Welcome to the Secondary Disciplinary Alternative Education Program (DAEP). The purpose of the Operations Manual is to provide direction regarding policies and procedures of the Secondary DAEP.

The Houston Independent School District’s Secondary Disciplinary Alternative Education Program serves students in grades 6 through 12 who have been referred to the program due to severe or repeated violations of the Houston ISD Code of Student Conduct or because of reasons defined in Chapter 37 of the Texas Education Code and have been removed from their home campus. While at the Secondary DAEP, policies and procedures established by Houston ISD and the Secondary DAEP will be strictly enforced.

The primary focus of the Secondary DAEP is to help guide students toward improved behavior, academic rigor, and the social skills needed so they may return to their home campus as a productive student and community member. With your support, our staff is committed to maintaining academic progress for each student within its restricted learning environment.

INSTRUCTIONAL HOURS Students: 9:45 am – 3:20 pm (5 hours) Teachers: 8:25 am – 4:10 pm

EXCEPTIONS: The Superintendent has granted exceptions to the standardized start/dismissal times for the following high schools for the 2018-2019 school year. These exceptions have already been added as a custom waiver for these schools, in order to capture approval. Principals at these campuses are asked to list this exception in the waiver section of their campus' School Improvement Plan. “16. DAEP (ELEMENTARY & SECONDARY)” TEA REQUIREMENTS FOR FULL FUNDING IN SPECIAL CASES Full ADA funding will also be provided to entities meeting any of the following requirements: 1. Dropout recovery campus(es) or program(s) operating under TEC, §12.1141(c) or §39.0548; school program(s) and campus(es) located at a day treatment facility, a residential treatment facility, a psychiatric hospital, a medical hospital, a correctional facility; or a disciplinary alternative education program (DAEP) providing 43,200 instructional minutes with any applicable waivers. CAPACITY: Currently, based on City of Houston permit, the capacity is 415 students and staff.

REGULATIONS: Texas Education Code Chapter 37 defines DAEPs by physical setting and a limited set of requirements associated with curriculum and teachers.

House Bill 811:

TEC §37.001(a)(4) is amended to add two new conditions that must be considered to determine what is in the best interest of the student before ordering a suspension, removal to a disciplinary alternative education program (DAEP), expulsion, or placement in a juvenile justice alternative education program (JJAEP):

(E) a student's status in the conservatorship of the Department of Family and Protective Services; or

(F) a student's status as a student who is homeless.

House Bill 692:

TEC §37.005 is amended to prohibit the out-of-school suspension of homeless students unless the student engages in certain behaviors defined by TEC §37.005(c)(1)-(3) while on school property or while attending a school-sponsored or school-related activity on or off school property.

PURPOSE The purpose of the Houston ISD Secondary DAEP is to provide students with the ability to maintain academic success in a school setting while addressing behavior and/or disciplinary issues.

PROGRAM DESCRIPTION Students in grades 6 through 12 may be placed in a DAEP setting because of severe or repeated violations of the Houston ISD Code of Student Conduct or because of reasons defined in Chapter 37 of the Texas Education Code, have been removed from their home campus are subject to placement in DAEP.

A student who is expelled for an offense that otherwise would have resulted in placement in DAEP does not have to serve a placement period in DAEP in addition to the expulsion. In deciding to place a student, regardless of the action resulting in a mandatory or discretionary placement, the district/campus will take into consideration the following:

1. Use of self-defense. 2. Intent or lack of intent at the time the student engaged in the conduct. 3. Disciplinary history. 4. Disability that impairs the capacity to appreciate the wrongfulness of the

conduct.

SOCIAL & EMOTION LEARNING/STUDENT DISCIPLINE

REVISED: 9/4/19 (GAVITO) CHECKLIST FOR ASSIGNMENT TO A

DAEP/JJAEP

Document incident in Student Information System (SIS): PEIMS Event/Reason Code, all PEIMS exclusionary Action Codes associated with this offense (i.e. out/in-school suspension, DAEP, JJAEP), police file number if applicable, detailed description of incident and if more than one student is involved, each student’s level of participation must be posted in SIS.

Law & Code permit an administrator to override TEC Chapter 37 and local requirements (T.E.C. 37.001(a)(4)). However, it is of utmost importance that all criminal activity be posted in the District's Student Information System (SIS). NOTE: An administrator must address and document the incident but is not required to suspend or refer to DAEP or JJAEP.

