Applicant details • Where the applicant is not a natural person, ensure the applicant entity is a real legal entity.

Question 1 • Schedule 3 of the Sustainable Planning Regulation 2009 identifies assessable development and the type of

assessment. Where schedule 3 identifies assessable development as "various aspects of development" the applicant must identify each aspect of the development on Tables A , Band C respectively and as required .

Question 6 • Section 263 of the Sustainable Planning Act 2009 sets out when the consent of the owner of the land is required for

an application. Section 260(1 )(e) of the Sustainable Planning Act 2009 provides that if the owner's consent is required under section 263, then an application must contain , or be accompanied by, the written consent of the owner, or include a declaration by the applicant that the owner has given written consent to the making of the application. If a development application relates to a state resource, the application is not required to be supported by evidence of an allocation or entitlement to a state resource. However, where the state is the owner of the subject land, the written consent of the state, as landowner, may be required. Allocation or entitlement to the state resource is a separate process and will need to be obtained before development commences.

2.0 INTRODUCTION

This Development Assessment Report has been prepared to support a Development Application for Material Change of Use and Operational Works on behalf of Gympie Regional Council. The Material Change of Use application seeks to establish a Tourist Park for recreational vehicles (RV) (motorhomes) on part of the application site fronting Ramsay Road. The operational works application seeks approval for the minor engineering works associated with the proposal (access road, stormwater and landscaping).

The application site is the Adrian McClintock Park (Gympie Showgrounds) which is located at 77 Exhibition Road, Southside and described as Lot 72 on G14747. Although the application site includes the whole of the Showgrounds, the area directly affected by the proposed development only comprises 6,000m2

adjacent to Ramsay Road.

Under the Gympie Regional Council Planning Scheme 2013 (the Planning Scheme) the subject site is located within the Sport & Recreation Zone. The proposal is subject to impact assessment.

The purpose of this report is to describe the characteristics of the site and surrounding land uses, detail the proposed development and provide an assessment against the applicable planning provisions.

This report should be read in conjunction with the accompanying covering letter, IDAS Development Application forms, Proposal Plans and Landscape Plan.

3.0 BACKGROUND

The Council is currently negotiating amendments to the existing lease for the application site with State Government. The intent of these negotiations is to allow for the relevant part of the site to be used as for a RV motorhome park. Other points to note about the current lease negotiations are as follows:

• the amended lease will limit the length of stay to three consecutive nights; and

• traditional facilities and services like bathrooms, showers, laundries and kiosks will not be made available on site.

It is important to note that these limitations are a direct result of previous discussions with the State Government which wants to ensure that this facility does not impact on other local licensed providers. The State's requirements have had a direct bearing on the design of the proposed development and in particular, the limited facilities and services proposed in this application.

In early 2016 Gym pie Regional Council undertook public consultation on its proposal to locate a RV Park at the Showground site. During the consultation period the Council received a number of submissions and in summary, the majority of the submitters recognised the benefits and strongly supported the facility.

4.0 SITE DESCRIPTION

4.1 SUBJECT SITE

The subject site is situated at 77 Exhibition Road, Southside and is described as Lot 72 on G14747. The application site has a total area of 30.94ha but Figure 1 below shows that the proposed Tourist Park will only comprise 6,000m2 of the site next to Ramsay Road on the north eastern side of the Showground.

The site is bounded by Exhibition Road to the north and north-west, Ramsay Road to the east and Radian Road to the south. There are several vehicular and pedestrian access points with the main ones being off Exhibition Rd. Internal access roads and major car parking areas within the site are sealed.

Figure 1 also shows that the Showground incorporates substantial infrastructure supporting horse racing/ training, annual show and other community activities. The existing facil ities include:

• Sand race track

• 600 seat grandstand incorporating licenced bar/ dining room, betting ring, commentators booth and other racing infrastructure

• Main show arena

• Indoor pavilion incorporating large multi-use space (used for indoor sports, exhibitions, concerts, ba lls and conferences), function/ meeting rooms, and licensed areas

• Stables

• Horse training facilities

• Pavilions - cattle, dairy, poultry, pigeon, birds

The majority of the build ing and facilities are concentrated on the southern side of the race track.

4.2 SURROUNDING LAND USES

As Figure 2 below illustrates, the Showground is located in Southside to the south west of the centre of Gym pie and on the western side of the Bruce Highway and Mary River.

