The Law Library Board of Trustees held a regular meeting, pursuant to notice thereof, on February 18, 2015 at the San Diego Law Library, located at 1105 Front St., San Diego, CA 92101. Present: The following Board members were present: Honorable Joseph Brannigan; Honorable Julia Craig Kelety, President; Honorable Yvonne E. Campos; Honorable David M. Gill; Nathan Low, Esq. Absent: Jeffrey D. Cawdrey, Esq., Treasurer; Honorable David Berry, Vice President, and Lorena Slomanson, Esq., Assistant Secretary. Also Present: John W. Adkins, Director of Libraries and Secretary to the Board; Marcia O’Hara, Assistant Director of Finance & Personnel; and Cyndi Quisenberry, Administrative Support Officer. Guests: Mara Elliott

1) Call to Order

Judge Julia Kelety, Board President, convened the meeting at 12:21 pm.

2) * Opportunity for General Public Comment a. No Public Comments

3) Minutes

a. Previous Meeting of January 21, 2014

MOTION (1): Judge Kelety called for a motion to approve the minutes of January 21, 2014. Judge Gill moved to approve the minutes; Judge Brannigan seconded the motion, and the minutes passed unanimously.

4) 2014-2015 Statement of Economic Interests - Form 700 • Judge Kelety reminded the Board that all Board members need to complete a

Form 700. • Complete and return to Cyndi Quisenberry who will file them all together.

5) Financial Report (O’Hara) a. Financial Reporting

• Ms. O’Hara reported that filing fees are up a little bit this month over last month. • The “Projection of Actual” on the Profit and Loss Statement was updated to

reflect current information. • Materials (pg. 2 of Profit and Loss Statement) – We are going to be over budget

by approximately 20k in Electronic Resources, but we will be under 20k in

Books-Continuations. Ms. Moran feels that the budget will balance out in the long run.

• The Westlaw Database will be cancelled at the end of the contract in March 2015. We should start seeing the savings in April.

6) New Trustee Search • Mara Elliott, applicant search committee recommendation, attended the meeting. • We are currently waiting on official resignation from Carolyn Brock to move

forward with the nomination. • The board agrees that the applicants were all of the highest caliber, and the

search was competitive.

7) Other Reports a. Foundation Liaison Report (Judge Gill; Nathan Low)

• The Foundation met with LexVid, an MCLE provider, to discuss possible partnership with the Foundation.

• The Foundation has amended their bylaws.

b. SDCBA Liaison Report • Judge Kelety and John Adkins will be meeting to discuss the required attendance

of the SDCBA liaison to BOT meetings. • Judge Kelety asked “what it is that we want from the SDCBA?” • Judge Kelety does not see a need for a liaison. Mr. Adkins suggested that once a

year might be a better option, with the liaison giving a “State of the Bar” type address.

c. Legislation Committee Report • The plan is for Mr. Cawdrey, Judge Berry, Judge Kelety, and Mr. Adkins to meet

and discuss active legislation. Relevant legislation will help create freedom to raise revenue and not depend on filing fees.

8) Secretary’s Report

a) Law Library press & praise o Lincoln Exhibit Reception: February 5th 2-4pm, at Downtown location -

Opening Reception celebrating Lincoln: The Constitution and the Civil War . Guided tours of the exhibit will be available, along with a screening of Lincoln: His Life and Legacy part 1 from the History Channel. All events are free and open to the public. o The traveling exhibition has been made possible by a major grant from the

National Endowment for the Humanities.

b) Outreach activities o 3 Classes, 19 Lectures, and 12 Legal Clinics.

c) 10 Facilities Maintenance Reports o North County trailer is dangerous. Closed for classes and events until the new

fiscal year. County will make some temporary fixes in the mean time.

d) Patron compliments/ complaints o 2 Patron Compliments/Complaints

e) Incident reports o 1 Incident Report

f) Monthly Activity Report o El Cajon patronage continues to fall. Need new metrics to determine the actual

use of this branch. How can we save this branch? We need to provide alternate methods of providing legal research access.

o Judge Campos suggested working with the County for referrals to the SDLL. How do we get the word out about our services?

o Mr. Adkins will work on a report on the state of the East County branch. The report should be available in April. Mr. Adkins thinks our best option will be working with the Public Library.

Subject: LexVid, San Diego Law Library Strategic Partnership

The Objective: The San Diego Law Library (the “SDLL”) regularly organizes continuing legal

education (“CLE”) programs at its facilities. The SDLL would like to expand its CLE operations

and earn extra revenue by distributing these programs online on an on-demand basis.

Proposed Solution: LexVid will produce the SDLL’s live programs and allow SDLL members to

access them using LexVid Services, Inc.’s (“LexVid”) established CLE viewing platform. Once

LexVid recoups program production costs, LexVid and SDLL will split the revenue earned from

SDLL members 50/50.

Steps Involved:

1. The SDLL will notify LexVid of upcoming live CLE presentations organized by the

SDLL. LexVid, using its editorial discretion, will determine which programs fit within

its library of CLE content. Selected programs will be filmed by LexVid in high-quality

HD format. The SDLL will assist LexVid in attaining any necessary releases from

presentations speakers and moderators.

2. LexVid will add video files, along with any accompanying course materials such as

powerpoint documents, PDFs, Word documents, or other written materials, to its

library of online CLE content.

3. As an accredited California CLE provider, LexVid will be responsible for providing CLE

credit in California for online participation in these courses, and will accredit the

program in additional states as it sees fit.

