Executive Summary

The NSW Riverina region supports a diverse and distinct mix of landscape, livelihood, cultural and lifestyle values.

Strategic and coordinated regional weed management is critical to maintaining these values, and building the

sustainability of the Riverina region’s primary industries, natural environments and local communities.

Together, the NSW Biosecurity Strategy 2013-2021 and NSW Biosecurity Act 2015 (which repeals the NSW

Noxious Weeds Act 1993 and is expected to be operational in early 2017) provide a modernised and clear vision

for safeguarding our primary industries, natural environments and communities from a range of biosecurity threats

(i.e., pests, diseases and weeds). The Riverina Regional Strategic Weed Management Plan (the Plan) supports

Goal 1 of the NSW Biosecurity Strategy: “biosecurity is a shared responsibility”.

The Regional Strategic Weed Management Plan was prepared by the Riverina Regional Weeds Committee

(RWC) on behalf of the Riverina Local Land Services Board, with guidance from the State Weeds Committee and

Local Land Services. The Plan focuses on weed risks that affect animal and plant industries, biodiversity, socio-

cultural factors, and infrastructure and service industries.

The Plan sets the priorities for weed management in the Riverina region for five years from 2017, and outlines

strategies and actions to achieve goals that focus on shared responsibility for weed management, sustainable

landscapes and collaborative leadership and innovation (Box 1).

The Biosecurity Act 2015 applies to all land in the region, whether public or private (i.e., it is tenure neutral), and

contains a range of new regulatory tools. These tools support the tenure-neutral approach to managing weed

biosecurity risk, and include Prohibited Matter, Biosecurity Zones, Mandatory Measures and Control Orders. This

Plan outlines these tools and their application.

The Plan also outlines land manager obligations under the General Biosecurity Duty (GBD) in the region, which

for weeds is broadly defined as: “…any person dealing with plant matter must take measures to prevent, minimise

or eliminate the biosecurity risk (as far as is reasonably practicable)”. An expert panel used best available

evidence and an internationally-recognised risk-based prioritisation process to develop the priority weed list for

this Plan. Appendix 1 includes the regional priority weeds to which “recommended measures to discharge the

General Biosecurity Duty” have been identified, and includes state-level priority weeds for the region. Appendix 2

lists other weeds of community concern, identified in the prioritisation process, to provide additional focus for

regional weed management.

Many stakeholders have played important roles in regional weed management planning in past years. This Plan

builds on these past planning efforts and has gained immeasurably from the accumulated experience and expert

local knowledge of Committee members and their networks. The Riverina RWC includes representatives from

local government, the local community, land managers, interest groups and state government agencies.

The Riverina RWC through its members will play an important role in advising Riverina Local Land services in

implementation of the Plan. Stakeholders will come together to develop key processes that facilitate the delivery

of:

shared responsibility

standardised, tenure neutral and prioritised approaches to weed management planning, investment and

delivery across the region

strategic approaches to communicating locally relevant key messages, and engaging partners, stakeholders

and the broader community

coordinated and integrated information management and research capacity

regional measures of performance that track the progressive impacts of our programs and interventions,

investment in priorities and progress towards outcomes for shared responsibility for weed management,

sustainable landscapes and collaborative leadership and innovation

robust monitoring, reporting evaluation and improvement processes that allow for measuring the

performance of this Plan, the effectiveness of the region’s overall investment in weed management, and how

we can improve our weed management projects, programs and policies

Identifying local implementation roles, responsibilities and partnerships will be integral to these processes.

The Plan provides a sound basis for a cooperative and coordinated approach to landscape-scale weed

management in the Riverina region. It articulates what “shared responsibility” means for the region’s communities

and stakeholders, and how they will work together to identify, minimise, respond to and manage high risk weeds,

now and into the future.

Box 1. Goals and actions of the Riverina Regional Strategic Weed Management Plan

provide multiple outcomes across natural environments and primary industries. The emphasis is on:

preventing new weeds from entering the region

eradicating or containing the spread of new weeds that do establish

managing widespread weeds where the benefits are greatest

Goal 4: Weed biosecurity is supported by coordinated, collaborative and innovative leadership

Actions focus on consistent and contemporary approaches to implementing this Plan, with emphasis

on:

providing good governance and leadership to support a collaborative approach

supporting and delivering the weed biosecurity reforms for NSW

implementing risk-based systems across all land tenures in a co-ordinated manner

supporting innovation by embracing continuous learning, information systems, research and

technology

The relationship between Local Land Services, the RWC, the SWC and other customers and stakeholders is

depicted in Figure 1.2.

