What is DEQ?
T he Department of Environmental Quality (DEQ) came into existence on
July I, 1995, as the result of Senate Bill 234 passed by the 1995
Legislature. DEQ consists of the environmental programs from the former
Department of Health and Environmental Sciences, along with the Energy
Division from the Department of Natural Resources and Conservation, and
the Reclamation Division in the former Department of State Lands. This
handbook is designed to guide you through the DEQ.

changed our world. Ever increasing amounts of informa- now just a click away. The
Montana Department of Environmental
Quality is no exception to this trend.
In order to fulfill our mission of protect-
ing Montana's unique environment, the DEQ collects, analyzes and uses many kinds of information. Our staff utilizes complex databases in order to monitor environmental data. We use hiahlv - - technical equipment and advanced

software to model and predict changes in environmental conditions. The Department is increasingly making use of the Internet and the wealth of information it can provide.
Much of the information that the DEQ collects and uses is available to the
public. We are constantly striving to find better ways to make it both useful and accessible. In fact, the information you will find in this handbook is also available
on our website at: www.deq.state.mt.us. You will also find much, much more.
Members of our regulated community can download many of the forms and
documents they need to achieve compliance with environmental regulations.
Consumers can find tips on how to prevent pollution and save energy. Commu-
nities can check the progress we are making in cleaning up contaminated sites.
You can read and submit comments on environmental impact statements and proposed rules. We are adding new features on a regular basis.
So, I urge you to use this booklet as a starting point to finding the information
you need. Computers will never replace the skills and dedication of our DEQ professionals. As always, they remain available to assist you by telephone or e- mail.
In the years ahead, we will continue to improve our services. Your support and suggestions are always welcome.
The department is split into five divisions:
Centralized Services Division: Support element of the DEQ structure.
It includes data management, fiscal and accounting, contracts and
procurement.
Enforcement: Formal enforcement, inspection, monitoring and training,
third-party complaint investigations, and emergency spills.
Permitting and Compliance: Permit issuance and compliance
monitoring for projects relating to air, water, public water supplies, solid
and hazardous waste, subdivisions, motor vehicle recycling, open cut,
hard rock, and coal and uranium mines, and applicable facilities under
the Major Faci1i.t~ Siting Act.
Planning, Prevention and Assistance: Planning, policy and standards
development relating to air quality State Implementation Plans, water
quality, non-point source management, groundwater protection, and
solid waste management.
Remediation: Abandoned mine reclamation, hazardous spill cleanup,
underground storage tanks and leaking underground storage tanks,
petroleum tank release compensation, Comprehensive Environmental
Response, Compensation and Liability Act (federal Superfund),
Comprehensive Environmental Cleanup and Responsibility Act (state
Superfund).
The goal of each DEQ employee is to have a well-defined regulatory entity that
makes sound, understandable decisions, quickly and openly. We encourage
your thoughts, or criticisms of the department and how it works for the people of
the Treasure State.

T he Centralized Services Division provides services to the department in the
following areas: central budgeting, accounting, fiscal reporting, internal
auditing, procurement, including contracts for services and the purchasing of
supplies and equipment, and information technology services. The division
works with other state agencies, the Governor's Office, the legislative branch,
federal agencies, legislative groups, and the public regarding the fiscal man-
agement of the department.

T he Enforcement Division facilitates fair, consistent and timely enforcement
of the laws and regulations administered by DEQ. The Case Management
Bureau processes enforcement actions, calculates penalties and tracks
compliance with DEQ orders. The Complaint Management Section manages all
citizen complaints and spill reports received by DEQ.

T he Permitting and Compliance Division reviews and assesses all environ-
mental permit and license applications to determine the correct control
measures and requirements needed to meet the laws and rules that have been
enacted to protect the quality of the state's air, water, and land.
This division prepares the appropriate environmental review documents to
comply with the Montana Environmental Policy Act. This work includes coordina-
tion and preparation, of environmental impact statements, ensuring methods and
standards are consistent with department policy, and coordination with regulatory
programs in the division, the department and other state and federal agencies.
The division conducts all facility inspections and reviews reports to determine
compliance with permit conditions and the laws and regulations. If violations are
discovered, the division provides the technical assistance needed to bring the
facility back into compliance or prepares an enforcement request for further
action by the Enforcement Division.
The Permitting and Compliance Division is organized into five bureaus:

Bureau responsibilities:
lssuing air quality preconstruction and operation permits;
lnspecting and providing compliance assistance for air
emission sources;
Certifying asbestos abatement contractors;
Tracking and inspecting asbestos abatement projects;
lssuing permits for open burning activities;
Participates in the operation of the Montana Smoke Management
Program with the major open burning entities;
Issuing operating, post-closure, and corrective action permits to
hazardous waste treatment, storage, and disposal facilities;
lnspecting and providing compliance assistance to hazardous waste
generators, transporters, and recyclers.

