1. Please indicate prorata break up details of all identifiable items of supply of Stores and ITC/ETC cost in proforma as noted above.

2. The statutory charges like Excise Duty, VAT/Sale Tax, Service Tax etc which will not be borne by the

bidder must be indicated with % rates as applicable in column 5 above, failing which this Organization will not be liable for payment of any such charges.

3. State Entry Tax, Toll Tax and other taxes which are collected by statutory bodies on the way during transportation of materials shall not be included in the price bid. These taxes, if paid, may be reimbursed as per actual on claim with original receipt of payment.

SCOPE OF WORK AND SPECIFICATIONS ENCLOSED IN SECTION-I

CONSIGNEE: DEPUTY DIRECTOR GENERAL (ENGINEERING)/ INSTALLATION OFFICER,

AIR, KADAPA, ANDHRA PRADESH.

2. The quotation should specifically mention Make & Type of the items, delivery date, terms

and condition of supply. The prices given should be firm and as under. (a) The prices quoted shall remain fixed during the entire period of supply/contract and

shall not be subject to variation on any account. A bid submitted with an adjustable price

quotation is likely to be treated as non responsive and rejected.

(b) The ‘Unit’ Price should be for the Unit as indicated in the tender enquiry.

(c) Prices quoted should be for F.O.R. Station of destination in India and Inclusive of charges as packing customs, etc., wherever applicable.

(d) The quotation should specifically mention rates for Supply, Installation charges

& Taxes separately.

3. In case of Quotation of F.O.R Station of dispatch basis, the purchaser will not pay

separately transit insurance and the supplier will be responsible until the stores arrive in

good condition at the destination. Tender/quotation in which transit insurance has been

specified as an additional item of expenditure is liable to be ignored.

4. The tender shall consist of three parts (bids) namely:

(a) EMD: Earnest Money amounting to Rs.16,000/- [Rupees Sixteen Thousand Only] in

the form of Demand Draft on Nationalized Bank / Commercial Bank drawn in favour of

The ADG (E) (SZ), AIR & DD, Chennai-5 should accompany the tender. Tenders without

EMD shall be summarily rejected and their bid will not be opened at the time of tender opening and shall be rejected as non responsive at the bid opening stage and returned to

the bidder unopened [EMD exemption is applicable for those who are registered with the

Central Purchase Organization, National Small Industries Corporation (NSIC) or the

Concerned Ministry or Department [ MIB / DG:AIR / DG:DD].

(b) TECHNICAL BID: Technical bid should contain the confirmation to the enclosed Technical Specifications. This should be submitted in a separate sealed envelope with

“TECHNICAL BID” written on it.

(c) COMMERCIAL BID: The commercial bid should contain the price bid and acceptance of

the commercial terms and conditions of this tender document. The price should be quoted for free delivery of materials at respective destinations. This should be submitted

in a separate sealed envelope with “The tenders will be submitted in sealed envelopes

with the name of work, date of opening and the bid enclosed written on the envelopes.

The above mentioned envelopes should be enclosed and submitted in another large size

envelope duly sealed and super scribed with SITC of 22 TR Packaged Air-Cooled AC Plant by replacing the existing Plant at AIR, Kadapa, Andhra Pradesh “ and date of

opening. The envelope will be received at this office of The ADG(E) (SZ), AIR & TV, Swamy

Sivananda Salai, Chennai-5 up to 1230 hrs. on 2.1.2013 . The technical bid and E.M.D.

will be opened on the same day at 1500 hrs.

The opening of Commercial Bid will be notified after recommendation of Technical Evaluation Committee.

In case tender opening date falls on a holiday, the bids will be received and opened at the

same specified time on next working day. Bids received late or submitted after the

scheduled specified time on scheduled date will not be entertained and will be returned back unopened. The purchaser may, at his discretion extend the deadline for the

submission of the bids by amending the bid document , in which case all rights and

obligations of the purchaser and bidders previously subject to then deadline will

thereafter be subject to the deadline as extended.

Tenderer should quote for all the required items. Partial tenders will be rejected. ( d) SECURITY DEPOSIT:

The successful Tenderer shall furnish the Security Deposit within 2 weeks after

placement of order at the rate of 5% of the Order Value, failing which the EMD will be

forfeited automatically, to President of India, without any notice. The security

deposit shall be furnished in the form of Demand Draft / Bank Guarantee drawn in

favour of The ADG (E) (SZ), AIR & DD, Chennai-5. The Security Deposit will be returned in full on completion of successful Guarantee/Warranty Period.

