NOTIFICATION In exercise of powers conferred by clause (j) of section 77 read with section 27 of
the Sikkim Excise Act, 1992 (2 of 1992) the State Government is hereby pleased to makes the following rules, further to amend the Sikkim Excise (Licensing for Foreign Liquor Bar Shop/Foreign Liquor Retail Shop/Pachwai shop, rules 2005, namely:-
Short title,
commencement
1. (1) These rules may be called the Sikkim Excise
(Licensing for Foreign Liquor Bar Shop/Foreign
Liquor Retail Shops /Pachwai Shop) Amendment
Rules, 2014.
(2) They shall come into force on the date of their
publication in the Official Gazette.
Amendment of Rule 10 2 In the Sikkim Excise (Licensing for Foreign Liquor
Bar Shop/Foreign Liquor Retail Shop/Pachwai Shop)
Rules, 2005 in rule 10 for the words “these Rules”
the following sentences shall be inserted namely:-
“The period of 2 (two) months i.e upto 31st May every
year shall be considered as grace period for renewal
of Excise License every year. In the event of failing
which the licensee shall pay the penalty to the
amount equivalent to License fee”.

NOTIFICATION
Whereas draft rules were published as required by sub-section (1) of section 76
of the Sikkim Excise Act, 1992 (2 of 1992) vide Notification NO.6/Ex(Abk) dated
11/9/2013 in the R.O No. 354/IPR/PUB/Class/13-14, dated 16/9/2013 inviting
objections and suggestions from all persons likely to be affected thereby before the
expiry of 45 (forty-five) days from the date of publication in the local News Papers as
well as in Sikkim Herald.
And whereas no objections or suggestions have been received from the public in
respect of the said draft rules.
Now therefore, in exercise of the powers conferred by sub-section (1) of section
76 of Sikkim Excise Act, 1992 the State Government is hereby pleased to make the
following rules further to amend the Sikkim Excise (Prohibited Site for liquor shops)
Rules, 1996, namely:-
Short title and
commencement
1. (1) These rules may be called the Sikkim Excise
(Prohibited sites for liquors shop) Amendment
Rules, 2014
(2) They shall come into force at once.
Amendment of Rule

2. In the Sikkim Excise (Prohibited sites for liquor
shops) Rules, 1992 in rule 4,-
(1) in sub rule (1),-
(i) for the words and figure “200 ft (walking
distance)”, the words and figure “50 ft (walking
distance)” shall be substituted;
(ii) after the words “main entry of “ and before the
word “hospital”, the word “schools” shall be
omitted;
(iii) after the words “Schedule to these rules:”, the
words and figure “and 200 ft (walking distance)
from any school”, shall be inserted;
(2) in sub-rule (2), for the words and figures
“200 meters” from the police checkpost situated at
the “border”, the words and figures “200ft” from
the police check post situated at the “inter
state/international border”, shall be substituted.

(Licensing for Foreign Liquor Bar Shop) Amendment,
Rules, 2014.
(2) They shall come into force at once.
(3) They shall come into force on the date of their
publication in the Official Gazette.

2. In the said rules, in clause (a) of rule 20, for the words
and figure “Rs. 5000/- per day”, the words and figure “Rs.
4000/- per day” shall be substituted.

3. In the said rules, in sub clause (i) of clause 1 of Form V-
A, for the words and figure “6PM to 4 AM”, the words and
figure “11 AM to 4 AM shall be substituted.

