Summary of Proposed Amendment

Objective

The purpose of the amendments is to ensure all stakeholders understand their roles and responsibilities in order to meet MRP compliance.

Changes made

RA 1010 – Clarification on the Tier classification for sites, establishments, base or buildings in order to ensure the Head of Establishment complies with the MRP correctly. Amendments address a number of RFCs, resulting from RC confusion over the content, and align the RA better with RA 1026.

RA 1026 – Amendments made to the Rationale to avoid ambiquity and therefore confusion within the RC when it comes to determining when an Aerodrome Operator is required. Rationale also amended to reflect the importance of the effective management of a DAM and DAAF in order to provide assurance of a SOE. Amendments to ‘Tier 3’ classification throughout RA to ensure it aligns better with RA 1010. These amendments address a number of RFCs.

Impact Assessment

There is expected to be minimal impact to the Regulated Community (RC). The amendments will clarify Head of Establishment and Aerodrome Operator requirements.

RA 1010 - Head of Establishment - Aviation Responsibilities

Rationale The Head of Establishment (HoE) is responsible for actively providing a Safe Operating Environment (SOE) for Air Systems on MOD aerodromes,►◄ Air Weapons Ranges, Electronic Warfare Ranges, aviation capable ships and Helicopter Landing Sites (HLS), in order to meet their Duty Holder-Facing (DH-Facing) responsibilities in accordance with (iaw) RA 10201 or RA 10242 as appropriate. Providing a SOE also enables the HoE to meet their legal Duty of Care responsibilities for all aerodrome users.

1. SOE. In Defence Aviation, a SOE is established when aviation operating surfaces, infrastructure, facilities, personnel, equipment and procedures are managed iaw regulatory and policy documents.

2. HoE. The HoE is the most senior MOD person nominated (or in the case of civilian organizations, the most senior representative appointed by that organization), as responsible for the site, establishment, base or building3.

1010(1) The HoE shall deliver their Duty of Care responsibilities supporting aviation activities, iaw the Classification Tier of their site, establishment, base or building.

3. Any MOD location where there is permanently based Aviation Duty Holder (ADH) / Accountable Manager (Military Flying) (AM(MF)) aviation activity ►should be classified as Tier 1. This includes Air Weapons Ranges, Electronic Warfare Ranges, MOD Heliports and unlicensed civilian Heliports operated under Contractor Flying Approved Organization Schemes (CFAOS) approval◄ The HoE should comply with the Regulations at Annex A Table 1, where applicable.

4. Any MOD location, ►with the exception of a Temporary Landing Zone (TLZ),◄ that is used for ad-hoc ADH / AM(MF) fixed-wing aviation activity and / or where recreational flying is the primary activity, should be classified as Tier 24. The HoE should comply with the Regulations at Annex A Table 2, where applicable.

5. When TLZ are established at locations iaw RA 35505, the ►Aircraft◄ operating authority should co-ordinate the Duty of Care and SOE responsibility in conjunction with the HoE6 for the duration of the activity. The Air System operating authority should also produce a Letter of Agreement or equivalent, for HoE approval.

6. ►A MOD HLS where there is no permanently based ADH / AM(MF) aviation activity◄ should be classified as Tier 3. The HoE should comply with the Regulations at Annex A Table 3, where applicable.

7. ►Any MOD location, or civilian location regulated by the MAA, considering the use of a Remotely Piloted Air System as the only activity, should consult the MAA to discuss the regulatory requirements with regards to the provision of a SOE◄.

1010(2) The HoE shall deliver their Duty of Care responsibilities where aviation activities are conducted within their site, establishment, base or building, through the provision of a SOE.

9. The HoE should carry out the actions detailed in RA 10267 in order to maintain an SOE, by ensuring the following:

a. They have an effective knowledge and understanding of the ►MAA Regulatory Publications◄8 that prescribe relevant safety standards, practices and key issues of risk management within the site, establishment, base or building. In addition, the HoE should know how they are applied and the essential interaction with all aerodrome users iaw RA 1020(4)9.

b. They understand the requirements for SQEP in aerodrome management iaw RA 1026. Where deemed appropriate, they appoint an Aerodrome Operator (AO) or Aerodrome Supervisor (Recreational Flying) (AS(RF)), to ensure the development and Maintenance of a Defence Aerodrome Manual8 or, Aerodrome Safe Operating Environment Manual8.

10. Where it is determined that an AO or AS(RF) is not required, the HoE should ensure that alternate safe operating practices are in place where aviation activity occurs.

11. Infrastructure works should be carried out iaw regulatory and policy documents.

12. ADH, AM(MF) or other operators, should be informed if there is a reduction in the level of resources or abnormal circumstances which might affect the SOE.