5. TAXES:

a. Payment o f Entry Tax / Octro i Duty and Toll Tax (on ultimate products). As the material, which is to be transported to the consignee, belongs to the Government of

India / Prasar Bharati and therefore is exempted from Entry Tax / Octroi Duty /

Toll Tax. However, if the State Governments / Statutory Local Bodies are bound to

levy such taxes, the taxes will be paid by supplier / contractor. Supplier / Contractor

may raise its claim, for reimbursement of such duties / taxes paid, with

Organisation, along with original receipt of the payment.

b. Sales Tax / Service Tax leviable and intended to be claimed from the purchaser should be

distinctly shown along with prices quoted. Where this is not done no claim for Sales Tax

/ Service Tax will be admitted at any later stage and on any ground whatsoever.

* Please note that this Office will not issue any Form such as ‘C’, ‘D’ etc.

6. Printed terms and conditions of tendering firms will not be considered as forming parts of their tender.

7. GUARANTEE / WARRANTY PERIOD: The Equipment / Work shall be guaranteed

against any Manufacturing defects for a period of 1 Year from the date of

commissioning. Any parts failing during the Guarantee period shall be repaired /

replaced free of charge by the supplier at the Sites.

8. DELIVERY OF STORES: The delivery of the entire Equipment at AIR’s site shall be

completed within Two Months from the date of placement of order. Delivery period may

also be quoted separately.

9. TERMS OF PAYMENT:

a. 80% of the contract price for the equipments/materials inclusive of Excise

Duty and Sales Tax shall be paid on initial inspection and delivery of equipments at site

in good condition.

b. 20% of the contract price for the equipments/materials and 100% of

Installation charges with Service Tax, on satisfactory completion of Installation, Testing, Commissioning and Handing over.

10. The quotation should be sent in a sealed cover addressed to the undersigned, by

name, so as to reach on or before 2.1.2013, 12.30 P.M.

THE COVER SHOULD BE SUPERSCRIBED WITH THE FOLLOWING:

a. Material for which quotations are enclosed.

b. Reference to letter of enquiry.

c. Due date of opening quotation.

11. The Quotations will be opened in this office at 3.00 P.M. on 2.1.2013in the presence of tenderers or their agents such as they may choose to attend.

12. QUOTATIONS NOT PROPERLY SUPERSCRIBED WILL NOT BE CONSIDERED.

13. The quotations submitted shall remain open for acceptance for a period of 90 (Ninety) days from the date of opening of the Tender. If any Tenderer/ Suppliers withdraws his

Tender/Quotation before the said period or makes any modifications in the Terms &

Conditions on the Tender/Quotation which are not acceptable to the Department, then

the Government shall, without prejudice to any other right or remedy, be at the liberty to

forfeit 50% of the Earnest Money as aforesaid.

14. Both your PAN - Permanent Income Tax Account Number and Income Tax Circle &

your TIN - Tax Identification Number and the Tax circle& Service Tax Registration

Number with details should be definitely indicated in your quotation.

15. In case of supply of any Specific or Manufacturer item, the Manufacturer’s Test Certificate/preferably from MSME, should be enclosed with the supply. The Goods are

subjected to Inspection before acceptance. The date of Inspection of may be intimated

to this Office before dispatch to the consignee.

16. RIGHT OF ACCEPTANCE:

The undersigned reserves the right to reject the lowest tender or all the tenders without assigning any reasons whatsoever. Further, the undersigned reserves himself the right to

increase or decrease up to 50% of the quantity of goods and services specified in the

schedule of the requirement without any change in the unit price of the order quantities

or other term conditions at the time of award of contract. All Quotations/Tenders in

which any of the prescribed conditions are not fulfilled or are incomplete in any respect

are liable to be rejected. The competent authority on behalf of President of India reserve himself the right of accepting the whole or any part of the Tender shall be bound to

perform the same at the rate quoted.

17. Canvassing whether directly or indirectly, in connection with Tender/quotation is strictly

prohibited and the Tender/quotation submitted by the Contractors / suppliers who

resort to canvassing will be liable to rejection.

18. The undersigned also reserves the right to place Repeat Order up to 50% of the quantity of goods and services contain in the running tender / contract within a period of 6

months from the date of order/ agreement at the same rate.

19. LANGUAGE / UNITS: All information supplied by the Tenderer & all markings, notes,

designation on the drawings & associated write-ups shall be in “English language" only. All dimensions, units on drawings, all references to weights, measures & quantities shall

be in MKS.

20. In case this is second enquiry, your Quotation in response to the first enquiry should be

presumed to be valid up to 120 days from the last date mentioned in para 11 above

unless we hear from you.

21. EXPERIENCE: The tenderer should give documentary proof for having successfully

designed. Fabricated, installed and commissioned similar type of equipment/work. They should also submit list of works which are in hand at the time of submission of tender.

