Compliance Report for 2015 British Columbia Renewable and Low Carbon Fuel Requirements Regulation It is the responsibility of anyone who manufactures or imports fuel to determine whether their activities qualify them as a Part 2 (Renewable) and/or Part 3 (Low Carbon) fuel supplier under the Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements) Act (available online at www.bclaws.ca ). All Part 2 and Part 3 fuel suppliers must report using the form “Compliance Report for 2015” unless they claim the Small Supplier Exemption (see below). The 2015 compliance period for Part 2 and Part 3 requirements is from January 1 to December 31, 2015. Compliance reports are due March 31, 2016. The compliance report must be signed by an officer or employee authorized by the fuel supplier, and records evidencing each matter reported under the Renewable and Low Carbon Fuel Requirements Regulation (Regulation) must be available for inspection upon request. These records must be retained for a period of seven years after the compliance period to which they refer. Payment of penalties must be enclosed with the report and submitted to the Ministry of Energy and Mines. Cheques or money orders are to be made payable to the Minister of Finance. Compliance Report for 2015British Columbia Renewable and Low Carbon Fuel Requirements Regulation

It is the responsibility of anyone who manufactures or imports fuel to determine whether their activities qualify them as a Part 2 (Renewable) and/or Part 3 (Low Carbon) fuel supplier under the Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements) Act (available online at www.bclaws.ca).

All Part 2 and Part 3 fuel suppliers must report using the form “Compliance Report for 2015” unless they claim the Small Supplier Exemption (see below). The 2015 compliance period for Part 2 and Part 3 requirements is from January 1 to December 31, 2015. Compliance reports are due March 31, 2016.

The compliance report must be signed by an officer or employee authorized by the fuel supplier, and records evidencing each matter reported under the Renewable and Low Carbon Fuel Requirements Regulation (Regulation) must be available for inspection upon request. These records must be retained for a period of seven years after the compliance period to which they refer.

Payment of penalties must be enclosed with the report and submitted to the Ministry of Energy and Mines.

Cheques or money orders are to be made payable to the Minister of Finance.

Small Fuel Supplier Exemption

Fuel suppliers who supplied less than a total of 75 million litres of gasoline and diesel class fuels (combined) in the 2015 compliance period may elect to be exempted from Part 2 and/or Part 3 requirements. A Part 2 or Part 3 fuel supplier who elects to be exempted must report using the “Short Form Compliance Report for 2015”. A Part 3 fuel supplier who does not supply any Part 2 fuels may not claim exemption.

Fuel suppliers who elect to be exempted from Part 3 requirements in a compliance period may not generate or otherwise acquire credits under the Act. However, if that company already holds credits, those credits may be sold at any time. For more information, see Information Bulletin RLCF-013 Validation and Transfer of Part 3 (Low Carbon Fuel) Credits.

Part 2 Report - Renewable Fuel Calculation – Gasoline Class Fuel

InstructionsThe renewable fuel requirement for gasoline is a 5% provincial average for the compliance period. The calculation for renewable content must represent 5% of the total volume of renewable and non-renewable fuel combined, using the formula in section 7 of the Renewable and Low Carbon Fuel Requirements Regulation (Regulation).Line 1. Report the total volume of petroleum-based gasoline supplied in the compliance period. This is the sum of all petroleum-based gasoline that was imported,

manufactured, or acquired under an agreement described in section 6 of the Regulation, and then sold or used. Do not include any volumes exported from British Columbia in the compliance period.

Line 2. Report the total volume of renewable gasoline class fuel supplied in the compliance period. This is the sum of all renewable gasoline class fuel that was imported, manufactured, or acquired under an agreement described in section 6 of the Regulation, and then sold or used. Do not include any volumes exported from British Columbia in the compliance period.

Line 3. Report the total volume of gasoline class fuel supplied in the compliance period. This is the sum of (Line 1 + Line 2). This calculation is done automatically in the form; please verify that the value is correct.

Line 4. For all of the gasoline class fuel supplied in a compliance period, sometime in that compliance period a portion of that fuel must include renewable content that amounts to 5% of the total volume. Report the volume of the renewable fuel requirement for gasoline class fuel. This calculation is done automatically; please verify that the value is correct.

Line 5. Report the total from Schedule A of all volumes of renewable gasoline class fuel notionally transferred by you to other suppliers under section 5 (1) (a) of the Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements) Act (the Act).

Line 6. Report the total from Schedule A of all volumes of renewable gasoline class fuel notionally received by you from other suppliers under section 5 (1) (b) of the Act.Line 7. If you exceed your renewable fuel obligation for the compliance period, under section 5 (3) (a) of the Act you may retain records of surplus volumes for up to 5% of

your obligation calculated in Line 4 and use that volume as credit in the next compliance period. Report the volume of renewable gasoline class fuel retained as credit for the next compliance period.

Line 8. Report the volume of renewable gasoline class fuel retained in the previous year to be applied as credit under section 5 (3) (b) of the Act. This is the same amount you reported on Line 7 in the previous compliance period.

