Burt Logan ◆ President’s Column

As I begin my next-to-the-last column, I look back on what an amazing ride it has been serving the in-dustry. Not only have I had the good fortune to be an FRSA member throughout my roofing career, but I’ve also had the opportunity to participate and serve at the local and state levels, and on the FRSA Board of Directors.

Being elected to the Executive Committee was an honor and a role I take great pride in. Over the past four years, I have had the

opportunity to work with some amazing industry leaders whom I admire and respect.

I’ve been able to be a part of FRSA history, helping to move the Association and the industry in a new direction by: establishing a training center, working on new building codes, adopting new technology to benefit member pro-grams and services, reconnecting with our Affiliate locations, rebranding the Convention and Expo, and reestablishing the Strategic Plan. These are just some of the achievements that I’ve witnessed over the past few years.

I want to thank the FRSA Past Presidents who have shared their experiences and wisdom with me. Soon I’ll be one of you sitting on the Advisory Committee imparting wis-dom to future generations.

I remember when I first began attending FRSA meetings; I was intimidated by some of the older guys involved. I sat in meetings and was in total awe of their knowledge, experi-ence and history, which they could recall at a moment’s notice – even more so during heated debates on a hot topic or contentious issue. I learned a lot from listening to them during meetings and at social functions. For those members who are new to the industry, I en-courage you to become engaged and join one of FRSA’s many committees. Take the first step – the benefits you’ll receive through participation will surprise you.

The Convention and Expo are about six weeks away, and I want to encourage you to put some time aside and attend the events, July 16-18, 2015, at the Orange County Convention Center and the Hyatt Regency Orlando (it’s still the Peabody Hotel to me!). There are many opportunities for education, socializing, partici-pation in sporting events and walking the Expo floor. This is slated to be the largest Expo we’ve

Cam Fentriss ◆ FRSA Legislative CounselAre Apartment Complex Owners Trying to Rewrite License Laws?An ugly and important piece of legislation came up during the 2015 legislative session. It did not pass, but it does need our attention right now.

The legislation would have created an exemption from construction licensure for apartment maintenance workers to perform repairs on heating and air-conditioning equip-ment and water heaters. Obviously that does not include roofing, but I am very sure the in-tent was to add it and more in the near future. Why do I say that? For two reasons:

First, the exemption would have been available to certain workers who completed a national apartment association course con-sisting of “90 hours of courses or online content that covers electrical maintenance and repair; plumbing maintenance and repair; heating, venting, or air-conditioning system maintenance and repair; appliance maintenance and repair; and interior and exterior maintenance and repair.” Why would you need to take a course for “exterior maintenance and repair” to work on HVAC equipment or water heaters? You would not, but it would sure make it easy to come back in a year and simply add the word “roofing” to the exemption.

Second, there is little doubt that apartment complexes would much rather use their own inexpensive maintenance staff to perform roof repairs, rather than pay a licensed roof-ing contractor. In fact, I think a pretty good argument can be made that the only reason they are looking to add this exemption in law is because they have likely been caught overstepping and their solution is to change the law rather than comply with it.

How did this get any traction at all? Don’t our elected officials realize how stupid it would be to give the seal of ap-proval to grossly unqualified low-level employees performing life safety work in buildings that house hundreds of people? I cannot answer the second question, but I can answer the first one: there was a very strong political push to pass this legislation (the lobbyist for the apartment group is one of the most powerful in Florida). All too often, if it is about big

money politics, it doesn’t matter whether or not the legislation is stupid or harmful or all wrong for the state of Florida.

One legislator pushing for this actu-ally said on the record that an apartment owner should have the right to make the choice to invalidate warranties in favor of using exempt and lesser workers. That sounds so good, except for the fact that the Legislature is not here to help commercial businesses cut corners and roll the dice. Government’s concern here should be for the safety of the tenants, not the building owners or managers (they can take care

of themselves and should not need to have their hands held by politicians).