The list shall contain the name of work, cost of work and present position of work.

22. AFTER SALES SERVICE:-

The Tenderer should give full details of after sales service capability. The locations of

service centers across the country shall be indicated. If there is no service centers at/ near the location of the site the tender is likely to be rejected.

23. TECHNICAL SPECIFICATION AND GENERAL TERMS AND CONDITIONS:-

For Technical Specification and other General Terms and Conditions see the

Annexures. The tenderer should submit necessary pamphlets description of items being offered along with technical bid and also the firms to which similar items

were supplied in the near past and completion report.

24. FAILURE AND TERMINATION CLAUSE

Time and date of delivery shall be essence of the contract. If the Contractor / Supplier fails to deliver the stores / execute SITC / SETC, or any installment

there of within the period fixed for such delivery in the schedule or at any time

repudiates the contract before the expiry of such periods, the purchaser may without

prejudice to any other right or remedy, available to him to recover demurrages for

breach of the contract:-

(a) Recover from the Supplier/Contractor as agreed, liquidated demurrages including

Administrative expenses and not by way of penalty, a sum equivalent to 0.5% per week

up to maximum limit of 10% of the contract value for such delay or part thereof

(this is an agreed, genuine pre-estimate of demurrages duly agreed by the parties)

which the supplier/contractor has failed to deliver thereof is accepted after expiry of the aforesaid period, provided that the total demurrages so claimed shall not

exceed 10% of the contract price of the stores / SITC / SETC. After full period of

extension, termination of the contract will be considered by the Organization.

(b) Purchase or authorize the purchase elsewhere on the account and at the risk of the contractor/supplier, of the stores not so delivered / SITC / SETC not carried out or

other of a similar description (where stores exactly complying with the particulars

are not in the opinion of the purchaser, which shall be final, readily procurable) by

serving prior notice to the contractor/supplier without cancelling the contract in

respect of the installment not yet due for delivery or,

(c) Cancel the contract or a portion thereof by serving prior notice to the

Contractor/Supplier and if so desired purchase or authorize the purchase of the

stores not so delivered / SITC / SETC not carried out, or others of a

similar description (where stores not delivered / SITC / SETC not carried out, exactly

complying with particulars are not in the opinion of the purchaser, which shall be final

readily procurable) at the risk and cost of the Contractor/Supplier. If the

Contractor/Supplier had defaulted in the performance of the original contract, the

purchaser shall have the right to ignore his tender for risk purchase even though the

lowest, where the contract is terminated at the risk and cost of the firm under the

provisions of this clause, it shall be in the discretion of the purchaser to exercise

his discretion to collect or not, the Security deposit from the firm on whom the

contract is placed, at the risk and expense of the defaulted firm.

(d) Where action is taken under sub-clause (b) or sub-clause (c) above, the

contractor shall be liable for any loss which the purchaser may sustain on that

account, provided the purchase or if there is an agreement, to purchase, such

agreement is made in case of failure to deliver the S tores/Services, within 6

months from the date of such failure and in case of repudiation of contract the

Contractor/Supplier shall not be entitled to any gain on such the entire discretion of the purchaser to serve a notice of such purchase on the Contractor/Supplier.

(e) It may further be noted that clause (a) above provides for recovery of liquidated

demurrages on the cost of contract price of delayed supplies (whole unit) at the rate

of 0.5% per week up to maximum limit of 10% of the contract value for such delay or part thereof. Liquidated demurrages for delay in supplies thus accrued will be

recovered by the paying authority on instruction as specified in the supply order, from

the bill for payment of the cost of materials / works submitted by the supplier /

contractor in accordance with terms of supply order on instruction from Purchaser

regarding liquidated demurrages amount.

(f) Notwithstanding anything stated above, equipment and materials will be deemed to have been delivered / SITC / SETC will be deemed to have been carried out only

when all its components, parts are also delivered. If certain components of stores are

not delivered in time / SITC / SETC not carried out in time, the stores / SITC / SETC

will be considered as delayed until such time all the missing parts are also delivered.

25. ARBITRATION OF CONTRACTUAL DISPUTES:

If a dispute arises out of or in connection with the contract, or in respect of any defined

legal relationship associated therewith or derived there from, the parties agree to submit

that dispute to arbitration under ICADR Arbitration Rules, 1996.The Authority to appoint

the arbitrator(s) shall be the International Centre for Alternative dispute resolution.

The International centre for Alternative Dispute Resolution will provide administrative services in accordance with the ICADR Arbitration Rules, 1996.

a) The number of arbitrator(s) shall be one who has legal as well as Technical

b) The language of the arbitration proceedings shall be English.

c) The place of arbitration proceedings shall be Chennai only.