Guiding legislation

The NSW Biosecurity Act 2015, NSW Local Land Services Act 2013 and NSW Local Government Act 1993

are the key legislative components that underpin this Plan. The Biosecurity Act 2015 will take effect with

publication of the regulations in the NSW Government Gazette in the first half of 2017. The Act is

administered by NSW Department of Primary Industries (DPI).

2.3 General Biosecurity Duty

The Biosecurity Act 2015 introduces the concept of General Biosecurity Duty (GBD) along with several new

regulatory tools for managing weeds. These tools are outlined in Table 2.1. A GBD applies to all weed

species that present a biosecurity risk regardless of whether or not they are listed in this Plan.

For weeds, the GBD means that any person dealing with plant matter must take measures to prevent,

minimise or eliminate the biosecurity risk (as far as is reasonably practicable). ‘Dealing’ has a broad

definition in the Act and the GBD applies equally to a carrier of plant matter and to any person who knows or

ought reasonably to know of the biosecurity risks associated with the activity. In general, if you deal with or

carry plant matter as part of a commercial, professional, volunteer or recreational activity or lifestyle, you

would be considered to know or ought reasonably to know the risks. Plant matter includes plants, parts of

plants and seeds. Biosecurity is everyone’s responsibility and further explanation of the GBD is available

from the Riverina Local Land Services (LLS) website and local offices, your local council office and NSW

DPI.

Weeds associated with adverse risks, which are not listed in this Plan, will generally be addressed through

community extension activities to ensure that landholders understand the biosecurity risk posed by the weed

and their obligations under the GBD. An authorised officer may accept a Biosecurity Undertaking from the

landholder that details actions and timeframes to reduce the risk posed by the weed infestation. If the

landholder still fails to address the weed problem, a Biosecurity Direction can be issued that provides more

detail on the actions that the landholder must take to manage the weed. Where the weed poses a

biosecurity risk, weed control may be enforced whether or not there is a direct reference to the weed in this

Plan. Key regulatory tools of the Biosecurity Act 2015 are detailed in Table 2.1.

Biosecurity Act Tool

General Biosecurity Direction: an Authorised Officer may give a General Biosecurity Direction to the

public generally or to a specified class of persons, if the officer reasonably believes it is necessary to

do so for any of the following purposes:

to prevent, eliminate or minimise a biosecurity risk

to prevent, manage or control a biosecurity impact that has occurred, is occurring or is likely to occur

to enforce, administer or execute the Biosecurity Act 2015 (including any instrument made under the Act)

Individual Biosecurity Direction: an Authorised Officer may give an Individual Biosecurity Direction

to a particular person if the officer reasonably believes it is necessary to do so for any of the following

purposes:

to prevent the person from contravening or continuing to contravene a requirement imposed by or under the Act,

to prevent, eliminate or minimise a biosecurity risk

to prevent, manage or control a biosecurity impact that has occurred, is occurring or is likely to occur

to enforce, administer or execute the Biosecurity Act 2015 (including any instrument made under the Act)

Biosecurity Undertaking: an Authorised Officer may accept undertakings:

An Authorised Officer may accept a written undertaking (a Biosecurity Undertaking) given by a person if the person has contravened or the authorised officer suspects that the person has contravened or is likely to contravene a requirement imposed by or under this Act.

An Authorised Officer may accept a biosecurity undertaking from a person instead of giving the person a biosecurity direction.

The giving of an undertaking does not constitute an admission of guilt by the person giving it in relation to the contravention, suspected contravention or likely contravention to which the undertaking relates.

A Biosecurity Undertaking must specify:

The contravention, suspected contravention or likely contravention to which the biosecurity undertaking relates, and

the measures that the person has agreed to implement to remedy or prevent the contravention, suspected contravention or likely contravention,

The period or periods by the end of which the measures must be implemented.

Prohibited Matter: a biosecurity matter that is prohibited matter throughout the state or in a part of

the state under section 27 of the Biosecurity Act 2015. Prohibited matter is aimed at prevention and

includes weeds that are nationally targeted for eradication and which are not currently present in NSW.

Biosecurity Act Tool

Control Order: The Minister may, by order in writing (a control order):

establish one or more control zones, and

establish measures, in connection with a control zone, to prevent, eliminate, minimise or manage a biosecurity risk or biosecurity impact.

Control Orders will be proposed as required to address subsequent eradication campaigns where

appropriate.

