I. INTRODUCTION Salt Lake County (hereafter referred to as County), on behalf of its Division of Community Resources and Development, is soliciting proposals from qualified firms (hereafter referred to as Proposer / Contractor) to enter into multiple award contracts to provide placement opportunities for AmeriCorps members under the Corporation for National and Community Service (CNCS) Program. Please submit written copies of your proposal. Proposers are advised that the County is not bound by the terms of the RFP until a written agreement is fully executed. Any activity taken by the Proposer prior to full execution of a written agreement is done at the Proposer’s sole risk.

II. DEADLINE FOR PROPOSAL SUBMISSION

Your sealed proposal must be logged and stamped received before 2:00 PM MDT on Wednesday, June 22, 2016 at Contracts & Procurement, 2001 South State Street, Room N4-600, Salt Lake City, Utah 84190-3100. No proposals will be accepted after the closing date and time.

III. PROJECTED SCHEDULE FOR THE RFP PROCESS County reserves the right to modify the following schedule at their discretion:

IV. PRE-PROPOSAL CONFERENCE

Interested Proposers are invited to attend a pre-proposal conference to discuss the services and to ask questions about this RFP. It will be held on Monday, June 13, 2016 at 11:00 am MDT. It will be onsite at 2001 South State Street, N4-600 Contracts and Procurement Conference Room, North Building 4th floor. If you would like to participate by phone, e-mail the buyer at [email protected] for the toll free phone number and meeting room number. Proposers are encouraged to submit their questions in writing before the pre-proposal conference through Bid Sync at www.bidsync.com. The meeting is for informational purposes only and is not binding. If the RFP needs to be modified or clarified, a written addendum will be issued.

V. QUESTION SUBMISSION

Questions may be submitted through Bid Sync. The deadline for questions submission is June 17, 2016. Bid Sync will e-mail the answers on an ongoing basis to all Proposers that have expressed an interest in the RFP. Do not contact County officers or employees, or selection committee members.

VI. TERM OF AGREEMENT The contract resulting from this solicitation will become effective on October 1, 2016 and will end September 30, 2017. The term may be renewed for additional 1 year contingent upon available funding and meeting performance expectations.

VII. BACKGROUND Salt Lake County developed a Ten Year Plan to End Chronic Homelessness in 2006. Part of the strategy on ending homelessness is to provide housing and appropriate services following the Housing First model which is to place homeless individuals into housing as quickly as possible. Salt Lake County has also been designated as a refugee resettlement area. Many refugees coming to the United States from other countries have similar barriers and are in effect homeless when they are resettled to Salt Lake County. The County plans to contract with qualified organizations to host AmeriCorps members under the National Community Service Program. AmeriCorps members will provide direct services to homeless or formerly homeless individuals and families to help them obtain and maintain housing, receive job placement services, employment and access other supportive or mainstream services with the goal of increasing their self-sufficiency and integration into the community. An example of the type of activities AmeriCorps members will be providing is included in Exhibit C.

VIII. SCOPE OF WORK AND TASKS TO BE COMPLETED The desired outcomes for these services are to have the AmeriCorps member have a positive experience during their term of service, learn skills that will help them in future employment, provide service opportunities for members to give back to the community, and receive their educational award. Clients who are homeless that have been assisted by AmeriCorps members will receive housing services, be placed in housing and maintain housing, receive supportive services, receive job placement services and employment and be referred to organizations that can provide other services they may need including access to mainstream services such as Social Security, education, training, medical, food stamps, or other public assistance programs. The sites hosting the AmeriCorps members will have a positive experience with the AmeriCorps program. Salt Lake County has 20 Member Service Years (MSY) slots for this program year beginning October 1, 2016. It is projected that 16 slots would be full time (35 hours) per week and eight would be part time (20 hours) per week. The exact configuration and number will be determined based on the responses received to this RFP. Organizations selected for hosting AmeriCorps members should be able to meet the following conditions:

1. Agree and adhere to the AmeriCorps requirements as outlined in Exhibit A 2. Provide a service opportunity for an AmeriCorps member that includes job duties

that provide direct services (not administrative work) which are not currently being performed by other staff and do not replace or displace current staff.

3. Provide services to the targeted population of homeless or formerly homeless individuals and families. Included in this population are refugees.

4. Provide supervision and appropriate job training for a full time member who will

work approximately 35 hours per week or a part time member who will work approximately 20 hours a week until their term of service is completed.

5. Pay a match for each full time AmeriCorps member of $10,000/year, part time $5,000/year. Match must be cash match paid on a quarterly basis to Salt Lake County.

6. Continue to pay the cash match if a member leaves the program early and cannot be replaced.

7. Ensure that the members report time in the automated time keeping system on a daily basis and the member’s time is approved by the site supervisor at least weekly (Monday).

8. Keep source documentation by individual AmeriCorps members on the services provided and outcomes achieved. Provide quarterly reports on AmeriCorps member activities and outcomes as required. These are unduplicated numbers of people served in the specific service categories. An example of the quarterly reports is included as Exhibit B

9. Perform mid-term and final performance reviews of AmeriCorps members. 10. Assist in the recruiting and selection of AmeriCorps members using the generic

job description developed by Salt Lake County and more specific agency job descriptions.

11. Participate in an evaluation of the AmeriCorps program to help measure the effectiveness of program outcomes.

12. Attend an annual orientation at the beginning of the program year. Allow members to attend quarterly trainings and participate in 3-4 community service projects. Allow members to attend conferences such as the Utah Homeless Summit and the Utah Poverty Conference.

13. Keep track of supervisor time and benefit costs spent in supervising AmeriCorps members and report that to the County as requested. This is used to document in-kind match.

IX. PRICING/COSTS/FEES

No other general costs for the operation of the AmeriCorps program are required of the agencies beyond the payment of match for AmeriCorps member except for:

1. If a member drives as part of their assignment, the agency is responsible for the payment of mileage reimbursement.

2. The County will pay for the first background check of a member but if that member decides not to take the position, the Agency pays for subsequent background checks for that position.

Members will be paid a living allowance (stipend) twice each month on the 7th and 22nd. The amount depends on their full or part time member status. Full time members are also eligible for health insurance benefits.

X. PROPOSAL FORMAT

All proposals shall be formatted according to the following specifications:

A. Proposal: The proposal cannot be more than 25 pages.

1. Cover Summary: Submit the attached cover summary indicating the Proposer’s willingness and authority to enter into an agreement with the County and to agree to all the terms set forth.

2. Page Numbering: The proposal shall contain page numbers.

3. Table of Contents: The proposal may contain a table of contents with references to page numbers.

4. Tabs: The proposal may contain tabs for the sections listed in the

Evaluation and Scoring Criteria. Tabs do not count toward the page limit.

5. Proposer Request for Protected Information: All documents submitted in response to this RFP will be treated as public records in accordance with GRAMA unless a claim of business confidentiality is submitted per the Request for a Protected Status. If claiming confidentiality, the Request for Protected Status form shall be placed directly behind the cover summary and does not count toward the page limit.

6. Number of Proposal Copies: Submit six (6) copies of your proposal and

one (1) unchanged electronic copy in PDF format on a thumb drive or disk.

7. Sealed and Marked Packaging: The proposal shall be sealed and clearly

marked “AmeriCorps 2016-2017 Program” on the outside of the package and on the body of the proposal. All copies shall be put into one envelope or box and sealed; do not put each proposal copy in a separate sealed envelope.

XI. EVALUATION AND SCORING CRITERIA

The proposal will be evaluated, scored, and ranked by a Selection Committee. Each member of the committee will be provided a score sheet to complete the proposal evaluation utilizing the point system listed below. Committee members will individually score the proposals and rank them 1st, 2nd, 3rd, etc. according to their total score. Each criteria will be scored. The following point system is utilized: Excellent (5): If the proposal offer exceeds expectations, with an excellent

probability of success in achieving all requirements of the RFP, and is very innovative; a score of “5” is given.

Good (4): If the proposal offers a very good probability of success, achieves all requirements of the RFP in a reasonable fashion; a score of “4” is given.

Acceptable (3): If the proposal offers a reasonable probability of success, but some of the requirements may not be met; a score of “3” is given.

Poor (1-2): If the proposal falls short of expectations and has a low probability of

success; a score of “1-2” is given. Unacceptable: If the approach completely fails the requirements; a score of “0” is

given.

20% Firm's Qualifications and Team. Provide a brief description of your organization, the scope and nature of services routinely provided and the names (with some explanation of their experience) of who would be supervising the AmeriCorps members.

25% Relevant Experience. Provide relevant experience you have had with hosting

and supervising AmeriCorps members within your organization and the type of activities these individuals performed while serving in your organization. Provide a name and phone number of who could be contacted to verify this experience. If you have not had previous experience in hosting AmeriCorps members, please indicate any other relevant experience you may have had or currently have in the supervision and development of job duties for temporary employees, interns, fellowships, volunteers, etc.

25% Proposed Approach. Describe how your organizations will identify and define

the type of work an AmeriCorps member will perform in your organization. Specifically identify how your organization will serve the homeless or formerly homeless (which could include refugees) with AmeriCorps members. Please indicate the number of AmeriCorps members (full or part time) you are requesting to be placed in your organization.