26. GENERAL:-

All the pages of the tender document should be duly signed, stamped and serially

numbered on submission, failing which the tender may not be considered as qualified

tender

Specification for SITC of 22 TR Air Cooled Package Type Air Conditioning Plants for Studios of AIR, Cuddapah

SECTION- I

GENERAL:

1.1 SCOPE:

1.1.1 This specification for SITC of one number of 22 TR packaged air cooled ductable air-conditioning plant consisting of Twin Hermatically sealed scroll compressor individually operated and controlled with Microprocessor controller,working with eco friendly R407c refrigerant, outdoor units, cooling coil, thermostatic expansion valves, direct expansion evaporator coil, blower motor, air cooled condenser, HP, LP cut out, internal overload protector etc., including all accessories required for satisfactory operation, for studios of AIR, Cuddapah, at site, including installation, testing and commissioning of complete equipment (under buy back scheme) as a replacement of existing plant(18T ACCEL Plant).

Plenum chambers are available above the false ceiling to connect the

respective group of plants to the existing ducting system. The supply duct is to be connected between new plant and the existing plenum chamber available above the false ceiling with suitable modification (if required) as per local prevailing condition.

Return duct: Return duct is also to be connected properly with suitable modification according to local site condition. The return duct should be supported at the bottom with MS angles to be fixed on the ground. The horizontal portion of the return duct should have minimum length of 3’ and connected with plant through canvas duct. False ceiling is to be covered properly after the supply and return duct modification/connection work is completed.

The plant shall deliver the specified tonnage, both in summer and monsoon seasons. The AC plant is expected to work for about 20 hours a day, 365 days in a year.

Existing air conditioning plant(which is under replacement and to be

dismantled) comprising compressor, condenser, cooling coils fan, old refrigerant pipes, electrical panel etc. shall be taken away by the successful tenderer after the new air conditioning plant is installed. The tenderers may examine the condition of the existing air conditioning plant before quoting the rates. The offered amount of dismantled items may be quoted separately. This will be taken into account for the consideration of lowest tenderer.

1.1.2 The prevailing mean Summer/Monsoon dry/wet temperature at these places are as

1.2 GENERAL CONDITIONS OF CONTRACT

Payment terms, insurance cover, SITC schedule and time of completion, inspection, testing and commissioning of equipment and guarantee terms, penalty for delay etc. would be applicable as per AIR terms and conditions on the subject framed by the indentor, namely, Additional Director General (South Zone), AIR & DD, Chennai. The schedule of measurements would be applicable as given in section-IV. 1.3 DESCRIPTIVE TECHNICAL LITERATURE AND DRAWINGS 1.3.1 Site visit In case, the tenderers desire to have guidance regarding the existing electrical & refrigerant layout of equipment in plant room, they are advised to inspect the site before submitting their tender. Site layout drawing is attached for reference. The installation is to be carried out in phases in order to avoid shut down of the existing A/c Plants, as AIR, Cuddapah is working station.

1.3.2 Tender Documents As a part of the technical bid, the tenderer shall submit the following in duplicate along with their tender.

a) Descriptive and technical leaflets giving complete mechanical and Electrical data about the equipment offered including detailed dimensions of the equipment.

b) A Statement of bill of quantities, technical particulars (see Annexure-1) and performance specifications of the equipment offered in the proforma as per Section-II and Section-III of the specifications.

c) Tentative details showing cable sizes and length, equipment capacities, switch-gear rating and number, rating and number of control components.

d) A tentative piping drawing showing layout for the entire refrigerant piping with all diameters, lengths, sizes and number of valves etc. shown clearly.

e) A schedule giving time period from start to finish of the complete work. Commercial bid will be in a separate sealed cover. 1.3.3. Installation Drawings In the event of an order being placed, the tender shall supply to the indentor 3 copies each of the following for approval within 1 month from the date of placement of the order.

a) Dimensional drawings (including sections) giving complete details for erection

of plants including foundation in case existing foundation can not be reused and new foundation is necessary.

b) Electrical wiring diagram and control circuits of all electrical equipment showing cable sizes and electrical rating of the related equipment.

c) Electrical Panel layout/diagram showing various sizes. d) The refrigerant connection from the plants to the outdoor units shall not be

laid on the plant room floor, they shall be laid on channels fixed to the wall at suitable height.

e) Instruction manuals of various equipment of the A/c plants detailing all adjustment, operation & maintenance/servicing procedures.

