Context & Background

The Universal Declaration of Human Rights (UDHR) is the foundation of international human rights law „ Proclaimed by the United Nations on 10 December 1948.„ Thirty rights and freedoms, covering civil, political, economic and cultural issues.„ Not legally binding, but aspirational„ Responsibility of “every organ of society”, including businesses, to promote

respect for human rights. „ Following World War II, intended to protect the world’s most vulnerable from

the world’s most powerful ‟ then seen to be governments. Now, many people see corporations as most powerful.

„ Consequently, recent initiatives have tried to define business’s responsibilities with respect to human rights. e.g. OECD Guidelines, UN Norms

BP’s Human Rights Policy

• BP published its “Human Rights Policy” in 2013 on http://www.bp.com/en/global/corporate/sustainability/society/human-rights/human-rights-policy.html

• BP’s human rights policy elaborates on the requirement within our code of conduct to treat everyone at BP - and everyone with whom we come into contact - with fairness, respect and dignity

• This policy applies to every BP employee and officer in BP wholly-owned entities, and in joint ventures to the extent possible and reasonable given BP’s level of participation. It contains the following seven commitments:− We conduct our business in a manner that respects the rights and dignity of all people, complying with all legal

requirements.− We respect internationally recognized human rights, as set out in the International Bill of Human Rights and the

International Labour Organization’s declaration on Fundamental Principles and Rights at Work.− We recognize our responsibility to respect human rights and avoid complicity in human rights abuses, as stated in the UN

Guiding Principles on Business and Human Rights.− We treat everyone who works for BP fairly and without discrimination. Our employees, agency staff and suppliers are

entitled to work in an environment and under conditions that respect their rights and dignity.− We respect freedom of association. Where our employees wish to be represented by trade unions or works councils, we

will cooperate in good faith with the bodies that our employees collectively choose to represent them within the appropriate national legal frameworks.

− We respect the rights of people in communities impacted by our activities. We will seek to identify adverse human rights impacts and take appropriate steps to avoid, minimize and/or mitigate them.

− We will seek to make contractual commitments with suppliers that encourage them to adhere to the same principles.

„ Created in 2000 by the US & UK governments, Amnesty International, Human Rights Watch, several extractive companies (including BP), and others.

„ The Voluntary Principles have become the industry standard; more governments, companies, and NGOs continue to sign on.

„ Three topics of guidance: Risk assessment Interaction between companies and public security Interaction between companies and private security

Interaction with Business Partners

„ Where we have direct control, our responsibility is straightforward. „ Our greatest challenges occur in situations outside of our direct control. „ In joint operations / ventures: Where BP is the operator, we will apply our code principles directly. Where BP is not the operator, we will seek to influence our partners and

operator to adopt similar principles.„ Employees who engage third parties (such as contractors, agents, or

consultants) must seek to make them aware of our code of conduct, and should seek their co-operation in adhering to the code ‟ including, where possible, a contractual requirement to act consistently with the code when working on our behalf.

Integrated Community Based Security

„ Introduced in 2004, ICBS was developed in the mold of community-oriented policing, which involves the local communities, police & other government bodies, and BP

„ Features:• Community-oriented security programs• VPSHR training for law enforcement apparatus and BP security• Government ‟ Private partnership

Joint Security Exercise between law enforcement and BP security Routine coordination

• Formal field security guidelines, incorporating VPSHR, to regulate the degree and manner of engagement with law enforcement apparatus (JUKLAP)

• Optimization of local resources through private guard force recruitment• Compliant and transparent handling of payments made to government officials• Procedure to address investigation and reporting of alleged human rights violations• Subject to periodic independent assessment by reputable external panel

ICBS Indicators of Success

„ Indonesian police and military receptive to the program

„ Indonesian police in Papua now capable to implement human rights training to the grassroots level of ranks and community.

„ Public participation on security program

„ Involvement of human rights NGOs--Komnas HAM, ICRC,ELSHAM Papua and other agency e.g. ICITAP and Pusham UII

„ Independently manages Security within Tangguh LNG, without any presence of Public Security Forces

„ Maintain minimum or very low operational disruption due to security incident

ICBS Highlights

HIGHLIGHTS„ Some 95% of total 320 security guards are from the nine directly affected villages of Tangguh„ Basic Human Right training for all Tangguh security guards „ Joint security exercise with Papua police, involving NGOs and media to test the implementation of the

field guideline (in yearly basis since 2007)„ Joint human rights training (Train of the Trainer Program) conducted by BP and Papua police with 37

police participants (21 for CDM + 16 for COP) and 6 BP Security (2008)„ In House Training; Police/TNI + BP Security (CDM & COP). (In yearly basis since 2009)„ JUKLAP Addendum in August 2009, followed by socialization to Police Force around the project. „ Security community program which include activities:

− Community Policing activities to inform to public on Indonesian Law and Exclusion zone in DAVs & other surrounding villages (yearly basis)

− Security Forum established to raise security awareness, establish a security network; & resolve local security issues in 2 Regencies (yearly basis)

Joint Human Rights Training

1. VPSHR Train the Trainer program for BP Security & Police Instructor covers:

a. Civil Disturbance Management (CDM)

b. Community Policing (COP)

c. Voluntary Principles on Security and Human Right

2. The trainer then conducted VPSHR In House Training for :

- BP Security at BP Site

- Police & Military at their own unit.