NOTIFICATION
WHEREAS, Article 162 of the Constitution provides that the executive power of the
State is co-extensive with the legislative power of the State;
AND WHEREAS, the executive power of the State under Article 162 of the Constitution
of India extends to matters with respect to which the Legislature of the State has power to make
laws;
AND WHEREAS, clause (3) of Article 246 of the Constitution provides that Legislature
of the State has exclusive power to make laws for such State in respect of any matter enumerated
in List II in the Seventh Schedule of the Constitution, referred to as the State List;
AND WHEREAS, under Entry 5, List II, State List of the Seventh Schedule to the
Constitution of India, the State has exclusive power to make laws with respect to a local
government, that is to say, the constitution and powers of municipal corporations, improvement
trusts, district boards, mining settlement authorities and other local authorities for the purpose of
local self-government or village administration;
AND WHEREAS, in the absence of any law or notification in the State providing for any
regulatory mechanism or in the form of an inquiring authority for redressal of the
grievances/complaints of Panchayati Raj Institution and urban local self Government, the State
Government, being competent deems it expedient to constitute such an Inquiring Authority and
also to prescribe method and procedure to be followed to deal with the grievances and
complaints.
Now, therefore, in exercise of the powers conferred by Article 162 of the Constitution, the
State Government hereby constitutes Panchayat Inquiring Authority/Ombudsmen for the entire
State and is further pleased to appoint Shri. R.K. Purkayastha, Principal Secretary, Law &
Parliamentary Affairs as the Panchayat Inquiring Officer for the said Panchayat Inquiring
Authority/Ombudsmen to deal with complaints and grievances of Panchayati Raj Institution and
Urban Local Self Government in the State in the following manner, namely:-
1. The Panchayat Inquiring Officer shall hold proceeding at Gangtok and may also, if
considered expedient, hold proceedings or part of the proceedings at other district
headquarters from time to time to deal with complaints and grievances, if any.
2. The Panchayat Inquiring Officer shall have all the powers of a Civil Court under the
Code of Civil Procedure 1908 (5 of 1908) for the purpose of taking evidence on oath
(with such Inquiring Officer is hereby empowered in impose) and of enforcing the
attendance of witnesses and compelling the production of documents and material object
and the Inquiring Officer shall be deemed to be Civil Court for the purpose of Section
195 and of Chapter XXVI of the Code of Criminal Procedure 1973 (2 of 1974).
3. Any person may by an application or through a legal practitioner file application before
the Panchayat Inquiring Officer setting out grounds of complaint and the prayer for relief
and the State Government may also refer or forward any complaint before such
Panchayat Inquiring Officer.
4. The Panchayat Inquiring Officer shall make a brief memorandum of substance of the
complaint and issue notice to the concerned and also proceed to take evidence of
witnesses as may be required from time to time and hear the parties and submit his report
to the State Government and the State Government may consider the report and before
taking any final decision on the report, where it intends to take action against the person
complained, give him an opportunity to file reply, if any, on the report, a copy of which
may be forwarded to him and on receipt of such report, the person against whom the
complaint was made, may file his response, if any within a period of one month from the
date of receipt of copy of the report of Inquiring Officer.
5. The Panchayat Inquiring Officer shall have the discretion to either accept or reject a
complaint if in his opinion; such complaint does not disclose any offence or is frivolous
or vexatious provided that while rejecting such complaint he shall record the reason.
6. No complaint shall be entertained if it is a subject matter of any pending legal
proceedings in any other court of law.
7. No complaint shall be entertained unless the subject matter of the complaint has not
occurred at a period which is more than 5(five) years on the date the complaint is filed.
8. The Panchayat Inquiring Officer will deal with all complaints and grievances in respect
of all the elected functionaries and officials of the Zilla Panchayat, Gram Panchayat and
all Urban Local Bodies in Sikkim.
9. The Panchayat Inquiring Officer shall make inquiries in respect of charges on any action
involving mal administration or irregularities in the discharge of administrative functions
by Panchayat/Urban Local Bodies and submit report to the State Government through
Secretary, Rural Management and Development Department and Urban Development
and Housing Department as the case may be.
10. Infrastructural, Administrative and Technical support including staff for the office of
Panchayat Inquiring Officer shall be provided by RM&DD, UD&HD & Law.
11. Financial Expenditure/costs as may be incurred by the office of Panchayat Inquiring
Officer shall be borne by RM&DD, UD&HD & LAW.
12. Annual Budget for meeting the expenditure and other financial requirement of the office
of Panchayat Inquiring Authority/Ombudsman shall be prepared in advance as usual
reflecting the requirement and proposal for incurring administrative expenses for the next
financial year.
13. Other terms and conditions, as will be notified from time to time, will form part of this
notification.

NOTIFICATION
In exercise of the powers conferred by clause (a) of section 77 read with section
10 of the Sikkim Excise Act 1992, (2 of 1992), the State Government hereby makes the
following rules further to amend the Sikkim Excise (Distillery for Manufacture of Spirit
and Foreign Liquor ) Rules, 2000 namely:-
Short title,
extent
and
commencement
1. (1) These rules may be called the Sikkim Excise (Distillery for
Manufacture of Spirit and Foreign Liquor) Amendment Rules,
2014.
(2) They shall extend to the whole of Sikkim.
(3) They shall come into force on the date of their publication
in the Official Gazette.
Insertion of new
clause (aa) and
(hh) in rule 2
2. In the Sikkim Excise (Distillery for Manufacture of Spirit and
Foreign Liquor) Rules, 2000 (hereinafter referred to as the
said rules), after the clause (a) and clause (h)of sub-rule (1)
of rule 2, the following clauses shall respectively be inserted,
namely:-
“(aa) “Absolute Alcohol” means alcohol of a strength
containing not less than 99.5 percent by volume of Ethyl
alcohol as measured at 60 degree F”.
“(hh) “E.N.A” means Extra Neutral Alcohol.”
Amendment of
rule 4
3. In the said rules, after clause (d) of the sub-rule (2) of rule 4
the following clauses shall be inserted, namely:-
“(da) supply of Absolute Alcohol,”
“(db) supply of Extra Neutral Alcohol,”