Line 9. If you do not meet your renewable fuel obligation for the compliance period, under section 5 (4) (a) of the Act you may defer the deficiency for up to 5% of your obligation calculated in Line 4 and add that volume to your obligation for the next compliance period. Report the volume you are deferring to the next compliance period.

Line 10. Report the volume of the renewable fuel obligation added from the previous compliance period under section 5 (4) (b) of the Act. This is the same amount you reported on Line 9 in the previous compliance period.

Line 11. Report the net volume of gasoline class fuel supplied in the compliance period where the net volume is:Line 11 = Line 2 – Line 5 + Line 6 – Line 7 + Line 8 + Line 9 – Line 10. This calculation is done automatically; please verify that the value is correct.

Line 12. Calculate the penalty payable, if any. The penalty is calculated as (Line 4 – Line 11) multiplied by a penalty rate of $0.30 per litre. If the amount is negative, enter “0”. Report the amount of the penalty payable in the Business Information and Declaration section.

In the compliance period, for each fuel supplier that you notionally transferred fuel to, or notionally received fuel from, you must report the fuel supplier name, address, contact information and the total volumes notionally transferred to, and/or received from that supplier. Volumes “transferred to” are those volumes notionally transferred by you to another supplier listed in the Schedule. Volumes “received from” are those volumes notionally received by you from another supplier listed in the Schedule. Determination Method Identify the method used to determine the carbon intensity of the Part 3 fuel. Regulation: If the fuel is petroleum-based gasoline or petroleum-based diesel fuel, choose “Regulation” under “Determination Method”, and report

the value of either 87.29 g CO2e/MJ for petroleum-based gasoline or 93.55 g CO2e/MJ for petroleum-based diesel fuel in the “Carbon Intensity” column.

Fuel code: If the director has posted a carbon intensity for the fuel (listed in Information Bulletin RLCF-012 – Approved Carbon Intensities), you must choose the Fuel Code in this column and the approved carbon intensity in the “Carbon Intensity” column.

Method 1: If you are determining the carbon intensity using default carbon intensity in accordance with section 11.04 of the Regulation, choose “Method 1” in this column and enter the default value in the “Carbon Intensity” column, reproduced in the table above.

Method 2: If you are determining the carbon intensity using GHGenius in accordance with section 11.06 of the Regulation, choose “Method 2” in this column and enter the carbon intensity value in the “Carbon Intensity” column. For carbon intensities determined using Method 2, an explanation of the inputs to the approved version of GHGenius and sufficient information to enable the Ministry to reproduce the carbon intensity analysis must be provided in Schedule E. Refer to Information Bulletin RLCF-006 – Determination of Carbon Intensity, available online.

Method 3: If you are determining the carbon intensity using an alternative method approved by the director, in accordance with section 11.07 of the Regulation, choose “Method 3” under “Determination Method”, and enter the carbon intensity value under “Carbon Intensity”. Attach a copy of the letter from the director approving the method.

Fuel Code If you choose Fuel Code for “Determination Method”, enter the fuel code in this column. Otherwise leave it empty.

Fuel Class The two fuel classes are gasoline and diesel. See the definitions in the Act.

Carbon Intensity Limit For 2015, this is 85.11 g CO2e/MJ for gasoline class fuel or 91.21 g CO2e/MJ for diesel class fuel.

Carbon Intensity Enter the value being reported for the fuel, in grams of carbon dioxide equivalent (CO2e) per megajoule to two decimal places (g CO2e/MJ).

Schedule C – Excluded Fuels

Under section 6 (3) of the Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements) Act, Part 3 requirements do not apply in relation to fuel quantities that the Part 3 fuel supplier expects, on reasonable grounds, will be used for a purpose other than transportation. The quantities and expected uses of excluded fuels must be reported in accordance with section 11.08 (4) (d) (ii) of the Regulation.

Schedule D - GHGenius Input and Output Summaries

InstructionsA separate copy of the GHGenius Input Summary Table is to be filled out for each carbon intensity determined using Method 2 and reported on Schedule B.

Carbon intensity values must be determined by using an approved version of GHGenius as specified in Information Bulletin RLCF-011 Approved Version of GHGenius, available online. The approved GHGenius for the 2015 compliance period is version 4.03.

Intergovernmental Panel on Climate Change (IPCC) 2007 global warming potential (GWP ) values must be used.

For Method 2 calculations, all records, including all GHGenius spreadsheets supporting any carbon intensity calculation, must be retained for 7 years after the end of the compliance period to which they relate. GHGenius spreadsheets should not be submitted with the reporting form but must be available upon request by the director.

GHGenius input data could include data such as feedstock transportation (distance between source area for the feedstock and plant location), plant fuel consumption (measured electricity, coal and natural gas inputs to the facility, based on periods of time when the plant was being supplied by the relevant feedstock) and finished product transportation (distances between facilities).

To ensure consistency and to enable verification of reported carbon intensity values, an input sheet must be submitted for each fuel for calculations under Method 2. Attach additional pages if you need more space.