Now that the legislative session is over, why should you care? Because this will come back up and you need to make sure your legislators hear from you before it is proposed again. Please tell them that this exemption would ensure that Florida has even more property damage and greater failure to comply with building and energy codes. Also, since it is pretty well known in the construction industry that this is already a hotbed for unlicensed activity, it also makes a lot of sense for you to take this opportunity to have your contracts reviewed by your attorney to make sure that they contain a clear statement about any work performed by anyone unli-censed, even if exempt from licensure.

For those of you that are a part of the FRSA Public Relations Committee or Board of Directors, you have heard me advo-cate for the use of social media in promoting the Association. Most compa-nies in the roofing industry also use some form of so-cial media for advertising. However, as with anything that is available to the public, roofers should be careful what they publish

on social media because “Big Brother” may be watching. While defending roofers throughout the United States

in Federal OSHA matters, we have encountered a variety of techniques used by OSHA inspectors and assistant area directors to assist in their prosecution of citations. These techniques include a review of social media posts on Facebook, Instagram, Twitter, etc. pointing to pho-tos of roofers on projects without fall protection. Most of these posts are issued by either marketing employees or third-party SEO firms. While the message is great and im-portant for promoting your business, we have had several instances where OSHA has used photographs posted on Facebook or Twitter in an attempt to support a roofer’s lack of safety training or use of fall protection.

Fortunately, in each case, our response was that the individuals in the photograph are not actual employees of the roofer on a job site but were third-party “actors” used for marketing purposes. Regardless, under the current ul-tra-aggressive Department of Labor, it is important that you keep a watchful eye on marketing posts that show or potentially show any employee of your company without fall protection or otherwise violating an OSHA standard.

In addition, review your website and make sure that all the content that has been published on your website is “OSHA compliant,” meaning that there is nothing that OSHA would deem offensive or contrary to existing safe-ty regulations. This would include photographs and text throughout the website. Again, most roofers do not create their own websites, and they are hosted and authored by third-party companies. These companies may understand the latest analytics and mobile optimization, but know nothing about roofing or safety. Therefore, it is important that management review the content so that it is not sur-prised during an OSHA proceeding when the website is used to support claims that the roofer does not advocate a safe working environment.

Over the past few years, FRSA has made major changes and huge strides to position the Association as an indus-try leader. With a strong Executive Committee and Board of Directors leading the way, staff has worked diligently to meet and exceed many of the goals outlined in the FRSA Strategic Plan.

Let me give you a little background information about the Association. FRSA is one of the National Roofing Contractors Association (NRCA) affiliate partners and is their largest regional affiliate group. Keep in mind; most of the other affiliates are multi-state groups, while FRSA represents only Florida. Our membership numbers far exceed other groups, as does our convention and expo. FRSA is fortunate to have a full-time staff of eight, who cover everything from membership services to code is-sues. Then add an Educational Foundation that produces industry specific seminars, a Credit Union offering fi-nancing and banking options and a Self Insurers Fund for workers’ compensation insurance and safety train-ing, and you have an unbeatable foundation to build your business upon.

Let me introduce you to your FRSA team members:

Mike Reed, CPA, AccountingMike is one of our long-term staff members, who has worked for the Association for 23 years. He handles the accounting and investments for all of our entities and ensures the financial integrity of the FRSA. Mike is also the first staff person most convention attendees meet, as he runs the registration desk for us. One of his many du-ties onsite is to sell, collect and organize the Educational Foundation raffle. In addition, Mike is staff liaison to the Governmental Affairs Committee and the Advisory Committee.

Janette Irizarry, Office ManagerJanette is another long-term staff member, who has worked for us for 16 years. Hers is the friendly voice greeting you when you call our offices. In addition to handling our phone system, Janette also works as the

Administrative Assistant for the Executive Director, co-ordinates the thousands of pieces of mail sent out, assists with convention and expo duties as needed, and organizes the Educational Foundation Training Center for groups renting the facility. No organization would be successful without someone like Janette paying attention to day-to-day office details.