4. In the said rules, in rule 10, after the words and figure “in
form D II”, the words and figure “and inform D II A” shall be
inserted.

5. In the said rules for the existing rule 33 of Sikkim Excise
(Distillery for Manufacture of Sprit and Foreign Liquor)
Rules, 2000 the following clause shall be substituted,
namely:
Licensee required to obtain permission to undertake
reduction , blending and bottling of Foreign Liquor in
collaboration with other distillery under the brand names
of the collaborator:- The licensee is required to obtain
permission of the State Government to undertake reduction,
blending and bottling of Foreign Liquor with other distilleries
under their brand name. Any manufacturer of Indian Made
Foreign Liquor having located in the State other than State of
Sikkim desire to enter into such collaboration with
distilleries/ any bottling units in Sikkim shall obtain the
permission from Government for collaboration on payment of
annual fee of Rs. 1 Lakh along with security deposit equal to
the amount of annual fee for the fulfillment of the condition.
The Commissioner shall issue the certificate in Form D-(B).
This is applicable for existing units also.

6 In the said rules for the existing FORM D II , the following
shall be substituted, namely:-

liquors/wine/bottling of Foreign Liquor brands /Wine in
collaboration with other distillery.

Whereas the land whose description is given below was likely to be needed for a public
purpose and notification to that effect had been made in the official Gazette No.49 dated
3rd Feb, 2011 under section 4(1) of L. A. Act 1894 (Act 1 of 1894) and in the Declaration under
section 6 of L.A.Act, 1894 vide Gazette No.135 dated 23rd March, 2012 and whereas it has subsequently
been revealed that the land is not required for public purpose and that possession over the land has not
been taken over by the District Collector, East the notification made earlier under section 4(1) of the
land Acquisition act 1894 and Declaration under section 6 of L.A.Act, 1894 is hereby cancelled.

DECLARATION UNDER SECTION 6 OF
LAND ACQUISITION ACT, 1894 (ACT I OF 1894)
Whereas the function of the Central Government under the Land Acquisition Act,
1894 (Act I of 1894) in relation to the Acquisition of land for the purpose of the Union have been
entrusted to the State Government by Notification No.12018/12/76/LRD of 10.01.1978 issued by
the Government of India in the Ministry of Agriculture & Irrigation under clause 1 of Article 258
of the constitution of India.
And whereas the Governor is satisfied that additional land is needed for a public purpose,
being a purpose of the Union, namely for the Establishment of 52nd Battalion by Sasastra Seema Bal in
the block of Melli and Melli Aching, West District, it is hereby declared that several pieces of land
comprising cadastral Plot Nos. and area mentioned in “Schedule of Properties” below is needed for the
aforesaid public purpose at the public expense within the aforesaid block of Melli and Melli Aching,
West District.

NOTIFICATION
With a view to streamline and ensure timely release of fund under Mid-Day Meal Scheme, the State Govt. of Sikkim is pleased to notify the “Green Channel” fund flow scheme with immediate effect;
1) The main objective behind adaptation of “Green Channel” is to facilitate the Schools for
timely flow of fund. The Scheme being a largest flagship program implemented
throughout the Country, needs utmost care and attention for its smooth and effective
implementation.
2) While adapting “Green Channel” Scheme, the following procedure shall come in to
force with immediate effect;
(a) To ensure accountability, transparency and effective utilization of fund, the
mechanism for online entry of actual MDM availing children (www.sikkimhrdd.org)
Roles & Responsibilities of different level of Officers / field functionaries as per
annexure I,
(b) To ensure timely billing and transparency, the pre-check procedure mentioned under
Annexure II and
(c) The procedures for Maintenance of Accounts in different levels, the Annexure III
shall come in to force with immediate effect.
3) All Institutions covered under MDM Scheme shall have to open a joint account in favour
of Head of Institution and Cooking Agencies mandatorily. Further, all Heads of
Institutions and field level of Officers are directed to visit www.trgmdm.nic.in for
monthly / annual data entry.

