PROPOSED SULPHUR MANAGEMENT FACILITY

Alberta Sulphur Terminals Ltd., a division of HAZCO Environmental Services Ltd. (AST), has proposed to construct a sulphur management facility to process sulphur generated by oil and gas related refining operations in Alberta. The proposed project (Project) includes facilities for sulphur forming and shipping, as well as facilities for storage of manufactured product (i.e. sulphur pellets). The proposed site is located at Section 35-55-20 W4M approximately 2.2 kilometres east of Bruderheim, Alberta. The proposal was referred to the Regional Environmental Manager of the Northern Region, who is the designated Director (the Director) under the Environmental Protection and Enhancement Act (EPEA) to decide if the proposed activity warrants further consideration under the environmental assessment process. The Director decided that further consideration would be required and that a Screening Report would be prepared to determine the need for an Environmental Impact Assessment (EIA) report. AST was directed to disclose the Project to the public and invite the public to provide input to the Director about the need for an EIA report. The Screening Report includes a summary of information available on the proposal from AST, Statements of Concern filed by the public, and advice from Alberta Environment staff and other regulatory agencies.

1.0 INTRODUCTION Alberta Sulphur Terminals Ltd. a division of HAZCO Environmental Services Ltd. (AST), has proposed to construct a sulphur management facility to process sulphur generated by various oil and gas refining operations in Alberta. The proposed project (Project) includes facilities for sulphur forming and shipping, as well as facilities for storage of manufactured product (i.e. sulphur pellets). The proposed site is located at Section 35-55-20 W4M approximately 2.2 kilometres east of Bruderheim, Alberta, in Lamont County. In July 2005, AST submitted an approval application in accordance with the Environmental Protection and Enhancement Act (EPEA) for the construction, operation and reclamation of the proposed sulphur forming and storage facility near Bruderheim. In August 2005, the Regional Approvals Manager of the Northern Region referred the proposed project to the Regional Environmental Manager of the Northern Region, who is the designated Director (the Director) for the purpose of making a decision whether the potential environmental impacts of the proposed activity warranted further consideration under the environmental assessment process. The Director decided that further consideration was warranted and that a Screening Report would be prepared to determine if an Environmental Impact Assessment (EIA) Report was required prior to the EPEA approval application being processed. Public notice of that decision was provided in December 2005 and directly affected persons were invited to submit Statements of Concern to Alberta Environment. In its July EPEA application, AST’s proposal included a sub-grade sulphur storage (i.e. sulphur block) facility. AST subsequently removed the sulphur block from the scope of its proposed development in response to a clarification request by Alberta Environment, and submitted a revised EPEA application in October 2005. Environmental issues relating to sulphur blocks are not considered in this Screening Report. The Screening Report was prepared in accordance with s. 4(1) of the Environmental Assessment Regulation.

1.1 Purpose of Screening Report Under s. 44(1)(b) of the EPEA, the Director determined that the potential environmental impacts of the proposed activity warranted further consideration under the environmental assessment process. Pursuant to s. 45 of the EPEA, that decision triggered a requirement for the preparation of a Screening Report regarding the need for preparation of an EIA report. A Screening Report helps the Director determine if an EIA Report summarizing the proposed activity, potential adverse effects, and their prevention, minimization or mitigation, is required prior to making regulatory decisions. Some types of information are best obtained and considered through the preparation of an EIA report. Typically this includes information about large, complex activities occurring in sensitive environments that may have a broad range of environmental, health, socio-economic and infrastructure effects requiring management or mitigation. An EIA report is also valuable for decision-makers when there is a substantial lack of technical and/or environmental information associated with a proposed project. On the other hand, less complex activities with well understood effects could be appropriately addressed without an EIA report using the EPEA approval application process and its information requirements. Some kinds of information such as air and water quality modelling are part of both information-gathering processes.