20% Project Schedule/Outcomes. Indicate the type of activities your AmeriCorps

member(s) would provide that could be reported on a quarterly basis. See Exhibit B, Quarterly Report for the activities that need to be reported. Pay particular attention to the categories of employment and housing. Indicate the number of unduplicated individuals your organization would provide job placement and housing placement services and the number of unduplicated individuals your organizations would be placed in jobs and in housing. Indicate the source (verification) documentation you will use to demonstrate the number of individuals that receive a job and are placed in housing.

10% Proposed Match Indicate what funds will be used to pay the match for each

AmeriCorps Member placed in your organization described above in item VIII.5 Scope of Work, and provide assurances that you will pay the match if a member leaves before their term of service is complete even if they cannot be replaced.

A. Preference System Salt Lake County may adjust scoring pursuant to its Preference System established by ordinance and policy. Please refer to the preference system (Attachment C) and include the preference information.

B. Interview, Demonstration, and Site Visit. The Selection Committee may invite Proposers for an interview. The purpose is clarification and verification of the written proposal. The selection committee may also submit questions to the organization for clarification on the proposal. The Selection Committee may re-score the proposal after the interview and receiving responses to the questions asked of the organization. C. Recommended Award After the Selection Committee has completed their evaluation process, the Selection Committee will then present a recommendation for awards to the proper signing authority for authorization to negotiate contracts. D. Debrief Meetings Debrief meetings with the selection committee members will not be allowed, however, a Proposer may discuss the RFP process with the chair/facilitator of the committee at any time.

XII. WRITTEN AGREEMENT REQUIRED The selected Proposer must agree to all requirements in the RFP scope of work. The selected Proposer must also be willing to enter into a written agreement with County and agree to all the terms set forth in the Example Agreement, attached to this RFP (Attachment E). If you wish to request alterations the RFP, including any of the terms of the example RFP Agreement, or any of the exhibits, attachments, or addenda, the alterations must be specifically identified in your proposal with reasonable alternatives presented. Any such exceptions must be submitted in a separate sealed envelope, and clearly marked as “Requested Alterations.” Only those alterations so specified will be available for discussion or negotiation. Proposer understands that deviations from the Example Agreement are made at the County’s sole discretion. Proposers are advised that the County is not bound by the terms of the RFP until a written agreement is fully executed and any activity taken on by the Proposer prior to full execution of a written agreement is done at the Proposer’s sole risk.

XIII. NOTICE TO PROPOSERS

By submitting a proposal to this RFP, Proposer understands and agrees to the following:

A. Government Records Access and Management Act (GRAMA): County is a governmental entity subject to the Utah Government Records Access and Management Act (“GRAMA”), Utah Code Ann. §§ 63G-2-101 to -901. As a result, County is required to disclose certain information and materials to the public, upon request. Generally, any document submitted to County is considered a “public record” under GRAMA. Any person who provides to County a record that the person believes merits protection under subsection 63G-2-305(1) or (2) must submit with their proposal both: (1) a written claim of business

confidentiality and (2) a concise statement of reasons supporting the claim of business confidentiality. Generally, GRAMA only protects against the disclosure of trade secrets or commercial information that could reasonably be expected to result in unfair competitive injury. For your convenience, County has provided a Business Confidentiality Request Form which is attached to this RFP as Attachment B. All documents submitted in response to this RFP will be treated as public records in accordance with GRAMA, unless a claim of business confidentiality has been properly made and approved by County. All proposed costs/pricing/fees submitted to the county are public records. An entire proposal cannot be identified as “PROTECTED,” “CONFIDENTIAL,” or “PROPRIETARY” and may be considered non-responsive if marked as such.

B. Copyrighted Material Waiver: In the event that the proposal contains copyrighted or trademarked materials, by submitting its proposal the Proposer grants the County the right to use, reproduce, and publish the copyrighted or trademark materials in any manner the County deems necessary for conducting County business and for allowing public access to the responses under GRAMA or otherwise, including but not limited to photocopying, County Intranet/Internet postings, broadcast faxing, and direct mailing. If the proposal contains materials whose copyright or trademark is held by a third party, it is the Proposer’s sole responsibility to obtain permission from that third party for the County to reproduce and publish the information. By submitting its proposal, the Proposer certifies that it owns or it has obtained all necessary approvals for the reproduction or distribution of the contents of the proposal and agrees to indemnify, protect, save and hold the County, its representatives and employees harmless from any and all claims arising from all intellectual property claims related or connected to the proposal and agrees to pay all legal fees incurred by the County in the defense of any such action.

C. Restrictions On Communications: From the issue date of this solicitation until a Proposer is selected and the selection is announced, Proposers are prohibited from communications regarding this procurement with agency staff, evaluation committee members, or other associated individuals EXCEPT the Buyer overseeing this procurement. Failure to comply with this requirement may result in disqualification.

D. RFP Cancellation: This RFP may be cancelled at any time prior to the execution of a written agreement if deemed in the best interests of County. This includes cancellation of the RFP after an award has been made, but prior to the execution of a written contract. Proposer is not entitled to recover any costs related to the preparation of the proposal due to cancellation of the RFP or withdrawal of an award prior to the execution of a written agreement.

E. Firm Pricing: All prices, quotes, or proposals are to remain firm for 120 days after the closing date, unless a different period is stated in County’s RFP. Any

proposal that does not offer to remain firm for the required period may be considered to be non-responsive.

F. Costs: Proposers bears all costs and expenses related to this RFP including, but not limited to, preparation and delivery of the proposal, attending the pre-proposal conference, and attending the interview.

G. Licensing: All applicable federal, state, and local licenses must be acquired

before the contract is entered into between County and the selected Proposer. Licenses must be maintained throughout the entire contract period. Persons doing business as an Individual, Association, Partnership, Corporation, or otherwise must be registered with the Utah State Division of Corporations and Commercial Code. NOTE: Forms and information on registration may be obtained by calling (801) 530-4849 or toll free at 877-526-3994, or by accessing: www.commerce.utah.gov.

H. Changes or Modifications: Any changes or modification to the RFP will be made

by written addendum. Proposer submitting a proposal based on any information other than that contained in County’s RFP and any addenda, do so at their own risk.

I. Receiving Proposals: Contracts and Procurement will administer receipt and

opening of all proposals. Proposals will be held, unopened, by Contracts and Procurement in the same condition as received if delivered prior to the date and closing time designated in the RFP. After the closing time, only the identity of each Proposer will be made public. If only one proposal is received in response to County request, Contracts and Procurement, in coordination with the agency requesting the project, may recommend entering into a contract to the single Proposer if the conditions cited above are met. Alternatively, Contracts and Procurement may re-solicit for the purpose of obtaining additional proposals.

J. Modifying or Withdrawing Proposals: Proposer may modify or withdraw their

proposals at any time prior to the closing time. Requests to modify a proposal before the closing time must be made in writing to the County.

K. Rejection of Proposals: Any proposal containing significant deviations from the

specifications of the RFP will be considered non-responsive and may be rejected in whole or in part.

L. Protests: Pursuant to Salt Lake County Code of Ordinances § 3.20.150, a protest

in regard to the RFP document must be submitted in writing prior to the RFP closing date. All other protests must be submitted in writing within five (5) business days after notification of the award is posted on Bid Sync. A protestor may file only one (1) protest after the RFP closing date. Protest letters must specifically and completely state the facts that the protestor believes constitute error in the RFP document or the award.

M. Free and Competitive Selection: Any agreement or collusion among prospective

Proposers to fix a price or limit competition will render the proposal void, and such conduct is unlawful and subject to criminal sanction. By submitting a proposal, the Proposer hereby certifies that no one in its firm or company has either directly or indirectly restrained free and competitive selection, participated in any collusion, or otherwise taken any action unauthorized by County Purchasing Ordinances or applicable law.

N. Ethical Standards: Proposer represents that it has not: (a) provided an illegal gift

to any County officer or employee, or former County officer or employee, or to any relative or business entity of a County officer or employee, or relative or business entity of a former County officer or employee; (b) retained any person to solicit or secure this contract upon an agreement or understanding for a commission, percentage, brokerage or contingent fee, other than bona fide employees of bona fide commercial agencies established for the purpose of securing business; (c) breached any of the ethical standards set forth in State statute or Salt Lake County Code of Ordinances § 2.07; or (d) knowingly influenced, and hereby promises that it will not knowingly influence, any County officer or employee or former County officer or employee to breach any of the ethical standards set forth in State statute or Salt Lake County ordinances.

O. Campaign Contributions: The Salt Lake County campaign finance disclosure ordinance limits campaign contributions by Proposers to County candidates. Salt Lake County Code of Ordinances § 2.72A. Proposer acknowledges and understands those limitations on campaign contributions mean that any person, business, corporation or other entity that enters into a contract or is engaged in a contract with County is prohibited from making campaign contributions in excess of $100 to County candidates during the term of the contract and during a single election cycle as defined in the ordinance. Proposer further acknowledges that violation of those provisions governing campaign contributions may result in criminal sanctions as well as termination of this Agreement.

P. Reasonable Accommodations: Reasonable accommodations for qualified

individuals to attend meetings may be provided upon receipt of a request with two (2) working days’ notice. Please contact Contracts and Procurement at 385.468.0306. TTY users may call 711.

