No. 33,] WEDNESDAY, AUGUST 18. [1886.

Circular Orders and Miscellaneous Information.

C.O. ''jjiy—The Acting Superintendent of Police directs the attention of the Police throughout the Colony to the following extract from an opinion of the Honorable the Acting Attorney General, in the recent case of " Cornwall v. Police," and to His Excellency the Governor's Minute thereon :—

Extract from C.S.O. No. ^fÄ". " I would like to add that if it be true that a

constable effected an entrance through a window of a private bedroom, and secreted himself in the bar room, and when the liquor was placed upon the counter stood up and took the spirits, such conduct on the part of a constable should be sevei'ely condemued. The duty of a policeman is to prevent breaches of the law, and not to stand by in hiding for the purpose of catching offenders after the porpetration of offences which he is in a Position to prevent. Every Inn-keeper in the Colony—so general has been the mis-reading of the law—would have supplied a traveller on a Sunday, and the conduct of the constable in this case in no way tends to encourage respect for the law."

SEPT. BUKT, Acting Attorney General.

28-7-86.

His Excellency the Governor's Minute. Hon, A, C. S.,

1 remit the fine-. so reply to Mr. Haynes. Such aotion as this constable it is stated took in detecting tuis offence certainly was very special aud exception-al, antl should only be taken with great circumspec-hoii, and for very good reasons, that is, presuming die ontry through the window, &c., was a legal act. It illegal, of course such action should never be • d.pn at all.

'̂'iid to the Superintendent of Police for his »iformation.