Before taking up the installation work at site, the tenderer shall ensure that the indentor approves the installation drawings. 1.3.4. COMPLETION DRAWINGS AND OTHER INFORMATION Three sets of complete drawings comprising the following shall be submitted by the tenderer while handing over the installation.

a) Electrical drawings for the entire electrical equipment showing cable sizes, equipment capacities, switchgear ratings, control components, control wiring.

b) Schematic control drawings giving detailed notes to explain the sequence of operation of the control circuit.

c) Piping drawing showing layout for the entire piping with all diameters, lengths, sizes and number of valves etc shown clearly. Isometric drawings showing each of the equipment/units shall also be supplied.

d) Detailed drawings and specifications in respect of parts likely to be damaged by wear and tear.

e) Lists of components like themostats, humidistats, other control components, relays, timers, contactors etc. giving their type, designation, function etc.

f) Schedule of items of which the tenderer is not the manufacture/the manufacturer’s authorised dealer. This should contain the specifications of each item and the agency from which these items are procured.

1.4 ERECTION

1.4.1. This specification provides complete erection including all the associated civil works like equipment foundation etc. of the air conditioning equipment at site by the tenderer. The entire work shall be carried out as per codes, regulations, detailed in Annexure-2 and as per following terms and conditions.

1.4.2. The tenderer shall make his own arrangement for storage of all equipment and materials brought to site from time to time and their safe custody at site till the plants are taken over by the indentor / his representative. The tenderer shall make his own arrangements for providing accommodation for his workmen at site, Tents may, however, be pitched in the site compound at places to be decided upon by the indentor or his representative at site.

1.4.3. The tenderer shall make his own arrangements for procuring necessary labour, skilled and unskilled. He should conform to all local government laws and regulations governing labour and their employment. 1.4.4 The tenderer shall indemnify and hold harmless the purchaser against all claims in

respect of injury to any person howsoever arising out of the erection of the equipment in the course of such installation. The tenderer shall discharge all his obligations under the Indian workman’s compensation act in as far as it effects workmen under his employ.

1.4.5 The tenderer and his employees shall comply with the regulations in force for controlled

entry into the premises where the air-conditioning equipment is to be installed.

1.5 TENDERER’S LIABILITY FOR DAMAGES CAUSED DURING INSTALLATION WORK AND IMPERFECTIONS NOTICED WITHIN THE GUARANTEE PERIOD.

If the tenderer or his/her workmen or servants shall break, deface, injure or destroy any part of the building in which they may be working or any building, road, road kerb, fence, enclosure, water pipe, cable drains, electric or telephone posts or wires, trees, grass or grass lands in the premises on which the work or any part of it is being executed, or if any damage shall happen to the work while in progress from any cause whatsoever, or if any defect, shrinkage or other faults appear in the work within 12 months (after final certificate or otherwise of its completion given by the indentor)arising out of defective or improper materials or workmanship, the tenderer shall, upon receipt of a notice in writing on that behalf, make good at his/her own expense, or in default, the indentor may get the same rectified and deduct the expenses from any amount that may be then due or at any time thereafter may become due to the tenderer or from his security deposit.

1.6 INSPECTION AND TESTS

1.6.1 Inspection: The equipment will be inspected by the indentor or his authorised representative at manufacturer’s works before dispatch in accordance with

various standards/procedures specified in Annexure-III in Section-IV or modifications thereof that may be carried out by the indentor in consultation with the tender before issuing A/T. The tenderer should intimate the indentor in advance about readiness of the equipment for inspection at a date mutually agreed upon by the indenter and tenderer. The tenderer should furnish in advance photocopies of all the relevant test certificates as per IS as applicable before giving inspection call. The tenderer must satisfy themselves about the readiness of the plant as per AIR specifications before asking the indentor for carrying out inspection and tests. If during the inspection, any components/parts fail, the same shall be replaced by the tenderer at his cost.

1.6.2 Acceptance Tests: Soon after erection of the plants at site, inspection of the plants

shall be carried out jointly by the Inspecting Officer and the representative of Indentor/consignee in the presence of tenderer’s representative before carrying out acceptance tests. The acceptance test are to be carried out as per Annexure-IV of Section-IV of the specification. Separate capacity tests shall be carried out during summer months (preferably during April to mid July) and monsoon (mid July to end of August). Before offering the plant for capacity test, the tenderer will conduct trial run of the plant for 20 days subject to minimum aggregate of 120 hours for each plant so as to be sure that the plants are running satisfactorily. In case of a major problem being noticed during initial test run, the period of 20 days/120 hours will start afresh.

1.7 GUARANTEE

The compressors shall be provided with on site guarantee for satisfactory working for a minimum period of five years. The remaining air-conditioning equipment shall be guaranteed for a minimum period of one year. Various defects arising/reported within the guarantee period as stated above will be rectified by repairs/replacement at site by the tenderer free of charge.