1.2 Information Sources The following information sources were considered in the preparation of this Screening Report: EPEA Approval application submitted by AST dated July 25, 2005; “An Assessment of Air Quality Impacts Associated with Operations At the Proposed

2.0 PROJECT DESCRIPTION 2.1 The Need for the Project

Sulphur, a by-product of sour gas processing, heavy oil upgrading and petroleum refining operations, is generated by oil and gas related facilities throughout Alberta. It is produced in sulphur recovery units that are used to minimize sulphur dioxide (SO2) emissions to the atmosphere. Sulphur is primarily used, both domestically and overseas, to produce fertilizers. Most of the sulphur produced in Alberta is sold outside the province, mainly to Florida, Asia and North Africa. Based on information provided by AST, the export demand for sulphur is expected to increase over the next few years. In Western Canada, sulphur is transported as a dry product (i.e. such as sulphur pastilles) by rail to Vancouver for shipment to export markets. AST’s proposal addresses the need for a sulphur forming facility that converts molten sulphur, produced by sulphur producers in the Fort Saskatchewan, Fort McMurray and Lloydminster areas, to sulphur pastilles for export to overseas markets.

2.2 Project Components

AST’s proposed sulphur forming and shipping facilities include: Road and rail access for receiving molten sulphur; Molten sulphur unloading and transfer facilities; Sulphur forming facilities to produce sulphur pastilles; Sulphur pastilles loading and shipping facilities; and A sulphur pastilles storage area.

2.3 Location

The proposed site is located in Section 35-55-20 W4M in Lamont County, Alberta, approximately 2.2 kilometres east of Bruderheim. The town of Lamont is approximately 6 kilometres southeast of the proposed site. AST’s proposed site location is surrounded mainly by agricultural and residential development with two chemical (sodium chlorate) manufacturing plants situated to the west.

Range Road 202, Highways 45 and 15, as well as Canadian National Railway and Canadian Pacific Railway service the site.

2.4 Land Use The Project’s proposed location is on land within the Alberta Industrial Heartland area structure plan. The Alberta Industrial Heartland Association is an organization whose purpose is to integrate the Sturgeon County, Strathcona County, Lamont County and City of Fort Saskatchewan area structure plans to ensure that future growth in the region occurs in a coordinated and responsible manner. The Project’s proposed location is on lands zoned as heavy industrial. Both industrial and agricultural activities occur in the vicinity of the proposed site.

2.5 Preliminary Geology and Hydrogeology

Based on information provided by AST, surficial deposits consist of undivided fine sediments of fine sand, silt and clay, and minor gravel beds. Near surface bedrock geology is mainly of the Late Cretaceous age. Three formations that subcrop the area are Belly River Formation, Bearpaw Formation and Horseshoe Canyon Formation. The Belly River Formation is the oldest bedrock formation. It is overlain by Bearpaw, which in turn is overlain by the Horseshoe Canyon Formation. The Belly River Formation is non-marine in origin and consists of sandstone, siltstone, mudstone and ironstone that has a thickness that ranges from 275 to 300 metres. The Bearpaw Formation consists of shales and siltstones. AST indicates that groundwater is near surface and that the overburden groundwater appears to be hydraulically connected to the more shallow bedrock groundwater. AST suggests that groundwater from approximately 45 metres and deeper is protected by a thick, competent shale unit.

2.6 Preliminary Hydrology AST’s proposed site is located approximately 800 metres west of Lamont Creek and approximately 1.5 kilometres south of Beaverhill Creek. The North Saskatchewan River is located approximately ten kilometres northeast of the site. The proposed processing and storage facilities are within a low lying area of the proposed site that contains a slough, a dugout, and two drainage ditches.

3.0 PUBLIC CONSULTATION AND STATEMENTS OF CONCERN Public input is an important component of the EPEA decision-making process. The EPEA approval process includes the opportunity for persons directly affected by a project to submit statements of concern. Early in the project planning and development process, proponents generally value input from the public and often hold information sessions and open houses to determine any public concerns associated with the project and what information they will need to address the concerns.