Q. Environmentally Responsible Procurement Practices: In compliance with

Executive Order #2013-4, County has implemented environmentally responsible procurement practices. Please refer to Attachment D.

R. Notice to Retirees of Utah Retirement Systems (“URS”)

County is a URS “participating employer.” Entering into an agreement with County may affect a URS retiree’s retirement benefits including, but not limited to, cancellation of the retiree’s “retirement allowance” due to “reemployment”

with a “participating employer” pursuant to Utah Code Ann. § 49-11-504 to -505. In addition, Proposer is required to notify County immediately if a retiree of URS is the Proposer; or an owner, operator, or principal of the Proposer. Proposer may refer the URS retiree to the URS Retirement Department at 801-366-7770 or 800-695-4877 for all questions about post-retirement employment regulations.

S. Employee Status Verification System Proposer shall register and participate in the Status Verification System before entering into a contract with County as required by Utah Code Ann. § 63G-12-302. The Status Verification System is an electronic system operated by the federal government, through which an authorized official of a state agency or a political subdivision of the state may inquire by exercise of authority delegated pursuant to 8 U.S.C. § 1373 to verify the citizenship or immigration status of an individual within the jurisdiction of the agency or political subdivision. Proposer is individually responsible for verifying the employment status of only new employees who work under Proposer’s supervision or direction and not those who work for another Proposer or subcontractor, except each Proposer or subcontractor who works under or for another Proposer shall certify to the main Proposer by affidavit that the Proposer or subcontractor has verified, through the Status Verification System, the employment status of each new employee of the respective Proposer or subcontractor. The Proposer shall comply in all respects with the provisions of Utah Code Ann. § 63G-12-302. Proposer’s failure to comply with this requirement may result in the immediate termination of its contract with County.

XIV. INSURANCE REQUIREMENTS

Insurance will be required per the amounts listed below. Please refer to the attached sample agreement for information concerning insurance requirements. A. Workers’ compensation and employer’s liability insurance as required by the State of Utah. B. Commercial general liability insurance in the minimum amount of $500,000 per occurrence with a $1,000,000 general policy aggregate. C. Professional liability insurance in the minimum amount of $1,000,000 per occurrence with a $2,000,000 annual policy aggregate limit.

D. Commercial automobile liability insurance that provides coverage in the minimum amount of $100,000 per occurrence.

I. CHANGES FROM THE 2015 AMERICORPS GRANT PROVISIONS

For your convenience, we have identified changes from last year’s AmeriCorps State and

National grant provisions. The list below is general and informational in nature, not

comprehensive. We reiterate the importance of reviewing all award terms and conditions,

because recipients are responsible for knowing, understanding, and complying with all

award terms and conditions.

1. Updated references to AmeriCorps member “slots” to refer to “member

positions.”

2. Section III.B. – Included websites and social media where recipients

should use the AmeriCorps name and logo.

3. Section IV.A. – Added requirements related to AmeriCorps members

completing their own enrollment and exit forms on-line in the

MyAmeriCorps Member Portal.

4. Update the hyperlinks to the AmeriCorps State and National Policy

Frequently Asked Questions.

5. Section V.F. – Revised timekeeping systems to be compliant with

Regulations. Moved approvals of formula professional corps timekeeping

II. DEFINITIONS

A. Recipient, for the purposes of this agreement, means the direct recipient

of this award. The recipient is legally accountable to CNCS for the use of

award funds, or member positions, and is bound by the provisions of the

award. The recipient is responsible for ensuring that subrecipients or other

organizations carrying out activities under this award comply with all

applicable Federal requirements, including the CNCS General Terms and

Conditions, these specific terms and conditions, regulations applicable to

the program, and the NCSA.

B. Planning Grant, for the purposes of this agreement, is an award or

subaward for the planning of a national service program. State Service

Commissions may award planning grants as part of their Formula Cost

Reimbursement prime award. Planning grants do not include member

positions. Planning grants are awarded for a maximum of one year, and

may not exceed $75,000 per program.

C. Subrecipient refers to an organization receiving AmeriCorps award or

member positions from a recipient of CNCS funds. See 2 CFR § 200.93.

D. Operating site means the organization that manages the AmeriCorps

program and places members into service locations. State subrecipients

(programs) are operating sites. National recipients must identify at least

one operating site to which they can assign service locations in the state

where they are placing members.

E. Program refers to the activities supported under the award.

F. Service Location means the organization where or with which a member

actually provides his or her service in the community. Typical service

locations are schools, food banks, health clinics, community parks, etc.

The service location may be the same as the operating site, but only if the

member actually serves at or with the operating site organization. A

member may serve at multiple service locations, all of which must be

listed in the portal, although the program must select only one for the

member’s primary assignment.

G. Member or participant means an individual:

1. Who has been selected by a recipient or subrecipient to serve in an

approved national service position;

2. Who is a U.S. citizen, U.S. national, or lawful permanent resident

alien of the United States;

3. Who is at least 17 years of age at the commencement of service

unless the member is out of school and enrolled in a full-time,

year-round youth corps or full-time summer program as defined in

the NCSA (42 U.S.C. § 12572 (a)(3)(B)(x)), in which case he or

she must be between the ages of 16 and 25, inclusive, and

4. Who has received a high school diploma or its equivalent, agrees

to obtain a high school diploma or its equivalent (unless this

requirement is waived based on an individual education assessment

conducted by the program) and the individual did not drop out of

an elementary or secondary school to enroll in the program, or is

enrolled in an institution of higher education on an ability to

benefit basis and is considered eligible for funds under 20 U.S.C. §

1091 (See Section IX. B.).

H. NCSA means the National and Community Service Act of 1990, as

amended. See 45 U.S.C. §§ 12501-12657.

III. AFFILIATION WITH THE AMERICORPS NATIONAL SERVICE

PROGRAM

A. Identification as an AmeriCorps Program or Member. The recipient

shall identify the program as an AmeriCorps program and members as

AmeriCorps members. All agreements with subrecipients, operating sites,

or service locations, related to the AmeriCorps program must explicitly

state that the program is an AmeriCorps program and AmeriCorps

members are the resource being provided.

B. The AmeriCorps Name and Logo. AmeriCorps is a registered service

mark of CNCS. CNCS provides a camera-ready logo. All recipient and

subrecipient websites shall clearly state that they are an AmeriCorps

recipient and shall prominently display the AmeriCorps logo. Recipients

and subrecipients shall use the AmeriCorps name and logo on service gear

and public materials such as stationery, application forms, recruitment

brochures, on-line position postings or other recruitment materials,

orientation materials, member curriculum materials, signs, banners,

websites, social media, press releases, and publications related to their

AmeriCorps program in accordance with CNCS requirements.

To publicize the relationship between the program and AmeriCorps, the

recipient shall describe their program as “an AmeriCorps

program.” Recipients shall provide information or training to their

AmeriCorps members about how their program is part of the national

AmeriCorps program and about the other national service programs of

CNCS. Recipients are strongly encouraged to place signs that include the

AmeriCorps name and logo at their service sites and may use the slogan

“AmeriCorps Serving Here.” AmeriCorps members should state that they

are AmeriCorps members during public speaking opportunities.

The recipient may not alter the AmeriCorps logo, and must obtain written

permission from CNCS before using the AmeriCorps name or logo on

materials that will be sold, or permitting donors to use the AmeriCorps

name or logo in promotional materials. The recipient may not use or

display the AmeriCorps name or logo in connection with any activity

prohibited by statute, regulation, or CNCS General Terms and Conditions,

and these specific award terms and conditions.

IV. MEMBER RECRUITMENT, SELECTION, AND EXIT

Member recruitment and selection requirements are in CNCS’s regulations at 45

CFR §§ 2522.210 and Part 2540, subpart B. In addition, the recipient must ensure

that the following procedures are followed:

A. Notice to CNCS’s National Service Trust. The recipient must notify

CNCS’s National Service Trust, via the MyAmeriCorps Portal, within 30

days of a member’s start of, completion of, suspension from, or release

from, a term of service. Suspension of service is defined as an extended

period during which the member is not serving, nor accumulating service

hours or receiving AmeriCorps benefits. AmeriCorps members must

complete their own enrollment and exit forms on-line in the

MyAmeriCorps Member Portal. All competitive recipients and

subrecipients that wish to utilize staff Portal enrollments and exits without

members completing enrollment and exit forms must send a request to

their CNCS Program Officer. (Subrecipient requests should be submitted

by state commissions.) Requests will be approved in cases where the

recipient or subrecipient is able to demonstrate that technological

limitations make it impossible or extremely burdensome for members to

complete their own enrollment and exit forms in the Portal. Technological

limitations would include lack of internet access, computer, and/or cell

phone, or a member population with low computer literacy skills that

cannot be addressed through training or technical assistance. For formula

programs, state commissions may choose to review requests from their

subrecipients, consistent with the conditions outlined above, or they may

choose not to allow any subrecipients to use paper forms. Approved

waivers are valid for one-year only. Recipients are required to reapply for

a waiver each year as necessary.

The recipient also must notify the Trust, via the My AmeriCorps Portal,

when a change in a member’s term of service is approved and changed

(i.e. from full-time to less than full-time or vice versa). Failure to report

such changes within 30 days may result in sanctions to the recipient, up to

and including, suspension or termination of the award. Recipients or

subrecipients meet notification requirements by using the appropriate

electronic system to inform CNCS of changes within the required time

frames. Any questions regarding the Trust should be directed to the Trust

Office (800) 942-2677.