This shall also include free supply of the refrigerant and compressor oil etc., if required, by the tenderer for optimum running of the plant during the guarantee period of the compressor. In this regard, the tenderers may also refer to other conditions specified in clause 1.6 above.

1.8 QUOTATIONS IN MKS/S.I.UNITS Values for performance figure given in these specifications are in MKS/SI units. Full particulars of all figures of performance of the equipment offered shall be furnished in MKS/SI unit. The technical data should be furnished in MKS/SI units only. The technical data should be typed or in capitals.

1.9 TRAINING The tenderer shall undertake to extend free on site training (for a period of not less than five days) in operation & maintenance of air –conditioning plants offered by them to four technical personnel from AIR, Cuddapah. Details of the training offered with period (not less than five days), may be indicated. The training shall be arranged at site.

1.10. PAST EXPERIENCE:

The tenderer should furnish detailed data regarding his past experience in supply, erection and commissioning of air-conditioning plants of similar or higher capacity and type. Due weightage will be given for the past experience while evaluating tenders. The criteria for this will be decided by the zonal office.

1.11. AFTER SALE SERVICE

The tenderer shall ensure adequate and prompt after sales service in the form of maintenance/servicing personnel and spares as and when required with a view to minimizing the breakdown period. The tenderer has also to give a written undertaking that spare parts required for air-conditioning plants shall be available off-the-shelf for a period of at least 10 years from the date of commissioning of the plants at site. Sufficient advance intimation shall be given to the indentor before phasing out any spare component/part so that indentor is able to stock the same for future use.

1.12. MISCELLANEOUS 1.12.1 Completeness of tender

In order to avoid correspondence and clarifications at a later date, tenderers are requested to indicate clearly all the technical details and information asked for in Section II & III of this specification. Each columns should be filled up. No dash -- should be written.

1.12.2 Net price may be quoted by the tenderer after taking into cosideration and

deducting the self evaluated cost of existing dismantled items of old AC plants at site.

SPACE:

All shop drawings shall be prepared by the Tenderer after examining Architectural

and other drawings, site conditions and shall be based and designed on the spaces shown on them. NOISE AND VIBRATION CONTROL:

The tenderer must take all necessary precautions to have a minimum noise

generation and its transmission as deemed necessary. Minimum vibration as permitted by IS relevant code shall be ensured. A few points for guidance are given below:

a) Double fire retardant flexible connection shall be made from air discharge to the

duct. b) Vibration isolation pads of suitable thickness and loading for elimination of

vibration shall be provided under packaged unit, air cooled condensers etc. as per recommendations of the manufacturer.

c) Flexible conduits of suitable diameter and length are to be provided for making flexible electrical connection to the motors. All conduit connections where conduits are 60mm and large shall be made of at least 1.2 times the minimum length and installed in U shape, grossly slack to provide maximum vibration isolation. The floor supported piping shall be mounted on rubber pads with 7.5 mm ribbed neroprene pads between the base plate and the support.

d) All suspended ceiling shall be isolated on hangers. The vibration hangers shall have stable steel spring. A neoprene neck shall be provided where the hanger rod is connected to the supporting element to prevent metal-to-metal contact. The steel spring element shall have static deflection equal to half the static deflection of the isolated equipment and shall be used to support all equipment from the vibration equipment or from the floor or ceiling of the equipment room.

e) All other mechanical equipment such as expansion tanks etc. shall have double deflection neoprene in compression for overload of 9 mm. The top and bottom surface shall be ribbed and boltholes shall be supplied in the base.

f) In case of conduits, pipes, tubes, the annular space between construction and penetrating element shall be filled with fibrous material and both sides sealed with hardening resident sealant. Details given in para 3.3.2 of Section III.

g) All floor mounted vibration isolated equipment shall be supported on steel frames or concrete block.

h) The air conditioning tenderer shall take all other precautions or provide on his own if not specified above for reducing noise level to within limits or minimise vibrations in all mechanical equipment without any additional cost.

ANNEXURE-III

INSPECTION PROCEDURE FOR INITIAL INSPECTION OF PACKAGED AC PLANTS AT MANUFACTURER/TENDERER WORKS.

I. AIR CONDITIONING PLANT COMPRISING COMPRESSOR & CONDENSER: 1. Physical verification of the unit for its make, model, type, capacity etc. shall be

carried out of the equipment offered at Manufacturer's/tenderer works with reference to A/T.

2. Manufacturer's test certificate shall be scrutinized to check compliance with the requirement as specified in the order.