3.1 AST’s Consultation Activities AST consulted with the public to describe the proposal, identify stakeholder concerns, and to solicit feedback regarding potential project improvements. The following public consultation activities were completed by AST:

AST’s initial presentation of the project proposal to Alberta Environment (AENV), Northern

Region, in May 2005. AST was asked to further define the scope of their proposal so that AENV could determine the most appropriate regulatory process;

Meeting with Lamont County to present AST’s proposed development and to get initial feedback regarding the compatibility of the Project with the County’s land use structure plan;

Personal meetings with area residents and landowners within 1.6 kilometres of the proposed site;

Discussions and meetings with area industries to obtain their input about the compatibility of the proposed Project with other industrial plans and operations;

Distribution of the Disclosure Document to other individuals and groups; An Open House on June 28, 2005, at the Bruderheim Memorial Community Hall where

approximately 69 individuals (including the public) met to discuss AST’s proposed sulphur management facility and provide feedback on potential environmental issues; and

A second open house in October 2005. 3.2 Statements of Concern

Before any Public Notice was published, AENV received a number of form letters from local residents indicating that they were opposed to the sulphur management facility proposed by AST. The basis for the objection included the potential for environmental impacts caused by the sulphur block, concern about the need for emergency response related to the facility, and that the proposed development would not provide added value to the economic well-being of the surrounding farming population and local community. AST published a Notice in the Lamont Reader on December 6, 2005, Edmonton Journal and Sun on December 8, 2005, Fort Saskatchewan Record on December 9, 2005, and Redwater Review on December 13, 2005, advising that the Director was considering the need for AST to prepare an EIA report on its proposed sulphur management facility. The Notice also indicated that sulphur blocks were not included in the scope of the proposed development. Persons directly affected by the Project were advised to submit their Statements of Concern about the need for an EIA report to the Director by January 16, 2006. During the Public Notice period, Alberta Environment received the following Statements of Concern:

A petition from the Friends of Lamont County containing 1051 form letters expressing concerns regarding potential environmental impacts, traffic and social issues;

261 form letters from individuals and families outlining eight areas of concern: property value, noise pollution, air emissions, soil contamination, transportation issues, sulphur fires and emergency response plan, “tip of the iceberg” and trust issues. Each issue had check boxes for specific items related to the issue. Many also provided personal comments on the form letters;

43 written letters from individuals and families expressing concerns with the Project; and 25 form letters and 1 written letter in support of the Project.

Six of the 43 written letters and one of the 261 form letters clearly stated that an EIA report should be required to address the concerns identified. One of the written letters, while not specifically stating that an EIA report should be required, did outline a number of further assessment requirements that would be needed to address concerns with the Project. All submissions were placed on the Register of Environmental Assessment Information for public viewing and copies of all the submissions were sent to AST for their information. It should be noted that this is, by far, the most Statements of Concern ever received by Alberta Environment in response to the preparation of a Screening Report to determine the need for an EIA report.

3.3 Government Agency Advice The Director provided information about the Project to the following provincial agencies and requested their advice:

Sustainable Resource Development; Energy and Utilities Board; Community Development; Economic Development; Education; Energy; Human Resources and Employment; Aboriginal Affairs and Northern Development; Health and Wellness; and Infrastructure and Transportation.

4.0 EVALUATION OF ISSUES AND CONCERNS The main issues and concerns raised by the public and government agencies are summarized in the following sections.