4. LexVid will make the programs available on-demand for the same price as all other

LexVid CLE content (currently $20 per credit hour). LexVid will also make the

programs available as a part of other LexVid CLE packages, including unlimited

access, multi-credit, and free packages.

5. The SDLL will promote the programs to its members, and offer its members an

exclusive 10% off discount code for use with any LexVid purchase. The discount code

will not only be used as an incentive for SDLL members to view/purchase programs,

but also as a way for LexVid to track revenue that comes from the SDLL.

6. LexVid will track all revenue earned from use of the exclusive SDLL discount code.

Once program production costs are recouped by LexVid (approximately $200 for

filming and post-production for each program), revenue will be split evenly with the

SDLL. This including all revenue from sales of non SDLL produced content (other

LexVid CLE programs, multi-credit LexVid CLE packages, etc.).

7. LexVid will give the SDLL its portion of the revenue share by the 15th of the following

month. For example, referrals from June will be paid by July 15th.

Patron Incident Reports Branch: Brief Description of Incident: Main Patron is in a wheelchair and has an assistance dog. Patron entered the elevator

on the first floor and pushed the button to go to 4th floor before the dog entered the elevator. Patron’s dog refused to enter the elevator. Patron attempted to block the elevator doors from closing while unsuccessfully trying to pull the dog into the elevator. The doors began to close. Staff member heard the beeping from the elevator doors being held open and investigated. Staff attempted to disengage the leash from the dog’s collar as the elevator doors closed and the elevator began to ascend. Staff was able to free leash from patron and prevent dog from being choked. Other staff attempted to assist and entered the elevator. Staff member had their foot run over by patron’s wheelchair, but reported no injuries. Senior staff spoke to patron and they decided that patron would no longer use the elevator if she had her assistance dog with her – staff would get material as requested. Patron incident 224.

Statistics Review – February 2015 Summary Vista had a strong month; their best in a year. El Cajon’s gate count rebounded from January. The patron inquiries totals for El Cajon and Chula Vista are still very low – roughly 2 or 3 inquiries per hour. Downtown had their worst month for inquiries in years. Its gate count was normal so this was probably a data entry issue. Overall, the total inquiries were lower than last year, but last year’s totals included 10 more days of being open.

Downtown’s patron inquiries this month are lower than expected. This appears to be an issue with entering information in the tracking software because other usage statistics – gate count, items used in the library, and items checked out – do not reflect the decrease. This year’s gate counts are similar to FY 2012-13 and earlier years so it looks like last year’s totals were the exception. Vista’s patron inquiries jumped again, to 52 per day, and its gate count was stable with 87 daily patrons. El Cajon continues to have a worrying drop in its daily patron inquiries total, but its gate count bounded back in February. February’s patron inquiries were still very low for the branch, though slightly higher than January: 15 to 11. Chula Vista is now open just 4 hours per day so I adjust stats to per 8 hours to make it easier to compare to other branches and to earlier months. The branch had some issues with data collection so this month’s totals have been estimated from previous months. It averaged 16 inquiries compared to 59 patrons per 8 hours.

Patron Inquiries: Chula Vista numbers were the same after their dramatic drop last month. Vista had their best month in a year. Downtown had their lowest total in many years. El Cajon is showing a worrying trend as their patron inquiries continue to decline. February was one of the lowest monthly totals on record for both Chula Vista and El Cajon. Downtown and Vista remain near their recent historical averages.

Gate Count: Compared to the average of the last 3 Februaries, Downtown is meeting its average; Vista was 8% lower, El Cajon 19%, and Chula Vista 30%. Compared to just February 2014, Main was the same, and Vista and El Cajon were between 5 and 8% lower.

Patron Inquiries Details: Downtown San Diego answered 1337 in February 2015, 20 days. Per day: 67 Last year, they answered 1528 in February (76 per day) and averaged 1711 (84 a day) over the last 3 years Last month, January 2015, was 1721. Per day: 77 Downtown was 12% lower than its February 2014 daily totals. El Cajon answered 138 in February 2015, 9 days. Per day: 15. Last year, they answered 439 in February (27 per day) and averaged 727 (40 a day) over the last 3 years. Last month, January 2015, was 105. Per day: 11. El Cajon was 44% lower than its February 2014 daily totals. Vista answered 850 in February 2015, 16 days. Per day: 16 Chula Vista was 16% lower than its February 2014 daily totals. Gate Count Details: Downtown had 386 patrons enter its gates. Per day: 192. This is the same as the average of the previous three Februaries: 192. The gate count was the same compared to February 2014. El Cajon had 457 patrons enter its gates. Per day: 51. This is about 19% lower than the average of the last three Februaries: 63. The gate count decreased 5% compared to February 2014. Vista had 1389 patrons enter its gates. Per day: 87. This is about 8% lower than the average of the last 3 Februaries: 95. The gate count decreased 8% compared to February 2014. Chula Vista had 416 patrons enter its gates. Per 8 hours: 59. This is about 30% lower than the average of the last three Februaries: 84. Days Open February 2015 – Downtown San Diego was open 20 days, Vista was open 16 days. El Cajon was open 9 days. Downtown San Diego’s total includes 4 Saturdays when the library is open a half day. Vista’s totals include 4 Fridays when they were open half days. El Cajon is open 2.5 days a week. Chula Vista was open 14 half days, or 7 equivalent days. Chula Vista is now closed on Fridays. All branches were closed in observance of Presidents’ Day and Lincoln’s Birthday.