5.0 PROPOSAL

This application seeks a Development Permit for Material Change of Use and Operational Works to be established in accordance with the accompanying Proposal Plans. The proposal seeks approval for a Tourist Park which will provide space for upto 25 self-contained RV motorhomes to park while travelling through Gympie. In accordance with the amended lease under negotiation, the length of stay will be limited to a maximum 3 nights. The facility will be closed to the public around the Annual Gym pie Show.

The Proposal Plans illustrate that a new sealed entrance will be created opposite the Child Care facility on Ramsay Road. A gravel internal loop road will be provided within the site which will be one way only. The proposed access arrangements have been prepared in discussion with the relevant Council Departments. Motorhomes will park on the grass areas between the internal road and fence and on the inside of the loop. Ground conditions within the site will be monitored and the facility will be closed should the ground become too wet. In ground hose points and underground irrigation will be installed to maintain the turf surface and minimise dust during dry periods.

The Tourist Park will be enclosed by a 1.8 fence which will be setback 10m from the outer edge of the internal loop road. Along the northern, southern and eastern boundary a chain link fence is proposed with a colourbond fence along the western boundary. The colourbond fence will be located on a 800m high earth mound.

The Proposal Plan illustrates that it is intended that the stormwater will continue to sheet flow across the site. In addition, a swale will be constructed though the existing low point of the site and will connect to a stormwater pipe that will discharge into an existing open drain within the Showgrounds site.

The Landscape Plan prepared by Insite MLA, show that landscaping will be provided around the perimeter of the Park to create an attractive setting for the park and to provide screening to the properties on the opposite side of Ramsay Road.

As the facility will only cater for self-contained motorhomes, it will not be connected to any services. Visitors staying at the park will be advised where the closest dump points for disposing of waste and water supply are located in town. This approach is consistent with the terms of the new lease for the Showground which as outlined above, will impose a number of restrictions on the operation of this facility.

Visitors will be responsible for collecting and disposing of their own litter but on site wheelie bins will be provided. The bins will be collected and move to a suitable collection point by the managers on collection days.

The site will be managed by Gym pie & District Show Society and Gympie Turf Club from the administration office on site and visitor fees will be utilised for the ongoing management of the Showgrounds.

The State Planning Policy (SPP) defines the Queensland Government's policies about matters of state interest in land use planning and development. The SPP only applies to development assessment if the planning scheme has not yet appropriately integrated the SPP. If there is a discrepancy between a local planning scheme and a state planning policy, then what is outlined in the state planning policy overrides the planning scheme.

The Planning Scheme reflects the SPP that were applicable when it was adopted. A new SPP was adopted in April 2016 but given the characteristics of the site, the nature and limited scale of the proposed development the SPP is not considered to be relevant to this application.

A review of State Assessment and Referral Agency (SARA) mapping and schedule 7 of the Sustainable Planning Regulation 2009 has identified that the proposal will require referral to SARA as the subject site is within 25m of a State-Controlled Road (Exhibition Road).

The State Development Assessment Provisions (SDAP) set out the matters of interest to the state for development assessment, where the state assessment and referral agency (SARA) is responsible for assessing or deciding development applications as assessment manager or as a referral agency. The SDAP is not applied by local government in the assessment of development applications.

Referral for State-Controlled Roads is triggered by the application and the SDAP are applicable. Table B.3 of the SDAP identifies that the following state codes are relevant:

7.0 PLANNING SCHEME

Under the Gym pie Regional Council Planning Scheme (the Planning Scheme) the site is included within the Sport & Recreation Zone. An assessment of the applicable provisions in the Planning Scheme has been undertaken below.

The proposed development is defined under the Planning Scheme as:

"Tourist Park - Premises used to provide for accommodation in caravans, self-contained cabins, tents and similar structures for the public for short term holiday purposes.

The use may include, where ancillary, a manager's residence and office, kiosk amenity buildings, food and drink outlet or the provision of recreation facilities for the use of occupants of the tourist park and their visitors, and accommodation for staff'~

Comment: The proposed development will be established in accordance with the above definition.

In accordance with Part 5, Table 5.10 Assessment Table for the Sport and Recreation Zone the proposal will be subject to Impact Assessment.

As the application is impact assessable, the proposal has been assessed against the relevant sections within the whole Planning Scheme and the key conclusions are discussed the following sections of this report.

The Strategic Framework sets the policy direction for the Planning Scheme and forms the basis for ensuring appropriate development occurs within the Planning Scheme area for the life of the Planning Scheme.