Factors to be considered. The following factors must be deliberately considered in every decision involving exclusionary consequences: (1) grade level and age of student; (2) verified intent to commit the offense; (3) discipline history including documentation of prior and substantial discipline concerns and incidents and subsequent interventions and supports; (4) self-defense as a mitigating factor; (5) inability in understanding the seriousness and the impact of the offense; (5) student’s status in the conservatorship of the Department of Family and Protective Services; and, (6) student’s status as a student who is homeless.

Special Education, 504, and English Learners (EL) regulations and procedures must be followed for

all identified students and for students, not yet identified, but referred for evaluation. Special Education Managers must review and sign-off on every SPED-related referral. All identified SPED and 504 students require a manifestation determination review. All documentation for EL students must be in compliance with all applicable procedures and requirements.

Provide student with due process/Parent Conference. Decisions to assign a student to a DAEP shall not be made until a formal conference has been held with the parent (JJAEP placements require formal hearing). The conference/hearing should be scheduled within three (3) days from the date of the offense and should be held within seven (7) days from the date of the offense. Document conference details including a list of those present. A parent may waive the right to a JJAEP hearing and agree to the expulsion, but this must be documented through a signed Notice of Waiver.

Communicate with parents/guardians. Send notice of recommended DAEP/JJAEP assignment to parent/guardian. The notice should be specific to the offense(s), to the length, and to the time and place for the conference/hearing. Parent must be informed that if unable to attend they must contact the campus to reschedule or make other arrangements. Note: if the administrator has documented a good-faith effort to inform the parents/guardians of the procedures without reciprocal response, the administrator may proceed with the conference and send notice to the parent of the decision.

Letter of Recommended DAEP/JJAEP Assignment. All written communications with parent/guardian must be in the language of the parent/guardian whenever possible. Communications must be clear and precise as to why the student is being removed, the length of removal, and all applicable appeals procedures (including who, where, and how to contact).

Submit referral via the on-line DAEP/JJAEP Referral application and follow through by providing all

PROGRAM CHARACTERISTICS CLASS SIZE: maximum of 15 students per teacher (per law) and to ensure students with disabilities have access to appropriate staff and resources.

SPECIAL EDUCATION / 504 STUDENT MANAGEMENT All Change of Placement ARDs are to be conducted by the home school, both upon entry and exit. THE DAEP CURRICULUM is focused on providing students functional academic, social, and daily living skills; includes job preparation; is relevant to students' economic and social experiences; and is delivered flexibly through a variety of innovative, nontraditional methods. Instruction is self-paced, individualized, challenging, and appealing to student interests. A major goal of curriculum and instruction is to provide students with successful experiences that improve behavior, self-esteem, and attitudes.

Teachers use Houston ISD curriculum documents in planning and delivering content. In addition, the Houston ISD pacing calendar is used to ensure students entering and leaving the Secondary DAEP are where all other students are within the curriculum. Students may choose from a variety of course offerings and electives. Academic support is provided for students who are not on grade level.

In addition, the Secondary DAEP, with input from the student, develop and individualized student plans and written contracts that formalize expectations including attendance for the length of their placement at the DAEP and for their success after their return to their home campus.

TECHNOLOGY/ INTERNET USE Secondary DAEP website: https://www.houstonisd.org/daep

• High school students must return their school issued laptops to their home school if they did not do so when they withdrew.

• Scholars will have numerous opportunities to access the Internet. Inappropriate use of the Internet and/or computer hardware and software will result in discipline and/or the loss of access to computers. Scholars should never access or download games or unauthorized software.

INSTRUCTIONAL TECHNOLOGY Using district approved technology hardware and applications Secondary DAEP integrates technology with instruction to help foster active learning.

• Laptops- Students use DAEP laptops on campus to access and complete assignments. Campus wide there are 15 laptop carts.

• Computer Lab- Students have access to a computer lab (teachers must reserve lab). The lab has 16 desktops, scanner, and printer.

COURSE OFFERINGS AND CREDITS AT DAEP Students may lose credits or course grades because courses offered at the home school are not offered at the DAEP. According to the Texas Education Agency, DAEP’s are required to offer only basic core courses (English, Social Studies, Math, Science, and Reading. Additionally, a DAEP must provide instruction in behavior.

The Houston ISD grade reporting schedule will be followed: Middle and High School will receive progress reports at the end of the third week and grades at the end of the six weeks. Progress reports and Grade Cards are sent home with the students.

A student loses not only privileges and opportunities but also endangers his/her academic record due to placement at the DAEP. Because of this, it is possible that repeated placements may impact the student so adversely that completion of a high school diploma program within the usual four years may be difficult to achieve.

