Sidewalk Vending Administrative Regulations

Section 1 Introduction On September 17, 2018, then-Governor Jerry Brown signed Senate Bill (SB) 946, which decriminalized street vending across the state of California. The stated intent of the legislation is to create entrepreneurial and economic development opportunities for immigrant and low-income communities; increase access to desired goods, such as culturally significant food and merchandise; contribute to a safe and dynamic public space; and promote the safety and welfare of the public by encouraging local authorities to support and properly regulate sidewalk vending.

1.1 Program Intent The City of Santa Monica (City) Vending Ordinance No. 2607 (Ordinance) establishes reasonable time, place, and manner restrictions around sidewalk vending. These regulations are available to the public; are administrative in nature; and can be changed at the City’s discretion. The purpose of these Administrative Regulations (“Regulations”) is to provide additional detail and guidance in the administration of the City’s Sidewalk Vending Permit Program, and to assist staff with the issuance and enforcement of vending permits.

1.2 Program Objectives • Be consistent with the requirements of state (SB 946) and local (Santa Monica Municipal Code

Chapter 6.36) law• Prioritize public health and safety• Protect the scenic and natural character of our City’s parks• Expand economic opportunity for those who aspire to vend lawfully and with appropriate

permits in the City• Be meaningfully enforceable

Section 2 Definitions Definitions pertaining to vending can be found in Section 6.36.020 of the Santa Monica Municipal Code (SMMC). Below are additional definitions that supplement the adopted definitions in the Ordinance:

a. “Badge” shall mean the identifying insignia for sidewalk vendors that do not have vending cartsand carry their merchandise on their person.

b. “Decal” shall mean the identifying insignia that is placed on a vending cart or conveyance afterthe operations have been approved by the City for vending.

c. “Director” shall mean the Director of Planning and Community Development or designee.d. “Public Right-of-Way” shall mean any public alley, parkway, public transportation path,

roadway, sidewalk, or street that is owned, granted by easement, operated, or controlled by theCity.

e. “Administrative Citation” shall mean any written form produced by an authorized enforcementofficer to formally document violations of SMMC or vending regulations.

f. “Open Area” shall mean any land area to which the public has unrestricted access.g. “Regulations” shall mean the Sidewalk Vending Administrative Regulations established and

recommended herein.

h. “Roaming Vendor” shall mean a sidewalk vendor that vends from their person or from apushcart with functioning wheels and does not stay in a fixed location but continuously movesfrom one location to the next. The maximum amount of time a roaming vendor can be in thesame location while not actively engaged in a sales transaction is three (3) minutes.

i. “Suspension” shall mean to temporarily rescind prior approval of a business license and vendorpermit for a specified period of time.

j. “Revocation” shall mean to indefinitely rescind prior approval of a business license and vendorpermit.

k. “Services” shall mean the selling or providing for pay any service.

Section 3 Application and Licensing Requirements A sidewalk vendor must apply for and obtain a business license and a vendor permit from the City. It is the sidewalk vendor’s responsibility to ensure that all required licenses and permits have been obtained and kept current, including all requirements of governmental agencies having jurisdiction over any aspect of the vending program.

3.1 Application Requirements As part the application process, a sidewalk vendor must provide the following:

a. A completed sidewalk vendor applicationb. Payment- Fees and taxes are listed in the table below:

* Fees are adjusted annually by a cost of living factor and take effect July 1st of each year. Penalty on the business license tax may apply to applicants that have been in operation without the required licenses and permits.

The table above summarizes the general fees and business license taxes for new applicants. Additional fees and assessments may apply. Applicants will be classified under the “vendor” tax rate classification as defined per SMMC 6.36. Sidewalk vendors must be in compliance and in good standing with payments of taxes, fees and citations. The City reserves the right to amend these fees to ensure cost recovery and facilitate program development.

c. Los Angeles County Health Permit- This requirement is for food vendors only.d. California Seller’s Permit- A Seller’s Permit issued by the Department of Tax and Fee

Administration is required for all sidewalk vendors.e. Images of the operational setupf. Any additional information, as requested by the City, deemed necessary.

Once the Business License Unit confirms the application is complete and payment has been received, the application will be routed to the appropriate City departments for review. If the appropriate approvals are received, a business license certificate indicating the sidewalk vendor permit and a decal will be issued. If the application is denied, a denial notification will be mailed. The applicant may appeal the denial decision per SMMC 6.16.