B. Parental Consent. Parental or legal guardian consent must be obtained

for members under 18 years of age before members begin a term of

service. Recipients may also include an informed consent form of their

own design as part of the member service agreement materials.

C. Reasonable Accommodation. Programs and activities must be accessible

to persons with disabilities, and the recipient must provide reasonable

accommodation to the known mental or physical disabilities of otherwise

qualified members, service recipients, applicants, and staff. All selections

and project assignments must be made without regard to the need to

provide reasonable accommodation. See the FAQ for more information:

D. Assigning Members to Service Locations. The recipient is required to

ensure that all operating sites and all service locations are entered in the

My AmeriCorps portal for all members within 30 days of members’

starting a term of service. The recipient is required to include the name of

the organization, and the full address or zip-plus-four of the service

locations where each member will be serving. If a member is serving at

multiple service locations, the program must select as the member’s

primary assignment the one where the member serves a majority of his or

her hours. However, all service locations must be listed in the portal.

E. Completion of Terms of Service. The recipient must ensure that each

member has sufficient opportunity to complete the required number of

hours of service to qualify for the education award. Members must be

exited within 30 days of the end of their term of service. If this award

expires or is not renewed, a member who was scheduled to continue in a

term of service may either be placed in another program, where feasible,

or if the member has completed at least 15% of the service hour

requirement, the member may receive a pro-rated education award.

F. Member Exit. In order for a member to receive an education award from

the National Service Trust, the recipient must certify to the National

Service Trust that the member satisfactorily and successfully completed

the term of service, and is eligible to receive the education benefit. The

recipient (and any individual or entity acting on behalf of the recipient) is

responsible for the accuracy of the information certified on the end-of-

term certification.

G. Penalties for false information: Any individual who makes a materially

false statement or representation in connection with the approval or

disbursement of an education award or other payment from the National

Service Trust may be liable for the recovery of funds and subject to civil

and criminal sanctions.

V. SUPERVISION AND SUPPORT

A. Planning for the Term of Service. The recipient must develop member

positions that provide for meaningful service activities and performance

criteria that are appropriate to the skill level of members. The recipient is

responsible for ensuring that the positions do not include or put the

AmeriCorps member in a situation in which the member is at risk for

engaging in any prohibited activity (see 45 CFR § 2520.65), activity that

would violate the non-duplication and non-displacement requirements (see

45 CFR § 2540.100), or exceeding the limitations on allowable

fundraising activity (see 45 CFR §§ 2520.40-.45). The recipient must

accurately and completely describe the activities to be performed by each

member in a position description. Position descriptions must be provided

to CNCS upon request. The recipient must ensure that each member has

sufficient opportunity to complete the required number of hours to qualify

for an education award. In planning for the member’s term of service, the

recipient must account for holidays and other time off, and must provide

each member with sufficient opportunity to make up missed hours.

B. Member Service Agreements. The recipient must require that each

member sign a member service agreement that includes, at a minimum,

the following:

1. Member position description;

2. The minimum number of service hours (as required by statute) and

other requirements (as developed by the recipient) necessary to

successfully complete the term of service and to be eligible for the

education award;

3. The amount of the education award being offered for successful

completion of the terms of service in which the individual is

enrolling;

4. Standards of conduct, as developed by the recipient or sub

recipient;

5. The list of prohibited activities, including those specified in the

regulations at 45 CFR § 2520.65 (see paragraph C, below);

6. The text of 45 CFR §§ 2540.100(e)-(f), which relates to Non-

duplication and Nondisplacement;

7. The text of 45 CFR §§ 2520.40-.45, which relates to fundraising by

members;

8. Requirements under the Drug-Free Workplace Act (41 U.S.C. §

701 et seq.);

9. Civil rights requirements, complaint procedures, and rights of

beneficiaries;

10. Suspension and termination rules;

11. The specific circumstances under which a member may be released

for cause;

12. Grievance procedures; and

13. Other requirements established by the recipient.

The recipient should ensure that the service agreement is signed before

commencement of service so that members are fully aware of their rights

and responsibilities.

C. Prohibited Activities. While charging time to the AmeriCorps program,

accumulating service or training hours, or otherwise performing activities

supported by the AmeriCorps program or CNCS, staff and members may

not engage in the following activities (see 45 CFR § 2520.65):

1. Attempting to influence legislation;

2. Organizing or engaging in protests, petitions, boycotts, or strikes;

3. Assisting, promoting, or deterring union organizing;

4. Impairing existing contracts for services or collective bargaining

agreements;

5. Engaging in partisan political activities, or other activities designed

to influence the outcome of an election to any public office;

6. Participating in, or endorsing, events or activities that are likely to

include advocacy for or against political parties, political

platforms, political candidates, proposed legislation, or elected

officials;

7. Engaging in religious instruction, conducting worship services,

providing instruction as part of a program that includes mandatory

religious instruction or worship, constructing or operating facilities

devoted to religious instruction or worship, maintaining facilities

primarily or inherently devoted to religious instruction or worship,

or engaging in any form of religious proselytization;

8. Providing a direct benefit to—

a. A business organized for profit;

b. A labor union;

c. A partisan political organization;

d. A nonprofit organization that fails to comply with the

restrictions contained in section 501(c)(3) of the Internal

Revenue Code of 1986 related to engaging in political

activities or substantial amount of lobbying except that

nothing in these provisions shall be construed to prevent

participants from engaging in advocacy activities

undertaken at their own initiative; and

e. An organization engaged in the religious activities

described in paragraph C. 7. above, unless CNCS

assistance is not used to support those religious activities;

9. Conducting a voter registration drive or using CNCS funds to

conduct a voter registration drive;

10. Providing abortion services or referrals for receipt of such services;

and

11. Such other activities as CNCS may prohibit.

AmeriCorps members may not engage in the above activities directly or

indirectly by recruiting, training, or managing others for the primary

purpose of engaging in one of the activities listed above. Individuals may

exercise their rights as private citizens and may participate in the activities

listed above on their initiative, on non-AmeriCorps time, and using non-

CNCS funds. Individuals should not wear the AmeriCorps logo while

doing so.

D. Supervision. The recipient must provide members with adequate

supervision by qualified supervisors consistent with the award. The

recipient must conduct an orientation for members, including training on

what activities are prohibited during AmeriCorps service hours, and

comply with any pre-service orientation or training required by CNCS.

The recipient must ensure that it does not exceed the limitation on member

service hours spent in education and training set forth in 45 CFR §

2520.50.

E. Performance Reviews. The recipient must conduct and keep a record of

at least a midterm and an end-of-term written evaluation of each member’s

performance for Full and Half-Time members and an end-of-term written

evaluation for less than Half-time members. The end-of-term evaluation

should address, at a minimum, the following factors:

1. Whether the member has completed the required number of hours;

2. Whether the member has satisfactorily completed assignments; and

3. Whether the member has met other performance criteria that were

clearly communicated at the beginning of the term of service.

F. Timekeeping. The recipient is required to ensure that time and attendance

recordkeeping is conducted by the AmeriCorps member’s supervisor.

This time and attendance record is used to document member eligibility

for in-service and post-service benefits. The recipient must have a

timekeeping system that is compliant with 2 CFR § 200.430.

If a Professional Corps program wants to follow the timekeeping practices

of its profession and certify that members have completed the minimum

required hours, excluding sick and vacation days, it must get advance

written approval from CNCS. If a State Commission Formula funded

Professional Corps program wants to follow the timekeeping practices of

its profession and certify that members have completed the minimum

required hours, excluding sick and vacation days, it must get advance

written approval from the State Commission.

G. Member Death or Injury. The recipient must immediately report any

member deaths or serious injuries to the designated CNCS Program

Officer.

VI. CHANGES IN MEMBER POSITIONS

A. Changes that Require CNCS Approval. Circumstances may arise

within a program that necessitate changing the type of unfilled

AmeriCorps member positions awarded to a recipient or subrecipient, or

changing the term of service of a currently enrolled member. Note that

once a member is exited with a partial education award, the remaining

portion of that education award is not available for use. The following

changes require written approval from CNCS’s Office of Grants

Management as well as written approval and concurrence from the State

Commission or Direct (including National Direct, State Direct, Tribal,

Territory Direct, or Education Award Only (EAP)) recipient:

1. A change in the number of member service year (MSY) positions

in the award; and/or

2. A change in the funding level of the award.

B. Changing Types of Unfilled member positions. Recipients or

subrecipients may change the type of member positions awarded to their

program if:

1. The change does not increase the total MSYs authorized in the

Notice of Grant Award (e.g. one half-time position cannot be

changed to one full-time position); and

2. The change does not result in an increase in the value of the

education award; and,

3. If the award is a Full-cost Fixed Amount or Professional Corps

Fixed Amount award, the member position will be filled by a

member serving in a full-time capacity.

Changes in types of member positions may be made by the recipient

directly in the My AmeriCorps Portal.

C. Changing a Term of Service for an enrolled Member. Changes in

terms of service for enrolled members may not result in an increased

number of MSYs for the program. With the exception of Education Award

only awards, recipients with Fixed Amount awards may not convert

members to less-than-full-time member positions. All changes to types of

member positions are subject to availability of funds in the Trust.

