SOUTH DAKOTA HIGH SCHOOL ACTIVITIES ASSOCIATION REGULAR MEETING OF THE BOARD OF DIRECTORS
SDHSAA OFFICE BUILDING February 27th, 2019 10:30 AM Pierre, South Dakota The Board of Directors held a regular meeting on February 27, 2019, at the SDHSAA Office Building in Pierre, South Dakota with members present as follows: Dr. Brian Maher Dr. Jerry Rasmussen Steve Morford Randy Soma Moe Ruesink Craig Cassens David Planteen Silas Blaine Staff members present included Dr. Dan Swartos, Jo Auch, John Krogstrand, Brooks Bowman, and Isaac Jahn. The meeting was called to order by Chairman Dr. Brian Maher at 10:30 AM, followed by the pledge of allegiance. Item #1-Approval of Agenda Motion by Moe Ruesink, second by Dr. Jerry Rasmussen, to approve the agenda as amended, with item #5D removed. Motion carried 8-0. Item #2-Open Forum Dr. Maher opened the public forum portion of the meeting. Mrs. Stephanie Ornelas (Spearfish Athletic Director) spoke to the Board regarding the advisory process. Mr. Todd Palmer (Sturgis Brown Athletic Director) spoke to the Board regarding the AA basketball schedule proposal submitted by the basketball advisory. Item #3- Approval of the minutes from the regular meeting held January 16, 2019. Motion by David Planteen, second by Randy Soma, to approve the January 16, 2019 minutes as presented. Motion carried 8-0. Item #4- Approval of Finance Reports SDHSAA Finance Director Isaac Jahn reported on the income statements and balance sheets for January of 2019, as well as the cash flow report. Brad Reinke presented Reinke Gray report. Isaac Jahn reported on the annual audit and preseted the Board with the DLA Audit Engagement Letter. Motion by Moe Ruesink, second by Steve Morford, to approve the Finance Reports as presented. Motion Carried 8-0.
Item #5- Consent Agenda The consent agenda contained the following items:
• Approval of January 2019 vouchers paid in the amount of $205,506.09. • Penalty to Sturgis Brown High School for an out of season violation in the sport of Boys Soccer. • Request from Bon Homme High School to petition up to Class A in all Fine-Arts Activities. • Requests from Tiospa Zina High School, Parkston High School, and Groton High School to petition up to Class A
in the sports of Boys and Girls Golf. • Requests from Lennox High School and Chamberlain High School to petition up to Class A in the sport of
Wrestling. • Requests from Woonsocket/Wessington Springs/Sanborn Central and Aberdeen Roncalli High School to petition
up to Class 11B in the sport of Football.
Motion by Steve Morford, second by David Planteen, to approve the consent agenda as presented. Motion carried 8-0. Item #6- Reports The Board heard reports on the following:
• State One Act Festival from Brooks Bowman • State Gymnastics from Jo Auch • State Wrestling from John Krogstrand • Site Selection Committee from Dan Swartos • Basketball, In/Out of Season, Gymnastics, Wrestling, and Football Advisory committees from SDHSAA staff
The Board heard further reports as follows: • Open SDHSAA Board Positions in 2019-20 from Dr. Swartos. Nominations for the following positions will be
accepted at the Annual Meeting in April: o West River At-Large (Athletic Director) o Large School Board of Education
§ SF Roosevelt to Pierre TF Riggs (1,749.230 to 561.565 ADM) § Brookings and Sioux Falls not eligible due to current Board representation § This is a 4 year position, filling the vacated position of Dr. Paul Turman of Pierre TF Riggs
o Native American Representative (Principal) § At least 50% Native American enrollment per SDDOE reporting § Includes the schools of Crazy Horse, Lower Brule, St. Francis, Takini, Tiospa Zina, Tiospaye Topa,
Pine Ridge, Crow Creek, Little Wound, Marty, Flandreau Indian, Todd County, Wakpala, McLaughlin, Oelrichs, Red Cloud, Dupree, White River, Andes Central, Waybay, Wagner, Timber Lake, Sisseton, and Bennett County
• SDHSAA Board Goals update from Dr. Swartos • There were no reports from the SDHSAA Foundation or the SDSSA
Dr. Maher declared the Board in recess at 11:44 AM and out of recess at 11:52 AM Item #7- Conduct first reading of Region Alignments in all Athletic Activities for 2019-20 and 2020-21 Motion by Dr. Jerry Rasmussen, second by Craig Cassens, to approve a first reading of the region alignments in all Athletic activities for 2019-20 and 2020-21. Motion carried 8-0. * Proposed Athletic Alignments found in Appendix A
Item #8- Conduct first reading of District & Region Alignments in all Fine Arts activities for 2019-20 and 2020-21 Motion by Steve Morford, second by David Planteen, to approve a first reading of the District and Region alignments in all Fine Arts activities for 2019-20 and 2020-21. Motion carried 8-0. * Proposed Fine Arts Alignments found in Appendix B Item #9- Conduct First Readings of proposed SDHSAA Constitutional changes by SDHSAA Board or Staff Motion by Randy Soma, second by Dr. Rasmussen, to approve the first reading of a change to Chapter II, Part I, Section 9 of the SDHSAA By-Laws (Student/Coach Ejection from a Contest) Motion carried 8-0. * Proposed Constitutional Change found in Appendix C Item #10- Consider agreement with Alliance Highway Safety/drivesafesd.com