4, who

lived two lanes away from them. Even at the office few people became aware about the fact of
both of them being together. Vikram had not disclosed about his marriage to any person at his
new office. On 14.02.2019, Vikram proposed Riya with a solatire ring5 to which she said “yes”.
The couple celebrated the news by throwing a small party at their Vasant Vihar residence. Rhea
introduced Vikram to her friends who stayed in the city while Vikram invited Advait, Paramvir,
Harun and Vishesh who were his colleagues at the Jan Sewa Bank of India (Bikaner) Jaipur
Branch. Following few weeks Vikram and Rhea went for 4 day trip to Goa for a vacation. He
booked a 1 BHK flat in Angara Enclave, South Goa from his credit card , they visited many
beaches, travelled to tourist attractions like falls, church, went for boat riding, attended local club
parties, took spa etc. Vikram had requested Riya not to put their pictures on social media to
avoid unwanted attention as people will judge them and not understand their relation. On
06.07.2019 Riya asked Vikram when he would marry her. He told her that first he has planned to
wait till the completion of the divorce with his wife which is taking some time due to long court
dates. Secondly, his wife is demanding too much money for her alimony and maintenance taking
advantage of his family’s wealth and reputation He told that he is having problem redressing to
the money issue because he has been saving for his younger sister’s marriage. Thus he asked her
to be understanding and wait till her younger sister’s marriage. Vikram went home for two days
on 17.09.2019. He took his family including his wife and daughter for a picnic to Subroto Water
Park followed by dinner. He also gifted a pair of silver payal (anklets) to his daughter Sukanya.
After spending a good quality time he returned back to Jaipur telling his family that he would try
to get a transfer back to a branch close to home next time.
In the office, the quarterly results of the work of various teams were announced by the Bank
Manager, he applauded and thanked everyone for their sincerity and dedication and asked them
to continue working in such manner. Vikram was exclusively appreciated by his supervisors
including the Bank Manager Mr. Adhir Kulkarni who noted and praised his persistent upgrade at
work. On 11.10.2019, Vikram informed Riya that his wife was demanding huge sum in order to
nullify the marriage. She told him that she could help him if he wanted to which he declined the
offer as he did not want to be a burden to her. Later, on 28.10.2019 Riya inquired from Vikram
that when will he be able to marry her. She also informed him that she wanted to attend her
cousin’s wedding at Bikaner. She further asked him to accompany her to the wedding and
thereafter meet her family members. Vikram told her that he wished to meet her family after he
is free from first wife’s relation so that he has nothing to worry about. He even expressed his
desire to ask her hand from her parents on meeting them. On 19.11.2019 Riya left for her home
to attend the wedding. Over there, while catching up with her family members, she showed their
photographs excitedly to her cousin, Shilpa and told her about their relationship. After few days
Riya again asked Vikram’s status of the divorce proceeding to which he said that he had a word
with his lawyer recently and mentioned about ongoing negotiations with other party. he told her