NOTIFICATION
The State Government is hereby pleased to lay down the guidelines / criteria for
implementation of Chief Minister’s Self Reliant Scheme (CMSRS) and for the grant of training /
vocational courses under Sikkim Youth Empowerment & Self Reliant Mission implemented by
Human Resource Development Department, Government of Sikkim as under, namely:
Chief Minister’s Self-Reliant Scheme
Eligibility:
i. Loans under this scheme shall be disbursed only to Sikkim Subject / Certificate of Identification holders and their descendants / holders of land parcha in the age group of 18 to 40 years.
ii. Original copy of valid Employment Card shall be submitted and will be in a safe custody of SIDICO till the loan is paid 100%.
iii. Not more than one member of a family shall be considered for the benefit, save in case of BPL families.
iv. Those who have availed loans under Chief Minister‘s Self Employment Scheme will not be eligible under this scheme.
Amount:
i. Quantum of loan shall be a minimum of Rs. 50,000/- and not exceed Rs.1, 00,000/- per individual per scheme.
ii. Processing Fees / application form Fee of 1% of the sanctioned amount shall be charged to cover the charge of administrative expenses of Sikkim Industrial Development & Investment Corporation Ltd, for loans under the scheme. No other amount shall be deducted from the loan.
iii. In case of default or death of a loanee, the guarantor / surety shall be liable for refund of only the principal amount to be paid within a period not exceeding one year.
Rate of Interest:
Loan shall be interest free for the first 2 years from the date of disbursement of 1st installment.
Thereafter it shall carry an interest rate of 6 % per annum.
Repayment of Loan
Loan shall be repaid on EMI basis in five (5) years after a moratorium period of 2 years. However,
the Loanee can make repayment before the due date.
Procedure
i. Sikkim Industrial Development & Investment Corporation Ltd, shall be the prescribed agency to accept all applications and disburse the loan amount at their end, duly ensuring that the eligibility criteria have been met and that all necessary obligations and formalities that are required to be fulfilled have been completed.
ii. Application of loans shall be examined with reference to genuineness of the request. Preference shall be given to candidates who have undergone higher/specialized training in the field for which the loan is sought.
iii. Applicant shall be required to submit an affidavit stating that he/she is not employed with any agency, that he/she has no outstanding dues with any financial institution and other requirement that may be considered necessary to be prescribed.
iv. Loans shall be disbursed by Sikkim Industrial Development & Investment Corporation Ltd after final approval of the Government.
v. List of Loanees with relevant details shall be submitted for information of the State Government by Sikkim Industrial Development & Investment Corporation Ltd, through the Human Resource Development Department.
vi. The Human Resource Development Department shall ensure wide publicity through Sikkim Herald and other Local newspaper regarding the scheme and the last dates of submission of application, so that all eligible Sikkimese youth will have a air chance for selection.

