Held here at the Orange County Convention Center, the IBS is one of the largest trade shows held that attracts professionals from all industries connected to home building. In addition to exhibitor booths displaying current products, attendees had oppor- tunity to gain insight into the anticipated future of the North American home build- ing market. At IBS, those in attendance learned that new home builders in the U.S. are pre- dicted to experience a rise in business by as much as 20 percent in 2011. The firm has been located in Montreal, Quebec, Canada since 1977. As the company grew and with the support of their customers, in 1979 they opened a loading facility in King City, Ontario, and since then have moved to a larger and more efficient facility in Alliston, Ontario. Freight forwarders are buzzing about the European 24-hour Advance Manifest Rule that came into effect December 31, 2010. The new requirements stipu- late that ocean carri- ers bound for an EU port from a non-EU load port must elec- tronically transmit Entry Summary Declaration (ENS) information to the customs office of the first EU port of entry no later than 24 hours prior to the commencement of vessel loading. was the continuinglevel of confusion– even amongstthose that havebeen following theprocess for sometime - over its realimplications. Thesituation has notbeen helped bychanges to thewording of the leg-islation - intro-duced at the very last minute – whichseem to obscure rather than clarifythe obligations to be placed on woodsuppliers to the EU, for example withregards to traceability. The EuropeanCommission has been mandated tofurther develop implementation meas-ures and guidelines and EC officials atthe meeting stated that “consultationstarts now” and that they would wel-come inputs from all interested par-ties. AHEC used the meeting, backed byfollow-up correspondence with theEuropean Commission and Europeantrade associations, to explain theAmerican Hardwood sector’sapproach to legality verification. Thiscombines the evidence of the 2008Seneca Creek study that there is anegligible risk of any American

The final version of the ITL wasadopted by the European Council onOctober 11, 2010 with a “phase in”period of 27 months being set aside(until the beginning of 2013) to clarifythe regulations and to give time fordevelopment of the required imple-mentation procedures by theEuropean Member States andtraders. The time will be necessary asunfortunately there seem to be sever-al areas of confusion and even out-right contradictions within the legisla-tion. The ITL includes a general “pro-hibition” against the “placing on theEU market of illegally harvested tim-ber or timber products derived fromsuch timber”. This is combined with arequirement that all EU importers andprimary producers implement a so-called "due diligence system". Thissystem must include procedures toassess the risk of all wood suppliesbeing derived from illegal sources andfor risk mitigation. Mitigation actionsmight include provision of extra infor-mation or third party verification andare required in all instances exceptwhere risks of illegal logging are iden-tified as “negligible”. It was clear from discussions at therecent International Timber TradeFederation meetings in Geneva thatthere is widespread support for thelegislation amongst European tradeassociations. However, equally clear

The American Forest ResourceCouncil (AFRC) recently joined someof its members such as SwansonGroup Manufacturing, Rough andReady Lumber, Washington ContractLoggers Association and DouglasTimber Operators, filing a lawsuit infederal district court in Washington,D.C., against the Secretaries ofInterior and Agriculture (SwansonGroup Mfg. v. Salazar). Challengingthe way the Forest Service estimateshow many northern spotted owls areimpacted by timber management, thesuit focuses on Owl EstimationMethodology (OEM).Put in place in 2007 and modified in2008, the OEM requires the use ofcomputer modeling to generate virtu-al owl sites, which are then used toestimate the number of owls to be“taken” by a management activity,without regard to whether the sitesare or ever have been used by realspotted owls. According to the AFRC, use of themethodology results in vast overesti-mates of the impact of forest manage-ment activities on the spotted owlpopulation. It is also a major cause ofthe Bureau of Land Management’sfailure to meet its obligation to pro-duce timber as required by the O & C

New research from the U.S. ForestService demonstrates that amongtheir many benefits, trees increasehome prices, improve air quality, andreduce household energy use and theeffects of climate change.“Trees in urban areas beautify neigh-borhoods and provide great economicbenefits,” Forest Service Chief TomTidwell said. “Aside from enhancingneighborhood aesthetics they filter theair, reduce storm runoff and absorbcarbon dioxide.”Reports issued by the Forest ServiceNorthern and Pacific NorthwestResearch Stations focused on specif-ic cities –Chicago, Portland, andSacramento. The studies detailed thefollowing findings:• Chicago’s 3.6 million trees annuallyreduce air pollution by about 890 tons,a $6.4 million benefit per year.• In Sacramento, trees planted on thesouth and west sides of housesreduced summertime electricity billsby an average of $25.16.• In Portland the study found thatstreet trees growing in front of or neara house added an average of $8,870

