SENDERO SPRINGS AT BRUSHY CREEK HOMEOWNERS ASSOCIATION, INC. SOLAR ENERGY DEVICE SUBMISSION CHECKLIST 

 **Section 202.010 of  the Texas Property Code provides  that a property owner’s association may not enforce a provision in a dedicatory instrument that prohibits or restricts a property owner from installing a solar energy device except as otherwise provided herein.  Prior to beginning installation of any and all Solar Energy Devices you must submit a request for approval to the Sendero Springs Architectural Control Committee (the “ACC”). A “Solar Energy Device”  is defined as “a  system or  series of mechanisms designed primarily  to provide heating or  cooling or  to produce electrical or mechanical power by collecting and transferring solar generated power” by Section 171.107 of the Texas Tax Code.    

PLEASE REVIEW THE ASSOCIATION’S SOLAR ENERGY DEVICES AND ROOFING MATERIALS POLICY PRIOR TO APPLYING. 

 Due to the comprehensive documentation necessary for the ACC to provide a complete review, the homeowner(s) may be requested to provide additional information after the initial submission. Failure to provide the documents listed below may result  in additional requests  for  information  from the ACC and additional times to process the request. The ACC reserves the right to visit the property to confirm information provided below in order to make a determination to approve or deny the request.**  ALL SUBMISSIONS:  

1. Architectural Control Committee Approval Request Form, completed and signed by the homeowner(s); 2. A current survey of the property clearly identifying the location of the home on the Lot; 3. An amended survey (created and sealed by a licensed professional or created and certified as accurate by 

the homeowner) that reflects the following: a. The roof line(s) of the house, including pitch/slope; b. Proposed placement of any and all solar panels on the roof; and c. Proposed placement of all additional equipment  related  to  the  installation of  the Solar Energy 

Devices,  including  but  not  limited  to,  utility  meters,  combiner  boxes,  and  other  electrical equipment; 

4. Specifications of the model/make, materials, estimated energy output, and all other equipment related to the installation of the proposed Solar Energy Devices; and 

5. Statement  that Solar Energy Devices will not create a  reflective surface on  the  roof  in accordance with Section  5.6  of  the  Sendero  Springs HOA’s Declaration  of  Covenants,  Conditions,  and  Restrictions  (the “Declaration”). 

 FOR ALL REQUESTS TO INSTALL SOLAR ENERGY DEVICES ON FRONT AND/OR STREET FACING ROOF PLANES, YOU MUST ALSO PROVIDE:  

6. Estimated annual energy production  report  for  the design  that  includes  front/street  facing solar panels (from an NREL‐approved modeling tool such as PVWatts.com); 

7. Estimated annual energy production report for an alternative design that would only include solar panels on  roof  planes  that  do not  face  the  street  and/or  front  of  the  house  (from  the  same NREL‐approved modeling tool utilized above); and 

8. A letter from the Solar Energy Device provider demonstrating the difference in energy production between the alternative roof planes pursuant to Texas Property Code §202.010.  

For further guidance on solar energy device restrictions, please reference to Sendero Springs’ Declaration and “Solar Energy Devices and Roofing Materials Policy for Sendero Springs at Brushy Creek Homeowners Association, Inc.”, executed May 24, 2017 (“Solar Energy Device Policy”).

 ** Prior to beginning installation of any and all Storage Sheds, you must submit a request for approval to the Sendero Springs Architectural Control Committee (the “ACC”). Failure to provide the information listed above may result in additional requests for information from the ACC and additional times to process the request. **  ALL SUBMISSIONS: 

1. Architectural Control Committee Approval Request Form, completed and signed by the homeowner(s). 2. A current survey of the property clearly identifying the following: 

a. Current placement of: i. The primary dwelling and garage; ii. Any other structures or improvements on the property (i.e. pools, spas, existing storage 

sheds, pergolas, gazebos, etc.); iii. Existing fences; iv. Existing property lot lines, utility easements, and drainage easements; and 

b. Proposed placement of the shed on the property, considering the shed: i. Must be within the building setback lines; ii. May not encroach upon any other  lot, utility easement, drainage easement, or public 

right‐of‐way; iii. Must be at least ten feet (10’) from the primary dwelling; and iv. Shall not interfere with the natural drainage of the lot or neighboring lots. 