DISCIPLINARY SYSTEM is based on a clear, strict, and fair discipline code that serves to develop student coping skills, self-control, and problem-solving abilities. The system includes positive and negative consequences for student behavior.

PARENT INVOLVEMENT. The program promotes parent involvement in their students' education, throughout their student’s placement, from admissions and orientation through the Bridge-Out process. There are also opportunities through parent conferences and student progress conferences. Parents are also invited to participate in Parent University exhibitions where, with community services, help students gain access to a range of services and training opportunities outside the schools, including: health and human services; services through the juvenile justice system; and employment, career, and vocational training.

STUDENT SUPPORT SERVICES AT THE SECONDARY DAEP COUNSELING The program helps students and their families gain access to counseling services through community and state programs. Students are provided academic and behavior counseling opportunities.

Counselors have an active and vital role in each student’s life beyond a crisis call. Counselors meet with students individually and in groups to help determine ways for the student to be successful. There is a small student-to-counselor ratio. Counselor input into the Bridge-Out process gives the sending school a guide for assisting the student in re-entry and success upon their return. The counselors help students in creating academic, behavioral, and social skills for success in the community and life.

WRAPAROUND SERVICES The Secondary DAEP also provides access to robust wraparound services, drug and alcohol abuse counseling and other student support services.

OTHER FEATURES: • Targeted use of instructional technology, with a balance of computer-assisted and

teacher-directed instruction • Special education services • Strong focus on effective classroom management techniques • Individual and group counseling • System of reduced privileges and rewards, tracked on progress charts

o Incentives to encourage student behavioral progress (e.g. shortened stay at the DAEP)

• Ensures safety and security by maintaining consistent enforcement of school-wide rules and procedures and comprehensive student supervision

• Students receive ongoing, long-term counseling, psychological, and support services

SAFETY AND SECURITY USE OF POLICE OFFICERS In cases where a student’s misbehavior is a direct violation of law, police officers will be summoned. Student will be told of the violation and may be issued a citation and given a court appearance date. After a citation has been issued, the student may also be suspended for a period of days after which the parent must attend a conference with an administrator. Depending on the reason for the citation, the incident may be cause for an expulsion hearing.

USE OF LAW ENFORCEMENT AGENCIES DAEP cooperates with all law enforcement agencies. Probation Officers will be contacted to report good and bad behavior. Warrants (arrest) may be initiated upon our students by appropriate authorities while they are on our campus. These situations are beyond our control as warrants are issued by a judge. Communication to the parents about the student's detention and release conditions are the responsibility of the arresting agency.

PHYSICAL RESTRAINT This intervention is used as a last resort by staff trained in Non-Violent Crisis Prevention Intervention (NVCPI) techniques. Physical Restraint is allowed by HISD School Board Policy FO-Local. Restraint will only be used if an employee reasonably believes that restraint is necessary in order to:

A. Protect a person, including the person using physical restraint, from physical injury. B. Obtain possession of a weapon or other dangerous objects. C. Protect property from serious damage

DAILY CHECK-IN SECURITY PROCEDURES A FULL SEARCH IS MADE UPON ARRIVAL. METAL DETECTORS ARE USED. CLOTHING AND POSSESSIONS WILL BE SEARCHED.

Ensuring order and safety is a vital part of the social, emotional, and academic educational program offered at the Secondary DAEP. Students assigned to the Secondary DAEP walk through metal detectors daily and are subject to daily searches

of their person, any possessions, and assigned materials upon arrival at school. During all daily searches, the following procedures will be used as a guide:

• Student will wait patiently wait in line • Student will remove shoes, belt, and any outerwear • Student will turn pockets inside out and give all items to staff • Student will walk through metal detector • Student will be patted down the legs, arms, and back by a staff member of the

same gender NOTE: Additional searches may be conducted at any time by an administrator who has been specifically trained to recognize and respond to reasonable suspicion.

TRANSPORTATION • For 2019 -2020, Houston ISD Transportation department will provide bus service to

grades 6-8 only. • Grades 9-12 must use Metro (Metro Q- Cards will be paid for by Houston ISD)

BEHAVIOR CONSEQUENCES FOR VIOLATION OF BUS RULES Established per Code of Student Conduct and DAEP policy (communicated and reviewed with parents/students): Serious/documented violations of bus rules on HISD buses will result in permanent removal of bus transportation privilege.