In October, I had the opportunity tovisit Malaysia courtesy of theMalaysian Timber Council (MTC). Iserved as a panelist in their “Dialogueon Requirement for Timber LegalityVerification in the Global Market” andattended their first ever GlobalWoodMart trade show. The MTC set up several special

tours. One was to a forest researchstation outside the city where we wereable to compare and contrast a regen-erated second growth forest with anold growth forest. To the untrainedeye, and to many well trained ones aswell, there was no obvious distinction.We were also able to visit FRIM, the

Forest Research Institute of Malaysia.It is just 20-30 minutes outside KualaLumpur and well worth battling anytraffic to get there. The recommenda-tion of the day? Whenever you are inMalaysia, for a future GlobalWoodMart or any other reason, besure to include a visit to FRIM.FRIM has multiple mandates, includ-

ing showcasing how natural forestsregenerate after selective harvesting.They have a second growth forest thatyou can take guided walks through. Itwas wonderful to see some commer-cial species that I had previously onlyseen as flooring, or logs or lumbergrowing tall. The rangers who served as guides

were informative and provided factsand figures for both the regular touristand the wood professional. The walk

included presentations at severalsmall demonstration areas. One site,for example, had hardwoods of differ-ing densities set out on the junglefloor. The rangers discussed decayrates and applications. Another dis-play of interest was an example of sapcollection from a Jelutong tree.Finally, there is also an optionalcanopy walk (if you can make thesteep hike uphill to get there!), whereyou can stand on rocking suspensionbridges and admire both the uppercanopy of the forest and the sight of

On my way back from anInternational Tropical Timber Council(ITTC) meeting in Japan, I read aninteresting article in the Wall StreetJournal, titled, ‘Not really ‘Made inChina.’The subject of the story is the Apple’siPhone. The moral of the story is thatalthough the iPhone is ‘Made inChina,’ it really isn’t (or at least mostof it isn’t). The story cites an amazingstatistic that the phone, popular withU.S. businesses and U.S. consumersalike, added $1.9 billion to the U.S.trade deficit with China in 2009.Anyone following the news under-stands the growing sensitivity towardthe U.S. trade deficit and concernsabout imports and U.S. jobs. So isbuying an iPhone (or iPad for thatmatter) bad for the U.S. economy andjobs?Not so fast says the research.Current U.S. Customs practiceassigns the whole cost of a product. Inthe case of an iPhone $178.96 isattributed to China where it was man-ufactured. However, the cost of con-structing an iPhone only accounts for

Thai Firm Seeks North American Hardwoods

A Complex Legal Landscape

With stricter requirements in the U.S.and Europe, it is more crucial thanever for companies to be able todemonstrate due care in sourcingboth legal and sustainable wood. TheLacey Act is a U.S. law amended in2008 to ban trade in illegally sourcedplants and their products, includingtimber and paper products. Already inthe U.S., there are Lacey enforcementactions underway against U.S. com-panies. Enforcement actions will like-ly continue in other sectors, as thecustoms declaration requirementsassociated with Lacey will expand toinclude many new product categoriesfor furniture, panel products, paper,sporting goods and musical instru-ments.On the other side of the Atlantic,

Europe is also tightening its policies tolimit illegal timber flows. ‘The ActionPlan on Forest Enforcement,Governance and Trade (FLEGT) ofthe European Union (EU)’ encouragesbusinesses to adopt purchasing poli-cies that exclude illegal timber. Andthis year, the European Parliamentoverwhelmingly approved a crack-down on illegal timber, voting to passnew legislation that will take effect in2012. This new law would require all

hours before loading for all shipmentsgoing to Europe or trans-shipping byEurope,” Vice President of TMXShipping, Curtis Struyk explained.“The carriers are now going to charge$25 per bill of lading for that service.For Asia and LTAM origins, the payerof the ocean freight will pay theCompliance Surcharge. For theEuropean Trade (origin: Europe andMediterranean), the charge will bebilled and collected at origin.” As for current business activity Struyksaid, “We’re not as busy as we werethis time last year but we’re in a good,perhaps even better position. Lastyear was a record year for us as far asnumber of shipments. Rates seem tohave stabilized at a reasonable level.Business is a little slower but at asteady pace. At this time last year, wewere having a tough time keeping upand now the workload is busy butwe’re not overwhelmed. So we’re at agood pace right now.”For the months ahead he does expectrate increases. “We’re about as low aswe can go right now and they tried toget some rate increases before theNew Year but there just wasn’t enoughbusiness to warrant it,” he explained.“Just as soon as the Chinese NewYear is over and we start shipping intoAsia again, they’ll probably try to getan increase in March. All indicationsare that business is going to be goodand customers that have been ship-ping their wood products to Asia andEurope and are taking orders. Assoon as the ships start filling up, that’swhen we’ll see some rate increases.”Overall he predicts 2011 will be astrong year for log and lumberexports.TMX Shipping Co. including Southeast Asia, West andSouth Africa. “The export market for lumber/logs in2010 has been a growing market incomparison to the previous year,where we experienced a slow recov-ery from the recession of 2008/2009,and markets now appear to be pickingup. The Chinese market, being at topstanding will continue to evolvethroughout 2011 and will more thanlikely be a top leader for increased vol-umes, whereas other areas such asEurope and the Mediterranean willcontinue to be steady but promisingmarkets,” Lovett said.“The container freight rates are likeany other industry where supply anddemand dictate the pricefluctuations. In 2010,” he said, “thelumber industry was able to maintainsomewhat steady ocean freight costs,however, still face variances due tofuel (BAF) and currency (CAF) levels– we feel very confident that no gen-eral rate increase on ocean freightcosts will be applied to the first quar-ter of 2011 and this alone is a positivefactor in comparison to 2010.”“Supply and demand is perhaps oneof the most fundamental concepts of

