    Concept of the supremacy of the constitution

    Article 153 of the Constitution of Malaysia grants the Yang di-Pertuan Agong

    (King of Malaysia) responsibility for safeguarding the special position of the Malays

    and natives of any of the States of Sabah and Sarawak and the legitimate interests

    of other communities and goes on to specify ways to do this, such as establishing

    quotas for entry into the civil service, public scholarships and public education.

    In this concept, the Federal Constitution of Malaysia is the highest law in the

    country. Other laws also cannot contradict with it. The constitution is the source of

    other laws where other laws are to be based by it. The Malaysian constitution is a

    written constitution, which basically means it is compiled in one document.

    The constitution also consists of laws and customs that have evolved

    overtime. The constitution exists based on the needs of the current situation of the

    country and the people. It also considers the ability of the government to ensure in

    fulfilling the content of the constitution. The constitution thus would give direction on

    how to rule the country.

    In general, the Malaysian constitution is a unique expression of the Malaysia's

    varied culture and history.

    Traditional elements of constitution

    The traditional elements of constitution existed long ago before the

    constitution was enacted. It is to establish the identity of Malaysia and foster

    understanding towards unity of the different races in Malaysia.

    Firstly, the Malays and Bumiputera of Sabah and Sarawak are given special

    position because they are the indigenous people of the land. It is enshrined in the

    Article 153. The privileges include positions in public service, scholarship, education,

    business and other special facilities.

    The official religion of Malaysia is Islam, but other religions may be practice in

    peace and harmony by the citizen. Everyone has the right to profess and religiouspractices.

    Next, the national language of the country is Bahasa Malaysia. It is for official

    purposes and to unity all the races in Malaysia using the same language. English is

    the second official language in the country due to its importance in the globalized

    world. Mandarin and Tamil language are practice in Chinese and Tamil school.

    In the system of monarchy, the king (Yang di-Pertuan Agong) has theabsolute power in every government and state administration with the assistance of

    dignitaries appointed. The institution monarchy remains after independence under

    the concept of constitutional monarchy in accordance with the democratic system.