Section 3.2 Roles and Responsibilities of City Departments a. Planning and Community Development (PCD)- PCD is the regulatory body responsible for

establishing conditions, administrative regulations, approval, suspension, revocation, andenforcement of vendor permits.

b. Finance Department, Business License Unit- The Business License Unit of the FinanceDepartment is responsible for the administration of the City’s Business License program, whichwill include the coordination of sidewalk vendor permits issued in conjunction with businesslicense certificates.

Section 3.3 Design and Dimension Requirements a. While in operation, all sidewalk vending including stands, pushcarts or tables must not exceed

the following operational size:

b. Roaming vendors must maintain an unobstructed view over 4 feet in height from the ground tothe table top structure of the cart.

c. All sidewalk vendors must adjust or relocate their operations to ensure that there is at minimum4 feet clearance on the sidewalk or pathway.

d. Sidewalk vendors must provide locking wheels on all vending carts to prevent uncontrolledmovement.

e. No vendor shall erect, place, or maintain any tent, canopy or other temporary shelter (excludingumbrellas) in the public right-of-way.

f. A sidewalk vendor may have one (1) umbrella. The use of an umbrella shall not exceed 10 feet inheight as measured from ground level to its highest point. The umbrella cannot be attached toany public or private fixture such as the sidewalk, street furniture, fence, bench, or trees. Theumbrella must be made of a sturdy and safe material, and must be attached and anchored tothe conveyance in such a way that sudden bursts of wind will not dislodge it.

g. No external power, piping, or plumbing is allowed. The cart must be entirely self-contained.h. Signage is permitted only if attached to the vending cart or the vendor's person.i. Operations must not damage public or private property.j. Vending operations must not lean against nor attach to a building or structure.k. Any person vending shall be limited to two (2) chairs. The chairs may be placed behind or next

to (but not in front of) the vending cart or table.l. Food and merchandise must be securely fastened to the vending cart or conveyance.

Section 3.4 Operational Requirements a. Hours of operations for roaming vendors in areas zoned exclusively residential shall be between

the hours of 8am to 9pm.b. Sidewalk vendors cannot leave their vending cart, table, device, or merchandise unattended at

any time.c. Any equipment or objects left unattended in public spaces or in any portion of the public right-

of-way will be considered discarded and may be seized or disposed of by the City.d. No cart or vending apparatus shall be chained or fastened to any pole, sign, tree, or other object

in the public right-of-way.e. Vendors must display their City-issued sidewalk vending decal on their pushcart, stand, display,

pedal-driven cart, wagon, showcase, rack, or other non-motorized conveyance when operatingin the public right-of-way. Specifically, the decal shall be placed directly on the upper left-handside of the side that faces the public.

f. All sidewalk vendor(s) shall wear City-issued vending badge(s) at all times during operations.g. Under no circumstance shall goods, wares, or merchandise be displayed using or placed directly

upon a street, sidewalk, pathway, structure (bench, planters, tree, trash container, signpost,etc.), or any public place.

h. No sidewalk vendor shall display merchandise by placing any blanket, tarp, or other covering inany public space, directly in the public right-of-way, or on any public fixtures, benches, orstructures.

i. A cart, stand, table, or any other vending device shall be parallel to the curb, with the longestside of the vending stand, cart, or table parallel to the curb.

j. No sidewalk vendor shall use any generator, wet cell battery with removable fill caps, or anyother power source that poses a fire or public safety hazard. No sidewalk vendor shall connector maintain an electrical cord to an adjacent building or to a City power source.

k. Any boxes, excess merchandise, or accessory items shall be stored entirely beneath the table orcart and shall not be stored or piled alongside, behind, or in front of the table or cart.

l. No sidewalk vendor or their operations shall obstruct the entrance or exit of any property.m. All vendors must offer receipts to customers for the sale of any food or merchandise.

Section 3.5 Good Neighbor Policies Permit holders will manage their vending operations according to the following good neighbor policies:

a. Maintain a quiet, safe, and clean selling location.

b. Provide adequate storage and disposal of garbage and trash.c. Ensure that noise and odors will not become a nuisance or burden on neighbors.d. Food vendors or their employees will walk 100 feet radius from the vending site after close of

business to gather and dispose of beverage and serving materials or other trash left by theircustomers.