HISD Bus Policy • Remain seated in an orderly manner facing forward. • Students shall keep arms, legs, head, and all personal effects • inside the bus and out of the aisle. • Students shall not eat or drink, including candy and gum, or use • of tobacco products while on the bus. • Students shall not mark or deface the bus and/or its equipment. • Any damage done to the bus is chargeable to the parent of the • Student responsible or the damage. • Students shall not fight, scuffle, throw objects, or possess/use laser pointers inside

or outside of the school bus or the bus stop. • Student shall use appropriate language while on the bus and shall not engage in

conversations or activities considered to be vulgar, abusive, or demeaning.

ENROLLMENT/PLACEMENT PROCESS LENGTH OF PLACEMENT (see GUIDELINES - SECONDARY DAEP)

STUDENT ASSIGNMENT LENGTH EXCEPTIONS Student assignments to the DAEP may be reduced by one day for every full week (Monday-Friday) the student has had perfect attendance with no behavior referrals and has demonstrated academic engagement.

EXTENSIONS TO PLACEMENTS Extensions to a student’s placement are made at the discretion of the Secondary DAEP.

PARTICIPATION IN EXTRA-CURRICULAR ACTIVITIES / TRESPASSING

Students assigned to a DAEP may not enter any school district properties, including those of districts other than Houston ISD, while they are assigned to the Secondary DAEP. If seen on a district property other than the Secondary DAEP, the student is subject to being charged with trespass and given a ticket. Students are not allowed to participate in or attend any extra-curricular activities sponsored by any school district within the State of Texas.

This is in compliance with TEC, Chapter 37, Sub Chapter A, which states that students who are assigned to a DAEP are prohibited from attending or participating in school-sponsored or school-related activities. Students will not visit or participate in activities at other campuses in the district. Failure to abide by these rules may result in an extension of your placement at DAEP and/or a citation for criminal trespass.

INTAKE PROCESS REFERRING SCHOOL IS REQUIRED TO (PRIOR to Withdrawal):

• Verify demographic information is correct in Chancery • School Referral Commitment Form (with calendar dates) • Referral to DAEP Record of Parent Conference • Withdrawal Form with correct signatures and grades listed • HISD Transfer Department has been given the scholar’s name that will be enrolling

at the DAEP

ENROLLING AT THE SECONDARY DAEP Parents may register their students at the DAEP on Monday, Wednesday, and Thursday. The student and their parent or guardian must be in attendance and observe the following arrival times:

Middle school must arrive between 8:30 and 8:45am.

High school must arrive between 1:15 and 1:30pm.

Upon arrival to the DAEP students are enrolled by their parents and begin matriculating through the program to complete their assigned days. starting with the intake process.

1. Lead Counselor assigns student to a counselor and assistant principal. 2. Bridge in:

a. Parent enrollment forms completed b. Parent orientation c. Parent in-take interview d. Student Assistance Questionnaire Review e. Bus route assistance

3. Student start 1st day at Secondary DAEP

PARENTS/GUARDIANS ARE REQUIRED to bring the following documents: 1. Birth Certificate, 2. Proof of Identity of Parent/Guardian, 3. Proof of Residence, 4. Social Security Card, 5. Immunization record, and 6. If applicable most recent prescriptions/orders signed by Healthcare

provider/Doctor

In addition, Parents must bring all withdrawal documents provided to you by the home school:

1. Withdrawal papers with current grades, 2. Most recent report card, 3. Personal Graduation Plan (PGP) for high school only, 4. Campus Enrollment Information, and 5. School Referral Commitment Form

ASSESSMENT & ENROLLMENT “FREEZES” During standardized assessment periods Secondary DAEP enrollment will freeze in order to accommodate testing mandates and procedures.

ORIENTATION

Students and a parent or guardian are required to attend an orientation meeting with the Houston ISD Secondary DAEP. During the intake meeting the policies, procedures, and expectations will be explained. The handbook will be reviewed with both the student and parent.

CULTURE CLASS

The student’s first day in the Secondary DAEP begins the day following enrollment. Their first full day is spent in Culture Class, where students are taught expectations in more detail and given opportunities to practice prior to joining the general population.

ATTENDANCE AND TARDIES Attendance will be reported daily. Days missed due to absences must be made up before a student may be considered for release. Students are required to bring a written note from a parent/guardian for any absence. The note shall include the date, reason, and be signed by the parent/guardian. Should a student need to see a doctor, then a note from the doctor/office is the most appropriate documentation. For court appearances, the judge or his designee shall issue appropriate documentation.

Note: A student may be denied credit and placement extended should they be in violation of the state compulsory attendance requirements.

A student is tardy after 9:45 am. A student shall bring a signed note from the parent/guardian when they are late. Excessive tardies may result in disciplinary action.