In exercise of the powers conferred by section 117 of the Sikkim Cooperative Societies Act,1978, (12 of
1978), the State Government hereby makes the following rules further to amend the Sikkim Cooperative
Societies Rules, 1981, namely:-
Short title,
extent and
commencement
1.(1) These rules may be called the Sikkim Cooperative Societies (Amendment)
Rules, 2013.
(2) They shall extend to the whole of Sikkim.
(3) They shall come into force on the date of their publication in the Official
Gazette.
2. In the Sikkim Cooperative Societies Rules, 1981,(hereinafter referred to as the said
rules), in rule 19;-
(i) in sub-rule (1),after the words and figure, ‘in sub-section (1)’, the words and figure
‘and sub-section (4)’, shall be inserted;
(ii) in sub-rule (2),after the words and figure ‘under sub-section (2)’, the words and
figure ‘and sub-section (4)’, shall be inserted.
3. In the said rules, after rule 29, the following rule shall be inserted, namely:-
‘29A Right of a member to get information:
Every member of a society shall have free access to its account books and other
connected record and information kept in respect of transactions with that member
and the Chief Executive shall make arrangements for the inspection of such
records and documents by the member on his request at the registered office of the
society.’
4. In the said rules, after rule 31, the following rule shall be inserted, namely:-
‘31A Constitution of Board:
(1) Election of a Board shall be conducted before the expiry of the term of the
board so as to ensure that the newly elected members of the Board assume
office immediately on the expiry of the office of members of the outgoing
Board.
(2) There shall be maximum of 21(twenty-one) number of directors of a
cooperative society.
(3) 1(One) seat for the Scheduled Caste / Schedule Tribes and 2 (two) seats for
women shall be reserved in the Board of every cooperative society to be filled
by members from such class or category of persons.
(4) The term of the Board shall be for a period of 5(five) years.
(5) In case of casual vacancies in the Board, it may be filled by nomination out of
the same class of members in respect of which the casual vacancy has arisen.
(6) The co-opted persons to be members of the Board as per sub-section (4) of
section 38 of the Act, shall not exceed 2(two) in addition to 21(twenty-one)
directors and these members shall not have voting right in any election of the
cooperative society or be eligible to be elected as office bearers of the Board.’
5. In the said rules, after sub- rule (1) of rule 33,the following sub-rule shall be
inserted , namely:-
‘(2) For the purpose of section 64A of the Act, the annual general meeting of all
the cooperative societies shall be conveyed within 6(six) months from the close of
each cooperative year, which shall be before the 30th September.’
6. In the said rules, in sub-rule(4) of rule 34,for the figures and words “3 years”, the
figures and words, “5 (five) years” shall be substituted.
7. In the said rules, after sub-rule(2) of rule 36, the following sub-rule shall be
inserted, namely:-
‘(3) Every society shall furnish to the prescribed authority, within
6(six) months from the close of each cooperative year;-
(a) a report on its activities during the year;
(b) an audited statement of Accounts for the year;
(c) its plan for disposal of surplus generated during the year
approved by the general body;
(d) a statement of amendments made to the Bye-laws;
(e) a declaration regarding holding general body meeting and
conduct of elections, if due; and
(f) any other report prescribed under the rules and other
information as required by the Registrar under the provisions
of the Act.’
8. In the said rules, in sub-rule (1) of rule 37, after the words and figure, “under sub-
section (1)”, the words and figure, “and sub section (6)”, shall be inserted.
9. In the said rules, in sub-rule (2) of rule 55, for the words and figure, “Rs.5000”, the
words and figure, “Rs. 1.00 lakh (Rupees one lakh)” shall be substituted.
10. In the said rules, in sub-rule (1) of rule 59, for the words and figure, “and in case of
Cooperative Credit Structure Societies, the provisions as laid down under section
64(1)(a),(b) and (c) of the Act shall apply”, the words and figure, “and section 64
shall apply to all types of societies”, shall be substituted.

section 22 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission
of India hereby makes the following further amendment in its Notification No. 434/SKM/2008(1)
dated 12.06.2008, as amended from time to time, relating to the appointment of Assistant
Returning Officers to assist the Returning Officer of respective Assembly Constituencies in the
State of Sikkim namely:-

01/03/03 in Court writ petition no.209/2803(Ramakant Devi vs union of India) and in
suppression of notification no.30/HC,HS and FW dated 26/09/2007,the State Government is
hereby pleased to constitute Quality Assurance Committee (QACs) at the State level to ensure
that the standards for female and male sterilization as laid down by the Government of India
are being followed in respect of pre-operative measures, operational facilities and post-

(iii) shall review and report cases of conception due to failure of sterilization in the state;
(iv) shall give directions on the implementation of measures for improving the quality of
sterilization services in the state;
(v) shall review the implementation of National Family Planning Insurance Schemes/
payment of compensation in the state
(vi) shall meet once in every six months.

constitute the “State Family Planning Indemnity” Sub-Committee” from within the State Quality
Assurance Committee to, redress, dispose and disburse claims/complaints received through the
District Quality Assurance Committee, to the district health society as per procedure and time
frame laid down in the manual, consisting of the following members, namely:-
(1) Mission Director(National Rural Health Mission) Chairperson;
Director Family Welfare -Convener;
(2) Joint Director(Reproductive and Child Health Officer) -Member;