to trust him to get divorce as soon as possible. On 20.01.2020 Vikram left for his home for a two
day visit taking emergency leave. He told Riya that he was very upset as his family was having a
hard time to cope up with the news of his grandmother demise. He thereafter came home to
perform the last rights. On 02.03.2020 Vikram’s younger sister, Naina was married to an I.A.S
officer stationed at New Delhi. Riya asked Vikram to take her along for the wedding but he
suggested that his family members will find it unacceptable at the moment and he does not
intend to harm his sister ‘wedding in any manner with the news of their sensitive relation. He
promised that he shall introduce her to the family after the divorce is done. Riya asked him the
status of his divorce proceedings. He told her that the proceedings will take few months to
conclude and tried to console her, to have strength to pass their tough time.
After few months, Riya missed her menstrual cycle in the month of May and she along with
Vikram decided to go to the clinic for checkup. The test results came positive confirming
pregnancy. With the news floating, Riya raised a concern telling Vikram about his need to wrap
his divorce proceeding sooner so that they can get married. Vikram for the first time showed
reluctance to herand saidthat he would need more time as she is aware divorce proceeding takes
time to conclude in the Court. Vikram suggested Riya to get an abortion as it was not right to be
have a baby before their marriage. This led an argument as Riya wanted to have the baby
whereas Vikram wanted otherwise. After a lot of discussion on 16.05.2020 Vikram and Riya
visited Dr. Bindu Verma, Maya Healthcare clinic to get the abortion. Vikram made her believe
that God was testing their hard times and they must be strong and considerate to each to each
other because that is what soul mates do. He took care of her after the procedure to help her
recover the mental and physical stress by catering to her needs.
After some days, Vikram told Riya that his wife is demanding 40 Lakh rupees as permanent
alimony for settling their divorce. He asked if she could lend him some amount for the time
being, promising he would repay her.. Riya gave him a sum of Rs 35 Lakh6 , on 25.07.2020.
Vikram thanked her and told her that their good days are near. Few weeks later Riya felt insecure
due to repetitive promises made by Vikram and so inquired about the stage of proceedings.
Vikram told her that he has paid 40 lakhs rupees to his wife and only the final paperwork is
pending which will need some more time. Annoyed to hear the same answer from a long time
she demanded her to meet his family. This caused an argument between them , Vikram said, “ If
you do not trust me at all, we will marry today itself”’. He took Riya to Shiva Niket Mandir and
exchanged garlands after putting vermilion on her forehead and married her.
On 21.08.2020, Vikram and Riya were invited to the wedding of Mr. Avnish Ghungroo, senior
employee from the insurance Department of J.S.B.I at Singhania Resorts. Saransh spotted
Vikram near the bar and decided to surprise him. Vikram was delighted to see him out of the
blue but also got nervous Riya too was happy to finally be able to meet Vikarm’s friend. He

introduced Riya to Saransh as her boss to which she responded, “ not just his boss also his wife”
to which Saransh excalimed that it must be a joke as his wife who is an acquaintance of
Vikram’s wife mentioned that they are doing well but miss him dearly due to his job demands.
He also told her about Sukanaya. While returning from the party, Vikram and Riya got into a
series of heated arguments wherein Riya accused him of being a liar and demanded explanation
on Saransh’s sayings. She was furious and also questioned why he did not mention anything
about the child earlier to her. Vikram told her that his wife had re-negotiated to demand more
money than 40 lakhs and he did not tell her to save her from further trouble. He pleaded to make
her understand that such news would have made her irritated and insecure which she was already
potraying. Riya demanded to meet with his family and threatened to tell the truth. He told her
that his parents would never be convinced to marry her due to her lower caste and would never
accept her. He started to make excuse to end their relation abruptly by saying that that nothing
could be done about their future now as the divorce would take a longer time than she would
expect.. He therefore suggested to break their relation for each other’s good and told her to move
on. She accused him of using her only for money, professional position and to meet his lustful
desires He shifted back to his old apartment the following day and officially broke up with her.
Riya went to Vikram’s apartment on 29.08.2020, and started yelling at him from the road of the
society attracting passerby and neighbours to watch. Anirudh had gone to the market during that
time. Vikram pulled Riya inside of the apartment in order to avoid a public scene. They
continued fighting in the apartment whereby Vikram told Riya to forget him and that he was not
interested in her anymore. She called him a cheater and threatened to file complaint against him.
Vikram replied “people of her caste clean toilet and they should not forget where they belong to.
I must tell you that reservation does not add intelligence’’. He also told her that she got this job
due to ease in reservation policies and without which she would not have been able to afford this
standard of living. Hearing this Riya threw his belongings out of the balcony and broke few
vases. When Vikram tried to stop her she her fell and fractured her wrist. Anirudh arrived after a
while and saw Riya injured and crying. He offered to help her but she refused and stormed out of
the apartment telling Vikram “I will not spare you for this. I will file rape charge against you for
your ill-doing”. Meanwhile, Saransh and his wife informed Bhavana about Vikram’s alleged
scenario. She called to confront him. He informed her that he was not having any affair with
anyone. Rather his boss, Riya was forcefully behind his life and used to harass her threatening to
spoil his carrer with false accusations. He told her that she even time and again offered him
money to divorce her (Bhavana).
Feeling cheated, humiliated and heartbroken Riya filed a written complained to the Bank
Manager on 01.09.2020. An enquiry was set up to look into the matter. She accused him of
using her for physical and professional means by deceitful conduct and misrepresentation of
facts. Vikram defended himself by denying all accusations stating the siutaion had arisen because
of her misunderstanding. He also said that Riya was not innocent as she was aware he was