Mark Zehnal, CPRC, Director of Technical ServicesMark is no stranger to FRSA, having served on the Board of Directors prior to joining the Association staff three years ago. Mark provides members with guidance on state and local codes and regulations, as well as insight into specific roof system applications. Whether you are a roofing contractor who has a question about a project or a manufacturer looking to better understand the process of obtaining a Florida Product Approval or Miami-Dade Notice of Acceptance, Mark has a broad range of knowl-edge. His always-growing network of professional relationships means that if Mark doesn’t have an answer to a specific challenge, there’s a good chance that he will know who to call to find a solution. Mark is also staff liai-son for the Codes and Regulatory Compliance Committee.

Cheryl Sulock, CMP, CSEP, Director of Convention and ExpoTwo years ago, we were fortunate enough to have Cheryl join our team. Previously, she had worked as our con-tact at the Orange County Convention Center, handling our show onsite. Cheryl organizes all the details of the Convention and Expo to make sure the events are suc-cessful. This year she’s made some awesome changes to both events and converted all of our paper registration documents to an online format. Registrations, payment and confirmations are now instantaneous, saving ev-eryone time and money. Cheryl also heads up the social media for all of FRSA’s events. In addition, she plans the quarterly Board of Directors and Committee meetings, is staff liaison to the Young Professionals Council, the

Convention Committee, the Ladies Committee and the Public Relations and Marketing Committee.

Maria Armas, Director of Member ServicesLast year Maria joined the team as the Director of Member Services, working diligently to gather new mem-bers; no small task, since we rely heavily on membership dues to fund the Association. She also works to keep cur-rent members abreast of new services as they are added and works on social media campaigns, such as “Member Mondays,” which are posted on Facebook highlighting a new benefit each week. Maria also works with the Affiliate Council, FRSA chapters located throughout the state. Together, they develop brochures, literature and pro-grams that help benefit both groups. Maria is staff liaison to the Membership Committee and the Affiliate Council.

Meghan Roth, Educational Foundation DirectorMeghan joined our team four months ago as the director of all programs for the Educational Foundation, including seminars and training, scholarships, membership, devel-oping Endowment contributions and the Silent Auction. To date, she has secured donations for the Silent Auction, the annual fund-raising event for the Foundation, from 90 different companies. As a past FRSA Scholarship Recipient herself, Meghan understands the need for fund-raising. She also coordinates events in the Educational Foundation Training Center and is staff liaison to the Educational Foundation Trustees and the Endowment Board of Governors.

Paul Nutcher, Editor ROOFING FLORIDA MagazineOur newest staff member, Paul joined our staff this month as the Editor of ROOFING FLORIDA Magazine. He is no stranger to the industry; he is the former Communications Director and former chair of the LEED for Homes Advocacy Committee, and was an original board member of the Central Florida Chapter of the U.S. Green Building Council (USGBC). He is also a former chapter president of the Construction Specifications Institute (CSI) of Greater Orlando, and holds the Construction Documentation Technologist (CDT) credential from CSI. Paul’s focus will be on securing advertising partners and editorial content for the magazine. He will serve as staff liaison to the Public Relations and Marketing Committee.

Lisa Pate, CEM, Executive DirectorLisa has worked for FRSA for 30 years and serves as the Executive Director overseeing the staff. She works with members and within the industry to keep everyone working toward the goals in the FRSA Strategic Plan. Lisa works closely with the Executive Committee, the Board of Directors and committees through the wide range of industry topics in which FRSA is involved. She fosters relationships with in-dustry professionals on the local, state and national level that allow the FRSA to grow and positively

influence the industry on a large scale. Lisa is staff liaison to the Executive Committee, the Board of Directors, the Unlicensed Activity Taskforce, the Disaster Preparedness and Response Committee and the Advisory Committee.

Marissa Tatum, Credit Union ManagerMarissa has been with the Credit Union for nine years and handles all their financial responsibilities, from State auditors and examiners to making sure the Credit Union adheres to Federal banking laws and regulations. She is responsible for the highly successful roof loan program available to FRSA contractor members and the recently launched mobile banking app. Marissa serves as the staff liaison to the Credit Union Board of Directors.