4.1 Air Quality The Project is expected to emit sulphur dust, particulates, hydrogen sulphide (H2S), sulphur dioxide (SO2), nitrogen dioxide (NO2) and carbon monoxide (CO). Sulphur dust would be generated mainly during the storage and handling of the pastilles. H2S would be emitted as fugitive emissions from tanks and equipment leaks. The pastilles forming process would be the major source of particulates, NO2, SO2 and CO. Based on the air assessment report submitted by AST, the storage and handling of the pastilles would not generate significant sulphur dust and the emissions associated with the operation of the sulphur forming facility should not cause adverse effects on the environment. To control odour, AST proposed that only molten sulphur that has been degassed to less than 10 parts per million of H2S would be received and a 600 meter setback from surrounding properties would be implemented. Concerns were raised that the open product storage area, the use of a front end loader for product handling, and the use of dust suppression as proposed by AST do not represent best available technologies for controlling sulphur dust emissions. Some Statements of Concern suggested that better technologies to control dust include sulphur pastilles storage in silos and transport by covered conveyor. The Statements of Concern also suggested that AST’s proposed product handling procedures would generate more sulphur dust than stated in AST’s submission. Local landowners expressed their concern that acid rain caused by SO2 emissions would adversely impact their farmlands and properties. Odour resulting from H2S emissions is another concern that was raised by the residents. Some Statements of Concern indicated that AST would not have control over the H2S content in the molten sulphur being received. Residents in the area also indicated their concern with potential health effects of the air emissions. Some have specifically stated that they have allergies, asthmas, or lung diseases and that sulphur dust would aggravate those conditions.

Air quality issues can be dealt with effectively through the EPEA Approval process. Acceptable limits and controls on various air emissions can be stipulated within an Approval to protect the environment and health of local residents.

4.2 Soil Contamination Sulphur dust resulting from product storage and handling operations at the AST proposed facility has the potential to acidify soils surrounding the proposed facility. AST indicated that the dust impacts would likely be present within a 150 – 200 metre radius surrounding the facility. AST proposes a soil-monitoring program to characterize the sulphur impacts on soils in accordance with regulatory requirements. Local landowners expressed their concern that soil acidification caused by sulphur dust would affect their property and farm lands. They also expressed concerns about soil contamination resulting from accidental releases of molten sulphur during transportation, loading, and unloading. Similar to other air issues, acid deposition can be dealt with effectively through the EPEA Approval process. 4.3 Surface and Groundwater Protection

The sulphur forming process proposed by AST would not have any direct contact with water, steam or air current as the forming medium. This effectively addresses the concerns regarding water contamination by process wastewater. Any surface runoff water coming into contact with the pastilles handling and storage areas would have the potential to contaminate surface and groundwater. AST proposed a lined ditching system and surface water collection pond to collect all precipitation that falls on the working area of the proposed facility to protect surface and groundwater. The water collected would be used as process make-up water and as a water supply for fire-fighting. Statement of Concern filers who depend upon a natural stream to feed their livestock are concerned that AST’s proposed project would impact the water supply both in terms of quantity and quality.

4.4 Traffic According to AST, the Project would add approximately 40 truckloads a day to local traffic volume and its Traffic Impact Assessment (TIA) study indicated access to the Project is via existing Range Road 202 that connects Highway 15 two miles east of the intersection of Highway 45 and Highway 15. The TIA study indicated that upgrades to the Highway 15 intersection would be required to maintain safe access if there were additional traffic generated from the Project. The TIA study indicated that no improvements to the Highway 45 intersection would be required. Several local residents expressed concerns that additional trucks and rail traffic would increase hazards to the already overloaded highway and rail system. There were also concerns that trains would block emergency response vehicles and personnel from responding to emergency situations, and that school buses on Highway 15 would be at higher risk because of increased

traffic volume. Some people also expressed concerns that the Project would cause traffic congestions and create delays when commuting to work, increasing travel time to get to desired locations. Increase in noise levels as a result of increase in traffic is another issue raised by the Statement of Concern filers. Alberta Infrastructure and Transportation has not indicated any major concerns with AST’s proposed improvements to mitigate the traffic impacts caused by the Project.

