2. Executive Summary

1. Landuse consent was granted in 2018 under 2180510-RMALUC to construct a second dwelling onthe site. This has since been constructed, resulting in a total of 2 dwellings on site.

2. It is now proposed that the site be subdivided around the existing dwellings as per the attachedscheme plan. The subdivision layout matches the existing internal fence layout between theresidential units.

3. Subdivision consent will be required as a discretionary activity.

4. The subdivision proposal will only serve to create cadastral boundaries and legal ownership rightsrelating to each individual dwelling. No physical changes or increase in density is required orprovided for by the subdivision.

5. All infrastructure and services etc have been installed (as shown on the attached plans) andeasements are to be created to cater for these services as part of this proposal.

6. As will be assessed through this application, no affected parties have been identified andneighbours consultation has not been undertaken.

7. As assessed within this application; the proposal is not anticipated to result in any significantadverse effects on the surrounding environment.

8. As assessed within this application; the proposal passes the tests to be processed on anon-notified basis.

9. As assessed within this application; and subject to Council's discretion, the proposal passes thegateway tests to be granted consent.

10. It is anticipated that conditions will be applied around development in accordance with plans andinformation submitted.

3. Site Description

1. Residentially zoned and located off Hongi Street, the site is a 111Om2 piece of land comprised in asingle title.

2. The site contains two HNZC houses, with a new dwelling having been recently constructed besidethe old dwelling (2 dwellings in total). This new dwelling was consented under 2180510-RMALUCand has been generally completed.

3. All infrastructure and services have been provided to the dwellings. Easements are to be createdover services etc as appropriate (see attached subdivision plan).

4. The site itself is essentially fiat. Ground cover is in either paved areas or lawn, with minimalplanting. Proposed Lot 1 in a low post and rail fencing, while proposed Lot 2 is fully fenced withhigh closed pale wooden fencing, providing a high degree of privacy to neighbouring sites.Internally, new fencing has been installed between each of the residential units in a configuration

matching the proposed subdivision layout.

5. The surrounding area comprises the same typical topography, development style and underlyingzone regulations, and the proposed development is considered compatible with the existingenvironment. It is also noted that the density is existing and subdivision will only serve to createseparate titles around this existing development.

4. Proposal Details

1. The intention is to subdivide the site into 2 independent titles. The subdivision layout has beenconfigured around the 2 existing dwellings and matches the recently constructed internal fencing.

2. Proposed Lots 1 and 2 have areas of 503m2net and 607m2netrespectively and comply with the

residential subdivision standards as a discretionary activity.

3. Access is to be provided status quo, with each of the units gaining access directly from theirrespective road frontages.

4. Services are to be provided as per the status quo, as illustrated on the attached plan anddescribed as follows:

Sewer: AS approved under 2180510-RMALUC, the Lot 2 development has connected to anexisting service line, serving and running through proposed Lot 1. This service line connects to thepublic sewer line on Heke Street. Easements have been created to legally accommodate thisarrangement.

Stormwater: Stormwater from Lot 1 discharges directly to kerb side as per the existingarrangement. Stormwater from Lot 2 discharges to a detention tank which discharges to thepublic system as approved under 2180510-RMALUC.

Water/Network Services: These again are to be provided status quo, with each lot gainingconnection via its respective road frontage.

5. Given that the proposed subdivision does not affect existing density, and does not require anyactual physical changes to the site, no affected parties have been identified and no neighboursconsultation has been undertaken.

6. The proposed subdivision layout does not result in development control non-compliances.

Assessment Criteria: 13.10.1 Allotment Sizes And Dimensions

(a) Whether the allotment is of sufficient area and dimensions to provide for the intendedpurpose or land use, having regard to the relevant zone standards and any District wide rulesfor land uses.

The proposed allotments comply with relevant shape factor dimensions and allotment areasand all allotments contain existing dwellings, so demonstrate that they can accommodateresidential development having regard to the relevant zone standards and any District widerules for land uses.

(b) Whether the proposed allotment sizes and dimensions are sufficient for operational andmaintenance requirements.

The allotments follow existing fences which delineate between the separate existing residentialunits. These have been configured to FNDC and HNZC standards for residential housing and areanticipated to provide for the above values.

(c) The relationship of the proposed allotments and their compatibility with the pattern of theadjoining subdivision and land use activities, and access arrangements.

The proposed subdivision layout mimics the existing fence delineated residential areas aroundthe existing dwellings and the proposed subdivision will not result in any discernible effect interms of the sites physical attributes.

(d) Whether the cumulative and long term implications of proposed subdivisions aresustainable in terms of preservation of the rural and coastal environments.

The proposed subdivision is around existing dwellings and is not expected to result in anycumulative and long term implications. Further, the subdivision is located within a residentialzone and is not anticipated to result in any adverse effects whatsoever in relation topreservation of the rural and coastal environments.

Objectives and Policies:

As has previously been repeated, the proposed subdivision is around existing consented and establishedresidential development and will not result in any physical changes. Having reviewed the objectives andpolicies under Sections 13.3 and 13.4 of the District Plan, it is not considered that the proposal is in anyway contrary to these values. No further assessment of objectives and policies is considered necessary.

Regional Plans:

1. Specific consideration of the Regional Plan is not considered necessary in this case.

Any Other Matters

1. It is not anticipated that any other matters will be relevant in consideration of the proposedactivity.

1. The consideration of resource consents is subject to Part Il of the Act. An analysis of the proposalagainst the provisions of Part 11 of the Act has been undertaken for Council's consideration asfollows;

Section 5 (Purpose)

1. Section 5 of the RMA states;

'(1) the purpose Of this Act is to promote the sustainable management Of natural and physicalresources.

(2) In this Act, sustainable management means managing the use, development, and protectionof natural and physical resources in a way, or at a rate, which enables people and communities toprovide for their social, economic, and cultural wellbeing and for their health and safety while-

• Sustaining the potential of natural and physical resources (excluding minerals) to meet thereasonably foreseeable needs of future generations; and

• Safeguarding the life-supporting capacity of air, water, soil, and ecosystems; and• Avoiding, remedying, or mitigating any adverse effects Of activities on the environment.'

2. Overall, with regard to the AEE, the proposal is not anticipated to generate any significant adverseeffects on the environment. The proposal is however, anticipated to result in positive benefits.Subject to the design constraints set out within this application, the proposed activity isanticipated to generate positive benefits without adverse consequence. Therefore, the granting ofconsent would be in accordance with Section 5 of the Act, which allows for people andcommunities to provide for their social, economic and cultural wellbeing while maintaining thevalues expressed.

Section 6 (Matters of National Significance)

1. Section 6 of the RMA States;

'In achieving the purpose Of this Act, all persons exercising functions and powers under it, inrelation to managing the use, development, and protection of natural and physical resources,shall recognise and provide for the following matters of national importance:

a. The preservation of the natural character of the coastal environment (including the

coastal marine area), wetlands, and lakes and rivers and their margins, and the protectionof them from inappropriate subdivision, use, and development:

d. The maintenance and enhancement of public access to and along the coastal marine area,lakes, and rivers:

f· The protection of historic heritage from inappropriate subdivision, use, and development.g. The protection Of recognised customary activities.'

2. It is not anticipated that the proposed activity will in any way result in adverse effects in relationto those matters addressed through Section 6 of the RMA.