Adrienne Paul, Customer Service RepresentativeAdrienne has been with the Credit Union for three years and is the customer service representative for the Credit Union. She’s a jack-of-all-trades, working with members on loans, opening accounts, collections and anything else that may need to be handled. The very successful roof loan program allows contractor members to offer their qualified customers a financing option for roofing proj-ects up to $15,000.

We’ve all heard the same thought expressed in many ways: bread and butter, blocking and tackling, and back to basics. Whatever you call it, a return to focusing on a primary objective and how it’s done can be very helpful.

Homeowners may select from the cuts and angular lines of Heritage Vintage, the wider cut and wood shake appearance of Heritage Woodgate, and the classic look of Heritage Premium and Heritage.

For contractors, the Heritage cut application method helps add speed and reduce waste. Only two cuts are re-quired to start five courses. Pieces that are eight inches wide or wider can be worked back into the field.

What is the Convention?FRSA’s Convention and Expo run concurrently and have been an annual event for 93 years. The Convention consists of educational seminars, golf, fishing and clay shooting tour-naments, a Welcome Reception, Friday Business Luncheon, and the S.T.A.R. “Spotlight Trophy for the Advancement of Roofing” Awards and FRSA Officer Installation Dinner on Friday night followed by the S.T.A.R. Awards After-Party.

What is the Expo?The Florida Roofing & Sheet Metal Expo is a trade show where vendors to the industry display their products, ser-vices and equipment and where the roofing and sheet metal community gathers to learn about the latest technologies and network with fellow industry representatives.

Where is the Expo being held?The Expo is being held at the Orange County Convention Center (West Building, Hall D2) in Orlando, FL.

What is the cost to attend the educational programs?Package deals are available for continuing education pro-grams, and the best value (if you are planning on attending social events also) is to purchase the full convention registra-tion. This package contains seminar credit for seven hours of C.E.U.’s and all social event tickets. If you’re attending only the seminars, you may purchase a 7-hour C.E. package for $240. You may also purchase individual tickets for each seminar. Cost is $45 per credit hour. If you do not need con-tinuing education credit, you may attend Seminars 2-26 at no cost. (Seminar #1 may not be audited on a complimentary basis.) Please keep in mind that seating may be limited and is available on a first-come, first-served basis after those re-quiring C.E. credit have been accommodated.

What about the sports tournaments?We offer three different sports tournaments on Thursday, July 16. We have a golf tournament at ChampionsGate Golf Club (cost is $110 per person – individuals will be paired), a fishing tournament at Sunrise Marina in Port Canaveral (cost is $150 per person if booked by June 16; $250 per person after June 16) and a clay shooting tournament being held at Tenorac Shooting Range in Lakeland (cost is $95 per person). What is the Silent Auction?The Silent Auction is the primary fundraiser for the FRSA Educational Foundation. The money is used to provide educational seminars throughout the year and also funds the scholarships given away each year.

The panel of three judges for the FRSA S.T.A.R. – Spotlight Trophy for the Advancement of Roofing – Awards wel-comed new panelist: Joseph J. Williams, AIA, RCC, an architect and president of A/R/C Associates, Inc., a roof-ing and waterproofing consulting firm. The panel, which also includes Jim Brauner of Brauner Safety Services and Mark Zehnal, CPRC of FRSA staff, met on May 6 to review the submissions received from FRSA member contractors.

New for 2015, the panel of judges selected one proj-ect among all of the submissions to receive the “Shining Star” Award, which recognizes the best roofing project throughout Florida. Applicants that submitted in all cat-egories were automatically eligible and they will not know they are receiving the “Shining Star” Award until the night of the ceremony. There is going to be more suspense and surprise this year.