II. FAN AND COOLING COIL: 1. Salient features such as model, size, physical dimensions and other details of

various sections, fan motor detail, fan dimension etc. shall be verified against the contract requirements.

2. Manufacturer's test certificate for the motor and air-handling unit shall be furnished and scrutinized as per contract requirements.

3. Test certificate for static and dynamic balancing of the fan/blower shall be furnished for verification.

4. Manufacturers internal test certificate on salient features like type, material, no. and gauge of fins and tubes and No. of rows shall be furnished and verified with reference to contract requirements.

5. Hydralic pressure to the extent of 24 Kg/cm² shall be applied and this pressure should be maintained for 15 minutes and no drop should be observed indicating any leaks. Alternatively pneumatic submerged pressure test shall be carried out for 15 minutes with compressed air or dry nitrogen at a pressure of 24 kg/cm² to ensure that there is no leakage.

III. SWITCH GEAR, CONTROL GEAR AND MEASURING INSTRUMENTS: 1. It shall be verified that control panel is of CPRI approved make. 2. Manufacturer's test certificate for MCCB shall be verified as per contract

requirement. 3. Availability of measuring instruments of required accuracy for conducting

different tests shall be verified. IV. ELECTRIC MOTOR: 1. It shall be verified that the electric motors are of approved make. NOTES: i) All the components where initial inspection at manufacturer's works is not

stipulated shall be of approved make. ii) Accuracy of testing instruments shall be as mentioned in the inspection procedure

laid down in this Section.

ANNEXURE-IV INITIAL TEST AT SITE AFTER INSTALLATION WITH TEST READINGS:

Tenderer's representative shall witness all type of routine tests. Performance tests of

equipment/control installed shall be carried out at site.

On completion of installation, the tenderer shall conduct initial test. Any defects found shall be rectified immediately. The test readings during initial test run shall be recorded in the Test Readings Proforma enclosed with this Annexure.

The initial test, which has to be carried out by the tenderer, shall be (but not limited to) as follows: a) Pressure tests for all refrigerant circuit as given in this specification/as

recommended by the manufacturer before charging the system. b) To check satisfactory functioning of all electrical motors, switchgear, control,

pressure testing of all air handlers’ etc. c) To check alignment of motors.

NOTES: All necessary test instruments such as thermometers, pyrometer, pressure gauges, anemometer, dust-count meter, Sound level (decibel) meter, personnel, and required quantity of gas, oil and lubricants etc. shall be arranged by the tenderer at his own expense. However, power for testing and commissioning of the system shall be provided free of cost by the indenter. In addition to the initial test as explained in Section I and above, the tenderer shall also give two continuous running tests of the system during peak summer and monsoon each of 24 hour duration or for 3 days each of 10 hour duration when the ambient conditions are close to the design conditions. The capacity test shall be conducted in presence of representative of the indenter and inside and outside conditions shall be recorded on hourly basis. CAPACITY OF PLANT: Before capacity tests are conducted, the following aspects shall be checked: a) The tests shall be conducted during the peak season only. In case the outside design

conditions are not available, then tests shall be conducted at design conditions closest to outside design conditions.

b) All internal loads such as light load, occupancy or equipment load shall be close to

design loads. Otherwise, artificial load shall be generated to satisfy internal design loads.

c) Hourly readings of temperature, relative humidity, electric current, power

consumption etc. shall be recorded. The capacity of the system components shall be computed as given in the TEST READING-PROFORMA given below.

d) Test readings shall be furnished in duplicate prior to handing over the plants.

ANNEXURE-VI

GENERAL TERMS AND CONDITIONS FOR WORK ORDER

1) NAME OF PURCHASER : The President of India

2) PAYING AUTHORITY : The ADG(E)(SZ), AIR & DD

3) PAYMENT TERMS a. 80% of the contract price for the equipments/materials inclusive of Excise Duty and Sales

Tax shall be paid on initial inspection and delivery of equipments at site in good condition.

b. 20% of the contract price for the equipments/materials and 100% of Installation charges

on satisfactory completion of Installation, Testing, Commissioning and Handing over.

4) BILLS : All the supplies and works shall be in conformity with the order and all the part bills shall be

prepared in quadruplicate in the same format as that of the Work Order. All those part bills

shall be submitted to the consignee for necessary certificates and onward transmission to the

paying authority.

5) DESPATCH INSTRUCTIONS:

The packing and marking of goods shall be as laid down in clause-12 of general

conditions of contract DGS & D69 (revised).

6) The contractor shall arrange to dispatch the goods duly insured direct to the

consignee under prior intimation for delivery at site by whichever mode of transport he may choose, to ensure safe delivery of goods at site. Unloading shall be done at site at the

contractor’s expense. The consignee will provide only storage space. The contractor will

provide his own security like locking etc., and store the materials at his own risk.