ATTENDANCE PROTOCOL 1. Excessive absence report to identify those scholars who have 3 or more absences.

REVIEW & TRANSITION Student placement is subject to review prior to returning to their home campus. A review meeting will be scheduled, and the parent is required to attend. A transition plan will be established and sent to the home campus. All necessary materials will be returned to the home campus upon the student’s release from DAEP.

HB 2184 RELATING TO A PUBLIC SCHOOL STUDENT’S TRANSITION FROM AN ALTERNATIVE EDUCATION PROGRAM TO A REGULAR CLASSROOM House Bill 2184 amended Chapter 37 of the Education Code by adding Section 37.023, titled “Transition From Alternative Education Program To Regular Classroom.”

These requirements apply to DAEPs operated by a school district or open-enrollment charter school; juvenile justice alternative education programs; and residential programs or facilities operated by or under contract with the Texas Juvenile Justice Department, a juvenile board, or any other governmental entity.

The law requires DAEP administrators to provide written notice of the date of the student’s release from the DAEP to the student’s parent or guardian and the administrator of the campus to which the student intends to return.

No later than five instructional days after the date of a student’s release from the DAEP, the campus administrator shall coordinate the student’s transition to a regular classroom. The coordination must include assistance and recommendations from:

1. school counselors 2. school district peace officers 3. school resource officers; 4. licensed clinical social workers; 5. campus behavior coordinators 6. classroom teachers who are or may be responsible for implementing the student’s

personalized transition plan, and 7. any other appropriate school district personnel.

The purpose of the meeting is to determine recommendations for the best educational placement of the student, as well as include recommendations for:

1. counseling, behavioral management, or academic assistance for the student with a concentration on the student’s academic or career goals

2. recommendations for assistance in obtaining access to mental health services provided by the district or school, a local mental health authority, or another private or public entity

3. the provision of information to the student’s parent or guardian about the process to request a full individual and initial evaluation of the student for purposes of special education services under Section 29.004

SECONDARY DAEP TRANSITIONS TO HOME SCHOOL

TRANSITION AND BRIDGE-OUT Once a student completes his/her assigned days they will go through a Bridge-Out process to transition to their home campus. The goal is for students to return to, remain at, and succeed in, their regularly assigned classrooms.

Successful transition of students from DAEP to the regular classroom is crucial to the students’ academic success. The home school will:

1. Receive meeting invite from Bridge Out Specialist at the DAEP sent to the transition liaison at the home school

2. The transition liaison should: a. accept meeting invite or decline with alternate availability, or forward to

an administrator who can sit in on the liaison's behalf b. forward meeting invitation to support staff (wraparound specialist, CIS,

counselor, social worker, supportive teachers) 3. All meetings take place on the home campus at the designated time on the

invitation 4. Bridge Out Specialist will facilitate the meeting (student report, DAEP report,

administrator)

STUDENTS WITH 15 DAYS OR LEFT AT THE END OF THE SCHOOL YEAR / RETURNING TO HOME SCHOOL A student may be released prior to the end of the student’s assigned days, when the assigned length of placement would end within 15 days after the start of the next semester for high-school students and within 15 days after the start of the next grading cycle for middle-school students.

Therefore:

• Middle school students with 15 or fewer days remaining will be released at the end of the six-week grading period.

• High school students with 15 days or fewer days remaining will be released at the end of the current semester.

Consideration for 8th grade students promoted to 9th grade being released should be taken into account to best meet academic program needs.

SECONDARY DAEP SUMMER SCHOOL • TWO OPTIONS FOR TRANSPORTATION: Parent Pick-up or Metro Transit System. • Criteria for summer session:

– Students who failed to meet promotion standards and have an overall yearly average of less than 70 (calculated from the final averages of all courses taken during the regular school year) and

– scholars who failed STAAR Mathematics and/or Reading • Cluster for over age scholars to work on Edgenuity during the summer school

session. • Middle school courses offered: ELA, Mathematics, Science, Social Studies. • High school scholars will be able to recover credit for NG’s and eliminate

attendance discrepancies. • Scholars who will NOT be able to attend the summer session on our campus are

as follows: – Students who desire to complete referral days during summer and have

met promotion standards – Students who are only required to retake the STAAR Assessments (only

required to come on campus the day of their test) • Students who incur disciplinary infractions will be dismissed from summer school

and retained for the school year.

• If the student’s last day to complete DAEP referral is the last day of school, the student will be notified to attend summer school at their home campus.

• Bridge-outs will be scheduled and conducted on the agreed day and time of the scholars' home campuses.