1. Full-time. State Commissions and National Direct Organizations

may authorize or approve occasional changes of currently enrolled

full-time members to less than full-time members. Impact on

program quality should be factored into approval of such requests.

CNCS-provided or funded health care or childcare costs are not

available for less than full-time members. Recipients and

subrecipients may not transfer currently enrolled full-time

members to a less than full-time status simply to provide the

member a less than full-time education award.

2. Less than Full-time. CNCS discourages changing less than full-

time members to full-time because it is very difficult to manage,

unless done very early in the member’s term of service. State

Commissions and Direct recipients (including National Direct,

State Direct, Tribal, Territory Direct, and Education Award Only

recipients) may authorize or approve such changes so long as their

current budget can accommodate such changes. Programs must

keep in mind that a member’s minimum 1700 hours must be

completed within 12 months of the member’s original start date.

3. Refilling Member Positions. With the exception of recipients

whose awards have special award conditions under 2 CFR §§

200.207 or 200.338, AmeriCorps State and National programs that

have fully enrolled their awarded member positions are allowed to

replace any member who terminates service before completing 30

percent of his/her term provided that the member who is

terminated is not eligible for and does not receive a pro-rated

education award. Programs may not refill the same member

position more than once.

As a fail-safe mechanism to ensure that resources are available in

the National Service Trust to finance all earned education awards,

CNCS will suspend refilling if either:

a. Total AmeriCorps enrollment reaches 97 percent of

awarded member positions; or

b. The number of refills reaches five percent of awarded

member positions.

4. Direct recipients may transfer refill member positions between

operating sites as long as they can ensure and document that the

same member position is not refilled more than once. Recipients

and subrecipients will require the assistance of a CNCS Program

Officer in order to transfer refill member positions between

operating sites. Refilled member positions may not be combined

with unfilled member positions.

D. Formula and State Competitive Award Member Position Transfers.

State commissions are allowed to transfer member positions among their

state formula and competitive subrecipients within a given prime grant in

order to maximize enrollment and cost effectiveness without prior

approval. State commissions may not transfer member positions between

competitive and formula subrecipients, or vice-versa. State commissions

may not transfer funds among their competitive subrecipients.

E. Notice to Childcare and Healthcare Providers. Recipients and

subrecipients must immediately notify CNCS’s designated agents, in

writing, when a Member’s status changes in a manner that affects their

eligibility for childcare or healthcare. See Section VIII.D.

VII. RELEASE FROM PARTICIPATION

Recipients may release members from participation for two reasons: (a) for

compelling personal circumstances; and (b) for cause. See 45 CFR § 2522.230 for

applicable requirements and 2 CFR § 200.333 for record retention requirements of

this documentation. In addition to the regulations, the following applies:

No Automatic Disqualification if Released for Cause: A release for cause

covers all circumstances in which a member does not successfully complete

his/her term of service for reasons other than compelling personal circumstances.

Therefore, it is possible for a member to receive a satisfactory performance

review and be released for cause. For example, a member who is released for

cause from a first term–e.g. the individual has decided to take a job offer–but

who-otherwise performed well-would, not be disqualified from enrolling for a

subsequent term as long as the individual received a satisfactory performance

evaluation for the first period of service.

VIII. LIVING ALLOWANCES, OTHER IN-SERVICE BENEFITS, AND TAXES

Requirements related to member living allowances and benefits are in 45 CFR §§

2522.240 and 2522.250. In addition, recipients must ensure that the following

procedures are followed:

A. Living Allowance Distribution. A living allowance is not a wage.

Recipients must not pay a living allowance on an hourly basis. Recipients

should pay the living allowance in regular increments, such as weekly or

bi-weekly, paying an increased increment only on the basis of increased

living expenses such as food, housing, or transportation. Payments should

not fluctuate based on the number of hours served in a particular time

period, and must cease when the member’s service ceases.

If a member serves all required hours and is permitted to conclude his or

her term of service before the originally agreed upon end of term, the

recipient may not provide a lump sum payment to the member. Similarly,

if a member is selected after the program’s start date, the recipient must

provide regular living allowance payments from the member’s start date

and may not increase the member’s living allowance incremental payment

or provide a lump sum to make up any missed payments.

Education Award Program Fixed Amount awards (EAPs) and Partnership

Challenge awards may provide a living allowance or other in-service

benefits to their members, but are not required to do so. Full-cost and

other Fixed Amount recipients must provide a living allowance to their

members.

B. Waiving the Living Allowance. If a living allowance is paid, a member

may waive all or part of the payment of a living allowance if he or she

believes his or her public assistance may be lost or decreased because of

the living allowance. Even if a member waives his or her right to receive

the living allowance, it is possible—depending on the specific public

assistance program rules—that the amount of the living allowance that the

member is eligible to receive will be deemed available. A member who

has waived the living allowance may revoke the waiver at any time and

may begin receiving the living allowance going forward from the date the

individual revoked the waiver. A member may not receive any portion of

the living allowance for the period of time the living allowance was

waived.

C. Taxes and Insurance.

1. Liability Insurance Coverage. The recipient is responsible for

ensuring adequate general liability coverage for the organization,

employees and members, including coverage of members engaged

in on- and off-site project activities.

2. FICA (Social Security and Medicare taxes). Unless the recipient

obtains a ruling from the Social Security Administration or the

Internal Revenue Service that specifically exempts its AmeriCorps

members from FICA requirements, the recipient must pay FICA

for any member receiving a living allowance. The recipient also

must withhold 7.65% from the member’s living allowance.

3. Income Taxes. The recipient must withhold Federal personal

income taxes from member living allowances, requiring each

member to complete a W-4 form at the beginning of the term of

service and providing a W-2 form at the close of the tax year. The

recipient must comply with any applicable state or local tax

requirements.

4. Worker’s Compensation. Some states require worker’s

compensation for AmeriCorps members. Recipients must check

with State Departments of Labor or state commissions to

determine worker’s compensation requirements. If worker’s

compensation is not required, recipients must obtain Occupational,

Accidental, and Death and Dismemberment coverage for members

to cover in-service injury or incidents.

D. Healthcare Coverage. Except for EAPs, Professional Corps, Partnership

Challenge awards, or members covered under a collective bargaining

agreement, the recipient must provide, or make available, healthcare

insurance to those members serving a 1700-hour full-time term who are

not otherwise covered by a healthcare policy at the time the member

begins his/her term of service. The recipient must also provide, or make

available, healthcare insurance to members serving a 1700-hour full-time

term who lose coverage during their term of service as a result of service

or through no deliberate act of their own. CNCS will not cover healthcare

costs for dependent coverage.

Less-than-full-time members who are serving in a full-time capacity for a

sustained period of time (e.g. a full-time summer project) are eligible for

healthcare benefits. Programs may provide health insurance to less-than-

full-time members serving in a full-time capacity, but they are not required

to do so. For purposes of this provision, a member is serving in a full-time

capacity when his/her regular term of service will involve performing

service on a normal full-time schedule for a period of six weeks or

more. A member may be serving in a full-time capacity without regard to

whether his/her agreed term of service will result in a full-time Segal

AmeriCorps Education Award.

Any of the following health insurance options will satisfy the requirement

for health insurance for full-time AmeriCorps members (or less than full-

time members serving in a full-time capacity): staying on parents’ or

spouse plan; insurance obtained through the Federal Health Insurance

Marketplace of at least the Bronze level plan; insurance obtained through

private insurance broker; Medicaid, Medicare or military

benefits. AmeriCorps programs purchasing their own health insurance for

members must ensure plans are minimum essential coverage (MEC) and

meet the requirements of the Affordable Care Act.

On Friday May 2, 2014 the U.S. Department of Health and Human

Services (HHS) announced a Special Enrollment Period (SEP) for

members in AmeriCorps State and National programs, who are not

provided health insurance options or who are provided short-term limited-

duration coverage or self-funded coverage not considered MEC. Members

in the AmeriCorps State and National programs and their dependents in

the Federally-facilitated Marketplace (FFM) are eligible to enroll in

Marketplace coverage when they experience the following triggering

events:

On the date they begin their service terms; and

On the date they lose any coverage offered through their program

after their service term ends. (Source: 45 CFR § 155.420(d)(9)).

Members have 60 days from the triggering event to select a plan.

Coverage effective date is prospective based on the date of plan selection.

If coverage is being provided via the Healthcare Marketplace, and thus

third party payment is not an option, programs must develop a process to

reimburse members for monthly premiums. Reimbursements for health

insurance premiums are considered taxable income for the member, and

programs must have a way to document such reimbursements.

E. Administration of Childcare Payments. In general, CNCS will provide

for childcare payments, which will be administered through an outside

contractor. Requirements and eligibility criteria are in the AmeriCorps

regulations, 45 CFR § 2522.250. Members serving in EAPs, Professional

Corps, or Partnership Challenge programs are not eligible for the childcare

benefit. CNCS will not cover childcare costs for members who served on

a less than full-time basis for a sustained period of time, or who have

ceased serving. Programs may provide child care to less-than-full-time

members serving in a full-time capacity, but they are not required to do so.