Section 3.6 Receptacle and Clean Environment a. Vendors are responsible for clean-up and removal of any food item, package, refuse, waste,

litter, and any other items or materials occurring because of or related to their food andmerchandise sales.

b. Vendors shall provide rodent-proof trash receptacles and remove all waste and litter collectedor discarded as a result of preparing or consuming food items or selling merchandise in theparks or at the beach offsite.

c. Vendors are prohibited from dumping any liquid or solid waste in any public trash cans ordumpsters, public rights-of-way, City streets, City sidewalks, parks, or on beach property.

d. Vendors are prohibited from distributing non-marine degradable disposable food service ware(i.e. plastic, bio-plastic, and aluminum). Disposable food service ware includes plates, bowls,trays, containers, utensils, straws, stirrers, and lid plugs. Cups and cup lids are exempted untilJanuary 1, 2020.

e. Vendors shall provide disposable utensils and straws only to customers who have requestedthese items. Vendors can ask customers if they need a disposable utensil or straw.

f. Vendors can distribute a plastic straw as an accommodation to people with disabilities.g. Single-use plastic carryout bags may be distributed to customers by vendors for the purpose of

safeguarding public health and safety during the transportation of prepared take-out foods andliquids intended for consumption away from the vendor’s premises.

Section 4 Restrictions In order to balance health, safety, and welfare concerns, the following restrictions will help mitigate existing and future issues that may arise.

Section 4.1 General Location Restrictions a. Sidewalk vending is permitted on sidewalks and pathways that are a minimum of 6 feet wide

and must maintain 4 feet clearance.b. No sidewalk vendor may obstruct the free movement of pedestrians or block the path of a

person.c. Sidewalk vendors must maintain a minimum of 4 feet distance away from another vendor in any

direction.d. Sidewalk vendors with multiple vendor permits must maintain a minimum of 50 feet distance in

any direction from their other operations.e. No sidewalk vendor may obstruct the free movement of vehicles or parked vehicles.f. No sidewalk vending cart or device shall occupy parking stalls or spaces.g. Sidewalk vendors cannot conduct business in such a way that would restrict or interfere with

the ingress or egress of the abutting property owner or tenant; create or become a publicnuisance; increase traffic congestion or delay; or constitute a hazard to traffic, life, or property.

h. No vendor shall use any noise-making device. The ringing of bells, chimes, or the intentionalproduction of other forms of electronic or mechanical sounds to attract the public is prohibited.

i. No vendor shall shout nor willfully make any loud noise (except in an emergency).j. No sidewalk vendor shall solicit or conduct business with persons in motor vehicles located on

traffic lanes of public streets and highways.k. Sidewalk vendors shall not block pathways, sidewalks, driveways, or other public rights-of-way.l. To comply with the Americans with Disabilities Act, all vendors must leave free-flow space of 4

their vehicle.

Section 4.2 Specific Location Restrictions Pursuant to Government Code (GOV) Section 51038(b)(1) and to promote and protect the public health, safety, and welfare, all sidewalk vending activities are prohibited in the following areas and distances from the following areas:

prevent an undue concentration of commercial activity that unreasonably interferes with the scenic and natural character of City parks and the beach, no sidewalk vendor shall vend in the following areas:

Section 4.4 Special Regulations for the Santa Monica Pier To promote the health, safety, and welfare of the public, the following restrictions on vending (both stationary and roaming) are necessary:

a. It shall be unlawful to vend upon the Santa Monica Pier other than from locations designated andmanaged under the authority of an approved license/concession agreement.

b. It shall be unlawful to vend upon the Santa Monica Pier Bridge or within 100 feet from theentrances and exits of the bridge.

c. It shall be unlawful to vend from the beach immediately adjacent to or under the Pier and within100 feet from the Pier’s entrances and exits including stairs, ramps, elevators, and plazas.

d. It shall be unlawful for any stationary vendor to vend in any portion of Palisades Park that is within500 feet of the Ocean Avenue entrance point to the Pier Bridge.

Section 4.5 Special Regulations for the Third Street Promenade and Transit Mall To promote the health, safety, and welfare of the public, the following restrictions on stationary vending are necessary:

a. It shall be unlawful to vend from stationary carts on the sidewalk or closed roadway of the three-block linear area that constitutes the Third Street Promenade other than by an approvedlicensed/concession licensee.

b. Roaming vending shall be permitted but may be regulated under the administrative discretion ofthe City as governed under vending regulations.