3. The manufacturer, model, and finished dimensions of the proposed shed, considering: a. The measurement from the ground to the peak of the storage shed roof may not exceed eight feet 

(8’) in height  i. Measure from the ground, including any foundation for the shed (cement blocks, cement, 

etc.) to the highest point on the top of the roof. This measurement must not exceed eight feet (8’); and 

b. Total square footage of the storage shed may not exceed one‐hundred and twenty square feet (120 sq. ft.). 

4. A description of the finish materials and colors of the storage shed outer walls and roof, considering: a. Materials and colors are  to be similar  to  those of  the primary  residence  (i.e. paint colors,  roof 

materials and colors should all match). i. Roof shingles should be the same color and material as those on the main house; ii. Siding, stucco, or other exterior wall finish should be the same color and a matching style 

to the main house; and iii. Otherwise be harmonious with the standard, type, quality, and color of the materials used 

in construction of the main house.  

For  further  guidance  on  storage  shed  restrictions,  please  reference  Sections  5.15  and  6.4  of  Sendero  Springs’ Declaration of Covenants, Conditions, and Restrictions.

PAINT COLOR POLICY FOR SENDERO SPRINGS AT BRUSHY CREEK HOMEOWNERS ASSOCIATION, INC.

1. If the proposed color palette differs from the existing paint/stain colors, you must submit

an application to the Architectural Control Committee (the “ACC”) for approval prior to painting/staining.

2. Approved Paint Colors using Sherwin Williams paint codes (“Approved Colors”), as identified below, have been provided as a guide for paint colors that will be approved by the ACC. Samples of the Approved Colors may be obtained at any local hardware or paint store. Homeowners should not rely on online previews of the Approved Colors, as the true color may vary depending on computer monitor settings.

3. Owners may request the ACC approve alternate colors not on the Approved Colors list by completing and submitting an Architectural Control Committee Approval Request Form, (available on the Association’s website under CiraNet Resident Portal>My Documents>Forms), along with a paint swatch or swatches from the manufacturer (available for free at your paint retailer) with the paint’s manufacturer and color code clearly visible. The ACC Approval Request Form and paint color samples should be provided to the ACC via the email address provided on the form. **You must ensure the paint’s color code and manufacturer are visible and clearly indicated on any paint samples.**

4. Siding/stucco should be painted in flat, satin, or non-gloss paint. Trim should be painted in flat or low-luster gloss (no shiny or high gloss paints). Stucco trim may be painted the same color as the main stucco of the house.

5. Garage doors may be painted/stained either a trim color, or the same color as the stucco/siding on the house.

6. Front doors must either adhere to the Approved Colors or Owner may request a variance for a different paint color.

7. Shutters, window hoods, and the side panels of doors and windows must be painted in a color from the Approved Colors list, including trim colors.

8. Homes being repainted/re-stained with the existing color(s), and the color(s) is/are listed in the Approved Paint Colors, do not need to apply for prior approval from the ACC, as long as the same paint/stain color is used.

9. For homes currently painted in colors not listed in the Approved Colors, when the paint is to be replaced or refreshed, the Owner must do so with an Approved Color or alternate color submitted to and approved by the ACC.

10. Violations of this Policy will be considered a violation of Dedicatory Instruments governing the Association. After proper notice, the Association shall have the right to enforce this Policy by the initiation of legal proceedings seeking injunctive relief and/or damages, attorney’s fees, costs of court, and all other remedies, at law or equity, to which the Association may be entitled.

11. Failure to enforce any violation of this Policy by the Board shall not constitute waiver of the right to enforce any future violations.

Approved PAINT COLORS USING SHERWIN-WILLIAMS PAINT CODES The Sendero Springs HOA does not endorse any specific manufacturer for exterior paint. The Sherwin Williams color codes are utilized below only as a representation of the Approved Colors. Other manufacturers and retailers can match the colors provided in the Sherwin Williams color codes. However, the Owner is responsible for ensuring the color of the paint, regardless of manufacturer, matches the Approved Color. *Please note that on-screen color representations may vary from actual paint colors.*

XERISCAPE POLICY FOR SENDERO SPRINGS AT BRUSHY CREEK HOMEOWNERS ASSOCIATION, INC.