The only element in the Strategic Framework that is directly relevant to this proposal is 3.5.2 (1) which seeks to deliver economic strength and diversity by creating an environment that enables the business community to take advantage of the opportunities to build linkages throughout and beyond the Region. Within this context, Specific Outcome 3.5.2 (h) is also relevant as it seeks to maintain and enhance the contribution that the marine and tourist activities make to the Region's economy.

Comment: It is considered that the proposal is consistent with both Element 3.5.2 (1) and Specific Outcome 3.5.2 (h) as it will help to diversity and strengthen the local economy. In this respect, the provision of additional short term tourism accommodation in Gym pie will provide greater opportunities for visitors to stop in the Town and to enjoy some of the local attractions and facilities. In this way, it is expected that the proposal will result in more money being spent in Gympie and as such, will help to strengthen the local economy.

A review of the maps in the Planning Scheme confirms that the site is only affected by the Flood Hazard Overlay. Importantly, as the map extract in Figure 3 below illustrates, the Flood Hazard mapping only affects a small area in the south eastern corner of the site. As the affected area does not include the proposed Tourist Park, the Overlay is not relevant to the assessment of this application.

7.5 DEVELOPMENT CODES

The Codes considered most relevant to this proposal are listed below.

• Sport and recreation zone code; and • Infrastructure and Operational Work Code

Comment: An assessment of the proposal against the relevant provisions of the above codes has been undertaken and the key conclusions are set out below but in summary, the code assessment has determined that the proposed development complies with all of the relevant Acceptable Outcomes of the codes.

7.5.1 Sport & Recreation Zone Code

The main purpose of this Code is to provide for a range of organised activities that includes sport, cultural and educational activities. In this respect, the Overall, Performance and Acceptable Outcomes in the Code seek to preserve, protect and increase the supply of sport, cultural and educational activities. As the proposed Tourist Park is not a sport, cultural or education use, the detailed provisions within the Code are not applicable. On this basis, the main issue raised is whether the proposal will compromise the purpose of the Code and Overall Outcome 3(a), which is repeated below, is considered to be directly relevant to this issue:

It is considered that the proposal does not compromise this Outcome for the following reasons:

• as the Tourist Park will comprise less than 2% of the total site area, the vast majority of the application site will continue to be used for sport and recreational purposes.

• the area that will be used for the Tourist park is not actively used for sport and recreation purposes;

• only minor infrastructural works are proposed to create the Tourist park and if necessary, could be removed or reused in the future should there be demand for this area to be used for sport and recreation;

• the Tourist Park will not impact on the current operation of the Showgrounds; and

• the proposed facility, could actually complement existing uses on the Showgrounds by providing convenient short accommodation that could be used by a range of people including competitors, officials and spectators.

7.5.2 Infrastructure & Operational Works Code

The proposed design has been prepared in discussion with a number of Council Departments and to reflect the restrictions that State Government will impose on the use in the new lease, which is currently being negotiated. In this respect, the proposed works have been designed to minimise the impact of the proposal on the Showgrounds and the surrounding area and to reflect the intent that the Park will only be used by self- contained motorhomes that will stay on site for no more than 3 consecutive nights. In this respect, it is considered that the proposal complies with the Code for the following reasons:

• the proposed infrastructure is appropriate to the scale and nature of the facility;

• the proposed parking and access arrangements are consistent with the restricted nature of the use and the limited capacity of the facility;

• the proposed landscape will create an attractive setting for the park and will soften its visual impact on the Showground and Ramsay Road;

• given the limited extent of the proposed earthworks and the control methods that will be used during construction, it is not expected that they will not have any adverse environmental impacts;

• the development will have any impacts on natural hazard areas; and

• the proposal has been designed to respond to the characteristics of the site.

The assessment set out above has determined that the proposal does not conflict with the relevant sections of the Planning Scheme.

8.0 CONCLUSIONS

This Development Assessment Report has been prepared on behalf of Gym pie Regional Council to support a Development Application for Material Change of Use and Operational Works in respect of land at Adrian McClintock Park (Gym pie Showgrounds), 77 Exhibition Road, Southside and described as Lot 72 on Gl4747. The proposed Tourist Park will provide additional short term accommodation for self-contained motorhomes and is intended to encourage more visitors to stop and spend time in the local area. The facility will be managed by Gympie & District Show Society and Gympie Turf Club and visitor fees will be utilised for the ongoing management of the Showgrounds.