Section 4.6 Prohibited Items There is a prohibition on the selling of counterfeit products, secondhand items, animals, items that will exceed the surface area of the vending cart, drugs, medicine, chemicals, lottery tickets, weapons, alcohol, fireworks, cannabis or cannabis products, industrial hemp products, adult-oriented material, tobacco, tobacco-related products, or any other items that are deemed unsafe.

Section 5 Suspension and Revocation In addition to the grounds outlined in SMMC 6.36.080(b), a vendor permit issued pursuant to the provisions of SMMC 6.36 may be suspended or revoked by the Planning and Community Development Department upon notice for any of the following causes:

a. The business has been found in violation three (3) or more times of any applicable regulationwithin a one-year period.

b. The business has been conducted in a disorderly or improper manner.c. The vendor is found to be committing an act that can be charged as a crime.d. The purpose for which the license has been issued is being abused to the detriment of the public.

A license or permit that has been issued to a person who is not eligible pursuant to SMMC or these regulations to hold such license or permit shall be deemed automatically invalid and issued in error.

Section 5.1 Cessation of Operations of a Sidewalk Vendor The City may order any sidewalk vendor to immediately cease operations and/or confiscate merchandise and/or any conveyance used if the continued operation presents any of the following situations, and the sidewalk vendor will be required to comply with such order immediately:

a. An imminent hazard to public health.b. Operating without the required business license, vendor permit, state, or county permits.

Section 5.2 Term of Suspension/Revocation Violations that may affect the safety of the public are generally considered to be the most serious. The length of suspension or revocation generally corresponds to the seriousness of the violation(s) and the number of violations. As provided per SMMC 6.36.080, any suspension of a vendor shall be for six (6) months. A vendor permit shall be revoked for 12 months upon new violations of SMMC or permit conditions related to public safety.

Section 5.3 Seizure of Permit and License(s) Authorized When the City determines that a sidewalk vendor is operating with imminent health hazards and has ordered the vendor to cease operations, the City has the right to seize the business license certificate and sidewalk vendor permit decal/badge.

Section 5.4 Surrender of Licenses and Permits Licenses, permits, badges, and decals shall be surrendered within ten (10) calendar days to the Finance Department’s Business License Unit upon revocation or suspension of the permit.

Compliance with state and federal construction-related accessibility standards ensures that public places are accessible and available to individuals with disabilities. Whether your business is moving into a newly constructed facility or you are planning an alteration to your current facility, by engaging the services of a Certified Access Specialist (CASp) early in this process you will benefit from the advantages of compliance and under the Construction-Related Accessibility Standards Compliance Act (CRASCA, Civil Code 55.51-55.545), also benefit from legal protections.

Although your new facility may have already been permitted and approved by the building department, it is important to obtain CASp inspection services after your move-in because unintended access barriers and violations can be created, for example, placing your furniture and equipment in areas required to be maintained clear of obstructions. For planned alterations, a CASp can provide plan review of your improvement plans and an access compliance evaluation of the public accommodation areas of your facility that may not be part of the alteration.

A CASp is a professional who has been certified by the State of California to have specialized knowledge regarding the applicability of accessibility standards. CASp inspection reports prepared according to CRASCA entitle business and facility owners to specific legal benefits, in the event that a construction-related accessibility claim is filed against them.

GOVERNMENT TAX CREDITS, TAX DEDUCTIONS AND FINANCING

State and federal programs below are available to assist businesses with access compliance and access expenditures:

Disabled Access Credit for Eligible Small Businesses

FEDERAL TAX CREDIT—Internal Revenue Code Section 44 provides a federal tax credit for small businesses that incur expenditures for the purpose of providing access to persons with disabilities. For more information, refer to Internal Revenue Service (IRS) Form 8826: Disabled Access Credit at www.irs.gov.

STATE TAX CREDIT—Revenue and Taxation Code Sections 17053.42 and 23642 provide a state tax credit similar to the federal Disabled Access Credit, with exceptions. Architectural and Transportation Barrier Removal Deduction

FEDERAL TAX DEDUCTION—Internal Revenue Code Section 190 allows businesses of all sizes to claim an annual deduction for qualified expenses incurred to remove physical, structural and transportation barriers for persons with disabilities. California Capital Access Financing Program