In pursuance of the directives laid down by the Honorable Supreme Court in Civil writ petition
no.209/2003, (Ramakant Devi verses Union of India), the State Government is hereby pleased to
constitute District Level Quality Assurance Committee(DQAC) at the district level to ensure that the
standards for female and male sterilization as laid down by the Government of India are followed in
respect of preoperative measures , operational facilities and post operative follow-ups ,consisting of the
following members, namely:-
(1) District Collector Chairperson;
(2) Chief Medical Officer Convener;
(3) District Medical Superintendent Member;
(4) District Reproductive and Child Health officer Member Secretary;
(5) Gynecologist, District Hospital Member;
(6) Surgeon, District Hospital Member;
(7) Anesthetist, District Hospital Member;
(8) Paediatrician, District Hospital Member;
(9) Assistant Nursing Superintendent Member;
(10) Representatives from the Law and Parliamentary Affair Department Member;
(11) Assistant Director, Sanitation Cell Member;
(12) Deputy Director, Information Education and Communication
Bureau Member;
2. The terms of reference for the District Level Quality Assurance Committee shall be as follows:-
The District Level Quality Assurance Committee shall;-
(i) conduct medical audit of all deaths related to sterilization and send reports to the
State Quality Assurance Committee Office;
(ii) collect information on all hospitalization cases related to complications following
sterilization as well as sterilization failure;
(iii) process all cases of failure complications requiring hospitalization and deaths
following sterilization for payment of compensation and will pursue these cases with
the insurance company or otherwise;
(iv) review all State institutions i.e. Government and accredited private / NGOs and
selected camps providing sterilization services for quality of care as per the
standards laid down and recommend remedial action for the institutions not
adhering to the standards.
3. A minimum of three members shall constitute the quorum.

The Committee shall have the following terms of references, namely:-

(b) the Committee shall review the new developments in the policy relating to Other Backward
Classes/Most Backward Classes certificate and creamy layer;
(c) the Committee shall lay down certain modalities to examine the issues of Other Backward
Classes /Most Backward Classes certificate and creamy layer;
(d) the Committee shall systematically inquire into the issues pertaining to eligibility and
genuineness of the certificate issued and expeditiously pass an order to cancel or confiscate
the certificate issued not later than 3 (three) months time;
(e) the Committee shall submit comprehensive status report on the issue pertaining to Other
Backward Classes/Most Backward Classes certificate to the State Government.

WHEREAS the Mahatma Gandhi National
Employment Guarantee Act, 2005 (MGNREGA) was notified on 7th
September 2005.
AND WHEREAS, pursuant to the National Employment Guarantee Act, 2005 the
National Employment Guarantee Scheme-Sikkim, 2006 vide Not No. 09/RM&DD dated
28th
May 2007 was formulated.
AND WHEREAS, Notification REGD No.D.L- 33004/99, dated 3rd
January 2014, from
the Ministry of Rural Development, Government of India, Schedule I and II of the
Mahatma Gandhi National Rural Employment Guarantee Act, 2005(42 of 2005) has been
amended and accordingly will be called the National Rural Employment Guarantee Act,
Schedule I and II Amendment Order, 2013.
NOW THEREFORE, in compliance with the Notification issued by the Ministry of Rural
Development, Government of India, the Government of Sikkim is hereby, pleased to
adopt the National Rural Employment Guarantee Act, Schedule I and II Amendment
Order, 2013, with immediate effect.