Under the Gympie Regional Council Planning Scheme 2013 the site is located within the Sports & Recreation Zone.

This report demonstrates that the proposal complies with the applicable state and local planning provisions for following reasons:

• The proposal does not conflict with any relevant State Planning Regulatory Provisions of State Policies;

• The proposal will not have an adverse impact on the operation of Exhibition Road, a State Controlled Road;

• The proposal is consistent with the Strategic Framework of the Planning Scheme as it is expected to have a positive impact on the local economy;

• The proposal does not impact on any areas affected by the Planning Scheme Overlays;

• The proposal will not compromise the purpose and overall objectives of the Sport & Recreation Zone Code, which seeks to protect the use of the Showgrounds for a range of sporting uses; and

• The proposed operational works have been prepared in discussion with the relevant Council departments and have designed to minimise impacts on the local area and environment and to reflect the nature and intensity of the proposed use.

For the reasons outlined above it is considered that approval of the proposed development is warranted.

Module 1: Community amenity • 1.1 Managing noise and vibration impacts from transport corridors state code

The purpose of the code is to regulate sensitive development to: (1) ensure that state transport operations and infrastructure are protected from development on

nearby land that may lead to operational constraints on the state's transport system (2) protect the community from significantly adverse impacts on health, wellbeing and quality of life

resulting from environmental emissions (noise and vibration) generated by existing and future state transport operations and infrastructure.

Comment: Although the proposed Tourist Park is defined as a sensitive use, the facility will be located more than 140m from Exhibition Road and as such, it is considered that it will not have an adverse impact on the operation of the State Controlled Road or the health or wellbeing of visitors staying at the Park.

• 1.2 Managing air and lighting impacts from transport corridors state code

The purpose of the code is to regulate sensitive development to: (1) ensure that state transport operations and infrastructure are protected from development on

nearby land that may lead to operational constraints on the state's transport system (2) protect the community from significantly adverse impacts on health, community wellbeing and

quality of life resulting from environmental emissions (air particles and light) generated by existing and future state-controlled transport operations and infrastructure.

Comment: As mentioned above, the Park will be more than 140m from Exhibition Road and as such, it is considered that it will not have an adverse impact on the operation of the State­controlled road or the health or wellbeing of visitors staying at the Park.

Module 18: State transport infrastructure protection • 18.1 Filling, excavation and structures state code

The purpose of the code is to protect the safety, structural integrity and operation of state transport corridors, future state transport corridors and state transport infrastructure.

Comment: The proposed development is located approximately 140m from the State-controlled road and does not include any proposed works that would impact on it.

• 18.2 Stormwater and drainage impacts on state transport infrastructure code

The purpose of the code is to ensure that stormwater events, including peak discharges, flood levels, frequency/duration of flooding, flow velocities, water quality, ponding, sedimentation and scour effects associated with development are minimised and managed to avoid creating any adverse impacts on a state transport corridor.

Comment: The proposal will only result in very minor changes to the existing stormwater regime on the application site and as such, is not expected to have any impacts on Exhibition Road.

Module 19: State transport network functionality • 19.1 Access to state-controlled roads state code

The purpose of this code is to ensure that development does not adversely impact the safety, function and operational efficiency of the state-controlled road network or a future state-controlled road.

Comment: The proposed development is located approximately 140m from the State-controlled road and does not seek approval for direct access to this road. In addition, given the limited size of the proposed facility, it is considered that it will not generate a volume of traffic that will have an adverse impact on the safety, function or operational efficiency of the state controlled road.

• 19.2 Transport infrastructure and network design state code

The purpose of this code is to ensure that: (I) Development does not compromise the safe and efficient management and operations of state

transport infrastructure and transport networks (2) Development does not compromise planned upgrades of state transport infrastructure or the

development of future state transport corridors (3) Upgrade works proposed to mitigate adverse impacts of development on the operation and

management of state transport infrastructure are: a. consistent with applicable design standards b. consistent with planned upgrades of the state transport infrastructure

(4) Development does not compromise the safe and efficient operation of the overall road hierarchy by imposing traffic loadings on state-controlled roads which could be accommodated on the local road network.

Comment: The proposed development is located approximately 140m for the state-controlled road. The development does not propose direct access to the state controlled road and is not visible from it. As mentioned above, it is not expected that the volume of traffic generated by the proposed use will adversely affect the performance of the local road network and as such, no upgrades to the state controlled road are proposed.