The Community Services Bureau regulates non-hazardous solid waste management facilities and public drinking water supply or treatment
facilities in Montana. The bureau assures that the environment is ad-
equately protected from the hazards of waste disposal and that the public
health is maintained through a safe and adequate supply of drinking water. These functions are achieved by technical reviews, licensing,
certifications, compliance monitoring, training and technical assistance.
Additionally, the bureau licenses and regulates motor vehicle wrecking
facilities and administers a state junk vehicle collection program that
recycles automotive scrap metal as well as protect the scenic beauty of
Montana's landscape.

Bureau's responsibilities:
Provide technical review and approval of public drinking water and wastewater system design and operational plans; Conduct sanitary surveys of public drinking water systems and provide technical assistance to help systems maintain compliance; Monitor and oversee required public drinking water system sampling to assure the delivery of safe water to the users of the system; Maintain a comprehensive record system for public drinking water sampling results and design and maintenance activities; Provide training and certification for operators of drinking water and
wastewater systems;
Provide technical review and licensing of solid waste treatment and
disposal facility designs and operational plans;
Conduct inspections of solid waste management facilities and provide
technical assistance to maintain compliance;
License septic tank pumpers and inspect disposal sites for septic tank
and sump wastes;
Provide training for owners and operators of solid waste disposal
facilities;
Review and license motor vehicle wrecking facilities and junk vehicle
graveyards;
Conduct inspections at motor vehicle wrecking facilities and junk
vehicle graveyards and provide technical assistance to assure
compliance;
Oversee county junk vehicle collection programs and administer a
grant to fund the activities of the county programs;
Provide training and assistance for county junk vehicle program
directors.

The Environmental Management Bureau (EMB) regulates activities governed by the Metal Mine Reclamation Act and the Major Facility Siting Act (MFSA). The EMB coordinates the permitting process for proposed "hard rock" mines and quarries, issues permits when appropriate, inspects permitted mining operations and ensures that disturbed areas are properly reclaimed after mining ends. It also performs environmental reviews for large powerlines, pipelines, conversion and generation facilities proposed under the MFSA.
Bureau responsibilities:
Regulation of Small Miner activities;
Regulation of exploration for "hard rock" minerals;
Permit review for proposed gold, silver, copper and other metal
mines, including interaction with federal and other state agencies;
Inspections and compliance assistance at operating "hard rock
mines and quarries;
Calculation, periodic review and maintenance of reclamation bonds,
and ensuring that reclamation is carried out properly after mining
operations cease;
Oversight of construction and operation of major energy-related
facilities for which a petition for coverage under the Major Facility
Siting Act has been accepted by the department;
Oversight of large fuel pipelines and large electrical transmission
lines;
Regulation of exploration for geothermal resources and enrichment of
uranium minerals;
Inspections, calculation of reclamation bonds, and ensuring that
MFSA certificate conditions are implemented.

The lndustrial and Energy Minerals Bureau administers the Montana Strip
and Underground Mine Reclamation Act, the Montana Strip and Under-
ground Mine Siting Act, and the Montana Opencut Mining Act. The bureau
oversees. permitting and compliance activities for coal and uranium
prospecting, mining, and reclamation, and opencut mining (sand, gravel,
bentonite, soil materials, peat, scoria, and clay).
Bureau responsibilities:
Overall administration and regulation of surface and underground
coal and uranium prospecting and mining and opencut mining for the
entire state;
Determine completeness and technical adequacy of all coal, uranium,
and opencut mine permit applications;
Conduct multi-disciplined analysis of prospecting and mining applica-
tions, amendments, and revisions;
Calculate and secure the correct bond and amount to ensure comple-
tion of reclamation;
Conduct regular, discipline specific and multi-disciplinary, on-site
compliance evaluations of all permitted operations;
Review and analyze all monitoring data and annual reports for
accuracy, completeness and anomalies;
Coordinate and participate in a variety of technical and public meetings;
Provide technical assistance and outreach to the mine operators and
interested citizens;
Respond to citizen complaints related to mining of coal and opencut
minerals;