Xeriscaping is defined as landscape design using native and adaptive plants that can thrive with little to no irrigation in arid conditions, such as those in Texas. Xeriscapes should need little to no water other than what is naturally occurring and tolerate heat and drought conditions. Since the passage of Texas Property Code Section 202.007 in June 2013, HOA’s must not unreasonably restrict Owners who desire a landscape that saves water. In accordance with Texas Property Code Section 202.007, the following xeriscape standards set guidelines for Owners in Sendero Springs HOA. To promote xeriscaping within Sendero Springs, the Sendero Springs HOA will allow reasonable variances to the turf areas to permit up to fifty percent (50%) of front and side yard vegetative space visible from the street to be xeriscaped, with fifty percent (50%) remaining as turf/sodded area. Additionally, the easement strip between the public sidewalk and curb (“sidewalk strip”) may be one hundred percent (100%) xeriscaped, and is excluded from the fifty percent (50%) of front and side yard vegetative space calculation. Section 5.21(a) of the Sendero Springs Declaration of Covenants, Conditions, and Restrictions, Clerk’s File No. 2002001226 in the Real Property Records of Williamson County, Texas (the “Declaration”) requires all lots (including front and side yards) to be at least seventy-five percent (75%) sodded. Section 5.21 of the Declaration allows variances to be granted by the “Architectural Control Committee (the “ACC”). The ACC may, in its discretion, grant a variance to the sodding requirement for any portion of a lot if the lot's landscaping otherwise complies with these xeriscaping rules. If the ACC approves landscape plans submitted in accordance with these rules, and the Owner constructs all landscape alterations in compliance with such approved plans, a variance to the "sodded" requirement will be deemed to be granted in accordance with Section 5.21 of the Declaration to the extent necessary to allow alterations to be made in accordance with the approved plans. It is the Owner’s responsibility to obtain written confirmation that the plans have been approved by the ACC, in compliance with Section 5.21 of the Declaration. Submission for Approval Prior to initiating any change in the landscape, Owners must submit plans and specifications detailing the proposed installation/design to the ACC. The request must include:

Property survey reflecting: o building setbacks o all permanent structures on lot o improvements o fence o existing trees and landscape o drainage and utility easements

Proposed landscape design plan including: o dimensions and placement of all design elements o details on the types of plants and ground covers (including color and materials) o weed barriers o bordering material(s) o hardscape materials (including color, size, and placement) o irrigation system layout o drainage plan

It is recommended, but not required, that plans be drawn by a licensed architect or landscape professional to increase the chance of approval of plans without changes being required. The ACC may request additional information or changes to the plans before final approval. Installation of any proposed xeric landscaping may not begin until the ACC has approved the request. Failure to gain approval in advance of doing work on the project may result in fines being assessed and may necessitate the return of the property to previous condition at Owner’s expense. Should Owner fail to comply with written notice of noncompliance and the guidelines stated therein, Sendero Springs HOA shall have the right to amend the Owner’s property to return it to a state of compliance at Sendero Spring HOA’s sole discretion and at the Owner’s expense. Such expense shall be defined as costs incurred by Sendero Springs HOA in connection with returning Owner’s property to compliance, including but not limited to, labor and materials, administrative fees, and legal fees. Should Owner fail to satisfy said invoice, a lien shall be placed on Owner’s property. 1. Design Requirements Color and texture should flow neatly from one area of the yard to another. Extensive areas of "desert" or "barren" appearance must be avoided in order to preserve aesthetic compatibility with the neighborhood. Large areas may not be composed of a single material; for example, any areas of bare mulch must be interspersed with plants. The ACC may, in its discretion, prohibit water features, urns, and other man-made ornamentation. 2. Turf Grass At least fifty percent (50%) of the front and side yard, visible from the street, must remain covered with turf grass (natural or synthetic). Approved natural turf grasses include:

St. Augustine Bermuda Buffalo Zoysia Tall Fescue

Suggested synthetic turf grasses include:

St. Augustine Bermuda Kentucky Bluegrass

Synthetic turf must maintain the aesthetic of natural turf and must not be easily distinguished from natural turf at a distance of fifteen feet (15’). Surface temperature of synthetic turf may not exceed that of the concrete with the same sun exposure. Natural and non-toxic based synthetic turfs (such as a soy-based polyurethane products) are encouraged to minimize chemical runoff. Owner must install any synthetic turf with proper substrate and drainage. As synthetic turf still requires ongoing maintenance, the Owner is required to rinse, brush, and remove any odors. Damaged, torn, or displaced synthetic turf must be repaired immediately. Synthetic turf may be granted as a variance to the sodded area requirements at the sole discretion of the ACC. Owner must provide samples of synthetic turf materials (substrate and grass) to be used in installation to be considered for such a variance.