LANDSCAPE CONSTRUCTION NOTES (cont.)PLANTING:

Do not vary the plant locations from those shown on the drawings unlessotherwise directed. Obtain approval of setout before planting. Do not plantin unsuitable weather or site conditions. excavate planting holes to a sizethat allows a minimum of 100mm site topsoil backfill beneath & around theroot system of the plant.

Apply a slow release fertiliser, Everris Professional landscape Formula Flora- 8 to 9 months , to manufacturers specifications at time of planting. Waterimmediately after planting & thereafter as directed to maintain growth free ofstress.

Plant numbers in mass planting areas have been calculated on theassumption that a death rate of 20% is expected due to the current weatherconditions.

MULCHING:

All garden areas are to be mulched with recycled forest mulch to amaximum depth of 100mm after settlement. Top up mulch as and whenrequired to maintain this depth at all times.

Mulch must comply with AS4454-2012 Composts, soil conditioners andmulches.

Turfing:

All areas to be turfed as shown on WD 01 and WD 02 shall be turfed using'A' grade Nara Native Turf grasss. Prior to laying turf, ensure all areas to beturfed are free from weeds. Cultivate existing surface to a minimum depth of200mm and remove all rock or stone over 15mm and debris brought to thesurface during cultivation. Top dress with imported soil which is compliantwith AS 4419 (2003) Soils for landscaping and garden use. Lay turf, in astaggered bond pattern and close butted to ensure a complete cover whenfinished. Water in and roll to achieve an even compacted surface which isflush to adjacent hard surfaces. Fill slight depressions and small gaps withtopsoil where necessary.

WATERING:

Water all plants at time of planting & as directed thereafter for theestablishment of the plant material. Truck mounted water tank withappropriate fittings to be used for landscape watering.

LANDSCAPE MAINTENANCE NOTES:MAINTENANCE PERIOD:

The maintenance period of 12 weeks for all softworks shall commenceat the time of practical completion & shall include;

· min 1 visit per week for the first 6 weeks

· min 1 visit per fortnight for the 6 weeks following

Works to be carried out during this period includes but is not limited to;

watering, mowing, weeding, fertilising, pest & disease control,re-seeding, re-staking, re-tying, replacement planting, re-mulching,cultivating, pruning, aerating, renovating, top-dressing and keeping thesite tidy.

Refer to Council's landscape requirements & details for furtherinformation.

LANDSCAPE CONSTRUCTION NOTESGENERAL:The contractor is to check all drawings and report any ambiguities oranomalies to the landscape architect for clarification as soon aspracticable. No claim for extras arising from failure to obtain clarificationof such matters will be allowed.

Landscape drawings are to be read in reference to associatedapproved architectural and civil drawings.

All works to be carried out in accordance with council's specifications &details where applicable.

EXISTING SERVICES:

The contractor shall locate any existing services beforecommencement of work. Any existing services damaged in any way asa result of the activities of the landscape contractor shall be restored toits original condition to the satisfaction of the Project Manager, either byor at the expense of the contractor.

SITE MANAGEMENT:

Ensure all vehicles leaving the job site are reasonable free and cleanfrom soil and/or mud

RUBBISH REMOVAL:

All rubbish including weed material and builders' debris shall beremoved from site and disposed of in accordance with Councilrequirements.

PLANT MATERIAL:

Confirm at time of tendering that all plant material species, minimumsizes & numbers as scheduled, will be available. No substitutions to bemade without approval.

Plants shall be well established with good form & free from pest &disease with large healthy root systems with a good root to shoot ratio,not pot bound & hardened off. Plant containers shall be free fromweeds.

All plants are to confirm to the 'Natspec Specifying Trees - A guide toassessment of tree quality, 2003'

SITE PREPARATION:

Cultivate to the following depths;

· 200mm for turf

· 300mm for shrubs and groundcovers

· 800mm for trees

prior to backfilling with imported organic garden soil.

Imported garden soil must comply with AS 4419 (2003) Soils forlandscaping and garden use.

The organic material used in the soil mix must also be fully compostedto ensure minimal slumpage over time.

Incorporate fully and thoroughly 'TerraCottem Universal into theimported topsoil at a rate of 1.5kg per m³ of soil mix.

Backfill in layers compacting the soil regularly to minimise subsidenceover time. Finish imported soil 75mm below adjacent pavements aftersettlement.