The S.T.A.R. Awards are now in their third year. Last year’s awards dinner and presentation showcased the premier projects of the best roofing and sheet metal contractors from around Florida. OSHA has published many recent articles and notices about its efforts to prevent falls and serious injuries from occurring in the workplace. The following are excerpts from a recent article about OSHA fining a manufacturer who was found to have repeat OSHA violations. The com-pany was fined $1.75 million dollars! It is instructive to read the comments that OSHA provided below in their press release:

“This company being fined has created a culture that values production and profit over worker safety, and employees are paying the price,” said the OSHA representative. The OSHA representa-tive went on to say that “safety and profits are not an either, or proposition” and “companies across this nation have both.” They further alleged that the company “intentionally and willfully disre-garded OSHA standards and its own corporate safety manuals to encourage workers to increase productivity and meet deadlines. The company apparently blamed the victims for their own inju-ries, but there is clear evidence that injuries were

caused by unsafe conditions created by the com-pany. OHSA is committed to making sure that the total disregard this company has shown to safety stops here and now.”

As you should already know, OSHA now requires employ-ers to report within 24 hours all injuries that result in an injured employee being admitted to a hospital. Most of-ten, you can expect that an OSHA investigator will be at your jobsite very quickly following the report of such an injury. Be careful that your employees follow your safety standards and requirements on the jobsite and do not place production ahead of their own safety. Compensating employees by piecework (such as roofing by the square) rather than by the hour can often lead to this type of en-vironment where safety is compromised for the sake of production. If you as an employer compensate your em-ployees in such a manner, you could be setting yourself up for a difficult evaluation if confronted by OSHA, the IRS, Wage and Hour, and other Governmental agencies.

A retrofit roofing and wall system can eliminate the removal of an existing roof or wall system, saving the building owner the expense of removal and disposal. Mostly used in com-mercial applications, the installation of the EZROS™ E-ZEE Roof Over System does not interrupt occupant activities inside the building, while transforming the exterior of the building with its many color options and overall design flexibility.

The EZROS System requires 40 percent less fasteners and labor than other one-piece systems for retro fit-ting applications over an existing metal, built-up, single ply or metal roof system. The EZROS retrofit framing design emulates the shape of existing sub-purlins, and comes with complete system components, including: sub eave, sub rake, sub valley, sub ridge, etc. to complete the project properly. Custom lengths are available to fit in-dividual project needs. The EZROS System allows for optional insulation and achieves a thermal break with air space between old and new roof.

In high wind zones, the EZROS System can assist with increased load capacity as required in coastal areas. The system offers less restrictions of water flow on the old roof when caught in weather during installation.

Since 1999, Trent Cotney of Trent Cotney, P.A. has dedi-cated himself to serving the roofing industry. As a Florida Bar Board Certified Construction Lawyer, Trent specializ-es in roofing litigation and arbitration, including defending roofers on construction defect claims, prosecuting lien and bond claims, defending OSHA citations, contractor

licensing de-fense, and bid protests. In addition, Trent reviews and drafts hundreds of roofing-related contracts a year for contractors, suppli-ers, manufacturers, and others in the industry.

In 2002, Trent joined the West Coast Roofing Contractor Association (WCRCA), the Tampa Affiliate of the Florida Roofing & Sheet Metal Contractors Association (FRSA). Although Trent understood the legal aspects of litigating roofing disputes and had worked on roofs, he wanted to be well-versed in the actual construc-tion of roofs and joined the local association so that he could learn more about the current issues fac-ing the roofing industry, attend manufacturer demonstrations of new and existing products, and be around others in the industry to share ideas. In 2004, he became a director for the WCRCA and re-mains a director to this day. In his capacity as a director and member of WCRCA, Trent writes a monthly legal article for the newsletter, and has provided more than a dozen seminars on roofing-related legal issues for the Association.

Trent became involved with the statewide roofing association, FRSA, in 2003 when he presented a seminar on construction defects and mold claims. He then joined the or-ganization in 2004, became General Counsel for FRSA in 2006, and currently serves as and has been a di-rector of the Association since 2007. Trent also serves as Co-Chairman of the Public Relations Committee and a member of the FRSA Educational and Research Foundation. Trent provides a monthly article for the FRSA’s ROOFING FLORIDA maga-zine on construction-related legal topics and provides seminars each year which give contractor continu-ing education credits.