RA 1026 – Aerodrome Operator and Aerodrome Supervisor (Recreational Flying) Roles and Responsibilities ►◄

Rationale Heads of Establishment (HoE)1 are responsible for actively providing a Safe Operating Environment (SOE)2 for all Air Systems on MOD Estate. ►HoE are responsible for appointing an Aerodrome Operator (AO) at MOD Tier 13 sites, and Tier 2 sites where recreational flying is not the primary activity,◄ where Aviation Duty Holders (ADH) ►and / or◄ Accountable Managers (Military Flying) (AM(MF)) ►manage◄ Risk to Life (RtL) ►◄. The appointment of an AO, along with the production of ►an effective◄ Defence Aerodrome Manual (DAM) ►and Defence Aerodrome Assurance Framework (DAAF)◄ provides assurance to the ADH, AM(MF) and any other operators of a SOE. For the assurance of non-MOD Aerodromes or ►Tier 33◄ sites, the ADH / AM(MF) or HoE may consider the creation and maintenance of an Aviation Safe Operating Environment Manual (ASOEM). At MOD Aerodromes where there are no ADH / AM(MF) ►managed◄ RtL but recreational flying activity4 is conducted, HoE are responsible for appointing an Aerodrome Supervisor (Recreational Flying) (AS(RF)). The appointment of an AS(RF) along with the production of an ASOEM, provides assurance to the HoE and Aerodrome stakeholders of a SOE. However, when considered appropriate, the HoE retains the option to appoint an AO to produce and maintain a DAM ►and DAAF.◄

1026(1) The HoE shall execute their responsibilities facing ADH ►◄ / ►◄ AM(MF) by nominating a Crown Servant AO for all MOD ►Tier 1◄ Aerodromes used by Air Systems for which an ADH ►◄ / ►◄ AM(MF) has responsibility for RtL ►and those Tier 2 Aerodromes where recreational flying is not the main aviation activity.◄

1. The HoE should co-ordinate with Front Line Commands (FLC), ADHs, AM(MF)s and other relevant ADH-Facing organizations to identify which Aerodromes within their Area of Responsibility (AoR) require an AO.

2. The HoE should provide the nominated AO for each MOD Aerodrome with a Letter of Authority and corresponding Terms of Reference (TOR).

3. There is no requirement for the AO to be based at the Aerodrome. Day-to-day management of the Aerodrome may be delegated, but the AO retains full responsibility.

4. The HoE may nominate an AO from outside their Chain of Command, subject to the agreement of all parties concerned, and provided that all necessary levers are made available to the AO by the HoE.

5. Commanding Officers of ships with aviation facilities may act as the AO for their individual platform in accordance with (iaw) the qualification requirements of paragraph 16.

6. The nomination of an AO at some Aerodromes will involve the overlap of HoE, ADH, AM(MF), ADH-Facing organizations and FLC’s AoR. In these circumstances the nomination and empowerment of the appropriate individual as AO will require co-ordination and agreement between some or all of these agents, as well as the individual’s chain of command.

r NPA7. An MOD Aerodrome in the context of this RA is defined as a MOD site,

establishment or base into which Air Systems operate. This includes the flight decks of any Royal Navy (RN) / Royal Fleet Auxiliary (RFA) ship capable of having aviation assets embarked. For MOD sites, establishments or bases ►classified as Tier 3◄ see RA 1026(6).

1026(2) An AO shall be responsible for the management of an MOD Aerodrome environment to support the safe operation of Air Systems.

8. An AO supports the HoE to discharge their responsibilities regarding the provision of a SOE for all Air Systems5. The AO should ensure that Aerodrome management and operations activity is fully integrated into all relevant Air Safety Management Systems6 (ASMS).

9. Specifically, the AO should:

a. Establish and maintain formal mechanisms for the management of all Aerodrome activities, operating procedures, standards, flight safety and regulatory compliance within their AoR, through the production and maintenance of a DAM, which is ►an◄ accurate, up to date ►living document, using the latest published template, where amendments are made when changes occur, and the latest version published online.◄

b. Establish and maintain a programme of 1st Party assurance of the DAM through the recording of activity in the DAAF. Ensure Aerodrome assurance activities are carried iaw the MRP and reference documents referred to in the DAM Notes for Completion.

c. Identify and monitor any decision, activity or change in circumstances that results in a hazard or change to the Aerodrome or its facilities. k. Ensure that adequate Aerodrome Rescue and Fire-Fighting services (ARFF) are provided and an Aerodrome emergency plan is developed and maintained iaw the Manual of ►Aircraft◄ Post Crash Management, RA 143015, RA 3261 and DFSR 02 DSA16, 17.

l. Assure the accuracy of Aerodrome data and aeronautical information iaw RA 103018.

12. The list of responsibilities in AMC to RA 1026(2) does not preclude the HoE from assigning the AO additional responsibility that supports the safe operation of Air Systems.