4.5 Fires and Emergency Response Plans Local residents are concerned that AST does not have emergency response plans to deal with major sulphur fires and related emergencies. They are concerned that sulphur fires are difficult to put out and that the local volunteer firefighters and Northern Region Community Awareness and Emergency Response (NR CARE) do not have the capacity to deal with a situation of this type, if it arises. Canexus, a sodium chlorate manufacturing facility located immediately southwest of the proposed facility, has expressed concerns with the adverse impact sulphur dust may have on its operations. Canexus states that sodium chlorate is a strong oxidizing agent and the presence of sulphur dust would create significant safety and operation issues for its facility. AST states that sulphur fires burn slowly and can be controlled easily. AST indicates in its Disclosure Document that an Emergency Response Plan would be reviewed and filed with local emergency response officials and organizations.

5.0 SUMMARY Alberta Environment has carefully considered the advice provided by the public and government agencies and information provided by AST. The Screening Report has identified the following items:

1. Socio-economic impacts are considered in making an overall public interest decision. A

socio-economic analysis is typically included in an EIA report, which is submitted to a public interest decision-maker such as the Natural Resources Conservation Board. Socio-economic considerations are difficult to address in the EPEA Approval process. Almost all Statement of Concern filers expressed concern that the Project would not provide adequate economic benefits to local communities and to the contrary, would lower land and property values in the vicinity of the development. In addition, concerns were also expressed that the Project would discourage other industries from locating projects in the Lamont County, which would further impact the economic well-being of the County and its residents. An EIA report would provide AST with an opportunity to present its business case to garner support from the County and its residents, and provide decision-makers with the information necessary to determine if the Project is in the public interest from a socio-economic perspective.

2. Air quality issues including dust, odours and acidification could be dealt with effectively

through the EPEA Approval process. Acceptable limits and controls on various air emissions would be stipulated within any Approval issued by AENV. AENV has developed standards and guidelines that regulate air emissions in order to protect the environment and health of Albertans.

Notwithstanding, it should be noted that a number of residents suffering from asthma and chronic lung diseases were concerned that the Project would further aggravate their illnesses. The Lamont Heath Care Centre stated, “There is significant evidence that Sulphur is a dangerous chemical especially to asthmatics and people with lung problems and unfortunately we have a very high number of these people in our county.” An EIA report would provide an opportunity for AST to conduct an in-depth human health impact assessment to better understand the potential health impacts of the Project and how these impacts could be mitigated. In addition, as Canexus stated in its submission, “The ingress of sulphur dust into our process would pose a potential explosion hazard as result of sulphur contaminating our product…” The environmental consequences of such an explosion is not well understood at this time.

3. Residents are concerned with the increase in traffic volumes and noise level that the Project

would generate on roadways. Many residents believe that the capacity of the roadways in the area is already at their maximum. The issues associated with impacts to transportation due to the Project cannot be addressed with EPEA Approval conditions should the Project be approved. These issues are better addressed through the EIA report process.

4. The responsibility of developing an Emergency Response Plan (ERP) rests with AST. The

ERP would have to comply with the regulatory requirements of the appropriate regulatory agencies, and consider the issues raised regarding the availability of resources that Lamont County may have to cooperatively participate in an emergency situation.

6.0 CONCLUSIONS AND RECOMMENDATIONS Having regard to the information and considerations outlined above, particularly the uncertainty of environmental consequences resulting from a potential explosion caused by sulphur dust coming into contact with sodium chlorate, and the potential socio-economic, human health, and transportation impacts associated with the Project, it is recommended that AST be required to prepare an EIA report. AST’s proposed project and EIA report should be referred to the Natural Resources Conservation Board (NRCB) for review under the NRCB Act. Section 54(2) of the EPEA allows the Minister of Environment to refer proposed activities to the Lieutenant Governor in Council (LGC) with the recommendation that the LGC make an order prescribing the proposed activity as a reviewable project within the meaning of the NRCB Act.
