The Student Rights Service is here to ensure
that your rights are upheld if you are accused
of general and/or academic misconduct
Introduction
▶ Misconductoffencescanresultinpenalties
rangingfromfinestoexclusion.
▶ Youshouldalwaysbeconsideredinnocent
untilprovenguilty.Ifamemberofthefaculty
accusesyouofmisconduct,youwillhavethe
chancetopresentyoursideofthestory.
▶ Disciplinaryprocedurescanbestressfulwith
seriousconsequences,soseekhelpearly
fromfriends,counsellors,StudentRights
Officersoralloftheabove.
Academic Misconduct
▶ Includescheatingorassistinganother
studenttocheat,forexampleplagiarism,
collusionorexamcheating.
▶ Ifthisrelatestoanexamination,youwill
appearataFacultyDisciplineCommittee
(FDC)Hearing.
▶ Ifthisrelatestoothercheating(e.g.
plagiarism),theChiefExaminerwilleither
disallowthework,orreportittotheFaculty
ManagerresultinginaFDCHearing.
▶ IftheChiefExaminerdisallowsyourwork,
youhavetherighttoappealandbeheard
byaFDC.

General Misconduct
▶ Includesattacking,harassing,intimidating
orthreateninganotherperson;interference
withproperty,ateachingsituation,a
ceremonyoranexam;copyingcomputer
softwarewithoutpermission;enteringa
computerfilebelongingtoanotherperson;
smokinginbuildings;havingunauthorised
materialinanexamination.
▶ NormallytheAssociateDeaninyourfaculty
willreferthemattertoaFDCHearing.
FDC Hearings
▶ PriortoyourFDCHearingyouwillreceive
relevantinformationandnames
ofwitnesses.
▶ YoucanrequestacopyoftheFDC’sfileand
youwillnormallybegivenatleast7daysto
prepare.
▶ Youwillbegiventheopportunitytoadmit
tothechargeandproviderelevant
information,ordenythecharge,question
witnessesandprovideyourownwitnesses
andevidence.
▶ Asupportpersonmayaccompanyyouin yourHearing.
Possible Penalties
▶ Areprimand;afinenotexceeding$500;
disallowanceoftheworkinquestion;failure
intheunit;paymentforanydamages
caused;suspensionfromtheuniversity;
exclusion.

Appeals to the Central Disciplinary Committee
▶ YoumayappealanFDCdecisionwithin20
daysononeormoreofthefollowing
grounds:excessivepenalty;bias;significant
proceduralirregularity;evidencenot
reasonablyavailableatthetimeofthe
FDCHearing.
▶ Whereyouhaveadmittedtoacademicand/
orgeneralmisconductatanearlierhearing,
youmayonlyappealonthegroundof
excessivepenalty.
Preparing a Case for the FDC
▶ Youshouldwriteacomprehensivestatement
aboutyourversionofeventsandsubmitthis
atleasttwodaysbeforetheHearing.
Include:
▶ Adescriptionofevents;
▶ Adiscussionofmotiveorlackthereof;
▶ Anoutlineofpreviousgoodhistory,
includingreferencesifappropriate;
▶ Mitigatingcircumstancesifyouare
admittingguilt;
▶ Discussionofwhatyouregardas
anappropriatepenalty(ifyouare
admittingguilt)includingwhyyou
believethatsuspensionorexclusion
maybeexcessiveinyourcase;
▶ Pleadingguiltyatanearlystagewill
oftencountinyourfavourwhenthe
FDCisconsideringapenalty.

▶ Gathercharacterreferencesandanyother
relevantevidence.
▶ Dresssmartlyandarriveearly.
▶ Respondhonestlyandthoroughly.