13. Where host nation or multi-national relationships exist, the AO will ensure a formal agreement is produced to facilitate the safe operation of Air Systems within the relevant AoR.

b. As a formal element to succession activities to ensure the incoming AO is personally content with their ADH-Facing responsibilities.

c. Regularly, in line with relevant Risk Register reviews7.

24. The DAM should be an open-source document to ensure it is available to all Aerodrome users, unless considerations in the operational domain override the Air Safety function of the DAM.

25. The AO should ensure that a DAAF is established and maintained, in conjunction with the DAM, to collate all assurance activity. The DAAF should cover all activities within the DAM to form a full record of assurance at 1st, 2nd and 3rd party levels.

26. ►By derogation to RA 1026(2), production of a bespoke DAM is not required for flight deck equipped RN or RFA ships. Navy Command should ensure that existing arrangements for assurance and oversight are detailed in the appropriate BRd.◄

27. Whilst a DAM or DAAF is not required for those MOD Aerodromes used solely by Air Systems for which an ADH ►◄ / ►◄ AM(MF) does not have responsibility for RtL, both documents may have utility in establishing and maintaining an appropriate assurance mechanism to ensure a SOE.

28. The purpose of the DAM is to provide, in a standardized format, a mechanism to inform military and civilian operators of accurate Aerodrome information that includes physical characteristics, available services, Aerodrome hazards and operating procedures. It also provides reference material for the AO to ensure that all Aerodrome management requirements are being met and assured correctly.

29. It is acceptable for the DAM to contain hyperlinks to other documents, for example an Air Traffic Control Order Book, provided that the hyperlinks are accessible to all DAM readers.

30. The DAAF is the tool by which 1st, 2nd and 3rd Party assurance is captured so that the AO can provide assurance that the Aerodrome is being managed in a way that accommodates the safe operation of Air Systems.

31. There is no requirement to publish the DAAF as an open source document. However, the DAAF is to be made available to 2nd and 3rd Party assurance organizations on request.

If an ASOEM is to be produced, the HoE should appoint a Crown Servant as an AS(RF), to provide the specialist advice.

42. The HoE should issue the AS(RF) with a personal Letter of Authority detailing their responsibilities and TORs.

43. The HoE should be provided by the AS(RF) with internal Aerodrome assurance of operating procedures, standards and flight safety.

44. The ASOEM should be managed by the AS(RF) and considered as a living document, subject to regular review and amendment in consultation with appropriate stakeholders:

a. Prior to / following any change or new activity that may impact the SOE.

b. As a formal element to succession activities to ensure the incoming HoE or AS(RF) are content with their responsibilities.

c. At least 6-monthly.

45. The HoE, in consultation with the MAA, needs to ensure that the AS(RF) is SQEP for the position, as a minimum, have previous command and / or supervisory experience within a flying squadron or Air Operations at a Standard Aerodrome, or be a current Civil Aviation Authority qualified Flying Instructor.

46. The ASOEM Template is recommended to be used as a ‘handrail’ to ensure that all elements of operating from the MOD Aerodrome are considered. Where existing documents cover the information required in the ASOEM, the information need not be duplicated and a simple reference to the source document maybe inserted. 47. An AS(RF) enables the HoE to discharge their responsibilities regarding the provision of a SOE33. The AS(RF) should ensure that Aerodrome management and operations activity is fully integrated with all appropriate stakeholders.

48. Specifically, the AS(RF) should:

a. Establish and maintain formal mechanisms for the management of all Aerodrome activities, operating procedures, standards, flight safety and regulatory compliance within their AoR, through the production and maintenance of an ASOEM, which is accurate, up to date and is subject to at least 6-monthly formal review.

b. Identify and monitor any decision, activity or change in circumstances that results in a hazard or change to the Aerodrome or its facilities. These hazards or changes should be communicated through effective formal relationships with the HoE and appropriate stakeholders.

c. Promulgate Aerodrome operating hazards through the ASOEM Hazard Log, to facilitate the conduct of timely risk and change management. The ►ASOEM◄ Hazard Log should be subject to formal review at least quarterly, in addition to being added as an agenda item to all Air Safety meetings. The AS(RF) should ensure amendments are captured, discussed and forwarded to the HoE and appropriate stakeholders.

d. Ensure that an appropriate Aerodrome wildlife risk management programme is considered in consultation with the HoE iaw RA 32708.

e. Ensure that all personnel who need to enter the movement area or other operational areas are both trained and qualified.

f. Ensure that appropriate safety management arrangements are established with all other Aerodrome users, to maintain safe operating practices.

g. Schedule Aerodrome inspections and surveys to ensure that the Aerodrome remains safe and compliant iaw RA 326412.

h. Consider the requirement for Rescue and Fire-Fighting provision, ensure that an Aerodrome emergency plan is developed and maintained, to the satisfaction of the HoE.

i. Ensure that incidents or occurrences are reported iaw RA 141020, Civil Air Publication 382 and the HoE is informed.