married , moreover she is taking advantage of pro-women laws and that he was subjected to
harassment by her. He told the Committee that she is of a dominant nature, has a temper issue
and is manipulating the facts to play the victim card. The Committee tried to resolve the issue
discretly by disciplinary consequences. Vikram was thereby transferred to New Delhi, Kirby
Place Branch in accordance to Committee’s opinion. He shifted back and lived with his family.
Dis-satisfied and aggrieved with the Committee’s sole opinion Riya lodged a complaint
regarding the same to the Mahila Thana Police Station, Jaipur. She mentioned that Vikram
engaged in physical relations with her on pretext of false promise to marry. He further committed
fraud by concealing facts for a loan of Rs 35 lakh rupees for divorce. He caused her emotional,
physical and mental trauma by forcing her to undergo abortion and fractured her wrist while
arguing. The Police after conducting investigation, found out there was no divorce7 filed by
Vikram at all in New Delhi or elsewhere in any court. An F.I.R. was registered against Vikram
Agnihotri on 16.09.2020 for offenses punishable under Sections 313, 325, 376, 406, 417, 420,
500, and 506, of Indian Penal Code 1860 and Sections 3(1) (u), (w) and 3 (2) (vii) of The
Scheduled Caste and Tribe (Prevention of Atrocities Act. 1989), (as amended by The
Amendment Act. 2015). The matter was listed in the District & Session Judge, Jaipur and is
undergoing trial. Based on brief arguments8 in the matter the charges framed in disputed are
mentioned as below.
1. Whether the accused is liable to be punished under Section 376 I.P.C?
2. Whether the accused is liable to be punished under Section 420 read with Section 406,
and 417 I.P.C?
3. Whether the accused is liable to be punished under Section 3(1) (u), (w) and 3(2) (vii) of
the S.C & S.T Act?

Whereas the Lessor /Owner is the owner and in possession of the property No: 1/A Race
Course Colony, Jaipur and has agreed to let out the 2BHK FLAT situated at 1/A Race
Course Colony, Jaipur , to the Lessee/Tenant and the Lessee/Tenant has agreed to take the
same on rent of Rs. 14,000/- (Fourteen Thousand) per month.
TERMS AND CONDITION OF RENT AGREEMENT AS UNDER:-
1. That the Tenant/Lessee shall pay as the monthly rent of RS. 14,000/- (Fourteen
Thousand) per month, excluding electricity and water charge.
2. That the Tenant /Lessee shall not sub–let any part of the above said demised premised
premises to anyone else under any circumstances without the consent of Owner.
3. That the Tenant / Lessee shall abide by all the bye - laws , rules and regulation,
of the local authorities in respect of the demised premises and shall not do any illegal
activities in the said demised premises.
4. That this Lease is granted for a period of Eleven (11) months only
commencing from 1st August 2017 and this lease can be extended further by both
the parties with their mutual consent on the basis of prevailing rental value in the
market .
5. That the Lessee shall pay Electricity & Water charge as per the proportionate
consumption of the meter to the Lessor /Owner.
6. That the Tenant/Lessee shall not be entitled to make structure in the rented premises
except the installation of temporary decoration, wooden partition/ cabin, air –
conditioners etc. without the prior consent of the owner.
7. That the Tenant/lessee can neither make addition/alteration in the said
premises without the written consent of the owner, nor the lessee can sublet part
or entire premises to any person(s)/firm(s)/company(s).
8. That the Tenant/Lessee shall permit the Lessor/Owner or his Authorized agent to
enter in to the said tenanted premises for inspection/general checking or to
carry out the repair work, at any reasonable time.

9. That the Tenant/Lessee shall keep the said premises in clean & hygienic condition and
shall not do or causes to be done any act which may be a nuisance to other.
10. That the Tenant/Lessees shall carry on all day to day minor repairs at his/her own cost.
11. That this Agreement may be terminated before the expiry of this tenancy period by
serving One month prior notice by either party for this intention .
12. That the Lessee shall use the above said premises for Residential Purpose Only.
13. That the Lessee/Tenant Shall not store/Keep any offensive, dangerous, explosive or
highly Inflammable articles in the said premises and shall not use the same for any
unlawful activities .
14. That the Lessee shall pay the one month’s advance rent to the Lessor the same shall be
adjusted in monthly rent.
15. That both the parties have read over and understood all the contents of this agreement and
have signed the same without any force or pressure from any side.
