18-1245-FI-PLA: Consideration of approval of the following final plats within thedevelopment known as Tessera on Lake Travis: Phase 1B1, Phase 3A1, Phase 3A2 andPhase 3A3.

Public Hearing Other

Preliminary Plats for all four phases presently under consideration have been previouslyapproved by both the Planning & Zoning Commission and City Council. In accordance withSection 2.13.5.B.1.b of Chapter 10 (Exhibit A) of the Lago Vista Code of Ordinances, approval ofthe final plat has been specifically delegated to the Planning & Zoning Commission, absent anappeal. The purpose of this non-discretionary process is to ensure consistency with priorapprovals and completion of all associated public improvements in a satisfactory manner.

All specified consistency reviews have been completed. Construction and required inspectionsof all associated public improvements is approaching, but not yet complete. However, thedeveloper has suggested that part of the very lengthy PID agreement might include a waiver ofthat requirement. As such, the staff recommends approval of the final plat of all four phasessubject to the following conditions, with approval signatures withheld until they have been met:

1. Correction of the certification sheets of each final plat phase. According to Section 2.18.B.4.eof Chapter 10 (Exhibit A) of the Lago Vista Code of Ordinances, the signatures of the Planning &Zoning Commission Chair and the City Administrator only are required (absent an appeal). TheCity Secretary shall attest to those signatures. As such, the reference to consideration andapproval by the City Council must be removed. The certificate of approval by the City Secretaryshould be replaced in its entirety by a simple testament of those two signatures.

2. Absent some form of documented agreement to the contrary, completion in full of thefollowing requirements regarding improvements enumerated in Section 2.19.5 of Chapter 10(Exhibit A) of the Lago Vista Code of Ordinances: completion with inspections of improvementsor delivery of a performance bond or some other equivalent form of security; delivery of "as-built"documents, and delivery of a maintenance bond or other surety to assure the quality of materialsand workmanship of the improvements.