Motion by Silas Blaine, second by Steve Morford, to approve the proposed agreement with Alliance Highway Safety/drivesafesd.com Motion carried 8-0. Item #11- Set Dates and Times for 2019-20 Board of Directors Meetings Motion by Randy Soma, second by Silas Blaine, to approve the 2019-20 Board of Directors dates and times as amended, moving the first meeting to NFHS Week 6. Motion Carried 8-0. * Proposed Dates and Times are found in Appendix D Item #12- Approve committee to Review the State Event Broadcast RFP Motion by Moe Ruesink, second by David Planteen, to approve the formation of a committee to review the State Event Broadcast RFP document. Motion carried 8-0. Item #13- Consider a Coporate Sponsorship Renewall with Billion Automotive Motion by David Planteen, second by Dr. Jerry Rasmussen, to approve, with thanks, a one-year corporate sponsorship renewal with Billion Automotive. Motion carried 8-0. Item #14- State Football Championship Venue Dr. Swartos and John Krogstrand reported on facility concerns for State Football in 2019. The Dakota Dome has begun renovations to the west side of the facility, which raise logistical concerns for the state football championships. Possible solutions discussed included reducing the number of comp passes given to participating schools, playing AA and AAA in one location and all other games in the Dakota Dome, and moving the State Championships to another venue for 2019. Staff recommendation was to move the event to South Dakota State University for 2019. Motion by Steve Morford, second by Moe Ruesink, to authorize SDHSAA staff to negotiate a contract with SDSU for use of Dana J. Dykhouse stadum for the 2019 State Football Championships, and to formalize deviation from the current contract with The University of South Dakota. Motion carried 8-0. Item #15- Update on 2019 Legislation Dr. Swartos briefed the Board on legislative issues from the current session that relate to SDHSAA.
Item #16- Board Sharing David Planteen thanked Dr. Swartos for his updates during the legislative session. Randy Soma thanked everyone who assisted with the State Gymnastics Meet in Brookings. Steve Morford commended the entire crew for a great state wrestling tournament. Dr. Maher declared the Board in recess for lunch at 1:06 PM and out of recess at 1:34 PM. Item #17- Executive Session per SDCL 1-25-2(1) Motion by Randy Soma, second by Silas Blaine to enter into executive session per SDCL 1-25-2(1). Motion carried 8-0. Dr. Maher declared the Board in Executive Session at 1:34 PM and out of Executive Session at 1:50 PM. Item #18- Adjourn Motion by Craig Cassens to adjourn. There being no further business, Dr. Maher declared the meeting adjourned at 1:51 PM. Respectfully submitted,

32 Appendix C- Proposed Constitutional Change PROPOSED CONSTITUTIONAL AMENDMENT SDHSAA FOOTBALL ADVISORY COMMITTEE Amend the SDHSAA Constitution and Bylaws as follows (new language in red underline): Chapter II – Bylaws for Athletics; Part I – Further Eligibility Requirements for Athletic Contests; Section 9. Student/Coach Ejection from a Contest. SECTION 9. STUDENT/COACH EJECTION FROM A CONTEST. Any student or coach ejected from an interscholastic contest by game officials will be ineligible for the next regularly scheduled contest at that level of competition and all other contests in the interim at any level of competition. In the sport of football only, any player ejected/disqualified for specifically violating the provisions of “Illegal Personal Contact” as outlined in Rule 9-4-3 of the NFHS Football Rules:
(a) Shall be disqualified only for the remainder of the current game if the foul occurs in the first half of a game, or,
(b) Shall be disqualified from the remainder of the current game, as well as the first half of the next varsity contest, if the foul occurs in the second half of a game.
A second ejection that occurs during the same sport season shall cause that coach or athlete to be ineligible for the next four regularly scheduled contests at that level of competition and all other contests in the interim at any level of competition. A third ejection… Rationale: The intent of this rule is to provide a lesser penalty for in-game contact fouls that may or may not be adjudicated properly by contest officials. NFHS Rule 9-4-3 allows for the ejection of a player when flagrant personal contact acts occur, such as targeting or a blindside block. The intention is to reduce what can be an ejection that requires a sit-out of nearly 25% of an athlete’s season for plays that, while should be taken out of the game, remain difficult to officiate. Of note, acts such as fighting, contacting a game official, and other heinous acts are not given leeway by this rule, and would still require the two-game sit-out. NFHS Rule 9-4-3 more generally references acts that are more germane to actual football plays; this rule change would allow our officials, coaches and administrators a bit of a reprieve when dealing with an ejection for what may or may not have been a “football play.” The penalty structure mirrors what is currently in place in the NCAA, but remains more strict on unsportsmanlike or other conduct issues.