3. Groundcover Non-turf areas may contain decomposed granite, organic mulch, crushed limestone, flagstone, or loose stone material for a ground cover that is maintained to prevent weed growth without using toxic or environmentally harmful chemicals as approved by the ACC. Decomposed granite or other small gravel (less than one-half inch( ½”) shall not be permitted within two feet (2’) of the driveway, public right of way, or street. Large expanses of ground cover may affect drainage. Therefore, a plant (as described in paragraph 4) should be placed at least every four feet (4’).Loose rock placed in the front or side yards, and/or sidewalk strip must not wash out onto the public sidewalk or street. Organic mulches, such as bark chips and inorganic mulches, such as crushed rock, should be applied at least three inches (3”) deep and maintained at all times at least two inches (2”) deep. Colored glass mulch, nut shells and husks, rubber mulch, lava rocks, and concrete/cement larger than a stone paver are not permitted as ground cover. Samples of all materials described in this paragraph must be submitted to the ACC for review and approval prior to installation. The ACC may prohibit or limit installation of rock ground cover (including gravel and crushed stone). 4. Plants Owners are encouraged to select native plants adapted to the pH soil conditions created by the non-turf materials used and avoid invasive species (see the City of Austin’s “Grow Green Guide” for more information). Sickly and dying plants must be promptly removed or replaced. The ACC may prohibit or limit installation of cacti. For public safety, plants with thorns, spines, or sharp edges must have a five inch (5”) margin to a public right of way. Plants in the sidewalk strip may not exceed twenty-four inches (24”) in height, as this constitutes a visual safety hazard to pedestrians and drivers. 5. Borders and Retaining Walls All xeriscaped areas must be surrounded by an approved bordering material to clearly define the xeriscaped area from turfed areas. Borders visible from the street may consist of metal edging or masonry. Masonry products include stone and clay brick pavers, which must match and/or complement the existing materials of the main residence. Common concrete blocks are not permitted to be used as border material. Pressure treated wood materials, such as railroad ties, are not permitted as they may contain a toxic compound Creosote and pose a potential health hazard. Metal edging must be properly secured and set with the top edge no more than two inches (2”) above grade. Metal edging with visible rust or exposed sharp edges should be replaced. All materials must be approved by the ACC prior to installation for color and type. 6. Hardscapes Hardscapes may include large boulders and natural materials that are used as part of the xeriscape design. The ACC prefers natural colored rock and masonry or masonry that matches the existing house color. Any proposed decorative items, such as urns, birdbaths, statuary, or other similar items may not exceed two (2) in number and must be approved by the ACC prior to installation. The ACC may prohibit or limit the size and number of hardscape items including boulders.

7. Irrigation and Drainage The xeriscape may not alter drainage patterns on a lot, and the Owner must ensure there is no runoff into a neighboring lot, public right of way, street, or public drainage point. The ACC encourages the use of efficient irrigation systems, such as drip systems, in the xeriscaped areas. Owner must submit a detailed irrigation and drainage plan to the ACC prior to installation. 8. Weed Barriers All weed barriers must be non-toxic and hidden from view (e.g. covered with mulch). Plastic weed barriers are discouraged as they may alter drainage and damage soil. 9. Sidewalk Strip Residents may convert the sidewalk strip areas from turf grasses to xeriphytic materials and plants. The sidewalk strip may be composed of rock larger than one-half inch (½”)and interspersed with plants consistent with materials in the yard and as defined in paragraph 4. Organic mulch is not permitted in the sidewalk strip due to run-off concerns. No boulders or large rocks exceeding twelve inches (12”) in height may be used in the sidewalk strip. No plants may encroach onto sidewalks, curbs, or streets. For public safety, plants with thorns, spines, or sharp edges must have a five-inch (5”) margin to a public right of way. Plants in the sidewalk strip may not exceed twenty-four inches (24”) in height, as this constitutes a visual safety hazard to pedestrians and drivers. 10. Maintenance Xeriscaped areas are subject to the same maintenance requirements as other landscaping and must be maintained at all times to ensure an attractive appearance and sanitary conditions. Plants must be trimmed, beds must be kept weed-free, and borders must be edged. Leaves and other debris must be removed on a regular basis to maintain a neat and attractive appearance. Sickly and dying plants must be removed or replaced. Perennials that go dormant in the winter, including ornamental grasses and shrubs, should be cut back during the winter to remove visible dead materials and maintain a neat and attractive appearance.. To the extent these guidelines contradict with any previous guidelines, rules, covenants, or restrictions, these guidelines shall control to the extent necessary to comply with Section 202.007 of the Texas Property Code. These guidelines are supplementary and are in addition to any and all other covenants, conditions, restrictions, rules, and guidelines in effect for the Sendero Springs HOA.