Recipients that choose to provide childcare and will claim the costs of

childcare as matching costs, as approved in their budget, may contact the

childcare contractor for technical assistance. The criteria for member

eligibility are contained in 45 CFR § 2522.250. Also see the FAQs,

information on administering childcare and healthcare benefits.

F. Notice to Childcare Providers. The recipient must notify CNCS’s

designated agents in writing within five business days after a member’s

status changes in a manner that affects the member’s eligibility for

childcare. After five days, the recipient will be liable for any erroneous

payments made to a childcare provider for an AmeriCorps member

ineligible to receive AmeriCorps childcare benefits. Examples of changes

in status include: changes to a member's scheduled service so that he/she

is no longer serving on a full-time basis, terminating or releasing a

member from service, and suspending a member for cause for a lengthy or

indefinite time period. Program directors should contact the childcare

provider on childcare related changes.

IX. MEMBER RECORDS AND CONFIDENTIALITY

A. Recordkeeping. The recipient must maintain records, including the

position description, sufficient to establish that each member was eligible

to participate and that the member successfully completed all program

requirements. A program may store member files electronically and use

electronic signatures if the program can ensure the validity and integrity of

the record and signature is maintained.

The program’s electronic storage procedures and system must provide for

the safe-keeping and security of the records, including:

1. Sufficient prevention of unauthorized alterations or erasures of

records;

2. Effective security measures to ensure that only authorized persons

have access to records;

3. Adequate measures designed to prevent physical damage to

records; and

4. A system providing for back-up and recovery of records; and

The electronic storage procedures and system provide for the easy

retrieval of records in a timely fashion, including:

1. Storage of the records in a physically accessible location;

2. Clear and accurate labeling of all records; and

3. Storage of the records in a usable, readable format.

B. Verification of Eligibility. Unless an individual’s social security number

and citizenship was verified through the My AmeriCorps Portal, the

recipient must obtain and maintain documentation as required by 45 CFR

§ 2522.200(c). CNCS does not require programs to make and retain copies

of the actual documents used to confirm age or citizenship eligibility

requirements, such as a driver’s license, or birth certificate, as long as the

recipient has a consistent practice of identifying the documents that were

reviewed and maintaining a record of the review.

Enrolling in the My AmeriCorps portal requires members to certify their

high school status. Such certification fulfills the recipient’s verification

requirement to obtain and maintain documentation from the member

relating to the member’s high school education. If the member is

incapable of obtaining a high school diploma or its equivalent, as

determined by an independent evaluation, the recipient must retain a copy

of the supporting evaluation.

C. Confidential Member Information. The recipient must maintain the

confidentiality of information regarding individual members. The recipient

must obtain the prior written consent of all members before using their

names, photographs and other identifying information for publicity,

promotional or other purposes. Recipients may release aggregate and

other non-identifying information, and are required to release member

information to CNCS and its designated contractors. The recipient must

permit a member who submits a written request for access to review

records that pertain to the member and were created pursuant to this

award.

D. National Service Criminal History Check. The specific requirements of

the National Service Criminal History Check, including the timing and

recordkeeping requirements, are specified at 45 CFR §§ 2540.200 - .207.

See also the final rule and the CNCS website for more information. You

must retain a record of the NSOPW search and associated results either by

printing the screen(s) or by some other method that retains paper or digital

images of the NSOPW checks, inclusive of the date record for when the

search was performed. Inability to demonstrate that you conducted an

NSOPW or the required criminal history check, as specified in the

regulations, may result in sanctions, including disallowance of all or part

of the costs associated with the non-compliance or other remedies that

may be legally available (see 2 CFR § 200.338).

X. BUDGET AND PROGRAMMATIC CHANGES

A. Programmatic Changes. The recipient must first obtain the prior written

approval of the AmeriCorps Program Office before making any of the

following changes (1-3):

1. Changes in the scope, objectives or goals of the program, whether

or not they involve budgetary changes;

2. Substantial changes in the level of member supervision;

3. Entering into additional sub awards or contracts for AmeriCorps

activities funded by the award, but not identified or included in the

approved application and award budget.

Upon notification to the AmeriCorps Program Office, recipients

may make programmatic changes due to, or in response to, an

officially-declared state or national disaster without written

approval from CNCS. As soon as practicable, recipients making

disaster-related programmatic changes must discuss the

recordkeeping, member activities, performance measure

adjustments, and other AmeriCorps award requirements with the

AmeriCorps Program Office. While written approval from CNCS

is not required before making disaster-related programmatic

changes, CNCS reserves the right to limit or deny disaster-related

programmatic changes.

B. Program Changes for Formula Programs. State Commissions are

responsible for approving the above changes for state formula programs.

C. Budgetary Changes. The recipient must obtain the prior written approval

of CNCS’s Office of Grants Management before deviating from the

approved budget in any of the following ways:

1. Specific Costs Requiring Prior Approval before Incurrence under

OMB Cost Principles 2 CFR Part 200, Subpart E. For certain cost

items, the cost principles require approval of the awarding agency

for the cost to be allowable. Examples of these costs are overtime

pay, rearrangement and alteration costs, and pre-award costs.

2. Purchases of Equipment over $5,000 using award funds, unless

specified in the approved application and budget.

3. Unless the CNCS share of the award is $100,000 or less, changes

to cumulative and/or aggregate budget line items that amount to 10

per cent or more of the total budget must be approved in writing in

advance by CNCS. The total budget includes both the CNCS and

recipient shares. Recipients may transfer funds among approved

direct cost categories when the cumulative amount of such

transfers does not exceed 10 percent of the total budget.

D. Approvals of Programmatic and Budget Changes. CNCS’s Grants

Officers are the only officials who have the authority to alter or change the

terms and conditions or requirements of the award. The Grants Officers

will execute written amendments, and recipients should not assume

approvals have been granted unless documentation from the Grants Office

has been received. Programmatic changes also require final approval of

CNCS’s Office of Grants Management after written recommendation for

approval is received from the Program Office.

E. Exceptions for Fixed Amount Awards. Recipients with Fixed Amount

awards are not subject to the requirements in Section C., Budgetary

Changes, above.

XI. REPORTING REQUIREMENTS

This section applies only to the recipient. The recipient is responsible for timely

submission of periodic financial and progress reports during the project period

and a final financial report and for setting submission deadlines for its respective

subrecipients that ensure the timely submission of recipient reports.

A. Recipient Progress Reports. The recipient shall complete and submit

progress reports in eGrants to report on progress toward achievement of its

approved performance targets.

B. Financial Reports. The recipient shall complete and submit financial

reports in eGrants (Financial Status Reports on menu tree) to report the

Cost reimbursement National Professional Corps recipients submit one

financial report per year.

All recipients, including Fixed Amount recipients, must submit the

Federal Financial Report (FFR) - Cash Transactions Report on a quarterly

basis to the Department of Health and Human Services Payment

Management System per the Electronic Funds Transfer Agreement.

C. Reporting Other Federal Funds. The recipient shall report the amount

and sources of federal funds, other than those provided by CNCS, claimed

as matching funds. This includes other federal funds expended by

subrecipients and operating sites and claimed as match. This information

shall be reported annually on the financial report due October 31st or at the

time the final financial report is submitted if the final report is due prior to

October 31st. Fixed Amount recipients are not required to report this

information.

D. Requests for Extensions. Each recipient must submit required reports by

the given dates. Extensions of reporting deadlines will be granted only

when 1) the report cannot be furnished in a timely manner for reasons, in

the determination of CNCS, legitimately beyond the control of the

recipient, and 2) CNCS receives a written request explaining the need for

an extension before the due date of the report.

Extensions of deadlines for financial reports may only be granted by the

Office of Grants Management, and extensions of deadlines for progress

reports may only be granted by the AmeriCorps Program Office.

E. Final Financial Reports. A recipient must submit, in lieu of the last

semi-annual financial report, a final financial report. This final report is

due no later than 90 days after the end of the project period.

F. Final Progress Reports. A recipient must submit, in addition to the last

semi-annual project report, a final project report. This final report is due

no later than 90 days after the end of the project period.

G. Financial Reports for Fixed Amount Awards. Fixed Amount recipients

are not required to submit financial reports to CNCS, including the final

financial report.

XII. AWARD PERIOD AND INCREMENTAL FUNDING

For the purpose of the award, a project period is the complete length of time the

recipient is proposed to be funded to complete approved activities under the

award. A project period may contain one or more budget periods. A budget

period is a specific interval of time for which Federal funds are being provided to

fund a recipient’s approved activities and budget.

Unless otherwise specified, the award covers a three-year project period. In

approving a multi-year project period, CNCS generally makes an initial award for

the first year of operation. Additional funding is contingent upon satisfactory

performance, a recipient’s demonstrated capacity to manage an award and comply

with award requirements, and the availability of Congressional appropriations.

CNCS reserves the right to adjust the amount of an award, or elect not to continue

funding for subsequent years. The project period and the budget period are noted

on the award document.

A planning grant covers a one-year project period.

XIII. PROGRAM INCOME

A. General. Income, including fees for service earned as a direct result of

the award-funded program activities during the award period, must be

retained by the recipient and used to finance the award’s non-CNCS share.

B. Excess Program Income. Program income earned in excess of the

amount needed to finance the recipient share must follow the appropriate

requirements of 2 CFR Part 200 and be deducted from total claimed costs.