NOTIFICATION
Whereas the State Government has deemed it expedient and necessary to have uniform and standard
procedure for issue of Accreditation / Press Cards to the Journalists through the Department of
Information and Public relations (DIPR), Government of Sikkim.
And Whereas keeping this in view the State Government is pleased to issue the following guidelines:
1. The Government of Sikkim shall constitute a committee called “the State Press Accreditation
Committee (SPAC)” consisting of 7 (seven) members to provide Accreditation to the news media
representatives by the Government of Sikkim for the purpose of access of information in the
Government and also to news materials, written or pictorial released by the Information and
Public Relation Department and/or other agencies of the Government of Sikkim.
2. The Secretary, DIPR, Government of Sikkim shall be the Chairman of SPAC and the Director;
DIPR shall be the Member Secretary of the SPAC along with 1 (one) representative from the
DIPR as member of the SPAC. The other members of the committee shall be 2 (two)
representatives nominated by the Press Club of Sikkim and 2 (two) representatives nominated
by the DIPR, Government of Sikkim from amongst the editors, reporters, recognized association,
national agencies and other organizations of journalists.
3. The Secretary, DIPR, Government of Sikkim shall convene the meeting of the SPAC, preside over
such meetings and maintain all records and proceedings of their deliberations.
4. The SPAC once constituted shall function for a period of 2 (two) years from the date of its first
meeting and will continue to function till it is reconstituted.
5. The SPAC once constituted shall meet atleast 2 (two) times in a year or more frequently, if
deemed necessary by the Secretary, DIPR, Government of Sikkim. The main purpose of meeting
of the SPAC will be to issue the Accreditation Cards to the journalists. Hence, the SPAC will
mandatorily meet during the month of March to finalize the issue of Accreditation card for the
coming financial year.
6. Accreditation cards issued during a financial year would be valid upto the end of the financial
year i.e. 31st March. Normally, renewal of the Accreditation Card and issue of fresh Accreditation
Card for the next financial year would be carried out between 1st March and 31st March of the
current financial year. Therefore, all applications for renewal and issue of fresh cards shall be
submitted during the said Window Period of 1st to 31st March of every financial year.
7. The eligibility criteria for issue of Accreditation Cards shall be as follows:
(i) The applicant should be working in any Media House / news paper / news agency within
the territorial jurisdiction of the Government of Sikkim.
(ii) The applicant should possess a minimum of 8 (eight) years of experience in the field of
journalism and should submit Experience Certificate as a proof of the same.
(iii) The application shall be in a prescribed format, duly recommended by the Editor of the
Media House.
(iv) The Media House which recommends for issue of Press Card should be Registered with
the Registrar for Newspapers in India, in case of Print Media. However, this would not
be applicable for Electronic / Web Media.
8. In order to ensure the importance and sanctity of Accreditation Cards, it is necessary to fix a
maximum limit of Accreditation Cards for each Media House. Accordingly the following limit is
hereby fixed:
(1) Print Media:
(i) Daily News Paper: 5
(ii) Weekly / Fortnightly News Paper: 2
(iii) Monthly / Bi-Monthly / Quarterly / Annual Magazine: 1
(2) Electronic Media:
(i) Television Channels: 5
(ii) Radio Channels: 5
(iii) Web Media: 2
9. Incase of freelancers the applicant should have atleast 10 (ten) years of experience in the field
of journalism and should produce substantial proof before the SPAC along with the application.
10. The maximum numbers of Accreditation Card as stated above is over and above the Press Card
which the Media House is entitled to.
11. As and when the Accreditation Card Holder resigns / removed from a Media House, the Editor of
the Media House shall immediately inform the Director, DIPR for cancellation of the
Accreditation Card.
12. The SPAC reserves the right to accept or reject the application for the issue of Accreditation
Card without assigning any reason thereof and the issue of Accreditation Card would be at the
discretion of the SPAC and shall not be claimed as a matter of right by anyone.
13. The Department shall not issue any new Press Card but will only renew the existing issued Press
Card till the press card holders will be entitled for the issue of Accreditation Card. The issuance
of Press Cards shall be done in the following manner:
(i) The application for renewal shall be in the prescribed format, duly recommended by the
Editor / Publisher of the Media House.
(ii) The Media House which recommends for renewal of Press Card should be RNI
Registered, in case of Print Media. However, this would not be applicable for Electronic /
Web Media.
(iii) The renewal of Press Card shall be done by the DIPR and SPAC shall not be responsible
for the renewal of the Press Card.
(iv) Press cards renewed during a financial year would be valid upto the end of the financial
year i.e. 31st March. Normally, renewal of the Press Card for the next financial year
would be carried out between 1st March and 31st March of the current financial year.
Therefore, all applications for renewal of Press cards shall be submitted during the said
Window Period of 1st to 31st March of every financial year.
(v) The renewal of Press Card would be at the discretion of the DIPR and shall not be
claimed as a matter of right by anyone.

NOTIFICATION
In exercise of the powers conferred by section 16 of the Sikkim Allotment of
House Sites and Construction of Building (Regulation and Control) Act, 1985,(11
of 1985), the State Government is hereby pleased to make the following rules
further to amend the Sikkim State Site Allotment Rules, 2012, namely:
1. Short title, extent and commencement:
(1) These rules may be called the Sikkim State Site Allotment (Amendment) Rules, 2014.
(2) They shall extend to the whole of Sikkim. (3) They shall come into force at once.
2. In the Sikkim State Site Allotment Rules, 2012, (hereinafter referred to as the
said Act) for rule 6, the following rule shall be substituted, namely:-