economics and is the backbone of amarket economy,” Lovett continued.“With that in mind, in 2011 we can pre-dict that the overall reduction of con-tainer ships will cease and will bemaintained to influence both marketvolumes and costs. As opposed to 2010, overall freightcosts will stabilize with the exceptionof fuel and currency surcharges thatare unforeseen costs and cannot beavoided due to increasing fuel levelsand the weak U.S. dollar; all carriersare forced to implement these sur-charges to stabilize ocean freightscosts on overall revenue for all cargo.Different from 2009 where thedomestic and export business wereextraordinarily strenuous times for ourindustry, 2010 has seen a steadyincline in the lumber/log containerexport principally to China, 2011 looksexceptionally optimistic. I am not aneconomist but according to Mr. L.J.Peter, “An economist is an expert whowill know tomorrow why things he pre-dicted yesterday didn’t happen today.”On that quote I would like to take thisopportunity to sincerely thank the for-est industry for all their support andmay 2011 be a healthy and prosper-ous year for family, friends and busi-ness.”

The outlook for 2011 is mixed amongfurniture manufacturers. Many execu-tives said they expect there will beproblems with the supply chain fromChina in the coming year. “There arereasons to be positive, but customersare still cautious,” said a manufacturerwho sells imported case goods. “Ithink everybody still has nervousnessabout what this ‘new normal’ is goingto bring.”

Any changes will like-ly come from bunker. If fuel pricescontinue to rise, carriers will increasetheir bunker fuel surcharge to coverthe increase.”Most carriers have implemented aslow steaming policy to conservebunker and help the environment.This policy has increased the carrier'stransit times to most ports. Bernardsaid some U.S. companies are notpleased with the policy. “The FederalMaritime Commission has agreed tolook at the slow steaming effect on theU.S. supply chain and environment. Ifthe policy is removed, the changecould affect the bunker.”Before the economic drop, most U.S.ports were at or close to full capacity.This caused a reduction in import andexport free days. Some ports areexpanding, but if volumes increase,Bernard said ports could face a con-

In 2012, the upgrade on thePanama Canal locks should be com-pleted. The upgrade will provide thechance for carriers to operate largervessels through the locks. This couldcause more imports to be dischargedat U.S. east coast ports, creating moreof a demand for container port space.”As for vessel space and equipment,Bernard explained that only a few ofthe world's top 20 container lines haveany appreciable amount of capacityidled despite it being the middle of thetraditional slack container-shippingseason.“Carriers have placed orders for newvessels, enough to cope with normaltrade growth, but space might becomea challenge in 2012. As for equip-ment, most carriers have increasedtheir global inventory. The closer theloading location is to a port the morelikely it is a shipper can meet theirequipment needs. Securing equip-ment at inland depots will alwaysremain tight. Shipper's need to beaware, most carriers are no longersupplying chassis. Instead, privatecompanies are beginning to supplychassis on a daily rental basis,approximately US$15-$25 per chassisper day.” For the year ahead, Bernard offered,“The change to 2011 has broughtabout new incoterms. Incotermsclearly define the responsibilities ofthe seller and the buyer involved in aninternational transaction. There arenow eleven terms instead of thirteenand several names have changed. It'simportant companies know the newincoterms and use the correctincoterm when selling their product.Not knowing can cost a company a lotof additional expense.”With more than 55,000 employeesand its global network of 900 offices inmore than 100 countries, Kuehne+Nagel has evolved from a traditionalinternational freight forwarder to aglobal provider of integrated supplychain solutions for a comprehensiverange of industries.