Biosecurity Zone: under Part 5 of the draft Biosecurity Regulation 2016 one or more Biosecurity

Zones may be established for the purpose of preventing, eliminating, minimising or managing a

biosecurity risk or biosecurity impact. The principal object of a biosecurity zone regulation is to provide

for the long term strategic management of a biosecurity risk or biosecurity impact through containment.

Emergency Order: an Emergency Order may be issued to respond to a current or imminent

biosecurity risk that may have a significant impact.

General Biosecurity Duty: used to manage the spread of all weeds that present a biosecurity risk.

Any person dealing with biosecurity matter must take measures to prevent, eliminate or minimise the

biosecurity risk (as far as is reasonably practicable). The General Biosecurity Duty applies equally to a

carrier of biosecurity matter and to any person who knows or ought reasonably to know of the

biosecurity risks associated with the activity. For priority weeds, recommended measures to reduce

biosecurity risk are detailed in Appendix 1 of this Plan.

Mandatory Measures Regulation: the regulations may require persons who deal with biosecurity

matter or carriers to take specified actions to prevent, eliminate or minimise a biosecurity risk posed or

likely to be posed by the biosecurity matter, carrier or dealing. Those requirements are Mandatory

Measures.

Appendix 1: Priority weeds for the Riverina region

Appendix 1 covers state-level determined priority weeds (A1.1) and regionally-determined priority weeds

(A1.2).

The NSW Biosecurity Act 2015 and regulations provide specific legal requirements for state-level priority

weeds (A1.1) and high risk activities. For each state-level priority weed, the state objective and how this

objective is achieved through specific requirements under the Biosecurity Act 2015 and regulations is

covered. These specific regulatory requirements include Prohibited Matter, Biosecurity Zones, Mandatory

Measures and Control Orders (see Table 2.1).

A1.2 in Appendix 1 identifies priority weeds for the Riverina region to which “recommended measures to

discharge General Biosecurity Duty” have been applied and articulates community expectations for

managing these weeds in the region.

A biosecurity zone, to be known as the alligator weed biosecurity zone, is

established for all land within the state except land in the following regions:

(a) Greater Sydney,

(b) Hunter (but only in respect of land in the local government area of City of Lake

Macquarie, City of Maitland, City of Newcastle or Port Stephens).

An owner or occupier of land in the Alligator Weed Biosecurity Zone on which there

is the weed Alternanthera philoxeroides (alligator weed) must:

(a) if the weed is part of a new infestation of the weed on the land, notify the local

control authority for the land as soon as practicable in accordance with Part 6, and

(b) eradicate the weed or if that is not practicable destroy as much of the weed as is

practicable and suppress the spread of any remaining weed.

The following legislative requirement also applies:

Biosecurity Zone

A Biosecurity Zone, to be known as the Bitou Bush Biosecurity Zone, is established

for all land within the State except land within 10 kilometres of the mean high water

mark of the Pacific Ocean between Cape Byron in the north and Point Perpendicular

in the South.

Biosecurity Zone (Part 5, Division 3, Clause 67, draft Biosecurity Regulation 2016)

An owner or occupier of land in the bitou bush Biosecurity Zone on which there is

the weed Chrysanthemoides monilifera subsp. rotundata (Bitou bush) must:

(a) if the weed is part of a new infestation of the weed on the land, notify the local

control authority for the land as soon as practicable in accordance with Part 6, and

(b) eradicate the weed or if that is not practicable destroy as much of the weed as is

practicable and suppress the spread of any remaining weed.

The following legislative requirement also applies:

A Biosecurity Zone, to be known as the water hyacinth biosecurity zone, is

established for all land within the State except land in the following regions:

(a) Greater Sydney or North Coast,

(b) North West or Northern Tablelands (but only land in those regions that is in the

local government area of Inverell, Moree Plains or Tenterfield),

(c) Hunter (but only land in that region that is in the local government area of City of

Cessnock, City of Lake Macquarie, City of Maitland or Port Stephens),

(d) South East (but only land in that region that is in the local government area of

Eurobodalla, Kiama, City of Shellharbour, City of Shoalhaven or City of Wollongong).

An owner or occupier of land in the water hyacinth biosecurity zone on which there

is the weed Eichhornia crassipes (water hyacinth) must:

(a) if the weed is part of a new infestation of the weed on the land, notify the local

control authority for the land as soon as practicable in accordance with Part 6, and

(b) eradicate the weed or if that is not practicable destroy as much of the weed as is

practicable and suppress the spread of any remaining weed.