7) INSPECTION : The material will be inspected at site. If any damages are found, material will be rejected.

8) INSURANCE:

The contractor shall arrange for the insurance covering the risk during transit, storage and

installation till commissioning. All the charges for such insurance shall be borne by the

contractor.

9) ADDITIONAL QUANTITIES:

The purchaser reserves the right to place order for additional quantity up to 100% of the

ordered quantity at the same rates and terms and condition during the currency of the

contract.

10) PENALTY FOR DELAY

If the contractor is unable to complete the supply, installation, testing and commissioning

within the stipulated time limit the purchaser may at his option allow such additional time as

may be considered justified with/without penalty and without altering terms and conditions of

the order. In the event of failure of the contractor to complete the supply, installation testing and commissioning within the stipulated time or the extended time, the purchaser has the

right to impose penalty of 0.5% per week or part thereof the contract price. The Contractor’s

liability for delay, however, shall not exceed 10% of the total contract price.

11) GUARANTEE/ WARRANTY: The contractor shall accept clause-18 of the Form no. DGS & D-71 with exception that his

obligation shall be limited for a period of 12 months from the date of taking over completion of

the successful performance excluding down time during which the equipment was not working

satisfactorily due to defective parts, faulty material/ design/workmanship or faulty erection.

During the guarantee period the contractor shall repair or replace free of charge any parts that

will become defective due to faulty material design, workmanship or erection.

12) CONDITIONS OF CONTRACT:

a. DGS & D-68 (Revised) and DGS & D-71 as amended up to date. However, such of these

conditions stipulated on this tender shall supercede corresponding conditions in DGS & D-71.

b. The contractor shall sign a contract agreement form in triplicate in the prescribed

proforma and submit the same along with Security Deposit within 2 weeks. The complete form with the purchaser’s signature shall be sent back to the contractor. No supplies will be

made and no work shall start unless the agreement is signed by the contractor and the

purchaser.

13) ENFORCEMENT OF LABOUR LAWS: While engaging labour for carrying out obligations under the contract the contractor shall

satisfy the conditions laid down under contract labour (Regulation and Audition) Act 1970 and

(Central) Rules 1971 as amended from time to time and observe all formalities required as per

the said Act/ Rules. The supplier shall also observe the provision under minimum wages act

1948(Central) Rules 1950 amended from time to time while engaging labour.

14) ARBITRATION OF CONTRACTUAL DISPUTES:

If a dispute arises out of or in connection with the contract, or in respect of any defined legal

relationship associated therewith or derived there from, the parties agree to submit that

dispute to arbitration under ICADR Arbitration Rules, 1996.

The Authority to appoint the arbitrator(s) shall be the International Centre for Alternative dispute resolution.

The International Center for Alternative Dispute Resolution will provide administrative services

in accordance with the ICADR Arbitration Rules, 1996.

The number of arbitrator(s) shall be one who has legal as well as technical background.

d) The language of the arbitration proceedings shall be English.

e) The place of arbitration proceedings shall be Chennai.

15) FORCE MAJEURE:

a. If any time during the continuance of the contract the performance in while or in

part by the contractor shall be prevented or delayed by reason of any war, hostility acts of the

public enemy. Civil commotion, sabotage, fires, floods, explosions, epidemics, Quarantine restrictions, strikes, lock-outs or acts of God (therein after restrictions refer to as events and

provided notice of happenings of any such eventuality is given by the contractor within 21

days from the date of occurrence thereof, the purchaser shall by reason of such event, neither

be entitled to cancel this order not shall have any claim for damages against the contractor in

respect of such non-performance or delay in performance and delivery shall be resumed as

soon as practicable after such events have come to an end or ceased to exist.

b. Provided further that if the performance in whole or part or any obligation under this

order is prevented or delayed by reasons of any such event for a period exceeding 180 days,

the purchaser and the contractor shall meet to find a neutral agreement to any effect resulting

the reform or the purchaser may at his option cancel order provided also if the order is cancelled under this clause, the purchaser shall be at liberty to take over from the contractor

at order prices all unused, un-damaged and acceptable material bought out components and

stores in course of manufacture in the possession of the supplier at the time of such

cancellation or such portion thereof as the purchaser may deem fit accepting such material,

bought out components and stores as the supplier may with the concurrence of the purchaser

elect to retain.

16) CANCELLATION:

The purchaser reserves the right to cancel the order in the event of non-performance /

delay in execution of the work or unsatisfactory performance by the contractor and recover payment already made if any, along with losses/ damages incurred.