Recipients that earn excess income must specify the amount of the excess

in the comment box on the financial report.

C. Fees for Service. When using assistance under this award, the recipient

may not enter into a contract for or accept fees for service performed by

members when:

1. The service benefits a for-profit entity,

2. The service falls within the other prohibited activities set forth in

these award provisions, or

3. The service violates the provisions of 42 U.S.C. § 12637 –

Nonduplication and Nondisplacement.

D. Full-Cost and Professional Corps Fixed Amount Awards and

Partnership Challenge Awards. The recipient must notify its Grants

Officer if it earns program income in excess of the amounts needed to

cover all expenditures under the award. The Grants Officer will determine

the disposition of the excess program income.

XIV. SAFETY

The recipient must institute safeguards as necessary and appropriate to ensure the

safety of members. Members may not participate in projects that pose undue

safety risks.

XV. NATIONAL SERVICE CRIMINAL HISTORY CHECK TRAINING

All recipients and subrecipients must complete CNCS NSCHC training every

year. The CNCS designated e-course provides a thorough overview of the

requirements and can be found at: http://cncstraining.articulate-

online.com/4240214797. Each recipient must identify at minimum one relevant

staff person to fulfill this requirement on behalf of the program. The program

must retain the certificate of completion and assign staff to retake the course

annually prior to the expiration of the certificate. Programs should save

certificates of completion from each year as part of grant record. For 2016,

recipients and subrecipients should complete this requirement and be certified by

December 31, 2016.

XVI. FIXED AMOUNT AWARDS

Fixed Amount awards are not subject to the cost principles in 2 CFR, Part 200,

Subpart E. Fixed Amount awards must comply with the remaining provisions of

2 CFR Part 200, including Subpart F relating to audit requirements. Fixed

Amount awards include Education Award program (EAP) Fixed Amount awards,

Professional Corps Fixed Amount awards, Full-Cost Fixed Amount awards, and

Partnership Challenge awards.

For Education Award programs (EAP), the fixed federal assistance amount of the

award is based on the approved and awarded number of full-time members

specified in the award. For full-cost and Professional Corps Fixed Amount

awards, the fixed federal assistance amount of the award is based on the approved

and awarded numbers of full-time members and the members’ completion of their

terms of service.

For EAPs, the final amount of award funds that the recipient may retain is

dependent upon the recipient’s notifying CNCS’s National Service Trust of the

members that it has enrolled. All EAP members must carry out activities to

Full-cost and Professional Corps programs may draw up to 20% of the funds

within the first two months to cover start-up costs (recruitment and application,

training, criminal history checks, etc.); however, total funds drawn should be

based on the number of members on board at the time and the percentage of hours

completed. Bi-annually, in some cases quarterly, and at closeout, CNCS will

calculate the final amount of the award for the year or entire project period (at

closeout) based on the number of successfully completed terms of service (as

certified by the program) as well as the hours served that were not certified as

successfully completed.

Partnership Challenge programs are awarded only member positions, but not

federal funds. Therefore, Partnership Challenge programs will not draw any

AmeriCorps Job Description

2016-2017 Program Year

Background and Purpose: Salt Lake County’s AmeriCorps Program places AmeriCorps members in community agencies who serve individuals and families who are or have been homeless. Many of them have lived on the streets or in refugee camps for years. They often have challenges with mental health and substance abuse. Because they have been or are homeless, they lack job experience and life skills to gain employment. The focus of the County’s AmeriCorps Program is on Economic Opportunity. One goal is helping individuals who are homeless get into safe, decent affordable housing and maintain their housing (housing stability). The other major goal is to improve the economic condition of individuals and families by providing activities that increase employable skills, help in securing employment and to access mainstream services which increase client assets and personal financial worth. To help with these efforts, AmeriCorps members will also work to recruit volunteers who can provide services and resources to individuals and families in the area of economic opportunity.

Provided here is a generic job description that will be used to focus the activities of the members as well as record their time in the on-lime time keeping system.

Activities

Housing Placement: identify individuals and families in need of housing. Interview clients to assess the type and need for housing. Record client information for tracking in the agency data base. Provide clients with information on housing opportunities. Explain the rules and requirements of housing. Work with landlords to identify housing opportunities. Provide assistance to help clients find, prepared applications and move into housing.

Housing Stability: Visit clients on a regular basis to assess housing stability. Develop working relationships with clients. Develop an individualized client self-sufficiency plan with goals. Based on assessments of client needs, refer clients to appropriate agencies for additional services such as mental health, substance abuse, public assistance, transportation and other supportive services. Communicate with property management staff to identify and reduce client problems. Act as an advocate for clients. Provide opportunities for clients to interact with others to foster healthy relationships and an overall positive housing experience through workshops, holiday celebrations, exercise groups, trips to local venues, trainings, etc.

Employment: Develop and provide opportunities for clients to gain additional skills and abilities to become employed. Prepare employment assessments and employment plans. Discuss short and long term goals for employment. Assist with gathering information and preparing resumes. Engage in one on one job coaching. Provide internet training opportunities for trainings to learn how to do job search. Develop and locate appropriate employment opportunities for clients. Arrange and/or escort clients to potential places of employments. Promote and conduct workshops, classes and programs on employment related activities.

Data and record keeping: Create and maintain individual client files and records for each client served and enter data on activities provided. Provide information on services provided for quarterly reports

Access mainstream Services: Perform or use data from client assessments to determine additional needs to maintain housing and/or secure employment. Based on assessment data refer clients to other agencies for services such as mental health, substance abuse, public assistance, social security disability, etc. Follow up on referrals. Work directly with clients in filling out paper work or attending meetings with client to become eligible for services. Act as an advocate for clients. Manage an active caseload of clients seeking mainstream services.

Volunteer Activities: Assist in the recruiting of volunteers and donated resources to help clients in their housing and employment activities. Assist in the management of volunteers to provide services to clients. Organize meaningful activities for clients that volunteers can provide. Develop systems to track the number of volunteers recruited and the hours of volunteer service provided.

Training: Attend weekly staff/staffing meetings and other meetings at the host site. Participate in agency training activities to increase knowledge and skills in delivering client services. Attend AmeriCorps orientation and training sessions as required. Participate in monitoring visits of the sites by County staff. Participate with other AmeriCorps members in service projects.

REQUIREMENTS If no offers are submitted claiming preferences(s), the solicitation will be awarded to the lowest or highest responsive, responsible bid as solicited or the highest scoring proposal. Environmental Compliance Practices Vendor Compliance Statement and Non-Debarment Certification

1. In compliance with Executive Order #2013-4, Salt Lake County has implemented

environmentally responsible procurement practices. The County requires all persons, businesses, corporations and other entities doing business or entering into a contract with the County to comply with all federal, state and local environmental laws, rules and regulations. Compliance with environmental laws, rules and regulations is a relevant factor in evaluating the integrity and responsibility of a business. The county, in its sole discretion, may not solicit proposals from, award contracts to, procure, or otherwise enter into business arrangements with any person, business, corporation or other organization that is noncompliant. If a vendor is suspended, proposed for debarment, debarred, ineligible or excluded from contracting with another government entity due to environmental non-compliance, the County in its sole discretion, may deem the vendor non-responsible and decline to award a contract.

AmeriCorps Program (Including funding provisions)

THIS AGREEMENT is made and executed as of the _______ day of

______________, 201__, by and between SALT LAKE COUNTY (“COUNTY”), a body corporate and politic of the State of Utah, by and through its Division of Community Resources and Development (“CRD”), and ________________ (“HOST ORGANIZATION”), collectively referred to herein as the “Parties.”

RECITALS

WHEREAS, COUNTY has entered into a grant agreement with the State of Utah to supervise within Salt Lake County an AmeriCorps Program (“Program”); and WHEREAS, the above-mentioned grant agreement authorizes COUNTY to contract with other entities, public or private, for services in support of the Program; and WHEREAS, the Parties intend to fully comply with the express and implied intent of the National and Community Service Act of 1990, 42 U.S.C. § 12501 et seq. (the “Act”), as well all applicable federal, state, and local statutes, ordinances, and regulations; and WHEREAS, HOST ORGANIZATION intends to transfer funds to COUNTY to assist COUNTY in administering the Program. NOW THEREFORE, by virtue of the authority recited and the mutual promises contained herein, the Parties agree as follows:

GENERAL PROVISIONS

1. Duration: This agreement shall be effective as of ____ through ____. 2. Jurisdiction: The provisions of this agreement shall be governed by the laws of

the State of Utah and the Ordinances of Salt Lake County, both as to interpretation and performance. All actions, including but not limited to court proceedings, administrative proceedings, arbitration and mediation proceedings, shall be commenced, maintained, adjudicated and resolved within the jurisdiction of Salt Lake County, State of Utah.

3. Conflict of Interest: HOST ORGANIZATION represents that none of its officers or employees are officers or employees of COUNTY unless such fact has been disclosed as required by the Utah Public Officers’ and Employees’ Ethics Act, § 67-16-1 et seq. (1953 as amended).

4. Termination: The parties may terminate their nonmonetary obligations under this

agreement at any time with or without cause by giving 30 days written notice to the other party. All outstanding accounts and payments will be processed according to the terms and arrangements set forth herein for approved services rendered as of the date of termination.