of Rule 6
1) Any person desirous of applying for a site under
these rules shall make an application in Form I and
deposit registration fee of Rs 5000/- (Rupees five
thousand only) through a challan issued by the Urban
Development and Housing Department under the
relevant head at the State Bank of Sikkim. In case of
reserved category, registration fee of Rs 2500/-
(Rupees two thousand five hundred only) shall be
deposited.
2) The challan shall be presented along with the
application form I and documents completed in all
respects to the Town Planner on working days.
3) The application form I shall be signed by the
applicant himself. No applicant shall make any cutting,
erasing or overwriting in the application. In case a
person desires to make changes, it is advised to obtain
and fill up a fresh application form.
4) No conditional application form will be considered.
Incomplete application forms shall be rejected
summarily without conveying any reason to the
applicant.
5) Application for allotment does not entitle for claiming
allotment of sites.
3. 3. In the said rule, for rule 17, the following rule shall be substituted, namely:-
Amendment of 17 Allotment of Additional sites
Rule 17
1) Any person desirous of applying for additional site
under these rules shall make an application in form I
and deposit registration fee of Rs 5000/- (Rupees five
thousand only) through a challan issued by the Urban
Development and Housing Department under the
relevant head at the State Bank of Sikkim. In case of
reserved category, registration fee of Rs 2500/- (Rupees
two thousand five hundred only) shall be deposited.
2) If for any reason of structural stability or genuine
difficulties arising due to the land profile, it becomes
necessary to allot additional area, it may be done only
for the said reason and not exceeding the area required
for stabilization of the building. The additional area shall
not exceed 50 % (fifty percent) of the initially allotted
site. This permission shall be given only once.
3) It is further subject to the condition that no additional
allotment will be made on public gullies, public open
spaces, etc or as indicated in the local area plan.
4) Application for additional site allotment does not
entitle for claiming allotment of sites.
4. In the said rule, after rule 19, the following rules shall be inserted namely;
19 A “Procedure for application of regularization of
occupied sites
1) Any person applying for regularization of site under
these rules shall deposit registration fee of Rs 1500/-
(Rupees one thousand and five hundred only) through
a Bank Receipt of State Bank in the State Bank of
Sikkim under the relevant head. In case of reserved
category, registration fee of Rs 500/- (Rupees five
hundred only) shall be deposited.
2) The Bank Receipt shall be presented along with the
application form II and documents completed in all
respects to the Town Planner on working days.
3) The application form II shall be signed by the
applicant himself. No applicant shall make any cutting,
erasing or overwriting in the application. In case a
person desires to make changes, it is advised to
obtain and fill up a fresh application. No conditional
application form will be considered. Incomplete
application forms shall be rejected summarily without
conveying any reason to the applicant.”
4) However, the submitting of application form (FORM
II) does not entitle for regularization of unauthorized
construction as a matter of right.
19 B
“For all categories, documents to be submitted along
with application form
The applicant shall furnish the following documents along
with the
application form II , namely:
1) attested copy of Sikkim Subject Certificate (SSC) /
Certificate of Identification (COI);
2) valid documental evidence other than those
issued/recommended by elected representatives;
3) proof of residence namely attested copy of passport
or identity card or election card or ration card or
driving license or telephone bill or electricity bill or
water bill (page carrying name and address);
4) affidavit stating that the facts mentioned in the
application form is correct and that legal action can be
taken against him/her for misrepresentation of facts;
5) in case of a woman applicant, certificate of marital
status (if she claims to be single) or Sikkim Subject
Certificate or Certificate of Identification of her
spouse (if she is married).”
5. In the said rule ,after rule 24, the following rule shall be inserted , namely :-
25 “Power to Relax”
In case of genuine difficulties arising out of the implementation of any of these rules, the State Government reserves the right to relax from application of any of the provisions which it considers justifiable on the merit of the case.

In exercise of the power conferred by section 25 of the Sikkim State Site Allotment
(Amendment) Rules 2014, the State Government is hereby pleased to make one time relaxation
of clause 19 (I) (ii) (iii) of the Sikkim State Site Allotment Rules, 2012 by omitting it. It relates
to the matter of possession of Sikkim Subject Certificate or COI and categorization of the
beneficiary under Economically Weaker Section of the society. This relaxation shall be
applicable for a period of 12 months only from the date of issue of this notification and shall
extend to all the Bazaars of Sikkim.

NOTIFICATION
The Department of Animal Husbandry, Livestock, and Fisheries & Veterinary Services
has decided to withdraw Notification No. 11/AH, LF&VS dated 26.6.2013 with immediate
effect. It has also been decided that the Department would not fix prices of beef, buff, chevon
and pork for a period of six months from date of issue of this Notification on experimental basis.
Further, during this above mentioned period of six months, Department shall observe
prices of these products in the different markets of the State, Depending upon the market
situation, the Department would take a decision on notifying maximum prices of these products
as earlier upon expiry of aforesaid period of six months.
This issues with approval of Competent Authority.
