A contractor orsubcontractor whodoesn’t get paid in atimely fashion canhold up a homeown-er’s sale or refinanc-ing.
DEAR MR.MYERS: We werereviewing thepaperwork for theupcoming pur-chase of our newhome, and noticedthat the sellerowes $4,222 for a“mechanic’s lien”that must be paidbefore the dealcan close. What isa mechanic’s lien?
ANSWER: It’s alien that’s filedagainst a homeown-er, usually by a gen-eral contractor orsubcontractor, whohas gone to courtand provided evi-dence that he or shewasn’t paid for ser-vices or materialsneeded to completethe job.
Your question is atimely one, as thepeak remodelingseason is gettingunder way.
Let’s say that you
hired a plumber tore-pipe a couple ofrooms but thenrefused to pay thebill. The plumbercould go to court,obtain a judgmentfor his unpaid ser-vices and materials,and then slap amechanic’s lienagainst your homefor the total amountyou owe him.
The lien wouldprevent you fromrefinancing or sell-ing the home untilthe plumber got allof the money he isowed.
More often,though, mechanic’sliens stem from ageneral contractorwho gets into a dis-pute with a subcon-tractor -- a squabblethat leaves thehomeowner caughtin the middle.
To illustrate, sayyou hire a generalcontractor for amajor remodelingjob that includes theaddition of two new
bedrooms and abathroom. The GCthen hires severalsubcontractors tohelp complete thejob, including anelectrician, a rooferand a tiler.
You’re happy withthe job, and the gen-eral contractor ispaid in full. But afew months later,the electrician sendsyou a bill for $2,500for the work andmaterials that hesupplied. It was thegeneral contractor’sduty to pay the elec-trician, but he keptthe money for him-self instead.
The subcontractorwould then have theright to file a lienagainst your proper-ty for his unpaidwork. If you’re fortu-nate, he might bewilling to settle thematter for, say, 50percent of the totalbill. You could thensue the general con-tractor in smallclaims court to get
the rest of yourmoney back, butgood luck; if the GCwouldn’t pay thesubcontractor, heprobably won’t payyou either.
There are a coupleof ways to help youavoid such possiblepitfalls. One is toinsist that the con-tract you initiallysign with the gener-al contractorincludes a provisionthat calls for him toproduce a perfor-mance bond, some-times called a com-pletion or contractbond, which is basi-cally a short-terminsurance policythat will reimburseyou if the contractordoesn’t fulfill all ofhis contractualresponsibilities.
A performancebond can be expen-sive, so many gener-al contractors balkat paying for one.An alternativewould be to includea “lien waiver” in
the original contractthat requires thecontractor to sign astatement indicatingthat all of the laborand materials forthe project havebeen paid beforeyour next install-ment payment isdue.

MYERS: How longwill the bankrupt-cy I filed a fewyears ago stay onmy credit record?
ANSWER: If youfiled Chapter 7 --often called a“straight” bankrupt-cy because nomoney is repaid toany creditors -- it’llstay on your recordfor 10 years fromthe date of the fil-ing.
If you instead filedChapter 11, whichrequires that at
least some of thedebt is paid back,it’ll stay on yourcredit record forseven years fromthe filing date.

MYERS: A homewe like was listedfor $214,000, andwe made a full-price offer. Theseller then made acounteroffer for$220,000. Isn’t helegally obligatedto sell the houseto us because ourinitial offermatched his$214,000 askingprice, or does hehave the right totry to squeeze usnow for an extra$6,000?
ANSWER: I getthis type of questionevery time that thehousing marketheats up (as it has
now) and manyhomes start drawingmultiple offers frombuyers.
Sorry, but the sell-er isn’t legally oblig-ated to sell his hometo you, even thoughyou offered to payhis full asking price.He didn’t sign a con-tract accepting youroffer, so he’s free tolook for a buyer whois willing to payeven more.
If he can’t findsuch a buyer andthen decides toaccept your original$214,000 bid, youwon’t have any legalobligation to gothrough with thedeal, either. That’sbecause your origi-nal offer was auto-matically renderednull and void themoment he made acounteroffer for$6,000 more.

Spring is the timeof the year whenmany of us start tothink about freshen-ing up our interiors.The most economi-cal and dramaticchange can be assimple as a freshcoat of paint. We allagree that freshlypainted walls canmake any space lookamazing, but choos-ing the right paintcolor can be daunt-ing. The task is sooverwhelming tosome that they justgive up and repaintusing the samecolor.
I recently spentsome time withBenjamin Moorecolor expert EllenO’Neill to talk abouttrends, color person-
alities and tips forpicking the perfectcolor for your home.Here’s her advice:
Don’t concernyourself with trends.O’Neill likes to con-sider her company’sproducts as backupsingers to trends.The staff trackssales, images onsocial media sites,domestic and foreignhome furnishingsshows and market-places. But theseefforts don’t createcolor trends. Theycompany’s goal is todevelop a colorpalette that willenhance new colorsand looks that areemerging.
This year’s backupsingers are ground-ed in greens andplums. The shadesof green take inspi-ration from a citrusgrove, a pot of lemonverbena or a sprig of
silver sage. Plumcomes in shades aspale as a rose petalor as rich as black.
The colors are allinspiring and beau-tiful, but how do youmake a choice?O’Neill recommendsyou take time to rec-ognize your “colorpersonality.” We allhave one. This is thecolor palette thatfills your closet andthat you gravitatetoward in decoratormagazines, onlinesites such as Houzzand Pinterest, andin furniture stores.Knowing your colorpersonality can saveyou costly mistakeswhen selecting paintcolors.
Once you knowyour color prefer-ences, try being alittle more playful.Find a fresh tone ortwo within yourcomfort zone and
try them. Purchasea sample bottle or aquart of that colorand paint a large 2-by-2-foot sample onyour wall. Live withthat color for aweek, taking note ofhow the lightchanges that colorthroughout the day.If you still enjoy thecolor, go for it.
If you don’t havethe time or spunk totry a new color for aroom, considerpainting just onewall, the trim in aroom, the fireplacemantel or a woodaccent chair. On theexterior, add a newcolor to your shut-ters, front door, win-dow boxes or a trel-lis. The new colorwill give your homea fresh look andspeak volumesabout who livesbeyond the front
door.I was curious as
to why a color fallsshort of a matchwhen I try to haveanother manufac-turer reproduce acompetitor’s prod-uct. O’Neill saidevery manufacturerhas its own formu-la. When you mixcolor pigments witha different formula,the resulting coloris always different.If you find a colorthat you love, buythe real thing.
What colors doesa color expert usein her own home?O’Neill, just likeme, tends to live inwhite rooms withsurprises such asdeep red librarywalls or a blackoffice. But don’tthink we are cop-ping out by paint-ing our walls white.
Choosing the per-fect shade of whiteis one of the tough-est color selectionsyou can make.