SENDERO SPRINGS AT BRUSHY CREEK HOMEOWNERS ASSOCIATION, INC. Finance Committee Charter

Adopted by Board of Directors on _______________

The Board of Directors (“Board”) for Sendero Springs Homeowners Association, Inc. (“Association”) may establish a Finance Committee (“Committee”) to assist the Board in financial documentation; preparation, reporting, and review. The Committee shall conduct its business in the best interest of the Association and in accordance with the Finance Committee Charter ("Charter"), the Association’s Articles of Incorporation, Declaration of Restrictions, and Bylaws.

Purpose. The Finance Committee shall be an advisory committee to the Board. The Committee's primary purposes shall be to:

1. Oversee the basic financial procedures of the Association to assure that policies and procedures required by applicable law, the Association’s Articles of Incorporation, Declaration of Restrictions, and Bylaws, and the Board are followed.

2. Monitor on a quarterly or monthly basis the cash flow of the Association by review of bank reconciliation reports, bank statements, and budget reports provided by Real Manage or other property manager ("Property Manager"). The Finance Committee will have no access to individual owner account statements.

3. Oversee the Reserve and Operating funds are invested in compliance with applicable law and in accordance with Declaration of Restrictions, and Bylaws.

4. Coordinate the budgeting process for both the Operating Budget and the Replacement Reserve Budget.

Membership. The Finance Committee shall consist of at least 3 (three) and no more than 5 (five) members. One member of the Committee must have substantial finance and/or accounting experience. The Committee shall be formed as follows:

• The Board shall appoint the Chair of the Committee and its Committee members after soliciting interest from homeowners. The Committee can also recommend homeowners to the Board for

appointment.

• Members appointed to the Committee by the Board shall be members of the Association.

• Committee members appointed may be members of the Board of Directors and/or any other

Association Committee.

• Members shall serve for a one-year term, effective on the date of the appointment of the Chair.

• Committee members can be re-appointed following the one-year term.

• The Committee is authorized to appoint sub-committees of volunteers to address specific topics consistent with this charter.

Responsibilities.

• Review the yearly annual budget, prepared by management. The budget is ultimately approved

by the Board of Directors.

• Monitor the financial performance of the Association throughout the year by reviewing monthly

financial statements and recommending action to the Board on any variances.

• Monitor compliance by the Association with all legal reporting requirements.

• Ensure that appropriate accountability and process controls are in place for financial

management.

• Review banking transactions and reports and to advise the Board on banking relationships and

investments.

• Review the annual audit before it is mailed to all the homeowners.

• Review the reserve study.

• The Committee shall meet at least quarterly, and as often as it deems necessary to carry out the obligations imposed upon it, unless directed by the Board.

Vacancies. The Board may remove a member of the Committee, in writing, with or without cause. The Committee may vote to recommend removal of its Chairman or any Committee Member to the Board with cause. Vacancies created by either of the above or for any other reason shall be filled by appointment by the Board.

Authority. The Finance Committee functions in an advisory capacity with no decision-making authority. It presents specific written recommendations to the Board as appropriate. The Committee is given the limited authority necessary for the reasonable execution of the stated purpose and responsibilities of this Charter.

Confidentiality. Each Committee member agrees to sign and abide by the Finance Committee Confidentiality Agreement.