5. Separability Clause: A declaration by any court, or any other binding legal source,

that any provision of this agreement is illegal or void shall not affect the legality and enforceability of any other provision of this contract, unless such provisions are mutually dependent.

SPECIAL PROVISIONS

1. COUNTY’S DUTIES: COUNTY agrees to provide the services and resources

described in Attachment A and to comply with the requirements of the AmeriCorps Provisions set forth in Attachment C. Both attachments are incorporated and made a part of this Agreement.

2. HOST ORGANIZATION’S DUTIES: HOST ORGANIZATION agrees to

provide the services and resources described in Attachment B and to comply with the requirements of the AmeriCorps Provisions set forth in Attachment C. Both attachments are incorporated and made a part of this Agreement. HOST ORGANIZATION also agrees to utilize AmeriCorps Members in the manner and to further purposes described in HOST ORGANIZATION’s Proposal provided as Attachment D. All attachments are incorporated and made a part of this agreement.

ATTACHMENT A

COUNTY shall: (a) Provide ____ full time AmeriCorps Member(s) (“ACMs”) to serve on behalf of

HOST ORGANIZATION. (b) Provide for education awards to ACMs who fulfill their complete 1700 hours for

full time ACMs and 900 hours for part time ACMs within the service term, and receive satisfactory performance reviews.

(c) Provide program staff for consultation with HOST ORGANIZATION staff on

decisions or problems concerning ACMs. (d) Direct the Program by furthering recruitment, tutoring, and lawful services to

lower income groups as set forth in its AmeriCorps state application. (e) Provide program staff for overall supervision of ACMs including individual

conferences. (f) Maintain for three (3) years verifiable records documenting each ACM’s

eligibility to serve and any other information relating to each individual member. (g) Conduct criminal background checks prior to ACM placement on all ACMs who,

during the course of their service, will have substantial direct contact with children or who will perform service in the homes of children or individuals considered vulnerable, as determined by COUNTY, to the extent permitted by state and local law. COUNTY shall maintain the results of these background checks in the individual ACM files.

(h) Provide an orientation at the beginning of each ACM’s term of service. (i) Provide Worker’s Compensation Insurance for ACM’s as required by Utah Code

Ann. § 67-20-3(1). (j) Provide liability insurance for ACMs, which covers both on-site and off-site

Project activities. (k) Consult with, prior to ACM placement, local labor unions which represent

employees of HOST ORGANZIATION or employees in the area served by the Program to insure compliance with the non-displacement requirements set forth by federal regulation.

(l) Allow ACMs who have served for at least twelve (12) months and 1250 hours to

take leave in accordance with the Family and Medical Leave Act.

HOST ORGANIZATION shall: (a) Provide COUNTY with $____ in consideration of the services provided by

COUNTY to HOST ORGANIZATION (including but not limited to the services set forth in Attachment A) to offset COUNTY’s costs associated with administering the Program. COUNTY will bill HOST ORGANIZATION quarterly for such funds.

(b) Provide the funds as set forth in subsection (a) of this attachment even if HOST

ORGANIZATION terminates this agreement pursuant to Section 4 of the General Provisions contained in this agreement. COUNTY has no obligation to refund any funds on a pro rata, or any other, basis in the event of such termination by HOST ORGANIZATION.

(c) HOST ORGANIZATION agrees not to hire any AmeriCorps members to work at

their agency until said member or members have completed their terms of service. (d) Provide the funds as set forth in subsection (a) of this attachment even if one, or

more, of the ACMs assigned to work for HOST ORGANIZATION terminates his or her relationship with the Program. If one, or more, of the ACMs assigned to perform services for HOST ORGANIZATION does terminate his or her relationship with the Program, COUNTY will have no obligation to replace such ACM.

(e) Maintain accurate time records and forward copies of each ACM’s time records to

COUNTY on a timely basis. (g) Provide day-to-day supervision for the ACMs. (h) Release ACMs from routine duties to attend special events, workshops, or

training planned for them by AmeriCorps staff.

(i) Prevent ACM’s from the following activities (i) Supplantation. Assistance may not be used to replace State and local public funds that had been used to support programs of the type eligible to receive support. For any given program, this condition will be satisfied if the aggregate non-Federal public expenditure for that program in the fiscal year that support is to be provided is not less than the previous fiscal year. (ii) Religious use. Assistance may not be used to provide religious instruction, conduct worship services, or engage in any form of proselytization.

(iii) Political activity. Assistance may not be used by program participants or staff to assist, promote, or deter union organizing; or finance, directly or indirectly, any activity designed to influence the outcome of a Federal, State, or local election to public office. (iv) Contracts or collective bargaining agreements. Assistance may not be used to impair existing contracts for services or collective bargaining agreements. (v) Nonduplication. Assistance may not be used to duplicate an activity that is already available in the locality of a program. And, unless the requirements of this paragraph are met, assistance will not be provided to a private nonprofit entity to conduct activities that are the same or substantially equivalent to activities provided by a State or local government agency in which such entity resides. (vii) Nondisplacement.

(1) An employer may not displace an employee or position, including partial displacement such as reduction in hours, wages, or employment benefits, as a result of the use by such employer of a participant in a program receiving Assistance.

(2) An organization may not displace a volunteer by using a participant in

a program receiving Assistance. (3) A service opportunity will not be created under this chapter that will

infringe in any manner on the promotional opportunity of an employed individual. (4) A participant in a program receiving Assistance may not perform any

services or duties or engage in activities that would otherwise be performed by an employee as part of the assigned duties of such employee.

(5) A participant in any program receiving assistance under this chapter

may not perform any services or duties, or engage in activities, that:

(i) Will supplant the hiring of employed workers; or (ii) Are services, duties, or activities with respect to which an

individual has recall rights pursuant to a collective bargaining agreement or applicable personnel procedures.

(6) A participant in any program receiving assistance under this chapter

may not perform services or duties that have been performed by or were assigned to any:

(i) Presently employed worker; (ii) Employee who recently resigned or was discharged;

(iii) Employee who is subject to a reduction in force or who has recall rights pursuant to a collective bargaining agreement or applicable personnel procedures;

(iv) Employee who is on leave (terminal, temporary, vacation,

emergency, or sick); or (v) Employee who is on strike or who is being locked out.

(j) Not require or permit ACMs, during the course of their service, to:

(1) Engage in efforts to influence legislation;

(2) Organize or engage in protests, petitions, boycotts, or strikes;

(3) Assist, promote, or deter union organizing;

(4) Impair existing contracts for services or collective bargaining agreements;

(5) Engage in partisan political activities or other activities designed to influence the outcome of an election;

(6) Participate in, or endorse, events or activities that are likely to include advocacy for or against political parties, political platforms, political candidates, proposed legislation, or elected officials;

(7) Engage in religious instruction, conduct worship services, or provide any direct benefit to religious activities unless grant funds are not used to support the religious activity; or,

(8) Engage in any organized fund raising including, but not limited to, financial campaigns, endowment drives, solicitation of gifts and bequests, and similar activities designed for the sole purpose of raising capital or obtaining contributions for HOST ORGANIZATION unless COUNTY determines, and approves in writing, that such activity complies with the AmeriCorps regulations.

(k) Indemnify, defend, and hold COUNTY harmless for any injuries or damages

arising out of HOST ORGANIZATION’S acts or failure to act. (l) Ensure the safety of all ACMs and prevent ACMs from participating in projects

that pose undue safety risks. (m) HOST ORGANIZATION shall comply with applicable uniform administrative

requirements, cost principles, and audit requirements as described in 2 CFR 200, the “Super Circular.” The Super Circular supersedes and consolidates the

requirements from OMB Circulars A-21, A-50, A-87, A-89, A-102, A-110, A-122, and A-13.

(n) COUNTY may also suspend or terminate this Agreement, in whole or in part, in accordance with the provisions of 2 CFR Sections 338 - 342, if HOST ORGANIZATION materially fails to comply with any term of this Agreement, or with any of the rules, regulations or provisions referred to herein; and COUNTY may declare HOST ORGANIZATION ineligible for any further participation in COUNTY’s contracts, in addition to other remedies as provided by law.

(o) HOST ORGANIZATION shall register and participate in the Status Verification

System before entering into a contract with the county as required by Utah Code Section 63G-12-302(3). The Status Verification System is an electronic system operated by the federal government through which an authorized official of a state agency or a political subdivision of the state may inquire by exercise of authority pursuant to 8 U.S.C. §1373 to verify the citizenship or immigration status of an individual within the jurisdiction of the agency or political subdivision. HOST ORGANIZATION is individually responsible for verifying the employment status of only new employees who work under the contractor’s supervision or direction and not those who work for another contractor or subcontractor, except each contractor or subcontractor who works under or for another contractor shall certify to the main contractor by affidavit that the contractor or subcontractor has verified, through the Status Verification System, the employment status of each new employee of the respective contractor or subcontractor. HOST ORGANIZATION shall comply in all respects with the provisions of Utah Code Section 63G-12-302(3). Failure to so comply on the part of the contractor may result in the immediate termination of its Agreement with COUNTY.

(p) Should members need to use their private vehicles for travel related to their duties HOST ORGANIZATION will provide mileage reimbursement.
